The fee waiver was approved in concept by the City Council on April 7, 1992. BACKGROUND At the April 7, 1992 Council meeting, the council approved a motion that included a provision to waive planning processing fees for affordable housing projects which are 100% deed-restricted for occupancy by lOw- and moderate-income residents. The attached resolution accomplishes this objective. Qualified pending projects which have not yet been approved, as well as future projects, would be entitled to the fee waiver. BUDGET/FINANCIAL IMPACT The elimination of planning processing fees for affordable housing developments would have a minimal fiscal impact. Due to 6-"1 - 1 - APR 1 4 1992 the low numbers of such projects, such impact would not be significant, likely amounting to less than $10,000 per year. RECOMMENDATION It is respectfully recommended that the city council adopt the attached resolution amending Planning fee requirements for affordable housing developments. Prepared by: D. CA:RMM:tp89/hpadv city Council Meeting 4-14-92 Santa Monica, California RESOLUTION NUMBER 8384(CCS) (City Council Series) AN RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA MODIFYING PLANNING, ZONING AND LAND USE FEES WHEREAS, the Santa Monica Task Force On Homelessness ("Task Force") has recommended that the City Council adopt measures to promote the development of affordable housing in Santa Monica; and WHEREAS, the Task Force has found that the city's planning and zoning restrictions and implementation make it difficult to develop affordable housing within the city limits, and has recommended the modification or elimination of current zoning regulations which slow down or prohibit the development of a range of housing opportunities for the homeless and special needs populations; and WHEREAS, Mun~cipal Code Section 9210 authorizes the setting of planning, zoning, and land use fees by resolution, and WHEREAS, the city Council has adopted Resol ution Number 7607 (CCS) and Resolution Number 8082 (CCS) setting planning, zoning and land use fees, and - 1 - .. WHEREAS, it is necessary to amend these fees with respect to affordable housing in order to encourage the development of such housing in the City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Residential housing projects in which 100% of the dwelling units are restricted for occupancy by low or moderate income households shall be exempt from the fees established by Resolution No. 7607 (CCS) and 8082 (CCS). SECTION 2 . Residential housing projects meeting the requirements of section 1 of this Resolution for which applications have been submitted but which have not yet been approved shall be entitled to a refund of any fees from which they would otherwise be exempt pursuant to this Resolution. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
