In response to that dlrection, the accompanying ordinance has been prepared and is presented to the City CouncIl for Introduction for first reading, The accoMpanying ordlnance adds SectIon 2.48.030 to the MunIcipal Code to create the position of Commissioner EmerItus on the Commission on Older Americans. The Commiss ion on Older Americans voted to establIsh thIS nonvoting commissioner Emeritus pOSItion ~n an effort to off~cially utilIze the talents of former Commissioners who have already served the maximum allowable number of terms on the commission. The Commission on Older Americans will make recommendations to the City council of people to appoint to the new position based upon certaIn eligibIlity criteria. To be eligIble persons must have served two full terms as CommIssioner on 1 JUN 2 1199't 8 r.n~ iJ ~ ~- ... the Commission on Older Americans and must be active in the Santa Monica community, The new Commissioners Emeritus will serve two year terms, which can be renewed without limit by the city Council. RECOMMENDATION It is respectfully recommended that the City Councll introduce the accompanying ordinance for first reading. PREPARED BY: Marsha Moutrle, Clty Attorney Joseph Lawrence, Assistant Clty Attorney 2 ... .- CA:atty\muni\laws\jl\emeritus City council Meeting 6-21-94 Santa Monica, California ORDINANCE NUMBER (CCS) (city Council Series) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ADDING SECTION 2.48.030 TO THE MUNICIPAL CODE TO CREATE THE POSITION OF COMMISSIONER EMERITUS ON THE COMMISSION ON OLDER AMERICANS THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 2.48.030 is hereby added to the Santa Mon1ca Municipal Code to read as follows: SECTION 2.48.030, commissioner(s) Emeritus. One or more commissioner (s) Emeritus shall be appointed to the Commission on Older Americans ("Commission") by the city Council based upon the recommendations of the Commission, To be eligible for appointment to such a position, a person must have served two full terms as a Commissioner on the Commission and shall be active in the Santa Mon1ca community. Each Commissioner Emeritus shall be a nonvoting member of the Commission, may represent the Commission at community and 1 -~ '" other functions as directed by the Commission, may serve on commission committees, and shall abide by the bylaws of the Commission. There shall be no limit to the number of commissioners Emeritus appointed to the commission, each of whom shall serve a two year term as a Commissioner Emeritus, Unlimited term renewals of Commissioners Emeritus can by made by the City council upon the recommendation of the Commission. SECTION 2. Any provision of the Santa Monica Municipal Code or appendices thereto inconslstent Wl th the provisions of this ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to affect the provisions of this Ordlnance, SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconsti tutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The city council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutlonal without regard to whether any portion of the Ordinance would he subsequently declared invalid or 2 ...... . - unconstitutional. SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within 15 days after its adoption, This Ordinance shall become effective after 30 days from its adoption.
