SUBJECT: Recommendation to Adopt an Amended Resolution to Revise
the Date of the Public Hearing from March 24, 1992 to
April 14, 1992 for the Confirmation of Assessment of

the Repair of Damaged Sidewalks, Driveways and Curbs
and the Removal of Hazardous parkway Pavings on Various
City Streets in Conj unction with the 1990-91 street
Resurfacing Program
Introduction
This report requests that City Council amend Resolution No, 8364
(CCS) to revise the date of Public Hearing from March 24, 1992 to
April 14, 1992 for the confirmation of assessment of costs for
gutter construction, street resurfacing, and the repair of
damaged sidewalks, driveways and curbs and the removal of
hazardous parkway pavings on various City streets in conjunction
with the 1990-91 Street Resurfacing Program.
Background
Resolution No. 8364 (CCS) was adopted by city council on March 3,
1992, setting a public hearing for March 24, 1992 to confirm the
assessment of costs in conjunction with the 1990-91 Street
Resurfacing Program, Subsequent to adopting the Resolution,
staff noticed that the date of public hearing in Section 2 of the
resolution was incorrect. For the purpose of legally notifying
property owners of the date of the public hearing, the City
Clerk's office has advised staff that the Resolution be amended,

Staff has revised section 2 of Resolution No. 8364 ( CCS) , with
the revised date of the public hearing and are resubmitting the
amended resolution for approval. The public hearing is to be
held on April 14, 1992.
Budget/Financial Impact
The recommendation presented in this report has no budget or
fiscal impact.
Recommendation
It is respectfully recommended that City Council approve the
attached resolution amending Resolution No. 8364{CCS) .

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA AMENDING RESOLUTION
NUMBER 8364 ( CCS) , AND HOLDING A PUBLIC
HEARING ON APRIL 14, 1992 FOR THE
CONFIRMATION OF ASSESSMENT OF COSTS FOR
GUTTER CONSTRUCTION, STREET RESURFACING AND
THE REPAIR OF DAMAGED SIDEWALKS, DRIVEWAYS
AND CURBS AND THE REMOVAL OF HAZARDOUS
PARKWAY PAVINGS ON VARIOUS CITY STREETS IN
CONJUNCTION WITH THE 1990-91 STREET
RESURFACING PROGRAM

WHEREAS, on March 3, 1992, the City Council voted to
set a publ ic hearing for March 24, 1992 pursuant to Resolution
Number 8364 (CCS) for the purpose of confirming the assessment of
costs for the purpose of gutter construction, street resurfacing
and the repair of damaged sidewalks, driveways, curbs and the
removal of hazardous parkway pav~ngs on various city streets~ and
WHEREAS, Resolution Number 8364 (CCS) inadvertently
included the incorrect date of public hearing for the
confirmation of assessment of costs,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Section 2 of Resolution Number 8364 (CCS)
is amended as follows:
SECTION 2. Pursuant to section 5870 et seq.
of the streets and Highways Code, the City
Council does hereby order and declare that on

the 14th of April, 1992, at 7:30 p.m., in the
City Council Chambers of City Hall, located
at 1685 Main street, it will hear and pass
upon the report by the Superintendent of
streets, of the cost of improvements together
with any objections or protests, if any,
which may be raised by any property owner
liable to be assessed for the cost of such
improvements and any - other interested
persons.
SECTION 2. The City Clerk shall certify to the
adoption of this Resolution, and thenceforth and thereafter the
same shall be in full force and effect.
