SUBJECT: Recommendation for city Council to Direct City
Attorney to Draft an Ordinance Modifying section
4922 of the Santa Monica Municipal Code to Prohibit
Smoking in Various City Facilities
INTRODUCTION
This report requests that Council direct the City Attorney to
draft an ordinance which would modify Section 4922 of the Santa
Monica Municipal Code to prohibit smoking in various City
facilities located off-site from city Hall and in the police
facility building.
BACKGROUND
On May 22, 1990, City Council adopted an ordinance amending Santa
Monica Municipal Code Section 4922 to prohibit smoking in City
Hall. At that time, City Council directed staff to review other
City facilities to determine whether or not smoking should also
be prohibited in any of those facilities.
DISCUSSION
City staff has concluded its review of other City facilities. As
a part of the review process, input was obtained from
representatives of City bargaining units. In addition, a survey

was conducted to determine which city facilities, if any, had
already implemented an informal no-smoking policy.
Based on that review, it is requested that smoking be prohibited
in the following City facilities: all City libraries, all city
fire stations, the city-occupied offices and public areas at the
Santa Monica Municipal Airport, the city pier management offices,
the civic auditorium, Rent Control facilities located off-site
from City Hall, the Finance Department and Risk Management
Division offices, the City cemetery building, the Solid Waste
Management Division facility with the exception of the lunch room
area, the Recreation Division administrative offices, the Parks
and Beach Maintenance Division administrative offices, the
Maintenance Division administration building, the
Water/Wastewater administrative offices, the Water/Wastewater
systems operation facility, the Ken Edwards facility, the Kid
City facility, and the police facility building with the
exception of the interview rooms.
There are a few other City facilities where smoking is not being
prohibited in an effort to accommodate City employees who smoke.
These arrangements have been worked out on a departmental level
in conformance with the existing smoking ordinance. However,
staff recommends that the ordinance give the City Manager the
authority to designate additional City facilities as non-smoking
in the future should conditions change.

BUDGET/FISCAL IMPACT
There would be no budget/fiscal impact if section 4922 of the
Santa Monica Municipal Code were to be modified as has been
described.
RECOMMENDATION
It is recommended that the City Council direct the City Attorney
to draft an ordinance modifying section 4922 of the Santa Monica
Municipal Code to prohibit smoking at those City facilities
listed in this report.
