It also requests that the City Counc i 1 adopt the attached Resolutlon of Intentlon and set a publ ic hearing for July 9, 1991, for the establishment of the approprlate assessment di strlCt. Background The Street Resurfacing Program approved for FY 1990-91 1ncludes gutter construction, street resurfacing, slurry sealing, curb and sidewalk, driveway and curb construction and repalr 1n var10US areas of the C,ty. The criten a used to determlne which streets are to be resurfaced and the method of repalr ,nclude: age, surface and subsurface condit1ons, complaints received, type of use (i.e., commercial, industrlal or residential), current traff,c volume, and projected change of use or volume. Pursuant to current City policy, an assessment distrlct is formed to lnclude only commerc1al or lndustrial zoned propert i es front i n9 on the streets to be mproved W1 th concrete gutters and street resurfacing (residentlal properties are not assessed for thi s work). 6 -/) - 1 - t1JlY ') C ~ :":. ~. , The proposed assessed costs are: 1) the cost of gutter constructlon (property owner's share est imated at $11. 50 per 1 i nea 1 foot), and 2) approxlmately one-half the cost of street resurfaclng (property owner's share est,mated at $9.00 per 1 ineal foot) . The total proposed assessment is $20.50 per 1 ineal foot when construction of both ltems is necessary. (Some properties presently have concrete gutters.) The assessment district will be administered in accordance w1th the procedures set forth in the Improvement Act of 1911 of the Californ1a Streets and Highways Code. Budget/Financial Analysis A contract was awarded in May 14, 1991~ for th1S work as part of the FY 1990-91 Street Resurfac1ng Program and no appropr1at1on act10n 1S requ1red at this time. The assessment district will generate revenues of approx1mately $50~OOO for FY 1991-92. A detailed breakdown of assessments wlll be available upon confirmatlon of assessments after the work has been completed. Recommendation It 1 S recommended that the City CounC1l approve the formation of the above assessment district and adopt the attached Resolutlon of Intent10n settlng a public hearlng for July 9, 1991. The proposed work or improvements in the opin1on of City Coune1l of the City of Santa Mon1ca is of more than local or ordinary publlC benef1t, and the C1ty Coune1l hereby proposes that eommercul or industr1al property owners in the dlstr1ct in the City of Santa Mon1ca to be benef1ted by gutter 1nstallat1on and street resurfac1ng be assessed the full cost of approx1mately $11.50 per lineal foot for gutter construction and approxlmately S9.00 per lineal foot for street resurfaclng, which is one-half the cost. Commerc1al and industrial property owners wi 11 be assessed the full cost of $6.00 per square foot for sidewalks, $7.50 per square foot for driveways and S10.50 per lineal foot for curbs. Resldential property owners are assessed for 50% of the above~mentioned costs. The dlStri ct affected by the proposed work or lmprovements 1 s shown upon a certain map indicating the exterior boundary thereof, Wh1Ch said Drawlng No. 5962 is on file in the offi ce of the C 1 ty Engineer. The map hereby 1 s referred to and shall govern for all deta il s as to the extent of said assessment district. The assessment distr1ct includes in general the lots and parcels described in Section 1 above but reference hereby 1 s made to said Drawlng for all details as to the extent of sa1d assessment distrlct and for any varlation between the last mentloned general description and the extent of said assessment district as shown on sa1d map. SECTION 4. No bonds will be lssued for the aforementloned assessment d1 strict. SECTION 5. Notice is hereby given that on Tuesday, the 9th day of July, 1991, at 7:30 P.M., in the Clty Council Chambers located 1n Clty Hall, 1685 Maln Street, Santa Monica, California, there shall be a publ ic hearing - 6 - . , before sa1d City Counc1l for the purpose of determ1mng whether the publ ic convenlence and necessity require the above-descr1bed lmprovements and for the purpose of allow1ng any and all persons having any obJectlons to the proposed work or lmprovements to appear and show cause why the sa1d proposed work or lmprovements should not be carried out 1n accordance w1th said Resolut1on of Intentlon. Inqu1ries concernlng this public hearing should be d1rected to the Department of General Services, Dlv1sion of Eng1neering, at 458-8721. SECTION 6. The City Clerk shall glVe notice of the hean ng by post1ng a copy of this Resolution in the manner descri bed by Streets and Highways Code Sections 5065 and 5616 and by pub 1 i cat lOn as herelnafter provlded. Any interested person may make protest against the proposed lmprovement in writing filed with the City Clerk at any time not later than the hour set for the heari ng in the manner prov; ded by Streets and Hl ghway Code Section 5220. SECTION 7. The Supen ntendent of Streets shall cause to be conspicuously posted along the line of sald contemplated work or improvements and also along all the open streets within said dlstrlct, notice of the passage of this Resolution of Intent10n 1n the manner and form prescrlbed by law. The office of the City Engineer 1S directed to mall notices, in the manner and form prescribed by law, of the adoption of th1S Resolution to all persons owning commercial or industrial property in the hereinbefore described assessment district, whose names and addresses appear on the 1 ast equalized assessment roll for the City taxes or as known to the office of the City Engineer. - 7 - " SECTION 8. Pursuant to Publ,c Contract Code Sect,on 20433~ the C,ty Council hereby states that the property owners may not contract for the 1mprovements and that the C,ty shall be responsible for awarding and administering the construction contract for thlS district.
