Waiving Fees
INTRODUCTION
This report recommends the City Council adopt the attached
ordinance to faCIlitate new construction of new single family homes
damaged by the January 17, 1994 Northrldge Earthquake.
BACKGROUND
On AprIl 19, 1994, as part of the adoption of the Earthquake
Recovery Act, the City Council directed staff to return wIth an
emergency ordinance to faCilitate new construction of sIngle family
homes damaged by the January 17, 1994 Northrldge Earthquake.
The proposed ordinance per~lts new constructlon of single family
homes to be processed ln the same ;.Ianner as Itln klndtl single fahlily
home constructlon. Standards for reVIew, code compllance, and all
other existing zonIng requlrenents Will contInue to apply to new
SIngle famIly home constructlon.
In addition to the expedited pernlt process, the proposed ordinance
authorizes the City Manager to waive payment of any permit
proceSSIng fees for homes da~aged In the January 17,

BUDGET AND FINANCIAL IMPACT
The recommendation in this report nay have a mlnor fiscal lmpact
due to the Walver of permit related fees. However, this lmpact is
not expected to be signiflcant.
RECOMMENDATION
It is recommended that the CIty Councll adopt the proposed
ordinance.

AN EMERGENCY ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
PROVIDING FOR EXPEDITED REVIEW OF APPLICATIONS
FOR NEW CONSTRUCTION OF SINGLE FAMILY HOMES
DAMAGED BY THE EARTHQUAKE, WAIVING FEES
AND DECLARING THE PRESENCE OF AN EMERGENCY
WHEREAS, the City Councll adopted Ordinance Number 1736(CCS),
the Earthquake Recovery Act, on April 19, 1994, in response to the
threat to public, health, safety, and welfare arising from the
widespread City damage caused by the January 17, 1994 Northridge
earthquake and its aftershocks, and
WHEREAS, among other things, the Earthquake Recovery Act
establishes expedited review procedures for in-kind repalr and
reconstruction of earthquake damaged structures; and
WHEREAS, the Council finds that the expedited procedures
should also be available for reVlew of applicatlons involvlng new
construction of single famlly homes which were damaged by the
earthquake as the review will help ensure rapid rebuilding of
structures but wIll not waive zoning or other City requirements
applicable to new construction; and
WHEREAS, wlthout a streamlined permit process for new
construction of single family homes, families may be left homeless,

neighborhoods will continue to exper~ence the negatlve effects of
unrepaired buildings, and economic hardships will result from the
delay in construction;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION 1. Applications for New ConstructIon of Sinqle Family
Homes. The review process for an application for new construction
of a single family home replacing an earthquake damaged single
family home shall be the same as the reVlew process for an
Earthquake Recovery Permlt set forth ln Section 7 of the Earthquake
Recovery Act, Ordinance Number 1736(CCS). For purposes of this
ordinance, "new construction" shall be defined as set forth in the
Earthquake Recovery Act. No other provision of the Earthquake
Recovery Act shall apply to an application for new construction of
a single family home. The standards for review, and all other
zonlng requirements applicable to new construction under the
current Zonlng Ordinance shall apply to such an application.
SECTION 2. Fee Waivers. The City Council authorlzes the City
Manager or his or her designee to waive payment of any permit
processing fees or such other applicable fees as may otherwise be
necessary for new constructlon of a single family home replacing an
earthquake damaged single family home, If the city Manager in his
or her sole discretion deems such waiver appropriate to faCilitate
the speedy construction of such a structure due to damage suffered
from the January 17, 1994 earthquake or ltS aftershocks.
SECTION 3. Any provision or provlsions of the Santa Monica
Municlpal Code or appendices thereto, Inconsistent with the

provisions of this Ordinance, to the extent of such inconsistencies
and no further, are hereby repealed or modif ied to that extent
necessary to effect the provisions of this Ordinance.
SECTION 4.
This ordinance is declared to be an urgency
measure adopted pursuant to the proviSions of Section 615 of the
Santa Monica City Charter.
It is necessary for preserving the
public health, safety, or welfare as set forth in the preamble to
this Ordinance.
SECTION 5.
The Mayor shall sign and the city Clerk shall
attest to the passage of this Ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
This Ordinance shall be
effective upon lts adoptlon.
