SUBJECT: Resolution to Set a Public Hearing for February 26,
1991, for the Confirmation of Gutter construction and
Street Resurfacing Assessments on Various City streets
in Conjunction with 1988-89 Program
Introduction
This report recommends that the city Council set a public hearing
for February 26, 1991, to hear protests regarding the work and to
confirm the assessments for gutter construction and street
resurfacing on various streets as listed below.
Backqround
On January 10, 1989, the City Council approved the formation of
an assessment district for street resurfacing and gutter
installation in conjunction with the 1988-89 Street Resurfacing
Program. The following streets were included:
1. Michigan Avenue from Lincoln Boulevard to 14th street;
2. Strand street from Main street to 4th Street;
3. 20th street from Arizona Avenue to Santa Monica
Freeway;
4. Intersection of Main Street and Pico Boulevard;
5. Intersection of Main Street and Ocean Park Boulevard:
and
6. Intersection of 4th street and pica Boulevard,
all within the city of Santa Monica.
Only commercial and industrial property owners will be assessed
$9.50 per linear foot for gutters and $7.50 per linear foot for
resurfacing. Property owners were notified in accordance with
State law and the public hearing was held February 14, 1989.

. After closing the public hearing, the Council ordered the work to
commence.
The work has been completed and commercial and industrial
property owner assessments are now due. A public hearing to
confirm the assessments must be held pursuant to Section 5882 of
the California streets and Highways Code. The attached
resolution sets the public hearing for February 26, 1991.
Commercial and industrial property owners will be notified of the
date and assessment amount fifteen days prior to the public
hearing.
Budget/Financial Impact
Approximately $38,374.17 will be generated from property owner
assessments. Revenue will be deposited in Account No. 01-500-
401-00000-0124-00000, street Resurfacing Assessment.
Recommendation
It is recommended that the city Council adopt the attached
resolution setting a public hearing for February 26, 1991, to
confirm the assessments for gutter and street resurfacing on the
above-mentioned streets.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING FOR FEBRUARY 26, 1991, TO HEAR
ANY PROTESTS OR OBJECTIONS TO THE
CONFIRMATION OF ASSESSMENTS FOR GUTTER
INSTALLATION AND STREET RESURFACING ON
VARIOUS CITY STREETS IN CONJUNCTION WITH
1988-89 PROGRAM
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of Streets will file a
report of work pursuant to Section 5882 of the Streets and
Hl.ghways Code of the State of Callfornia, relating to the
construction of certain improvements completed on:
1- Michigan Avenue from Lincoln Boulevard to 14th Street;
2. Strand street from Main Street to 4th Street:
3. 20th street from Arizona Avenue to Santa Monica
Freeway:
4. Intersection of Main street and Pico Boulevard:
5. Intersection of Ma~n Street and Ocean Park Boulevard;
and
6. Intersection of 4th Street and pico Boulevard,
all within the City of Santa Monica.
SECTION 2. Pursuant to Section 5870 et seq. of said
Code, the city Council does hereby order and declare that on the
26th of February, 1991, at 7:30 p. m. , in the City Councll
Chambers of city Hall, it will hear and pass upon the report by
the Superintendent of Streets, of the cost of construction
together with any objections or protests, if any, which may be
raised by any property owner liable to be assessed for the cost
of such construction and any other interested persons.

SECTION 3. All protests or objections must be in
writlng and filed with the city Clerk on or before the time set
for the hearing of the protests and objections.
SECTION 4. The Superintendent of streets is hereby
directed to mail notices, in the manner and form prescr lbed by
law, of the cost of construction and of the adoption of this
Resolution to all persons ownlng commercial or industrial real
property in the hereinbefore described assessment district whose
names and addresses appear on the last equalized assessment roll
for the City taxes or as known to the city Clerk.
SECTION 5. The city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter, the
same shall be in full force and effect.
