SUBJECT: Ordinance Adding Section 3.08.4&0 to the Santa Monica
Municipal Code To Establish Preferential Parking Zone HH
At its meeting on September 26, 1995, the City Council directed
the City Attorney to prepare an ordinance establishing a
preferential parking zone in the area bounded by Adelaide Drive, 7th
Street, San Vicente Boulevard and Ocean Avenue. Tn response to this
direction, the accompanying ordinance has been prepared and is
presented to the City Council for its consideration.
The accompanying ordinance adds Section 3.08.460 to the Santa
Monica Municipal Code establishing Preferential Parking Zone HH in
the area bounded by Adelaide Drive, 7th Street, San Vicente
Boulevard, and Ocean Avenue. Parking in Zone HH will be prohibited
at all times, except by permit. All other provisions applicable to
preferential parking zones would apply.
An initial study was prepared in accordance with the provisions
of the California Environmental Quality Act. Based upon this
initial study, a negative declaration has been prepared. Both
documents are attached to this Staff Report as Exhibit A. Notice of

preparation of the negative declaration was given in the manner
required by law.
RECOMMENDATION
It is respectfully recamrnQnded that:
1. The negative declaration be approved.
2. The accompanying ordinance be introduced for first
reading.

AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA ADDING SECTION 3.08.460
TO THE SANTA MONICA MUNICIPAL CODE TO
ESTABLISH PREFERENTIAL PARKING ZONE HH
WHEREAS, the Parking and Traffic Engineer has received a
petition requesting establishment of a preferential parking zone in
the area bounded by Adelaide Drive, 7th Street, San Vicente
Boulevard, and Ocean Avenue; and
WHEREAS, the petition has been verified to be signed by
residents living in two-thirds of the dwelling units comprising not
less than fifty percent (50$) of the developed frontage of the
proposed preferential parking zone; and
WHEREAS, the Parking and Traffic Engineer has undertaken such
studies and surveys deemed necessary to determine whether a
preferential parking zone should be designated in the area; and
WHEREAS, the City Council is satisfied that the proposed area
meets the designation criteria set forth in Municipal Code Section
3.08.040,
NOW, THEREFORE, THE CITY COUNCIL DF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:

SECTION 1. Section 3.08.460 is added to the Santa Monica
Municipal Code to read as follows:
Section 3.08.460. Preferential Parkincr
Zone HIi.
(a) The following named and described
area within the City shall constitute
Preferential Parking Zone HH: the area bounded
by Adelaide Drive, 7th Street, San Vicente
Boulevard, and Ocean Avenue.
(b) No vehicle shall be parked ar
stopped adjacent to any curb in Preferential
Parking Zone IiH at any time without a permit
issued and displayed in accordance with this
Chapter.
(c) Any vehicle parked or stopped
without a permit when required by this Section
may be removed from the street by any police
officer.
{d) The annual fee for each permit
issued for Preferential Parking Zane HH shall
be $15.00 per permit, or such other fee as may
be established from time to time by resolution
of the City Council.
SECTION 2. Any provision of the Santa Monica Municipal Cade
or appendices thereto inconsistent with the provisions of this

Ordinance, to the extent of such inconsistencies and no further, are
hereby repealed or modified to that extent necessary to affect the
provisions of this Ordinance.
SECTION 3. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of any competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this Ordinance. The City Council hereby
declares that it would have passed this Ordinance, and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional without regard to whether any portion
of the Ordinance would be subsequently declared invalid or
unconstitutional.
SECTION 4. The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall cause
the same to be published once in the official newspaper within 15
days after its adoption. This Ordinance shall become effective
after 30 days from its adoption.

California, having been filed by the Planning and Community Development Department on November 28,
1995, and the application having been reviewed by the Planning and Community Development Department,
therefore, the Department hereby finds that:
1. The proposed activity does constitute a proj~t within the meaning of the California
Environmental Quality Act of 1970, as amended.
2. The proposed activity is not exempt from the provisions of such act by reason of being a
ministerial, categorically exempt or emergency activity.
3. The proposed activity does not appear to have a substantial adverse effect upon the
environment.
4. Inasmuch as it can be seen with reasonable certainty that no substantial adverse effect is
involved, na proper purpose would be served by the preparation of an Environmental Impact
Report.
5. A Negauve Declaration document is the proper, correct and appropriate procedure required
to assure compliance with the purpose and intent of the California Environmental Quality Act
of 1970, as amended.

Dear Mr. Foley:
The City of Santa Monrca rs proposing a resident preferential parking zone
along the boundaries of Adelaide Dnve, Seventh Street, San Vicente Blvd.
and Ocean Avenue. As you are aware a change in intensity of use of land, in
this case changing street parkrng from public to private use, constitutes
development, pursuant to Section 30106 of the Coastal Act, and requires a
coastal permit.
Because of the proximity of the preferential parking zone's boundary to
coastal recreational areas, such as the beach and Palisades Park, the
Commission is concerned with the potential adverse impact the proposed
preferential parkrng may have on public access
At this trine it rs not known to what extent Adelaide Drive and San Vicente
Blvd., which currently allow free parking to the general public, are used by
the public to access Palisades Park and the beach. Therefore, the Impact of
changing these two streets, especially in the proximity of Ocean Avenue, to
preferential parking, can not be determined.
Furthermore, at fourth Street, leading from Adelaide Dnve down to Ocean
Avenue (within the Crty of Los Angeles), there is a flight of stairs that
provides indirect pui,iic access to the beach. By designating the surrounding
streets far preferential parkrng the Clty may eliminate public access to those

members of the public who drive and park an Adelaide Dnve or Fourth Street
and use the stags for coastal recreational access.
Although I am aware that the stairs are heavEiy used l,y exercise enthusiast,
it is not known to what extent the stairs are used by the general public far
coastal recreat~anal access. It is also not known what percentage of the
general public that use the stairs for access are nearby residents and haw
many drive to the area and use the surrounding streets far parking.
Furthermore, alternatives to the proposed preferential parking need to be
analyzed. Alternatives to preferential parking could include signage to limn
the type of usage, placement of mechanisms, such as turnstiles, to
discourage logging, etc Df course, since the stairs are wEthin the City ofi Los
Angeles' lurfsdzction some alternatives may need to involve the City of l.os
Angeles.
Additional research is necessary to adequately determine the full impact of
the proposed preferential parking zone an coastal recreational access. At
this time the impacts of the proposed pralect on access are unknown.

RESPONSE TO COMMENTS
1. The staff of the California Coastal Commission expressed concern that the proposed
preferentzal parking zone will adversely affect public access to Palisades Park and the beach
since Adelaide Drive, Fourth Street and San Vicente Boulevard currently allow free parlang
to the general public. Additionally, Commission staff suggested that alternatives to the
establishment of a preferential parking zone be considered to alleviate the impact of heavy
on-street parlang demand created by the use of the Fourth Street stairs by exercise
enthusiasts from outside the neighborhood.
Coastal access issues are not within the purview of CEQA analysis and are, therefore,
not addressed in the Initial Study. Secondly, the City of Santa Monica has na authority over
the Fourth Street stairs as they are located outside the city boundaries in the City of Los
Angeles and is, therefore, limited in the nature of alternatives that might be considered to
alleviate the parking impacts created by the usage of the stairs.
The preferential parking zone writ require a coastal permit. Preferential Fartdng Zone
"HH" will be submitted to the California Coastal Commission for review where the coastal
access issues can be addressed. The next Commission heanngs which are scheduled locally
are due to occur in May 1996.
