INTRO:JUCTION
The proposed ordlnance updates and clarlfles var1.OUS seetlons of
the Business, Professions and Trades Section of the Code. The
ord1.nance properly cross-references other Code sections relating to
buslness l1.cense and regulatory restrictions.
It would also add
bowllng, bllllards & pool halls, telemarketlng, tow truck operators
and valet parklng to the llst of buslness actlvitles required to
obtaln a pollce permlt and pay the $44 fee. Upon adoptlon of the
proposed ordlnanee, staff w1.ll return to Council to revise the
resolut1.on set tlng pollce perml t fees.

DISCUSSION
The proposed ord1nance clar1f1es the eX1st1ng requ1rement that
businesses obta1n separate bUS1ness llcenses for each bUSlness
locat1on
As appl1ed to auto dealers, these requ1rements mean that
any auto dealer who ~s a franch~see or distr1bution branch for a
part1cular type of vehicle would be requ1red to obta1n a separate
llcense for each franchlse or dlstrlbutlon branch that ~t operates.
The sectlcns on the Rental of Non-Resident1al Property and Rental
of ReS1dent1al Property 1nclude techn1cal term1nology changes Wh1Ch
expla~n that any ent1ty which rents, leases, subleases or llcenses
commerclal or non-commerc1al property is requ~red to obta1n a
bUS1ness llcense
The sectloD on retall bUSlnesses deletes the language perta1n~ng to
"ltlnerant peddler" as thlS actlvity is regulated under Chapter
6 32. The section on Special Events deflnes promoter and adds the
category of speclal sales of goods or serVlces. This sect10n also
requ1res each part1clpant 1n any Speclal Events to obta1n a
separate buslness llcense appropr1ate to the category of bUS1ness
10 whlch the partlc1pant engages at the Speclal Event.
The proposed ordinance adds Chapter 6.14, entitled "Regulatory
Restrlct1.0nS on Des1.gnated Euslness Act1.vitles," wh1.ch renumbers,
amends and clarlfies eXlstlng sections. This Chapter sets forth

Under the revlsed regulat1ons, the police would be authorlzed to
seal vendlng machines for wh1ch the proper llcense fee has not been
paid. The pollce ,,,ould be author1zed to impound any vend1ng
machine when a 11cense fee 18 not pa1d by the ovmer with1n 30 days
of rece1pt of not1ce that the fee has not been pa1d.
Chapter 6.14 also clarlfles that the C1ty'S amusement zones
cons1sts of the "Promenade" and the Santa Hon1ca Pler

The regulatlons regardlng taxlcabs, WhlCh are contalned ~n Chapter
6.48 of the Code, change the term "limouslne" to "veh~cle"
throughout the regulatlons. Incorporated lnto thlS sectlon lS the
requ~rement that outstandlng parklng tlckets and related pena1tles
and fees be pald prlor to the lssuance of a decal Th::..s ~s

The ordlnance makes several techn1cal changes to the Code VarlOUS
sectlons are deleted because they were renumbered and lncorporated
lnto the proposed ordlnance. In addition, changes have been made
throughout to change references from the Dlrector of General

The City Manager shall have the authority
to adopt such rules and regulations as in his

SECTION 30. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent with the provisions of this
Ordinance, to the extent of such inconsistencies and no further, is
hereby repealed or modified to that extent necessary to affect the
provisions of this Ordinance.
SECTION 31. If any section, subsection, sentence, clause, or
phrase of this Ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the

remaining portions of this Ordinance.
The City council hereby
declares that it would have passed this Ordinance and each and
every section, subsection, sentence, clause, or phrase not declared
invalid or unconstitutional without regard to whether any portion
of this Ordinance would be subsequently declared invalid or
unconstitutional.
SECTION 32. The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance.
The city Clerk shall
cause the same to be published once in the official newspaper
within 15 days after its adoption.
This Ordinance shall become
effective 30 days from its adoption.
