SUBJECT: Recommendation to Hold a Public Hearing to Confirm
Assessment of Costs for Construction of Streetlighting
on Various streets
Introduction
This report requests that the City Council hold a public hearing
for the confirmation of the assessment of costs of streetlighting
construction on the following streets:
1. Twenty-fourth Street from pico Boulevard to Pearl~
street;
2. Franklin street from Northerly city Limits to
City reservoirs;
3. Ashland Avenue from Fourth street to sixth
Street;
4. Fifteenth Street from Broadway to Colorado
Avenue;
5. Harvard street from Montana Avenue to wilshire
Boulevard;
6. Delaware Avenue from stewart street to Warwick
Avenue;
7. pine street from Lincoln Boulevard to Seventh
street;
8. Tenth Street from Ashland Avenue to 220'
southeasterly~
9. Seventh street from Colorado Avenue to Olympic
Boulevard Westbound; and
10. Lincoln Boulevard from Santa Monica Boulevard to
Olympic Boulevard Westbound,
all within the City of Santa Monica.
Discussion
In accordance with street Improvement Act of 1911 procedures, on
August 8,
1989,
September
12,
1989,
November
14,
1989,
December 12, 1989 and on December 12, 1990, resolutions were
adopted by Council forming the streetlight district for the
above-mentioned City streets.

On March 13, 1990, Council awarded a contract, 5492 (CCS) , to
Pax in Electric, Inc. for construction of the street light system.
The construction work is now complete.
On December 12, 1990, the city council set a public hearing for
January 22, 1991 to assess the costs for the subject street
lighting project. Notices stating the estimated cost of
improvements and the date of the public hearing were mailed to
each property owner in the district and posted on January 4, 1991
in accordance with state law. Typical cost to property owners
for a 50 ft. lot is $395.38. The City's share is $395.38. A
list of property owners and estimated assessment amounts will be
available in the Council Chambers at the time of the Council
meeting. Commercial owners typically pay 100% of the cost of the
streetlighting improvements ($719.01 for 50 ft. frontage).
Notices were also posted near mail boxes on each multi-family
building in the area in order to inform tenants of the public
hearlng and pass-through of costs.
The City will also pay 100% of the streetlighting costs of the
City-owned properties, low income housing site, at 506 and 536
Ashland Avenue and on the west side of Seventh street from
Colorado Avenue to Olympic Boulevard Westbound.
An exception to the standard procedure was Harvard street where
special, more expensive lights were requested by residents.
After deducting the City's share, the balance was distributed
equally to each property. City policy allows residents of any
street to propose a different type of streetlight. On Harvard
street, residents decided to install special decorative lights.

The residents understood that the City would pay for half the
cost of a standard streetlight installation and the residents
would be assessed the other half plus the increased cost of the
decorative lights. The residents agreed and the special lights
were installed. Typical cost to property owner for a 50 ft. lot
is $776.03. The City'S share is $395.38.
staff have met with Rent Control and will provide them with
assessment amounts for each property.
They will work with
landlords regarding the pass-through of costs to tenants.
Budqet/Financial Impact
The total cost to install the streetlights is $376,353.00. The
city's portion is $160,880.98 and the property owner's portion is
$215,472.02. The City's portion is available under Account Nos.
01-770-453-25489-8917-99155 and 01-770-453-25490-8917-99155, New
streetlight Systems, for the payment of the city's estimated
share of the project.
Recommendation
It is recommended that the City Council:
1. Open the public hearing;
2. Close the public hearing and acknowledge any protests:

3.
Adopt
the
attached
Resolution
confirming
the
assessments, on the above-mentioned city streets.

CITY OF SANTA MONICA APPROVING ASSESSMENT
DIAGRAM AND CONFIRMING ASSESSMENT FOR
STREET LIGHTING ON VARIOUS CITY STREETS
ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City of Santa Monica, pursuant to
Section 5100 et seq. of the Streets and Highways Code, commenced
proceedings to construct street lighting and appurtenant work on:
1. Twenty-fourth Street from Pico Boulevard to Pearl
Street;
2. Franklin street from Northerly city Limits to City
reservoirs;
3. Ashland Avenue from Fourth street to Sixth Street;
4. Fifteenth Street from Broadway to Colorado Avenue;
5. Harvard Street from Montana Avenue to Wilshire
Boulevard;
6. Delaware Avenue from Stewart Street to warwick
Avenue;
7. pine street from Lincoln Boulevard to Seventh
Street;
8. Tenth Street from Ashland Avenue to 220'
southeasterly;
9. Seventh Street from Colorado Avenue to Olympic
Boulevard Westbound; and

WHEREAS, the proceeding is more fully descr~bed ~n the
Resolutions of Intention adopted by the City Council on August 8,
1989, September 12, 1989, November 14, 1989, December 12, 1989
and December 12, 1990, being Resolution Numbers 7872 (CCS) I 7900
(CCS), 7934 (CCS) , 7951 (CCS) and 8138 (CCS) , respectively: and
WHEREAS, the contract for the above described work has
been fulfilled to the satisfaction of the superintendent of
streets; and
WHEREAS, the Super1ntendent of Streets has made an
assessment to cover the sum due for the work performed and
specified in the contract; and
WHEREAS, the assessment has been filed with the city
Clerk; and
WHEREAS, the City Clerk gave the notlce required by
sections 5362 and 5363 of the Streets and Highways Code; and
WHEREAS, upon the day and hour f lxed for hearing by
the city Clerk, the C1ty council of the City of Santa Monica
heard and passed upon any and all objections, appeals, and
protests,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That all objections, appeals, and protests
of every kind and nature be the same are hereby overruled and
denied.
SECTION 2. That the diagram of property affected and
benefited by the construction of a high-pressure sodium street
lighting system and appurtenant work on Twenty-fourth street
between Pico Boulevard and Pearl Street; Franklin Street from
Northerly city Limits to city approximately 1,125 feet
Southeasterly; Ashland Avenue between Fourth street and sixth
Street ~ Fifteenth street between Broadway and Colorado Avenue;
Harvard Street between Montana Avenue and Wilshire Boulevard;
Delaware Avenue between Stewart Street and warwick Avenue; Pine
Street between Lincoln Boulevard and Seventh Street; Tenth street

between Ashland Avenue and 220' southeasterly; Seventh street
between Colorado Avenue and Olympic Boulevard Westbound; and
Lincoln Boulevard between Santa Monica Boulevard and Olympic
Boulevard Westbound, all in the city of Santa Monica, as more
fully described in Resolution Numbers 7872 (CCS) , 7900(CCS), 7934
(CCS) , 7951 (CCS) and 8138 (CCS), and therein declared to be the
property to be assessed to pay the expense of the improvements,
is approved and the City Clerk is directed to execute the
certificate on the diagram to the Superintendent of streets.
SECTION 3. That the assessment for the construction
of a high-pressure sodium street light1ng system and appurtenant
work on Twenty-fourth Street between Pico Boulevard and Pearl
Street; Franklin street from Northerly City L1mits to city
approximately 1,125 feet Southeasterly: Ashland Avenue between
Fourth street and sixth Street; Fifteenth Street between Broadway
and Colorado Avenue; Harvard street between Montana Avenue and
wilshire Boulevard; Delaware Avenue between stewart street and
Warwick Avenue; pine street between Lincoln Boulevard and Seventh
street; Tenth street between Ashland Avenue and 220'
southeasterly; Seventh street between Colorado Avenue and Olympic
Boulevard Westbound; and Lincoln Boulevard between Santa Monica
Boulevard and Olympic Boulevard Westbound, as more fully
described in Resolution Numbers 7872{CCS), 7900{CCS), 7934 (CCS) ,
7951 (CCS) , and 8138 (CCS) , be the same hereby is confirmed and
approved.
SECTION 4. That the Superintendent of Streets shall
forthwith attach a warrant to said assessment bearing the date of
this confirmation.
SECTION 5. The assessment roll, warrant and diagram
shall be recorded in the Office of the Superintendent of Streets,
and immediately thereafter the city Clerk shall file a copy of
the assessment diagram in the Office of County Recorder, and
thereafter shall record in said office of the County Recorder, a
Notice of Assessment, all in the manner and form as prescribed by
Section 3114 of the Streets and Highways Code of the state of
California.
SECTION 6. The City Clerk shall certify to the
adoption of this Resolution, thenceforth and thereafter the same
shall be in full force and effect.
