Introduction
This -•eport recommends that the City Council sev a pu;^lic rea~r~ng
for May 14, 1996, tc corf-rm assessment tests for repairing dar~~aged
sidewalks, driveways, curbs, and removing damaged oavement i_~
parkway areas on various City streets, and to hear protes~s
regarding the ccmp_eted wcrk.
Background
On October 9, 1979, City Council approved a s~dewalc repair px•ograrl
which provided far broperty owner part~cipatior: ire the cost of
repairing damaged sidewalks Residential property owner
participation is 500 of the cost cf the repairs ?f the damage is
related to tree rents, wzth the City pay~rc the remainir_c 5Co o
the repair costs. Property owners are assessed 10~~a c•f the cost
if the damage is not related to tree rods aria commercial property
owners are assessed 100% cf the cosy regardless cf the cause of
the damage.

provisions of Chapter 22, Secticns 5500 tc 5530, of the Streets arrd
Highways Code of the State of Caifornia. A Resolution setting the
public hearing for 5 30 p m. on Nay 14, 1995, .s attached. All affected

property owners will be nctif~ed of the public hear~r_g dare and the
assessment amount fifteen 115; days prior to the public hearir_g. A list
of property cwners ar_d assessment amounts will be available tc Council
at the time of the public hearing.
Budget/Financial ImnaC~
The financial calc:laticr_, which wi~l ir_di cate total revenues tc be
derived from this assessrner_t dis~rict over the next two years, will be
presented to the City Co~.~ncil at t e time o- public hear-ng Cash
revenues will be deposited in Account No 01-500-e21-.n,0000-01"79-10000,
"Sidewalk Repair Revenue." Any unpaid assessments will be placed on the
1996-1997 property tax rolls by ire Los Angeles County Assessor's
office .

HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Superintendent of Streets w~11 file
a report cf work completes pursuant to Sectior_ 5E17 of the Streets
and Highways Code of the State of California, relating to

SECTION 2 Pursuant to Sect~.an 56G0 et sea. of saga
Code, the City Council does hereby order and declare that on the
14th day of May, 1996, at 6.30 p m., ~n the City Lour;ca.l Chambers
of City Hall, 1585 Main Street, Santa Monica, it wail hear and
pass upon the report by the Superintendent of Streets of the cost
of repairs, together with objections or protests, ~f ar_y, which
may be raised by any property owner liable to be assessed for the
cost of such repairs and any other interested persons.
SECTION 3. All protests or objections must be in
writing and filed with the City Clerk an cr befcre the time set for
the hearing of the protests and objections
SECTION 4 The Superintendent of Streets is hereby
directed to mail nctices, in the manner and form prescribed by
law, of the costs of repair and of the adoption of this Resolution
to all persons owning real property affected by the sidewalk
assessment repair program, whose names and addresses appear on the
last eaual~zed assessment roll for the City taxes or as knowr_ tc
the City Clerk.
SECTION 5. The City Clerk shall certify to the
adopta.an of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
