BACKGROUND
The Cl ty Planning Commisslon approved the Tentative Map and the Ten-
ant-Participating ConverSlon for the above proJect on 7/6/94, after
a publlC hearlng and a careful reVlew of the record and staff
reeommendatlons. The actlon of the Planning Commisslon was based
on the CommiSSlon r S findings that the proposed Tenant-Partlclpatlng
ConverSlon meets the requirements of Artlcle XX of the City Charter
and that the proposed subdivislon lS eonslstent wlth applicable
general and specific plans as adopted by the Clty of Santa Monica
along wlth all mandatory requlrements of the Subdlvls~on Map Act of
the State of Callfornla.
The owners have submitted to the Clty a Wrltten Consent Agreement
blndlng the owners and any successors ln interest to each condltlon

imposed in connectlon wlth approval of th1S Tenant-Partlclpating
ConverSlon. This Written Consent has been approved by the Clty
Attorney and the City Manager. Each partlc1patlng tenant has been
lnformed ln writing of h1S or her rlghts under Artlcle XX of the
Clty Charter The Llcense Di vislon reports that proper arrangements
have been made to ensure payment of the Tenant-Partlcipating
Converslon Tax.
The Flnal Map conforms to the Tentatlve Map The Final Map has been
eertified by the Clty Englneer for conformance wlth the Tentatlve
Map and conditions thereon, the Subdlv1S1on Map Act and local
ordlnances. The City Attorney's office has approved a Declaration
of Covenants, Condltlons, and Restrietlons, or equlvalent document,
for thlS proJect as eomplYlng wlth the conditions of the Tentatlve
Map and the Tenant-Particlpatlng ConverSlon.
Council approval of a flnal map for a Tenant-Part1clpatlng
ConverSlon represents one of the last steps necessary in the
converS1on process Followlng City Council action aEd approval by
the Callfornla Department of Real Estate the appllcants may begln
selllng thelr un1ts to the tenants. As each unit is sold a
conversion tax per Sectlon 2008 of Artlcle XX 1S due ln an amount
equal to twelve times the monthly maXlmum allowable rent for that
unlt. These taxes wlll be used to asslst low and moderate lncome
households to purchase or lmprove thelr unlts subJect to affordable
repayment per Sectlon 2009 of Artlcle xx.

BUDGET/FISCAL IMPACT
The recommendatlon presented ln thlS report does not have an immedl-
ate budget or flscal lmpact. If and as unlts In the project are
sold ln the future, Tenant-Part1clpatlng Converslon Taxes wlll be
collected pursuant to the prOV1S10ns of Artlcle XX of the Clty
Charter and some lncreased property tax revenues may be generated.
RECOMMENDATION
It is respectfully recommended that the Flnal Map for thlS Tenant-
Partlclpatlng Conversion be approved by adoption of the accompanying
resolution.
