TO: Mayor and City Council FROM: City staff SUBJECT: Resolution to Set a Public Hearing on July 12, 1994, for the Confirmation of Assessment of Costs for the FY 1992- 93 Annual Street Resurfacing Program and Appurtenant Work Introduction It is recommended that the City Council set a public hearing on July 12, 1994, to confirm assessment of costs for constructing and repairing concrete gutters, sidewalks, for resurfacing streets and conducting appurtenant work, and to hear protests regarding the completed work. These improvements were performed in conjunction with the FY 1992-93 annual Street Resurfacing Program at various commercial, 1ndustrial and residential locatlons. Backqround The FY 1992-93 annual street Resurfaclng Program included gutter construction, street resurfaclng, slurry sealing, parkway pavement removal, curb ramp constructlon, curb and gutter repairs, and sidewalk and drlveway construction at varlOUS locat1ons in the city. The criteria used to determine the streets included in that year's program and the method of repair included: age, drainage problems, surface and subsurface conditions, complaints received, type of use (i.e. , commercial and residential) , current traffic volume, and projected change of use or traffic volume of the streets. 1 MAY 1 0 199't 6E , .{ ~ ---- In accordance with the 1979 City Council POllCY declslons, residential properties are assessed at one half the cost of removal and replacement of damaged curbs, sidewalks, driveways, and parkway pavement. Commercial properties are assessed the full cost of repair of this work. Residential properties are not assessed for new gutter construction or street resurfacing; however, commercial and industrial property owners are assessed the full cost of the repairs. The assessments are calculated such that each commerclal and residential property owner(s) pays the same unit cost regardless of the width of the street affectlng thelr property. TYPlcal assessment for a commercial or industrial property o\Vner wlth a 50 foot lot, is $650.00 for resurfacing, and $800.00 for new gutter construction. Consistent with the present policy for assessing commerclal and industrial properties, this assessment is a cash assessment and no bonds will be issued. On April 23 and May 27, 1993, notices of the Clty's intent to form a street resurfacing assessment distrlct and hold a public hearing were posted and mailed in accordance wlth state law to all affected property owners. The public hearing was held on June 15, 1993, and after closing the public hearing, the city Council ordered the work to commence. The annual Street Resurfac1ng Program is completed and property owner assessments are now due. A publlC hearing to confirm the assessment of costs must be held pursuant to section 5882 of the 2 - --- Callfornia streets and Highways Code. The attached resolutlon sets the public hear1ng for 6:30 p.m. on July 12, 1994. All affected property owners will be notified of the public hearing date and the assessment amount at least forty-five days prior to the public hearing. Some corner lots are assessed at 50% of the street resurfacing and gutter construction costs instead of 100% of the costs. North 6. 7th street - San Vicente Boulevard to North City Limlt 7. 6th street - Broadway to Arizona Avenue The assessment distrlct was admlnlstered in accordance with the procedures set forth ln the Improvement Act of 1911 of the California Streets and Highways Code and the Government Code. BUdget/Financial Analysis The total revenue from this assessment 1S expected to be $198,604.26. Gutter construction and street resurfaclng assessments will generate $84,643.51 and 'iHll be deposlted in Revenue Account No. 01-500-402-00000-0124-10000, "street Resurfacing Assessment." Addltional revenue in the amount of $113,960.75 for the repair of sidewalks, driveways and curbs, and the removal of pavement in parkway areas will be deposited in Revenue Account No. 01-500-421-00000-0179-10000, "Sldewalk Repalr 4 - - -- -- - -~ Revenue." Any unpa1d assessments will be placed on the 1994-95 property tax roll by the Los Angeles County Assessor's Office. Recommendation It is recommended that City Council adopt the attached Resolution setting a public hearing for July 12, 1994, to confirm the assessment of costs for the gutter construction, street resurfacing, and repair of damaged sidewalks, driveways and curbs and the reIDoval of parkway pavements on the above named streets.
