Subject: Resolution setting a Fee for Storage of Refuse Bins on
Public Property
INTRODUCTION
This report recommends adoption of a resolution establishing
fees for the placement and storage of refuse bins on City
property, streets, and alleys.
BACKGROUND
On February 26, 1991, city council adopted an ordinance providing
for charging those who place and store refuse bins on City
property, streets, and alleys, and providing that the amount of
the fee be established by resolution.
There has been a desire for the past b.lO years by do\vntovJn
business organizations including the Chamber of Commerce and the
Bayside District Board of Directors to clean up the downtm.Jn
alleys. Many business establishments place their refuse bins in
the alleys and parkways as a convenience and as a way to maximize
use of their property. others place refuse bins in alleys and
parkways because they state that it is a necessity in that their
building extends from property line to property line. In either
case the lack of a City policy affecting the placement of bins in
streets, alleys, or parkways has resulted in an unsightly and
often hazardous condition for pedestrians and or vehicles. In

addition, there is presently no incentive to the community to
remove bins from public property.
staff recommends that a fee of $15 per month for each bin be
established. Each refuse bin uses approximately 20 square feet
of space. The rate is based upon 75 cents per square foot per
month which includes a public inconvenience factor to account for
unsightly obstacles and interrupted traffic flow.
FINANCIAL/BUDGET IMPACT
It is not known how many refuse bins will be affected by this
proposed fee for use of public property. A survey and count of
the bins will be completed the end of April. Due to the lead
time which will be necessary for notifications, City inspections
and the assessment of charges, it is anticipated that no revenue
will be received prior to July 1, 1991.
RECOMMENDATION
Staff recommends that Council adopt the attached Resolution
setting a fee of $15 per month for placement and storage of
refuse bins on public property.

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA SETTING THE
FEE FOR STORAGE OF REFUSE BINS ON
PUBLIC PROPERTY
WHEREAS, Municipal Code Section 5223(a) allows fees
to be set by Resolution; and
WHEREAS, it has been determined that the best
interests of the City will be better served through the
regulation of trash bin storage in alleys and other public rights
of way,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The fee for storage of refuse bins on
public property shall be Fifteen Dollars ($15) per month for each
bin.
SECTION 2. The city Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
