Introduction
Th1S report recommends that City Counc i 1 approve the formation of an
assessment district to construct concrete gutters; resurface streets; and
repair damaged sidewalks, driveways and curbs and remove damaged pavement 1n
parkway areas. These improvements are 1 n conj unct 1 on wi th the FY 1991-92
Street Resurfacing Program at vanous commerc1al, industrial and resident1al
locat1ons 1n the City. It also requests that City Coune1l adopt the attached
ResolutlOn of Intention and set a public hearing for May 12, 1992, for the
establishment of the appropr1ate assessment d1str1ct.
Background
The FY 1991-92 Street Resurfacing Program includes gutter construction; street
resurfacing; slurry seal i ng ; parkway pavement removal; and repair of curb,
sidewalk and drlVeway construction at vari ous 1 ocat lOns in the City. The
Street Superi ntendent, the C 1 ty Englneer, the Mal ntenance Manager and the
Street Ma i ntenance Superi ntendent inspected and eval uated the streets that
ranked hlgh on the "Pavement Management System Report" as streets 1n need of
repa1r. The criteria used to determlne Wh1Ch streets are to be resurfaced and
the method of repair includes: age, surface and subsurface condltlons,

complalnts received, type of use (i.e., commercial and residential), current
trafflC volume, and projected change of use or volume of the streets.
In accordance with a 1981 City Council policy, residential propertles are
assessed one hal f the cost of removal and replacement of damaged curbs,
sldewalks, driveways and the removal of damaged parkway pavement. Commercial
properties are assessed the full cost of repalr of this work.
Residentlal properties are not assessed for new gutter construction or street
resurfaclng; however, commerc i a 1 and industrial property owners are assessed
the full cost. The proposed assessments are designed so that each commercial
and industrial property owner pay the same unlt cost regardless of the wldth
of the street on which thelr property fronts. Cons i stent wi th the present
pol icy for assesslng commercial and lndustrial properties, this assessment
wi 11 be a cash assessment and no bonds wi 11 be issued. The total estimated
assessment for a commercial or industrlal property owner with a 50 foot lot,
would be $450.00 for resurfacing, and $575.00 for new gutter construction.

The assessment d1strict will be administered in accordance with the procedures
set forth in the Improvement Act of 1911 of the Californ1a Streets and
Highways Code.
Budget/Financial Analysis
The assessment district will generate revenues of approximately $60~000 for FY
1992-93. The estimated cost for the 1991-92 Street Resurfacing Program 1 s
$560,000. There is $622,400 budgeted 1n var10US accounts for th1S program.

Recommendation

A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA SETTING A PUBLIC HEARING ON MAY 12, 1992 FOR
THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC
CONVENIENCE AND NECESS ITY REQUIRE THE CONSTRUCTION OF
CONCRETE GUTTERS, STREET RESURFACING, SIDEWALK, DRIVEWAY AND
CURB REPAIR AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY
AREAS AND APPURTENANT WORK ON VARIOUS CITY STREETS, IN
CONJUNCTION WITH THE FY 1991-92 STREET RESURFACING PROGRAM,
AS SHOWN ON CITY DRAWl NG NO. 6026~ IN THE CITY OF SANTA
MONICA
WHEREAS, the City Council of the City of Santa Moni ca proposes to
initiate proceedings under the Improvement Act of 1911 for the construction of
concrete gutters, street resurfacing, repair of damaged sidewalks, driveways
and curbs, and the removal of damaged pavement in parkway areas; and
WHEREAS, Section 19 of Article XVI of the Californla Constitution
provides that certain specified debt 1 imi tati on and majority protest
provisions shall not apply if, after the giving of such reasonable notice by
publication and posting and the holding of such public hearing as the City
Council of the City of Santa Monica shall have prescribed~ the City Council,
by no less than four-fifths vote of all members thereof~ finds and determines
that the public convenience and necessity require the proposed improvements to
be made; and
WHEREAS~ Streets and Highways Code Section 2804 provides that the
"Special Assessment, Investi9ation~ Limitation and Majority Protest Act of
1931" shall not apply to any proceed i n9 otherwi se subject thereto when said
improvement proceeding is by a charter city and said city has compl ied with
the proviSions of Section 19 of Article XVI of the California Constitution;

WHEREAS, the City of Santa Monica is a charter city of the State of
California,
NOW~ THEREFORE~ THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1- The City Council proposes to initiate proceedings for the
installation of concrete gutters, street resurfacing, repair of damaged
sidewalks, driveways and curbs~ and the removal of damaged pavement in parkway
areas, and appurtenant work adjacent to residential, commercial and industrial
propert i es on City streets as shown on City Drawi ng No. 6026 on fil e in the
office of the City Engineer as follows:

and Highways Code of the State of California.

The proposed work or improvements in the opinion of City Council of the City
of Santa Monica is of more than local or ordinary public benefit, and the City
Council hereby proposes that:

The di stri ct affected by the proposed work or improvements is shown upon a
certain map indicating the exterior boundary thereof, which said Drawing No.
6025 is on file in the office of the City Engineer. The map hereby is
referred to and shall govern for all details as to the extent of said
assessment district. The assessment district includes in general the lots and
parcels described in Section 1 above but reference hereby is made to said
Drawing for all details as to the extent of said assessment district and for
any variation between the last mentioned general description and the extent of
said assessment district as shown on said map.
SECTION 4. No bonds will be issued for the aforementioned assessment
district.
SECTION 5. Notice is hereby given that on Tuesday, the 12th day of
May, 1992, at 7:30 P.M., in the City Council Chambers located in City Hall,
1685 Main Street, Santa Monica, California, there shall be a public hearing
before said City Council for the purpose of determlning whether the publ ic
convenience and necessity require the above-described improvements and for the
purpose of allowing any and all persons having any objections to the proposed
work or improvements to appear and show cause why the said proposed work or
improvements should not be carried out 1n accordance with sa1d Resolution of
Intention. Inquiries concerning this public hearing should be directed to the
Department of General Services. Division of Engineering, at 458-8721.
SECTION 6. The City Clerk shan give notice of the hearing by
posting a copy of this Resolution in the manner described by the Streets and
Highways Code Sections 5065 and 5616 and by publication as hereinafter
provided. Any interested person may make protest against the proposed
improvement in wri t i ng fil ed with the City Cl erk at any time not 1 ater than

the hour set for the hearing in the manner provided by the Streets and
Highways Code Section 5220.
SECTION 7. The Superintendent of Streets shall cause to be
conspicuously posted along the line of said contemplated work or improvements
and also along all the open streets withln said district, notice of the
passage of this Resolution of Intention in the manner and form prescribed by
1 aw.
The office of the City Engineer is directed to mail notices, in the
manner and form prescribed by law, of the adoption of this Resolution to all
persons owning commercial, industrial or residential property in the
hereinbefore described assessment district, whose names and addresses appear
on the 1 ast equal i zed assessment roll for the Ci ty taxes or as known to the
office of the City Engineer.
SECTION 8. The City Clerk is directed to publish this Resolution in
The Outlook on two successive dates. The first publication is to be made not
less than fifteen days prior to the date of the above public hearing.
SECTION 9. Pursuant to Public Contract Code Section 20433, the City
Council hereby states that the property owners may not contract for the
improvements and that the City shall be responsible for awarding and
administering the construction contract for this district.
SECTION 10. The City Cl erk shall cert ify to the adopt i on of th is
Resolutlon, and thereafter the same shall be in full force and effect.
