Also proposed is an amendment ta the Ad~ustmer~t section of th~ cade. Revisions to Proposed Ordina~ce At the March 28, 1995 Council meeting at which this item was originally consider~d, Councilmembers made cornrnents regarding various definitions. Staff ~as reviewed a nurnber of the proposed defin~tions and 3r~corporated changes in the attached ordinance. ~ach of the revisions are discussed below. In addition, the definitions af "nightclub" and "restaurant" recerl~~ly approved by the Counci? have beer incarporated into these amendments with a modification to tre restaurant definition to clarify tne appl~ca~ion of the new definition to ex~sting restaurants. A~armat change ta ~he dzfinitions section has also been made. Eac~ definztian has been separately numbered for easp of citation and ~o allow amendments to individual definitions without the requiremen~ that t~ae entire defxnit~ons sec~ion be re-enactect. Accessory B~a~ldinq. As originally propos~d, this definition would have required a minimum separation between the primary build~ ng and ar? accessory build~ ng of at least f ive feet . For consister_cy wa.th pro~risions of th~ Uniform Building Code regarding separation between buildings, the required distance has - 2 - been rev~sed to six feet In addztion, language is added to clarify what nature of a~tachment would make ~n accessory structure par~ of the primary building. Ba~ery. Th~s deflnitian has been revised to d~lete the prrase "or portion thereaf" so as to more specifical~y define ~his use Sirnilar revisions were made to the definitions of "~zl~catessen", "Incidental Food Services", and "Liquor Store" Basement. A reference to the Ocean Park dXS~ricts was added to this definition far clarificatian Beveraqe Facility, Non-Alcaholzc This defin~tion (originally titled "cof~eehouse") was created in the cor.~ext of spec~al regulations pertaining only ~a the Bayside Distrzct. Since it is not used in any other dist~-ict, ~~ has been del.eted from the ger_eral Zoning Ordinance definitions, but ~h~s or a similar d~fa.nition will b~ used in th~ p~rmanent Bayside regulations. Bed and Brea~~~ast Facility The word "generally" was added to reflect th~ fact t~at on occasion persons rnay stay at such Establ~snments longer than thirty days. A similar change has been made to the definitions of "hatel" and "motel". Baardirq House The phrase "unrelated to the person lett~~g the room" was deleted as unnecessary languag~, and the phrase "and where there is or.-site ~acility management" was addzd to further - 3 - clari~y 4he na~ure af such use. Delicatessen. The phrase "or portion thereof" and the word "primarily" have be~n deleted from the definition to provide greater clarity. Dwellinq Unit. As previously proposed, an amendment would have added the words "in a building or portiors thereof" after ~he word "rooms" This char_ge is being de'eted as unnecessary. Finished First Floor. A reference to the Ocean Park district has been added `o this definition; a sim~lar addition was also made to the def~n~t~on of Garaqe, 5emi-Subterranean. Garaqe. In ~a.eu of the word "used" the phrase "designed for use" has been substituted in the second line of this definition - 4 - Garaqe, Sernz-Subterranean, Grocery Store, and Grocery Store, Neiqhborhood Minor word~ng changes have been made to these definitions for greater c~ar_ty. Incidental Food Serv=ce Cla~iiying changes have been made to this dzfinition. I~ addition, instead of simp?y stating that "table servic~ is not provided'" the definition has ~een revised to state that orders for fofld are no~ taken from the table. Liquor Store. The ~eference to "wine store" has ~een del~ted from this proposed definition as annecessary. Mezzanine A comment was made that mezzan~~es should be permitted to have closets This would be consistent with the recommen~at=on of the Plann~ng Cornrn~ssion, however staff reco~rnends tza~ the requiremen~ Lhat rnezzanines be op~n areas should be rnaintained. N~ahtclub. The changes to this definition are consistent with those approved by the City Council at the October 10, 1995 meeting. Restauran~. The changes to this definition are consister_t with thase a~proved by the City Council at the Oc~obe~ 10, 1595 meeting, with the addition of language clarifyir_g the applica~ian of the new definition to existing restaurants. - 5 - Restaurant, Fast-Food or Take-Out. A reference to "Drive- through" restaurants has been added to the titie of t~is definition. In addition, th~ use o~ the term "inexpensive" ~ood has been deleted, since ~here are growing numbzrs of fast-~ood outlets that provide higher-priced ~ast-food. Story. The phrase "or the p~r~ion ~etween a ~loar a~d the raaf or attic" has been added to t~is definit~on far clarif~cation. Substantial Remodel. Concern has be~n expressed that ~he definition which was originally proposed would result in significant problems in rernodelling pro~ects where wat or o~her unanticipated deficiencies are encountered ir the construc~ion nrocess and walls that were intended ta remain wauld be considerzd "demolished". That de~~nition would have considered a wal~ to be demolished if plaster or wallboard on bath sides of the wall is removed On Ju'y 13, 1995, the P'~anning Comm~ssion adopted an interpretation which creates an alter~a~ive approach to address trese issues. The currently-proposed definit~on would be consistent with this interpre~ation. A wall would ~e considered maintained as long as th2 framing and foundat3cn are substantially intacL Ad~ustment Amendment. This amendment was intenaed ta addr~ss sitaa~~ons where it may be app~opriate to allow the retention of ex~sting non-conforming setbacks for buildirgs that are "substantially rernodel~ed." The amendment has been revised and - 5 - simplified to sta~e that at least thirty-~ive pe~cent of the exte~zor walls must zemazn. BUDGET~FINANCIAL IMPACT The recommendation prese~4ed i~ this report does nat have any budge~ or financial impact. Proposed Ordinance B Strik~out/Bold Version of Ordinance v9 - 7 - A T~'A C1~MEN~ A f:\atty~muni\laws~mhs~def5 City Counci~ Meeting 10-17-95 Santa Monica, California ORDINANCE NUMBER (CC5} (City Council Series} AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING ZONING ORDINANCE SECTION 9.0~.02.030 REGARDING DEFINITIONS; AND SECTION 9.04.20.34.030 REGARQING ADJUSTMENTS WHEREAS, the Planning Commission adopted a Resolutian of Intention to amend the Definitions and Adjustment section of the Zaning Ordinance; and WI~EREAS, the Planning Commission held a public hearing on the proposed amendment and made recommendations to the City Council fallowing the hearing; and WHEREAS, the City Council held a public hearing on the proposed amendment; and WHEREAS, the City Council finds and declares that the praposed amendment is consistent in principle with the goa~s, objecti~es, policies, land uses, and programs specified in the adopted General Plan, including several of the objectives listed under Objectiva 1.1 of the Land Use Elem~nt of the General Plan, inciuding protecting the quality ot ~ife in al3 residential 1 ~}~ Q~~ neighborhoods, promoting af~ordable housing, and insuring fair treatment af property owners and residents in that the Zoning Ordinance is the primary means df implementing the policies of the General Plan, and to effectively imple~ent General Plan policies, the Zaning Ordinance must be clear, concise, and complete in its expression of the C~ty's land use policies; the proposed changes to the Definiti~ns section o~ the Zoning Ordinance will act to clarify existing definitions; add new definitions of ter~-s used in the Ordinance, and reduce unnecessary or duplicati~e language by deleting terms which are not used in tha Ordinance or are defined elsewhere in the Ordinance; in addition, the proposed amendment to the Adjustment section of the Zoning Ordinance will promote the retention of useful building elements, which may, among other effects, reduce consumption of natural resaurces and act to reduce develapment costs, promoting housing affordability; and WHEREAS, the publzc health, safety, and general welfare require the adoption of the proposed amendment, in that the proposed changes to the Definitions section of the Zoning Ordinance will act to enhance understanding of and compliance with the development standards of the General Plan as implemented by the Zoning Ordinance; in additian, the proposed amendment to the Adjustment section of the Zoning Ordinance will, by allowing the retentian of viable building elements, reduce cansumption af 2 ~~ 00~ natural resources and act to reduce development c~sts, promoting housing affardability. Sectian 9.04.02.030 of the Santa Monica Municipal Code is amended, and Sections 9.04.02.030.405 to 9.04.02.030.920 are added to the Santa Monica Municipal Cade to read as fol~aws: 9.04.02.D30 Definitions. The following words or phrases as used in this Chapter shall have the follow~ng ~eanings: 9,04.02.030.005 Acce~sory Buildinq. A detached building located on the same parcel as the principal building, which is incidental and subordinate to the princ~pal building in terms af both size and use. A building will be considered part of the principal building if located less than six (6) feet from the principal building or if connected to it by fully enclosed space. 9.04.02.a3a.aia Acae~sory Liviaq Quarters. Living quarters within an accessory building on the same premises as a single family res~dence. Such quarters shall not have a kitchen, sh~wer, or tub enc~osure and shali nat be rented as a separate dwelling. 3 ~~ ~ ` ~ t 9.04,02.830.~iS Accessory Use. Any use of land ar a building or portian thereof which is clear~y incidental ta the principal use of the land or building and located an the same parc~l as the principal use. 9.04.02.030.020 Aat of Nature. A natural accurrence such as an earthquake, flaod, tidal wave, hurricane or tarnado which causes substantial damage to buildings or property. 9.04.02.030.025 Affordable Housinq Project. Housing in which One Hundred Percent (100~) of the dwelling units are deed-restricted or restricted by an agreement appraved by the City for occupancy by low ar moderate income households. Such prajects may also include non-residential uses, as long as such uses do not exceed Thirty-Three Percent (33~) of the floor area of the total project. 9.04.02.030.030 Altered Grade. A change in the elevation of the ground surface from its natura~ state due to grading, excavation ar filling, 9.04.02.030.035 Arcade. A public passageway or colonnade open alang at least one side, except for structural supports, usually covered by a canopy or permanent roofing. 9.04.02.030.040 Art Gallery. A room ar structure in which original works of art ar limited editions of original art are bought, sold, loaned, appraised, or 4 ~ x' ~ ~ ~ exhibited to the generai public. 9.04.02.030.045 Artist Studia. A buiZding ar portion of a bu~lding used as a place of work by an artist. This shall not include performance or exhibition space, unless otherwise permitted. Living quarters for the artist may be ~ermitted prouided the area devoted to living quarters does not exceed f~.fty percent (50%) af the square faotage of the tatal studio space. 9.04,02.030.450 AttiC. The area loCated abave the ceiling of the top story and below the roof and not usable as habitable or commercial space. 9.04.02.030.055 Auditorium. A building or room designed to accommadate groups of people far meetings, parformances or evants. 9.04.02.030.050 Automobile Center. A grouping of individual automobile deal2rships offering a variety af automobile makes and models proposed as a single development praject. 9.04.02.030.065 Autamabile Dealership. Any business estab~ishment which sells or leasas new ar used automobilas, trucks, vans, trailers, recreational vehicles, boats or motorcycles or other similar motorized transportatian vehicles. An automobi~e dealership may maintain an inventory of the vehicles for sale or iease either an-site or at a nearby locatian and may provide an-site facilities for the repair and service a€ the 5 p~ 0 ~ ~ vehicles sold or leased by the dealership. 9.Q4.02.030.070 Automobile Rental Agency. Any business establishment which rents or otherwise provides motorized transportatian vehicles an a short-term basis typicaliy for periods of less than ane (1) month, and which maintains such vehicles on-site ar at a nearby locati~n. Far the purpose of this Chapter, rental of trucks exceeding one ton capacity or renta~, of other heavy equipment shall constitute distinct uses separate from an automobile rental agency. 9.04.02.030.075 Automobile Repair Faaility. Any building, structure, improvements, or land used for the repair and maintenance of automobiles, motorcyc~es, trucks, trailers, or similar vehicles including, but not limited to, body, fender, muffler ar upholstery work, oi~ change and lubrication, painting, tire service and sales, or the installation of CB radios, car alarms, sterea equipment, ar cellular telephones. 9.04.02.~30.080 Automobile Service Statian. Any establishment whose primary function is the retail sa~e af petrolaum products and vehicle accessories normally associated with this use, and shall include those service stations providing full--service or self-service stations . 6 ~ _•. ;~? t .~ ,, 9.04.02.030.085 Automabile Storage Lat. Any property used for short- or long-term parking of vehic~es for sale or lease at an off-site or an-site automobile dealership. 9.04.02,G30.090 Automobile lfashinq Facility. Any building, structure, improvement or ~and principally used for washing mator vehicles. 9.04.02.030.095 Awninq. A temporary shelter supported entirely from the exterior wall o~ a building. Awnings may be fixed or collapsible, retractable, or capable of being folded against the face of the supporting building. 9.04.02.030.100 Bakery, An establishment which is primarily engaged in the retai~ sale of baked products for consumptian off-site. The products may be prepared either on or off site. Such use may inc~ude incidental food se~vice. A bakery shall be considered a general retail use. 9.04.02.030.105 Balcony. A platform that projects from the wall of a building and is surrounded on the exposed sides by a railing or wall up to forty-two (42} inches in height. 9.04.02.430.110 Bar. An estabiishment with a "public-premises" liquar license and restaurants with a liquor service facility that is physical~y separate from 7 ~~ 0~4 tha dining area and is regularly operated during hours not carresponding to food service haurs. 9.04.02.030.115 Basement. The portion of a structure below the finished first floor. A basement shall be considered a story if the finished f irst floor extends more than three (3) feet above the average natura~ or in the Oeean Park Districts, theoretical grade. 9.04.02.030.120 Bathroom, Full, A room containing a sink, a toilet, and a shawer and/ar bathtub. 9.04.02.030.125 Bathroom, Half. A room containing a toilet and a sink. 9.04.02.030.130 Say ~indow. An angular ar curved window which projects from the building surface. If such bay or greenhouse window includes floor area, then it sha11 count towards parcel coverage. 9.d4.02.asa.135 Bed a~d Breakfast Facility. A building or portion thereof which is used as a temporary lodging place for indi~iduals generally for less than thirty {30) cansecutive days, and which does not have more than four {4} guest rooms and one (1) kitchen. 9.04.02.o30.i40 Hedroom. A private room planned and intended far sleeping, separated from other rooms by a door and accessible to a hathroom without crossing another bedroom. s ~~ ~~5 9.Q4.02.030.145 Baarding House. A residential building with common cooking and eating facilities where a room or any portion of a room is rented fo~ periods of generally at least thirty (30) days, where meals are provided, and where there is on-site facility management. 9.04.02.030.150 Buildinq. Any structure having a roaf supported by columns ar walls and intended for the shelter, housing, or enclosure af any individual, animal, process, equipment, goods or 1t-aterials of any kind or nature. 9.04.02.030.155 Buildinq Heiqht. The vertical distance measured from the average natural grad~ to the highest point of the roof . Horaever, in connection with development projects in the Ocean Park districts, building height sha~~ mean the verticai distance measured from the theoretical grade to the highest point of the roof. 9,04.02.030.i60 Buil~linq, Principal. A building in which the principal use of the parcel on which it is lacated is conducted. 9.04.02.030.165 Building Size. The aggregate of building ~nass and building bulk permitted on a parcel which is defined by height regulations, setbacks, and other property development standards. 9 ~~ ~~ ~ 9.04.02.030.170 Canopy. A roof-like cover that projects from the wall of a building for tha purpose af shielding a daorway, window or wall from the elements. 9.04.02,03D.175 Carpart. A permanently roofed structure praviding space for parking or temporary storage af vehicles and enclosed an not more than three (3) sides. 9.D4.02.030.i8D Ghanqe af IIse. The establishment af any use which differs from the previous use of a building or place of business including but not limited to having different impacts, such as having a different parking requirement or requiring a new pl.anning permit or being otherwise differently regulated by the zoning ordinance as compared to the prior use. A change of ownership alone does not constitute a change of use. 9.04. 02 . D3Q. t85 Child Day Gare Faci.3.ity. A facility which provides non-medical care to children under eighteen (18) years of age in need of personal services~ supervision, or assistance essentia]. for sustaining the actie~ties of daily living or for the pratection of the individual an less than a twenty-four (24} hour basis. Child day care faciiity includes day care centers and family day care homes. Also see Day Care Center, Family Day Care Home, Large and Sniall, 9.a4.02,030.190 Church. See P].ace of Warship. 10 M~ Q~~ 9.04.02.030.195 Cinema. A motion picture theater where the primary use is to show motian or video pictures and to which admission is free or a fea is charged, received or collected, either by the sale af tickets Qr by any other means or device by which money or something of value is received or paid therefar. 9.04.02.030.200 Club vr Lvdqe. A building and related facilities owned or aperated by a corparation, association, or graup af individuals established for the fraternal, social, educational, recreational, or cultural enrichment of its me~ers and not primarily far profit, and whose members pay dues. A private club or lodge does not include a facility where the principal membersha.p requirement is payment of a membership ar admission fee. 9.04.02.030.205 Community Care Facility. Any state licensed facility, place, or building which is maintained and aperated to provide non-medical residential care, day treatment, adult day care or foster family agency services for children, adults, or children and adults as defined in Article 1 of Chapter 3 of the California Health and Safety Code Section, 1500 et seq. 9.04.02.030.210 Cangreqate Hausing. A mvlti-family residenti.al facility with shared kitchen facilities, deed-restricted or restricted by an agreement approved by the City for occupancy by low or moderate income households, designed for occupancy far periods of six (6) 1~ ~'r Q~~ months or longer, providing services which may include meals, housekeeping, and personal care assistance as well as camman areas for residents of the facility. 9.04.02.030.215 Conva~escent Home. See Rest Home. 9.04.02.030.220 Cultural Facilities. Museums, galleries, theaters and the like, which promote educational and aesthetic interest within a community. 9.04.02.030.225 Day Care Center. Any child day care faci~ity other than a family day ca~e home, and includes infant centers, preschools and ext~nded day care facilities. 9.04.02.030.230 Delicatessea. An establishment which is engaged in the retail sale of faod products for consumption off-site, including but not limited to salads, cheeses, cooked meats, smoked fish, and dried and canned go~ds. Such use may inc~ude incidental food service. 9.~4,02.430.235 Dsmolition. See Substantial Remodel. 9.04.G2.030.24~ Domestia Violence Shelter. A residential facility which provides temporary accommodations to persons or families who ha~e been the victims af domestic violence. Such a faciZity may also provide meals, counseling, and other services, as well as common areas for the residents of the facility. ~2 ~~ 0~9 9.04.02.030.245 Driveway. An access road leading frQm a public street or right-of-way to a designated parking area~ or from one parking area to another, but not including any ramp, aisle, maneuvering area, or driveway apron. 9.04.02.030.250 Duplex. One (1) structure on a single parcel cantaining two (2) dwelling units, each of which is functianally separated from the other. A duplex shall be considered a multi-family dwelling. 9.04.02.030.255 Dwellinq. A structure or portion thereof which is used principally far residential occupancy. 9.d4.02.030.260 Dwellinq, Multi-Family. A building containing two (2) or more dwell~ng units. More than one dwelling on a parcel shall be considered a multi-family use. 9.04.02.030.265 Dwellinq, Single-Family, A buildinq containing ane (1) dwelling unit which contains only one (1) kitchen and which is located on a permanent foundatian. 9.O~t.02.030.270 D~ellinq Unit. One (1) or more rooms designed, occupied or intended for accupancy as separate living quarters, with ful~ cooking, sleeping, and bathroom facilities for the exclusive use of a single household. 9.04.02.030.275 Dwellinq Unit, Efticiency. A dwel].ing uni.t consisting of not morE than one (1) 13 ~-• ~~~ habitable room together with kitchen or kitchenette and bathroom facilities. 9.0~.02.030.280 Electric Distribution Substation. An assembly of equipment which cauld include fuel cells and microwave, cable, radia and/or other communication facilities as part of a system for distributian of electric power where electric energy is normally received at a sub transmission voltaga and transformed to a~ower voltage, and/or produced at this lower vQltage in case a fuel cell is installed, for distribution to the customer. 9.04.02.030.285 Faaade. An exteriar wall of a building. 9.04.02.030.290 Family Day Care Home, Large. A home which provides family day care for seven (7~ to twelve (12} children at any one time, including children under the aqe of ten (10) years who xeside at the home, as defined in Stat~ regulations. 9.04.02.030.295 Family Day Care Hcme, 8ma11. A home wh~ch provides family day care for six ( 6) or fewer children at any one time, including children under the age of ten (la) years who reside at the home, as defined in Stata regulations. 14 ~~ ~~ ~ 9.04.02.030.300 Fence. A barrier of any mate~ial or combination of mat~rials functianing as an enclosure or for screening. 9.04.02.030.305 Fence Heiqht. The ver~ical distance between the ground and top of a fence measured from the existing grade. The height shall be measured in a continuum at each point alang the fence. 9.04.02.030.310 Finished First Floor. The top of the f~rst flaor of a structure which does not extend more than three (3) feet above the average natural or in the Ocean Park Districts, theoretical grade. 9.04.~2.03Q.315 Floor Area. An enclosed accessory building or portion of a principal building designed for use for the parkinq or temporary storage of vehicles. 9.04.02.030.335 Garaqe, Semi-Sulaterranean, A structure iocated partly undergraund used for parking and storage of vehicles, where the finished floor of the first level of the structure not more than three (3) feet abave the average natural, or in the Ocean Park Districts, theoretical grade of the parcel, except for Qpenings for ingress and egress. 9.04.02.030.340 Garaqe, Subterranean. A structure antirely underground, except for openings for ingress and egress. 9.04.o2.asa.345 General Retaii. A business which is engaged in selling gaads or merchandise to the qeneral public and which may provide services incidental to the sale of such goods. 9.04.02.030.350 Grade, Averaqe Natural . The average elevation of the ground le~el of the parcel surface in its natural state as measured at the intersection af the rear and front setback lines (if any) with the side setback lines af the parcel. For parcels with a grade differential of 12.5 feet or mare~ as measured from either any point on the front setback line 18 ~ • ~'~'~ to any paint on the rear setback line, or from any point on a side setback line to any point on the opposing setback line, Average Natural Grade shall be calculated on three equa~ sec~tents ~f the parceZ created by drawing imaginary lines connecting opposite parcel lines at the intersection of the rear and front setback lines {if any) with the side setback lines at 1/3 increments of the depth of the parcel from the rear to the front setback (if any). Mature heights of qroundcaver will usually range from three (3) inches to three (3) feet. 9.04.02.03G.384 Ground Floor. The first level of a building other than a base~ent. 9.Q4.02.D30.385 GrouDd Fioor Street Frontage. The first level of a building, other than a basement, to a depth af no less than fifty (50} feet of the frant o£ the parcel. 9,04.Q2.030.39d Hardscape. An apen area comprised of durable nan-living materials including, but not limited to rocks~ pebbles, sand, wood, mulch, chips, walls, fences, planters, bri.cks~ stone, aggregate, natural forms, and water features. 9.04.02.030.395 Hedqe. A barrier of plant material functioning as an enclosure or used for screening. 9.04.02.03D.400 Homeless Shelter. A residential facility, ather than a communa.ty care facility, operated by a pr~vider which provides temporary accoinmodatians ta persons ar families with low income. The term "temporary accommodations" means that a person or ~amily will be 20 ~~ 0~~ al~owed to reside at the sh~Iter for a t~me period not to exceed six (6) months. For purpose of this definition, a "provider" sha~l mean a government agency or private non-profit organization which provides or cantxacts with recognized community organizations to provide emergency or temporary shelter, and which may alsa pravid~ meals, counseling and other services, as well as common areas for residents of the facility. Such a facility may have individual rooms, but is not developed with individual dweliing units, with the exception of a manager's unit. 9.04.02.a3a.4fl5 Hospice. A facility that provides residential living quarters for up to six (6) terminally ill persons. A hospice is a permitted use in all residential districts. 9.04.02.030.410 Hotel. A building, group of buildings, or a porti.on of a building which is designed for or occupied as the temporary lodging place af individuals for generally less than thirty {30) consecutive days including, but nat liinited to, an establishment held aut to the public as an apartment hotel, hostel, inn, time share project, tourist court, or other similar use. 9.04.02.030.415 Household. The area within the boundaries af a given parce~ which consists of living plant material including, but not limited to, trees, shrtxbs, woody and herbaceaus ground covers, grass, fl.awers, vines, irrigatian systems, and other design features commanly used in landscaping, but not ir~cluding walkways, driveways, patios, and other landscape features that use smooth cancrete or asphalt. 9.04.02.030.435 Light Manufacturing. Manufacturing uses conducted within an enclosed bui~ding that include fabricating, assembling, testing, repairing, servicing or 22 ~~' ~2~ processing prvducts where the nature of the operation is not obnoxious or offensive by reason of emission af odor, dust, naxious gas, noise, vibration, glare, heat or other adverse environmental impacts. 9.04.02.030.440 Liquor Store. An establishment primarily engaged in the retail sale of packaged a].coholic be~erages, such as ale, beer, wine, and liquor, for consumption aff the premises. 9.04.02.030.445 Living Area. The interior habitable area af an existing principal dwe].ling unit including a basement but not including a garage. 9.04.02.030.450 Living Quarters. A structure or portian thereof which is used principally for human habitation. 9.04,G2,03C.955 Loadinq Space. An off-street space or berth on the same parcel with a building for the temparary parking of a vehicle while loada.ng or unloading of goods . 9.04.02.030.460 Lof~. A loft is considered a mezzanine. 9.04.02.030.465 Lot. See parcel. 9.04.02.030.470 Lo~-Tncome Household. A household whose gross annuaZ income does not exceed sixty percent (60~) of the median incame of the Los Angeles-Long Beach-Anaheim Primary Metropolitan Statistical Area (PMSA), as determined periodically by the U.S. Department 23 ~~ 030 of Housing and Urban Development (HUD}, adjusted for hausehQld size. An intermediate level without walls or partitions, bathroams, closets, or screens, and open to one roam below. The clear height above or belaw a mezzanine floor shall nat be less than seven (7) feet. No more than one (1) mezzanine may be pern~itted in any one (1) room. When the total floor area of any such mezzanine exceeds one-third (1/3) of the total floor area in the room below, it shall constituta an additional story. 9.04.02.030.494 Middle-Income Hausehold. A sma11 retail store selling cammonly purchased groceries~ fast-foods, househaid goods, and impulse items, and located on the same parcel as a service station or operated in conjunction with a service station with comman parking. 9.04.02.030.500 Mixed-IIse Develapment. The development of a parcel or building with two (2) or more different land uses such as, but nat limited to, a combinatian of residential, affice, manufacturing, retail, public ~r entertainment in a single or physically integrated group of structures. 9.04.02.030.505 Mobilehame Park. Any area ar tract of land used or designed to accommodate one {1) or more trailers in use for long-term human habitation with minimum facilities far water, sewer, electricity, and laundry. 9.04.02.d30.510 Moderate-In~~me Hausehold. A household whose gross annual income does not exceed one hundr~d percent (100~) of the median income of the Los Angeles-Long Beach-Anaheim Primary Metropolitan Statistical Area (PMSA), as determined p~riodically by 25 ~ y` ~ ~ ~ the U.S. Department of Housing and Urban Dev~lopment (HUD), adjusted far hausehold size. Rooms in such an establishment shall be generally provided for periods of less than thirty (30) cansecutive days. 9.04.02.030.52~ Niqht Club. An establishment which provides music, dancing, or other entertainment, and which may also serve food or drink, but which does not otherwise qualify as a"bar" or "restaurant." 9.04.02.030.525Nonconforming Bv-ilding or 8tructure, Leqal,. A structure, the size, dimension, or lacatian of which were lawfu~ prior to the effective date of the ordinance codified in this Chapter or any amendment 26 ~k~ ~~3 thereto, but which fails tQ conform to the present requirements of the Zoning Ordinance. 9.04.02.030.530 Nursinq Home. A facility licensed t~ provide full-time convalescent or chronic care to individuals who, by reason of ad~anced age, chronic ~llness, or infirmity are unable to care for themselves. 9.a4.02.030.535 Off-8ite Hazardous ~aste Facility. An operatian involving handling, treatment, storage ar disposal of a hazardous waste in ane or more of the following situatians: (a) The hazardous waste is txansported via commercial railroad, a public-owned road or public waters, where adjacent land is not owned by or leased to the praducer af the waste. (b) Tha hazardaus waste is at a site wh~ch is not owned by or leased to the prod~cer of the waste. (c) The hazardous waste is at a site which receives hazardaus waste fram more than one producer. 9.04.02.03D.540 office, Specialty. Uses intended to provide a service without requiring an appointment such as travel agencies, real estate offices and insurance agencies. 9.04.Q2.030.545 Open Space, Cammon. A glazed surface whose area is larger than any other glazed surface in a roam whieh serves as a primary space. 9.04.02.030.685 PrinCipa~ Use. The primary or predominant use ot any site. 9.04,02.030,690 Private Tennis Court. A tennis court which is used for noncommercial purposes by the owner(s) af the property or guests. 9.04.02,030.695 Publio Land, Any governmex~t-owned ~and, including, but not limited to, public parks, beaches, playgrounds, trails, paths, schools, public buildings, and other recreational areas or public open spaces. 9,C4.02.a3~.700 Public Utility Service Genter and Service Yard. Any building or property used for the administration of public utility repair~ maintenance, and installation crews, warehouse, storage yard or maintenance garage including vehicle parking o~ a public utility. 33 ~~ ~~~ 9.04.02.030.7~5 Recreational Bui~dinq. Inc~dental park structures such as restrooms and maintenance facilities, community roams, locker rovms and shawers servicing persons using the beaches or ocean, playing caurts, playgrounds, picnic areas, public swimming pools. 9.04.02.030.710 Residential Care Facility For The Elderly. A state licensed housing arrangement chosen voluntarily by residents over sixty (60} years of age where varying levels and intensities of care and supervision, protective supervision, persona~ care, or hea~th-related services are provided, based upon residents' varying neads, as determinEd in order to be admitted and remain in the facility, as defined in Chapter 3.2 of the California Health and Safety Code, Section 1569 et. seq. A Residential Care Facility far the Elderly serving six (6) or fewer persons shall be considered a family dwelling for all zoning purposes. 9.04.02.030.715 Residential Facility. A community care facility which consists of any family home, group care facility, or similar facility as determined by the Director of the State Department of Social Services, for twenty-four { 24 ) hour non--medical care af persons in need of personal services, supervision or assistance essential for sustaining the activities of daily living or for the protection of the individual, as defined in Article 1 of Chaptex 3 of the Califarnia HeaJ.th and Safety Code, 34 ~~ ~'~~ 5ection 1500 et seq. An extended or intermediate care facility licensed or approved to provide health care under medical supervision for twenty-four (24) ar mare consecutive hours to two (2) ar more patients . 9.04.02.030.730 Restaurant. Any building, raom, space, or portian thereof where food is sald for consumption on site, except for uses qualifying as incidental food service. A restaurant may provide music or other entertainment if: (1) there is sit down meal service provided at all times while the entertainment is taking place; (2y there is no dancing ~r dance floar; {3) there is no cover charge or minimum drink purchase requirement; and (4) the entertainment is provided only in the dining areas. A restaurant with entertainment beyond the ~cope af these limitati.ons during specified hours on a nightly, weekly, or ather regular basis shall also be cansidered a nightclub and such entertainment use shall be prahibited unless a separate conditional use permit for that nightclub use has been obtained. 35 ~ ~ ~~~ Restaurants legally existing as of the effective date of this Ordinance which provide entertainment beyond the scope af the limitatians set fQrth above shall be able to cantinue such entertainment as existed on the eftective date of this Ordinance without abtaining a nightclub conditional use permit, provided that the provision of live entertainment or dancing is not the primary use of the establishment, and provided there is no intensification or expansion of such entertainment component. 9.04.02.D30,735 Restaurant, Fast-Faod, Take-Out or Drive-Through. A restaurant where customers purchase food and either consume the food on the premises within a short periad of time or take the food off the premises. Typical characteristics of a fast-fQOd restaurant include, but are not limited to, the purchase of faod at a walk-up window or counter, payment far faod prior to consumption, and the packaginq of ~aod in disposable containers. A restaurant shall not be considered a fast- food or take-out restaurant solely on the basis of incidental or occasianal take-out sales. A restaurant sha11 be considered a drive-through or drive-in restaurant where customers may be served food in their vehicles for consumption either on or of~ the site. 36 ~~ ~~~ 9.04.02.a30.740 Roaf. A building or buildings, including a single family dwelling, that provides residence for a group of senior citizens with a central kitchen and dining facilities and a separate bedroam or private living quarters. 9.04.02.030.770 Senior Housing. Multi-family residential housing, ather than a Residential Care Faci~ity for the Elderly or Senior Group Housing, de~eloped with individual dwelling units, in which each unit is restzicted for occupancy by at ~east one person 37 ~~ a44 in each household who is sixty (60) years of age or o3der.
