MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTIONS
2.32.210 to 2.32.260 REGARDING DISPOSITION OF UNCLAIMED
PROPERTY
The Santa Monica Municipal Code currently provides a procedure
for the disposition of unclaimed property by the Chief of Police.
The current law provides procedures and time periods which exceed
the requirements of state law.
The purpose of this proposed
ordinance is to conform the City's requirements to those imposed by
state law.
A. Summary of Proposed Ordinance.
This proposed ordinance would amend the Santa Monica Municipal
Code to make the procedures and time periods consistent with state
law in the fOllowing manner:
(1)
section
2.32.210
would
permit
unclaimed property to be placed in the custody
of the Police Department and provides that the

owner of the property or money has 90 days,
rather than 120 days, to provide proof of
ownership.
(2) section 2.32.220 sets forth the
procedures to follow if the true owner does
not claim the property. If the value of
property is more than $250.00, the Police
Department shall:
(a) wait 90 days for the true owner to claim
the property;
(b) If no owner appears, publish a notice
once in a newspaper of general
circulation and if the owner does not
appear in the seven (7) days after
publication, ownership vests in the
finder upon payment of the cost of
publication;
(c) If a public employee is the finder of the
property, it shall be sold at a public
auction.
If the value of the property is less than
$250.00, the Police Department shall:

(a) Wait 90 days for the true owner to claim
the property;
(b) If no owner claims the property within
the 90 days, title vests in the finder of
the property;
(c) If a public employee is the finder of the
property, it shall be sold at a public
auction.
Property which remains unclaimed is to be
sold at public auction to the highest bidder
and if no bid is received, the City can
destroy or otherwise dispose of the property.
If any property subject to auction is needed
by the City, it may be retained by the City
and not put up to bid.
(3) section 2.32.230 provides that money
which is held by the Police Department or a
combination of the Transportation Department
and the Police Department for six months is to
be turned over to the Finance Director for
deposit into the general fund.
(4) Section 2.32.240 provides procedures

for receipt of lost money or property by the
Police Department.
(5) Section 2.32.250 provides procedures
for receipt of lost money or property by the
Transportation Department.
(6) section 2.32.260 provides for a
summary procedure if the property is in danger
of perishing; losing the greater part of its
value; or if the lawful charges amount to two-
thirds of the value of the property.
B. Chanqes From Current Municipal Code.
The main changes to the Municipal Code are shortening the time
period for holding property from 120 days to 90 days; elimination
of the requirement of putting property up for public auction twice
before it can be destroyed or otherwise disposed of by the City;
and elimination of requirements of publishing a notice after the 90
day period if the property is less than $250.00 in value. The
ordinance also updates the code so that it refers accurately to the
departments which have duties under these provisions.
RECOMMENDATION
It is respectfully recommended that the accompanying

SECTION 5. Santa Monica Municipal Code section 2.32.250 is
amended to read as follows:
2.32.250 Buses.
Not withstanding anything to the contrary
contained in section 2.32.200 hereof, any lost
money or property found in or upon any bus
belonging to the City or in or upon any
building occupied by the Transportation
Department of the City shall be delivered into
the custody of the head of the Transportation
Department of the city, which person shall
care for and protect all such '..I-r~ C'. r
property coming into his (~r h'!"" possession.
Said department head shall restore such
property or money to its true owner or the one
entitled to possession upon proof of ownership
or right to possession satisfactory to said
department head and upon the payment of all
necessary costs incurred in the care and
protection of such property. Should any such
property or money be not restored wi thin a
period of ninety days from the date of
finding, said department head shall cause such

property or money to be delivered into the
custody

SECTION 7. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent with the provisions of this
Ordinance, to the extent of such inconsistencies and no further,
are hereby repealed or modified to that extent necessary to effect
the provisions of this Ordinance.
SECTION 8. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconsti tutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the Ordinance would be subsequently declared invalid or
unconstitutional.

SECTION 9.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption. This ordinance shall become
effective after 30 days from its adoption.
