Resurfaclng Program and Appurtenant Work on Various City
Streets
Introductlon
This report recommends that the City Council set a public hearing
on May 28, 1996 to confirm the assessment costs ror constructing
and repairing concrete gutters, sidewalks, ror resurfacing streets
and complet~ng appurtenant work, and to hear protests regarding the
completed work. These lmprovements were performed in conjunction
with the FY 1994-95 Annual Street Resurracing Program at various
commercial, lndustrial and residentlal locatlons.
Backoround
The FY 1994-95 Annual Street Resurfacing Program lncluded concrete
gutter construct lon, street resurfacing, slurry sealing, parkway
pavement removal, curb ramp construction, alley reconstruction,
curb and gutter repairs, and sidewalk and driveway construction at
various locations ln the Clty The criteria used to determine
which streets were lncluded in that yearts program and the method
of repalr included: age, drainage problems, surface and subsurface

residential} , current traffic volume, and projected change of use
or trafric volume or the streets.
To assist the Clty ~n attalning a sustainable city, 100% of the
existlng pavement was recycled and approximately 25,000 used tires
were added to the asphalt mlX used in the resurracing.
In accordance with the 1979 City Council policy, residential
properties are assessed at one half the cost or removal and
replacement of damaged curbs, sidewalks, driveways, and parkway
pavement. Commerclal properties are assessed the full cost or
repair or thlS work
Residential propert~es are not assessed for new concrete gutter
constructlon or street resurfacingj however, commercial and
industrial property owners are assessed the full cost or the
repa~rs The assessments are calculated such that each commercial
and lndustrial property owner(s} pays the same unit cost regardless
or the width or the street affecting thelr property. For street
resurraclng a typlcal assessment ror a commercial or industrial
property owner with a 50 foot lot is $925.00 and $1,150.00 ror new
gutter construction. Conslstent with the past policy ror assessing
commerclal and ~ndustrlal properties, this assessment 1S a cash
assessment and no bonds will be issued. This policy has recently

changed for new assessment districts allowing payments to be made
on an installment plan via the issuance of bonds.
On April 81 19941 notices of the City1s intent to form a street
resurraclng assessment district and hold a public hearlng were
posted and mailed ln accordance with State law to all affected
property owners. The public hearlng was held on May 311 19941 and
after closing the publlc hearing 1 the City Council ordered the work
to commence.
The Annual Street Resurfacing Program is completed and property
owner assessments are now due. A public hearlng to conrirm the
assessment costs must be held pursuant to Section 5882 of the
California Streets and Highways Code The attached resolution sets
the publlC hearing ror 6;30 p ffi. on May 281 1996. All affected
property owners will be notlfied or the public hearing date and the
assessment amount at least 45 days prior to the public hearing. A
11st or property owners and assessment amounts wlll be available to
the Clty Council at the time of the public hearing.

* Residentlal property owners pay 100% or the cost if the damage
is not caused by street trees. About 95% of the sidewalk and
curb damage in resldential areas is caused by street trees.
The unlt costs lnclude stafr time ln conducting engineering surveys
and posting and ma~llng of notices, construction management,
lnspections and construction. Owners of corner lots where the
legal address lS the street being repaired pay 100% of applicable
repair work Ir the legal address lS the adjacent street, the
property owner pays 50%. Corner lots have the potential of belng
assessed for both sldes of their lot it both streets are repaired.
ThlS policy eases the impact on corner lots by assessing 100% on
one street and 50% on the cross street.

The assessment dlstrict was adminlstered in accordance with the
procedures set rorth in the Improvement Act of 1911 of the
Callfornla Streets and Highways Code and the Government Code.

Budoet/Financial Analvsis

The total revenue rrom this assessment is expected to be
$317,529 76. Gutter constructlon and street resurfacing
assessments wlll generate $127,561.51 and will be deposited in
Revenue Account No. 01-500-402-00000-0124-10000, nStreet
Resurracing Assessment. n Addltional revenue in the amount of
$189,968.25 ror the repair of sidewalks, driveways and curbs, and
the removal or pavement in parkway areas will be deposited ln
Revenue Account No. 01-500-421-00000-0179-10000, nSidewalk Repair
Revenue." Any unpaid assessments will be placed on the 1996-97
property tax roll by the Los Angeles County Assessor's Of rice.
Recommendation
It lS recommended that the Clty Councl1 adopt the attached
Resolution setting a public hearing for May 28, 1996, to conrlrm
the assessment costs for the improvements performed in conjunct~on
with the FY 1994-95 Annual Street Resurfaclng Program and
appurtenant work at var~ous locations throughout the City.
