SUBJECT: REQUEST FOR RESOLUTION IN SUPPORT OF THE LOS ANGELES
COUNTY COORDINATED PARATRANSIT PLAN
Introductlon
As part of the Americans with Disabilities Act, passed by
congress ln July 1990, clt1es which offer fixed route translt
servlce must provide complementary paratrans1t service to those
dlsabled individuals who cannot utilize an accessible fixed route
transit bus. Paratransit serv1ce is normally provided using
specially equipped vans and taxis. In Los Angeles County, the
Los Angeles County Transportation commission (LACTC) plans to
establish, operate and fund a countywide paratransit network, on
behalf of the cities, to meet the requirements of the Act. Th:ts
report requests that the city Council adopt the attached
resolutlon to particlpate in the LACTC's coordinated paratrans:tt
network.
Backqround
In July 1990, Congress passed the Amer1cans with Dlsabilities Act
(ADA) . One provlsion of the ADA requires cities which offer
fixed route transit service to provide complementary paratrans:tt
service to those disabled individuals who cannot utilize an
accesslble transit vehlcle. In order to encourage coordinatlon

ln large metropolltan areas, speclflc provlslons of the ADA allow
agencles, such as the LACTC, to coordinate service, and to
prepare and submit one unlfled countywide plan.
On December 3, 1991, the City Council adopted Resolution 8330
(CCS) WhlCh authorized the Clty to partlclpate ln the LACTC's
coordinated paratransit nett-lork. On behalf of the flxed route
operators in Las Angeles County, the LACTC prepared an lnterlm
plan for the provision of paratransit servlces and subnitted lt
to the U.S. Department of Transportation (DOT) on January 27,
1992. The final paratransit network plan is to be submitted to
the DOT by July 26, 1992. In order to do this, the LACTC must
have resolutions from each affected city by June 15, 1992
certifying ltS intention to participate in the flnal coordlnated
plan and to maintaln current levels of paratransit service untll
the coordinated plan is fully lmplemented.
Presently, the city uses approximately $400,000 of Proposition A
Local Return funds annually to sponsor a paratransit syste!"l
through \~estside Independent Servlces to the Elderly (HISE) .
WISE provides serVlce to both dlsabled and frail elderly
individuals. The WISE paratransit service is available from 8:00
a.m. to 7:00 p.m. Monday through Friday, 12:00 p.m. to 3:00 p.m.
on Saturday, and 9:00 a.m. to 2:00 p.m. on Sunday. WISE serves
destinations throughout Santa Monlca and a few selected medlcal
facilltles outside city boundaries. Under the LACTC Plan, the
city would continue to fund WISE paratranslt serVlce at the
current level. Additlonal service required by the ADA wlll be
funded and provided by the LACTC.

The LACTC network will utilize the services of a broker, who will
receive ride requests from eligible disabled indiv~duals and
schedule a trip on an ex~sting public, pr~vate, or not-far-profit
paratransit service prov~der ~n the area. The prov~der w~ll be
reimbursed for the cost of providing the tr~p through the LACTC .
If the existing provider cannot provide the service, the broker
will arrange for the service to be prov~ded by a
"fill-in-the-gap" overlay provider, such as a tax~cab service or
an operator from a nearby area.
The LACTC paratrans~t network includes five zones, as shown on
the attached map. Currently, serv~ce has been implemented in the
eastern San Gabriel Valley. Service in the Wests~de zone is
scheduled to be implemented in January 1993. service in all
zones will be fully implemented by January 1997. Under the LACTC
plan, as service in each zone becomes operational, d~sabled
patrons will be able to travel between zones wlthout the need to
transfer between vehicles. paratransit service would be
aval1able during the same hours that fixed route transit service
is available.
There are several benefits for the city if it participates ln the
Plan. The City will meet its obligation to provide an expanded
complementary paratransit service, and wlll not be required to
prepare, submit and fund an ~ndiv~dual paratransit implementat~on
plan to the U.S. DOT. These responsibilities will be assumed by
the LACTC. By joinlng the proposed network, the paratrans~t
serv~ce above the level currently provided by the City will be
funded by the LACTC. Significantly, e1~gib1e residents vnl1

benefit s~nce cross-Jur~sdictional paratransit services to the
disabled will be greatly expanded.
In the future, ~f the City would like to withdraw from the
regional network. it may do so, provided that ~t prepares and
submits the appropr~ate plan to the DOT and undertakes the
expanded operating obligations.
LACTC Responsibilltles
As the coordinating agency for the Paratransit Plan. the LACTC
would assume the follow~ng responsibilities:
0 Prepare and submlt a coordinated countywide plan by July
26, 1992 and update it annually thereafter beginning
January 26, 1993;
0 Administer an ADA-eligible certification and reglstration
process;
0 Hold public hear~ngs as required by the ADA;
0 Develop and staff a committee comprised of disabled
individuals and/or agencles representing the disabled as
required by the ADA;
0 Implement the coordinated paratransit Plan;
0 provide funding for the cost of the ADA-mandated service
above that currently expended for disabled transportation.

By adopt~ng this resolution, the City is authorizing the LACTC to
assume the City's obligation to provide the complementary
paratransit service and submit the plan as required by the ADA.
City Responsibilities
As a participant in the reg~onal paratransit network, the city
agrees to assume the following responsibilities:
0 Adopt the final Plan by June 15, 1992;
0 Provide relevant fiscal and operating data about its
current fixed route and paratransit services to the LACTC
in a timely manner for inclusion ~n the requ~red annual
update of the ADA paratransit plan;
0 Authorize, by City council resolution, the annual update
of the Los Angeles County consolidated paratrans~t plan
due to DOT annually on January 26.
0 In accordance w~th 49 CFR Part 37.141, the city must
maintain its current level of paratrans~t serv~ce,
presently provided through WISE.
BUdgetary/Financial Impact
Under ADA, the City ~s obligated to operate paratransit serv~ce
to complement its fixed route service. Adopting the resolution
and participating in the regional paratransit network will result
in expanded paratransit service that will be funded by the LACTC.

Recommendation
City staff recommends that the City Council adopt the attached
resolut~on to participate ~n the Los Angeles County paratransit
network since it w~ll allow the City to meet the complementary
paratrans~t provisions of the ADA ~n a coordinated manner, while
enhanc~ng the level of paratransit service to the d~sabled
commun~ty.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA IN SUPPORT OF THE LOS ANGELES COUNTY
COORDINATED PARATRANSIT PLAN
WHEREAS, the Americans with Disabilities Act (hereinafter
referred to as "ADA") was enacted on July 26, 1990 (Publlc Law
101-336) ; and
WHEREAS, on September 6, 1991, the United States Department
of Transportation (hereinafter referred to as "DOT") issued a
final rule implementing the transportation-related provisions of
the ADA (49 CFR Parts 27, 37 and 38, Transportation for
Individuals with Disabilities) ; and
WHEREAS, Subpart F, Sections 37.121 and 37.135 of 49 CFR 37
requires that each fixed route translt operator provide
complementary paratransit service to disabled individuals,
prepare a plan for implementation of such service and begin
service implementation by January 26, 1992, unless the city has
participated in the development of a coordinated paratransit
plan; and
WHEREAS, Subpart F, section 37.141 of 49 CPR 37 allows the
preparation and submittal of a single coordinated paratransit
plan among the operators of fixed route transit service with
overlapping and contiguous service areas; and

WHEREAS, the city of Santa Monica (here~nafter referred to
as "ci ty") operates a fixed route transit system in Los Angeles
County and is required to provide ADA-eligible complementary
paratransit service and prepare and submit an annual paratransit
plan to DOT; and
WHEREAS, the Los Angeles County Transportation CommlSSlon
(hereinafter referred to as "LACTC") , which is mandated by state
statutes to coordinate paratransit services in Los Angeles
County, has initiated the development of a countywide coordinated
paratransit network (hereinafter referred to as "Network") as the
most appropriate and effective means of meeting the ADA
obligations of the Los Angeles County fixed route transit
operators; and
WHEREAS, the city adopted Resolution Number 8330 (CCS) on
December 3, 1991 authorizing its participation in the development
of the Plan; and
WHEREAS, on behalf of Los Angeles County's f~xed route
operators, the LACTC prepared an lnterim plan for the provision
of the ADA paratransit service, which included support
resolutions from fixed route operators and cities which operate
or participate in fixed route transit systems and submitted sa~d
interim plan to DOT on January 27, 1992; and
WHEREAS, the LACTC has agreed to prepare the DOT-required
first-year coordinated paratransit plan (hereinafter referred to
as the "Plan") to be submitted to DOT on July 26, 1992 for all
participating Los Angeles County fixed route transit operators
which pass resolutions adoptlng the Plan; and

WHEREAS, the Clty has participated in the development of
the Plan and has provided fiscal and operating data about its
current fixed route and paratransit systems to the LACTC ln a
timely manner: and
WHEREAS, the City agrees to maintain current levels of
paratransit service until the coordinated plan is fully
implemented, in accordance with 49 CFR 37.141: and
WHEREAS 1 the LACTC will provide funding and coordinate the
operations of paratransit services, above the level of elderly
and disabled transit services being provided by the city, which
may be required by the Plan; and
WHEREAS, the City deSlres to fulfill its ADA-mandated
paratransit obligations through participation in the coordinated
paratransit plan and network as developed by the LACTC,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City is committed to meeting its
ADA-mandated paratransit obligations by supporting and
participating in the Los Angeles County Coordinated Paratransit
Plan to be submitted to DOT on July 26, 1992 .
SECTION 2. The City does hereby adopt the Los Angeles
County Coordinated Complementary Paratransit Plan.
SECTION 3. In accordance with 49 CFR Part 37.141, the city
does hereby agree to maintain current levels of paratransit
service until the coordinated plan is fully implemented.

SECTION 4. The city Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.
