Backqround During the 1990-1991 budget process the City Council approved funding to replace the existing playground equipment and install new signage at Ocean Park Beach Park. Plans and specifications were prepared by the city Engineer's Office. A Notice Inviting Bids was published on March 5 and 6, 1991, in the Evening Outlook and in four construction journals. Bidding documents were sent to eight WMBE associations. Bid documents were requested by six contractors. Bids were opened and read publicly by the Deputy City Clerk on March 25, 1991. six (6) bids were received as follows: Terra-Cal Construction, Inc. $ 233,906.00 $ 341,200.00 Hondo, Co. RYCO Construction, Inc. city Engineer's Estimate . . . . . $ 386,968.00 $ 393,303.00 $ 479,000.00 $ 163,000.00 All bids received exceeded the City Engineer's estimate for the project. The City Engineer's estimate was low due to the bid price of the concrete seat wall. In 1984, the manufacturer provided a factory "pre-cast" seat wall as part of the orig1nal Ocean Park Beach Park construction proj ect. Because the seat wall was extruded in pre-made forms, the cost was relatively low on a lineal footage basis. In preparing the estimate the City Engineer's Office used the previous contractor's lineal footage price updated for inflation. The City has now learned that the manufacturer has ceased doing business. As a result, the bidders were forced to price the seat wall as a cast-in-place element instead of pre-cast. To rebid the project would result in a minimum delay of two months due to the need to rewrite the specifications to reduce the scope of the project and allow contractors adequate time to prepare bids. The proj ects needs to be completed before the summer since that is the busiest season for the park use and construction at that time would inconvenience the public. In lieu of rebidding, staff has modified the scope of the project by reducing the lineal footage of the seat walls and simplifying the signage design. These changes have been approved by the Cultural and Recreation Services Department. - 2 - . . section 608 of the Charter of the City of Santa Monica states that the city Council, after rejecting bids, may determine by resolution that the work may be purchased at a lower price on the open market, therefore, Staff requests authorization to negotiate the modified scoped project. Recommendation It is recommended that the city Council: (1) Adopt the attached resolution rejecting bids and waiving competi ti ve bidding for a construction contract for Replacement of Ocean Park Beach Park Playground Equipment and Signage. (2) Authorize the City Manager to negotiate with the low bidder and other responsible contractors and execute a contract for the foregoing construction; and - 3 - e . (3) Authorize the city Engineer to issue any necessary change orders to complete additional work in conformance with the Administrative Instructions. RESOLUTION NUMBER 8219 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A CONTRACT FOR THE REPLACEMENT OF OCEAN PARK BEACH PARK PLAYGROUND EQUIPMENT AND SIGNAGE WHEREAS, Section 608 of the Santa Monica City Charter provides that the city council after rejecting bids may declare and determine in its opinion that work may be purchased or performed at a lower price in the open market or with City employees; and WHEREAS, all bids received for the replacement of Ocean Park Beach Park Playground Equipment and Signage were In excess of budget: and WHEREAS, the bids received for the work greatly exceeds the City Engineer's cost estimate for the work, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council rejects all bids for replacement of Ocean Park Beach Park Playground Equipment and Signage. SECTION 2. In accordance with Santa Monica City Charter Section 608 t the city Council declares and determ~nes that, in its opinion, an amended Contract within the budget can be accomplished by negotiation in the open market, and waives competitive bidding for the said improvements. - 5 - . . SECTION 3. The c~ty Manager is author~zed to negotiate and execute a contract for replacement of Ocean Park Beach Park Playground Equipment and Slgnage. SECTION 4. The city Clerk shall certify to the adoptlon of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
