SUBJECT: Recammendation to Approve the Proposed Transportation
Management Plan (TMP) Ordinance.
INTRODUCTION
This report recommends that the City C~uncil approve the propased
Transportation Management Plan (TMP} 4rdinance, which includes
changes that were made to address issues raised by Council during
the public testimony on August 20, 1991, as well as changes
recommended by staff ot the South Coast Air Quality Management
District (AQMD).
BACKGROUIdD
At the August 20, 1991 City Council me~ting, Counc~l asked staff
to revise the TMP Ordinance based upon comments by Council and
issuas raised during ths pubZic testimany.
This report outlines the changes to the Ordinance based upon
Council comments, input from a meeting organized by the
Neighborhaod Support Genter and comments from AQMD staff.
Attachm~nt B also provid~s staff responses to questions raised by
Council that did not lead to actual changes in the Ordinance.
Attachment C provides selected pages from the AQMD employer
handboak. The City will prepare an emp~oyer hand~ook similar to

SLTMMARY OF CHANGES
The following summarizes the re~isions mada to the Ordinance
since the August 20, 1991 meeting:
Changes Resulting from Cauncil Action
o Credits for telecommuting, clean fuel vehicles and
compressed work weeks in ca3.culating AVR have been
clarified. Emplayers will not be penalized for
utilizing a guaranteed ride home program.
o Definitions af CZean Fuel Vehicle or Low Emission
Veh~c~e (LEV) and Guaranteed Ride Home have been added
to the Ordinance.
o The use of a clean fuel vehicZe has been added as a
possible mitigation measure in a Worksite
Transportation Plan.
o The City's ability ta require employers ta form and
participate ~n a Transportation Management Association
(TMA) has been c~arified.
o The potential fee reductions available to emplayers who
jain a TMA and/or achieve a 1.5 AVR have been
clarified.
o Flexibility has been added to tha definition of
"AZ~ernative Wark 8chedul.es".
Changes Resulting from AQMD Comments

o The number of days an employer has to request an
extension of the submission date for a Worksite
Transportati~n Plan has been changed from 75 days to 6~
days.
o Tha terms '~auditing" and "complianca inspection" have
been separately defined, and language has been added to
retain the City's and AQMD's right to canduct
unannounced complxance inspectians.
o Language has been added stati~g that empZoyers are not
exempted from compliance with AQMD's Regulation VII
pertaining to ~mergency episode plans.

o An implementation schedule has been added to the
Warksite Transportation Plan requirements.
o The employee s~rvey requirement has been clarified so
that employers with 100 or more employees must use a
survey which confo~-ms with the AQMD employee survey
requirements.
o Language has been added which states that a second
disapproval notice of a worksite transpartation plan,
and until appro~al of a plan by the City, will be
dee~ed a violatian of the Ordinance.
o Provisians allowing AQMD enfarcement of certain
violations has been add~d.
o A record keeping pravisian has bean added which
requires an employer to keep detailed recards of a1Z
documents verifying the figures used to caZculate AVR.
o The imp}.ementation date of the Ordinance has been
changed to February 1, 1992 to allow for necessary
changes to AQMD's ordinance allc~wing for ex~mptians to
Regu].ation XV and approval of the MoU between the City
and the District.
BUDGETIFINANCIAL IMPACT
The fo~lawing outlines the anticipated expenditures and revenues
for implementation of the propased Transportation Management
Plan. Due to the pot~ntial sh~rtfall of revenues after the
fourth year (due to the proposed incentive fe~ reductions), staff
is recommending that the ordi.nance limit the maximum reduction of
fees ~0 85~ af the total fees required. This wil~ help ensure
the program generates sufficient revenues to cover vperational
costs.
The follawinq outlines the current FY Z991-92 budget for the TMP
Program. This level af funding was approved by Council during
the FY Z990~91 Year-End Budget Review:

As is shown in the foliowing projections, the fees collected by
the City will not be sufficient to cover the antzcipated
expenditures far the first two years. Therefore, funds from the
Colorado Place and Water Garden traffic mitigation fees will be
required to offset the deficit. The development agreements for
those two groj ects state that each develop~nent is to cQntribute
$500,00~ fox salarias of amployees exclusiveiy in~olved in the
imp].ementatian of a Transportation Managem~nt Plan. As of June
30, 1992, there is a balance of approximately $690,000 avaiiable
far implamentation of the TMP, which is sufficient to cover the
projected shartfall for the first two years Qf $157,878.

the total adjusted annually to reflect a 5~ inflation rate.
The TMP budget and fees will be reviewed annually as part af the
budget process. The annual revi.ew will provide oppart~znities to
modify the TMP budget or fees as more accurate information is
available as to the number of employees covered by the Ordinance
and the amount of discounts claimed by participating employers.
NOTIFICATI~N
A~ notificatian flyer was mai~ed Monday, October 21, 1991
announcing the October 29, 1991 meeting on the TMP Ordinance to a
3ist of over 504 interested parties. The flyer stated that
copies of the propased Ordinanc~ wauld be available in the City
Clerk's office an Thursday, Octaber 24, 1991. A copy of the
notice was printed in the october 23, 1991 issue of The Out~aok.
The Chamber of Commerce Transportation Committee was sent a copy
of the revised Ordinance, and staff has met with a Committee
representative to discuss the changes. City staff also attended
a meeting organixed by the Neighborhood Support Center and
discussed recent changes to the Ordinance.
RECOMMENDATXON
It is recommended that the City Council introduce the praposed
Ordinance for first reading.

CHAPTER 2B - TRANSPORTATIDN MANAGEMENT
SECTION 9228. Findinqs. The City Council
finds and declares:
(a) Expected growth in papulation and
employment apportunities in the City will be
accompanied by concomitant increases in traffic

project that future traffic levels on surface
streets will lae severe unless rneasures are takan to

and carbon manoxide concentrations exceed state and
federal standards some days in the City.

excessive delays deve~op repeatedly due to vehicles
arrivinq at rates qreater than capacity and where
emerqency vehic~a travel is impeded.
{e) New development and major additicns to
existing develcp~ent by the year 2010 will have an
adverse impact on the existing transportat~on
systems by addinq approximately 17,004 trips to the
existinq demand of over 24,Q00 p.m.-peak hour trips
from non-residential land uses.
(f) The City's General P~an calls for
formation of a•plan to implement the transportation
management poliCies of the Circu~ation Element, an
unconqested traffic circulation system, energy
conservatian, and maintenance oP noise and air
quality levels within established standards.
(g) The transportation system is impacted
Citywide by the traffic and parkinq requirements af
development.
(h) Transportation Systems Management,
Transportation ~emand Manaqement~ and Transparta~ion
Faci~ity Development strateqies can imprave service
and opera~ions ta increase mability and the general

" efficiency of the system. These strategies
encampass traffic aperatians, ridesharing, and
bicycle improvements as well as transit planning and
management of the system. These strateqies enhance
vehicle flaw or shift demand on an existinq
transportation facility and can be effective to
mitigate negative effects of transportation, such as
air quality, energy use, and noise levels.
(i) Reduction o~ congestion and the time of
commute trips will improve the quality of li€e in
the City and improve quality and Zevel of access for
residents and employ~es and patrans of local
businesses.
(j) Coordination of Transportation Systems
Management, Transpartation Demand Management, and
Transpartation Facility flevelopment strategies with
other cities a~d co~nties in the reqion and through
regianal agencies will assist in meetinq the goals
o~ this Chapter.
SECTION 9221, Purpos• and Object$vos. The
purpas~ and objective~ of this Chapter are to
establish a transportation management plan that
wili:
(a) Allow for any growth permitted by the
land use p~ans of the City while minimizing
peak-hour autamabile commute trips from new and
existing places of employment.

(b) Reduce traffic impacts within the
community and reglan through a reduction in the
number af vehicular trips and total vehicle ~iles
traveled.
(c) Reduce the vehiCuZar air po~lutant
emissions, enerqy usage, and ambient naise leve~s
through a reduction in the number o~ vehicular
trips, totai vehicle mi~es traveled, and traffic
conqestion.
(d) £nsure City compliance with South Coast
Air QuaZity Management District Regulation KV, and
require emgloyers both ta maet Regulatian Xv air
quality tarqets and to achieve City traffic

(e) Achieve a cammuter Avezage Vehicle

roadway and is expressed by delay and the ratio of
volume/capacity (V/C). Six ~evels of service are

fZow conditions with severe capacity deficiencies
and delays. This definitian is based on the Highway

uses, cultural uses, restaurants, cafes, and banks.
Preferential Parking. Parkinq spaces
designated or assiqned for carpool and vanpool

sliminate the trip altogether, or commute at other
than peak periods.
Transport~tion FacilitY Develapment ("TFD"~.
Construction of major capitai improvements to a
hiqhway or transit system or installatian of
operating equipme~t which includes new constructian
of the existing system ar construction oF a new
system.
Transportation Management Association ("TMA"}.
A group formed so that employers, employees, ind
deve~opers can col~ectively address community
transpartation-related problems. Transpartation
Management Associations may be £ormed to implement
TDM, TSM, and/or TFD stratagie5 in emplayment

clusters or at multi-tenant warksites. The primary
function o~ ~ TMA ls to pool resaurces to impiement

Caordinators. The City may identify emplayment
clusters or multi-tenant worksites where an employer
arqanization such as a TMA shauld be formed.
Transportation System Manaqement ("TSM"~.
Strategias designed to improve traff ic f low throuqh
modifications in or eoordination vf the operation of
exi~tinq facilities.
Trip Reductidn. The reduction in sing~e
occupant vehicle trips by private ar publi~ sector
programs used during peak period~ of centmutinq.
Vanpool. A van or simiZar motior vehicle with
a seaCing capacity of seven ar more persons occupied
by four or more employees traveling together ta
work.
Vehicle. A passen~er car ar tr~ck u~ed for
commute purposes includinq any motorized two whee~ed
ve~ic~e. vehicles shall not include bicycles,
transit vehicles, buses serving multip~e worksztes,
or vehicles which stap only to load or unlcad
pass~ngars or materials at a worksite while on route
to other worksite(s1.
Work Place or Worksite. A bnildinq, part of a
building, or grvupinq af buildings located within
the City which are in actua2 physica~ ccntact cr

separated saleiy by a pri~ate or public roadway, and
which are owned or operated ~y the same employer.
warksite Transpartation Plan ("WTP"~. A plan
for ~mple~entatian of transportation management
strategies which is desiqned to reduce the impacts
of a particular worksite on traffic and air quality.
Worksite Transportation Plan Appeals Hoard
t"WTP Appeals Board"). ihe administrative review
body for decisions of the City's Transportation
Manager~ent Coordinator. The WTF Appeals Board shall
cansist af the Parking and Traffic Enqineer, the
Director of the Land Use and Transportatian
Managemant Department, and an at-large member
appointed by the City Council. The Parking and
Traffic Engineer and the Director of the Land Use
and Transportation Management Department may
desiqnate an smployee from his or her division or
department as his or her representative.
Worksite Transportation Plan Cocrdinator. An
employee, tenant, praperty owner, property manager,
cantracted service, or rapresentative of an employer
assaciation, with appropriate tr-aininq as approved
by the City and the South Coast Air Quality
Management District, whose function is to promote
TMP program activit~es. The Coordinator does not
have to be on-sita at all times; hewever, all
worksite-related infQrmation must be kept at the
warksite. Worksite Transpartatian Plan Coordina~ors

shall be responszb~e for day-to-day imp~e~entatian
a# warksite transportation pians. Worksite
Transportation Plan Caordinators snall prepare and
make availabZe r~deshare informatio~, notices,
questionna~res, handouts, computer matches, transit
and bicyc2e route maps, and shall ha~e a permanent
mailinq address, daytime te3ephone number and
~ffice. Warksite Transpartatian Plan Coordinators
shall administeX incentive programs includad within
worksite transportation plans, such as rideshar~
ma~chinq, vanpaol brokeraqe, bus token or pass
distribu~ian, parkinq fees, and transportation

Caordinators shall participate in City-sponsored
training workshops and information roundtables.
SECTION ~223. Applioabil~ty.
This Chapter sha~l appiy to emp~oyers and
developers as defined above. The City shaZl not be
exempt from the requirements of this Chapter.

(1) Employers shall pay an ann~al
transpartation impact fee calcuiated usinq the
following formuia: Fee ~(Number af Eh-ployees) x
(Employee Cost Factor).
For purposes af calculating an employer's
annual impact fee, the definition of employee ~hall
include those employees who report to work during
the peak periods, includinq fu11-time, part-time,
temporary, seasonal, at-hame or in-field contractars
of consultants working at a worksite far two months
or more.
(2) The City TMP ~ffice shall begin
notifying employers of required Employer Impact Fees
in accordance with the Emplayer Worksite Plan
Schedule in Section 92~8(a). Employer Impact Fees
shal~ be due and paid in full with submittal of the

( 6) E`mplayers of 100 or mare employees
submittinq an approved Regulatian XV Plan less than
six months old shall be exempt from the Emp~oyer
Annual zmpact Fee for the first year.
(b) Developer Impact Fee. The purpose of the
developer impact fee is to defray the ccst of
providing transportation facilities and services
associated with new commercial development.
(1) Developers who apply for bui~ding
permits far new or expanded deve~opment projects in
the City shal~. mitigate their resultant
transportation by paying a one-time transpartation
impact fee. The amount of the fee and manner of
paymant shall be established and from time to time
amended by resolution of the City CounciZ.
{2) Fees shall apply to developers who
have nat received certificates of occupancy as of
the effective date of this Chapter.
{3) Developers shall pay the reqt~ized
fee prior to issuance of a buildinq permit.
De~elopers who have already obtained building
permits must pay the required fee prior to issuance
of a certificate of occupancy.
{4) The failowing land uses are
encauraged by the City because of their beneficial
impacts and shall receive reductions from the
Developer Impact Fee: supermarkets and pedestrian-
oriented uses on the qround floor of a multi-story

buildinq. Soth the Impact Fee and the reduction
sha~l be established by re~olution.
(5) Refunds of the Developer Impact Fee
shail be made upon the filing at a request ~or
refund within six (6) manths of expiration of a
building permit upan verification that construction
af the improvements for which the permit was issued
have not commenced and no extensions of the building
parmit have been granted. No interest shall be paid
on any refunded fee.

located within close geogzaphic proximity of each
other and Employers at multi-tenant worksites where
mvre than fifty {50) employees are employed in the
aqgregate may voluntarily form a Transportation
Management Association ("TMA"). The City's
Transportation Manaqemant Coordiaator may also
require tbsse Qmgloyers to form and join a TMA, and
thsy sha3l do so within ninet~ {90) days af
notification by the City. For purposes of
determininq whether mare than fifty (50) emplayees
are employed at a multi-tenant warksite, emplayees
who are employed by an employer with fewer than ten
employees need not be counted.
(f} Upon the City Parking and Traffic
Enginesr's approval of a written request, an
employer may submit a sinqle Warksite Transportation
Plan encompassinq all worksites subject to the

SEC`i'IE3N 9?.92. Transportation Kitiqatiop
Monftorinq.
(a) Annuai Report and Plan Update. Onqoing
manitorinq of an approved wark5ite Transportation
Plan shall l~e conducted by the emgloyer usinq
standardized forms approved by the City in arder tc

monitar progress in achievinq transportation
mitigation qoals. An annual report sha11 be
submitted twelve (12) months ~rom the date ot the
initial plan approval data. The City sha~l notify
the employer of the submittaZ deadiines for the
review and update. The annua~ report shall focus on
rideshar~ng and tr~p-reductian incentives offered by
the employer. The review and update shall consist
of a report that.
(1) CaZculatea AVR leveZs attained
under the approved plan.
(2) Verifies that the plan incentives
have been offered.
- (3) DeteYmines the nu~ber and
percentage of the project papulation that
participated in rideshare activities, by mode, since
the last reporting date.
{4~ qetermines the use of Code-required
on-site parking facilities (i.e., numb~r of spaces
far visi~ors, sinqle occupant vehicles, carpools,
vanpools, etc.) and the proqress mad• since the ~ast
reportinq date.
(5) Detertnines the use ot cff-site
parking to achieve rideshare and transit objectives
since the last reportinq date.

follcw-up audits on a selective basis. Employers
shall receive at least ten (10) days noti~e af such

SECTION 9233. Entorcem~nt.
(a) Violations of This Chapter.
(1) No business iicense shal~ be
renewed if an employer has nct paid the fee required
by this Chapter.
(2) Failure to submit an initial pian
~rben dus, annual report and plan update wh~n du~,
or mandatory plan revisians whan due, or failure ta
implement provisions of an approved plan as ~et
forth ia ~h~ plaa implam~atatiaa schodul~, is a
vio~ation of this Chapter. Add#,tionally, upoa
rac~ipt of a:~cond disapproval notic~ and until
sucb tim~ as a r~vi~~d plan ia agprov~d by ths Citp,
the davelopar or employ~r shall b~ d~sm~d in
viol~tion o! ttiis Chapt~r.
(3) Each day that a developer or
amployer violates the provisions of this Chapter or

transportaCion plan shal~ constitute a separate
violation.

(b) Enfarc~ment Actions. In addition to any
other remedy pravided for by law, the City, or th~
Soutti Coaat Air Quality Manaqtm~at Distri~t rh~n
apprapriat~, may take the follawinq actians for
violatian of this Chapter or af the terms and
conditions of any approved WorKsite Transportation
PZan:
(1) Require the addition of elements
to a wo~k or deveZopment site plan submitted by an
employer or developer.
(2y Transfer authority for plan
implementation from an employer or developer ta the
City.
(3) Institute proceedings to revoke
any approvai af a worksite transportation plan.
(4) Reveke the business license held
by any violator, fo~lowing the procedures set forth
in Section 9154.6 of the Municipal Code.
(5) Impose an enforcement fee as
pro~ided for in Section 9233(c).
(5) RequeSt that tha Czty Attorney
take appropriate enforce~ent actzon. Referral 5y

the City's Transportation Manaqement Coordinator is
not a conditian precedent to any enforcement actian
by the City Attorney.
(~) Notvithstandfnq any otib~r
provisions o~ this Chapt~r rsqardinq p~aa!li~s or
f~~s tar ~a~orceateat aetions or far violationa, for
v~olators with 100 or more employees, th• City, in
additian to any other remadias undsr this Chaptar,
shall refer the matter to the South Coast Air
Quality Management District for appropriate action
under Article 3, Chapter 4, Part 4 of ~ivision 26 of
the Health and Safety Cade.
(c) Enforcement Fees.
(1) An enforcement fee shall be paid
to the City by each person who has vio~ated the
pravisions of this Chapter or the terms and
canditions af any Worksite Transportation P1an. The
purpose af this fee is to recaver the costs of
enforcement from any person who violates the
provisions of this Chaptex dr any permit tir
approval.
(2) Fees shall be assessed as follows:
(a) Far the first violation
during a calendar year, there shaZl be no fee. The
City's Transportation Management Caordinator shall,
however, cause a warning notice to be mailed ta the
vialator.

(b) For the second violation
during the calendar year, the fee shall be Five
Dollars ($5.O~y pe~ empioyee ge~ day,
(3) The City~s Transportation
Manaqe~ent Coordinator shall cause to be issued a
natice imposing enforcement fees under this Section.
The not ice sha 11 provide that the f ee sha 1~ be due
and payab~e within fifteer~ {35) days fzom the date
of the notice. A penalty ag ten percent (10~) per
month shall be added ta any fees that have not been
paid when due.
(4) Any person upon whom fees have
been impcsed pursuant to this Sectian may apgeal the
~action in accordance with the followinq procedure:
(a) A notice of appeal shall be
filed with the City's Transportation Management
Coordinator with~n ten (10} days of the date of the
notice.
~b) At the time of filing the
no~~ce af appeal, the appe~lant shail deposit with
the City Treasurer money in the amaunt of alI fees
due. If, as a result of the hearing, it is
determined that the City is not entitled to all or a
pvrtion af the money, the City sha~l r~fund to the
person all or a portion of the money deposited.
(c) The Worksite Transpartation
Plan Appeals Saard ("WTP Appeals Board") shall hold
a hearing on the appeal within forty-five (45) days

of the date of filing of the appeaZ. The City shali
give the appellant at least five (5) days notice of
the time and~place af the hearing. The WTP Appeals
Board shall render a decision within fifteen (15)
days af the date af the hearinq. The purpose af the
hearing shall be limited to whether or not the
~iolation occurred.
(d) The WTP Appeals Board sha~l
uphold an appeal af an enforcement fee under this
Section in only one of the fallowing circumstances:
1. An error has been made in
calculating the enforcement fee,
2. The person is found nat
to have been violatinq the provisions af this
Chapter or the terms and conditions of the Worksite
Transportation Plan.
{ej The decision af the WTP
Appeals Board shall be final except for judicial
review and there shall be na appeal to the City
Council.
(f) Any notice issued pursuant to
this Section sha11 set forth the appeal rights as
provided for in this subsectiart.
(q) Any notice of revocation
issued pursuant to this Section shall be final upon
the expiration of the appeal period if no appeal is
timely filed or upon ~he decision of the wTP Appeals
Board.

SECTION 9234. ~dmiaistrativ ~pp~als.
(a) Disapproval of a Warksi~e Transpartativn
Plan by the City~s Transpartation Manageme~t
Coardinator, inc~uding a revision of such a plan,
may be appealed to the Worksite Transportation Plan
Appeals Board.
(b) Ari appeal of an actian by the czty~s
Transpcrtatian Management Coardinator shall be filed
with the City•s Parkinq and Traffic Division within
ten (10) consecutive calendar days foliawing the
date af actian fzam which an agpeal is taken. If na
appeal is tamely filed, the actian by the City's
Transportation Manage~ent Coordinatar shall be
final.
(c) A hearinq on an appea~ shall be scheduled
within sixty (60} days of the date of filinq of an
appeal. Notic~ of an appeal hearing shall be mailed
to the appellant not less than ten (1E3) canseeutive
calendar days prior to the hearing soheduled befare
the Worksite Transpartatian Appeals Board.
(d) A written decision an an appeal sha~l be
issued thirty (30) days from the date of hearing.

{e) An action of the City's Transportation
Manaqement Coardinator that is appealed to the
Worksite Transportation Plan Appeals Hoard sha~l not
become effective unless and unt~l approved by the

SECTION 2. Any provision of the Santa Monica Municipal
Cvde or appendices thereta inconsistent with the pro~isians of
this Ordinance, to the extent cf such incansistencies and no
further, are hereby repealed or modified to that extent necessary
to affect the provisions of this Ordinance.
SECTIdN 3, If any section, subsect~on, sentence, clause,
or phrase af this Ordinance is for any reason held ta be invalid
or unconstit~tianal by a dec~sion of any court of any campetent
jurisdictian, such decision shall not affect the valzdity of the
remaining portions of this Ordinance. The City Cauncil hereby
declares that it would ha~e passed this Ordinance, and each and
every section, subsection, sentence, ciause~ or phrase not
decZared invalid or unconstitutional witho~t regard to whether
any portion of the Ordinance wo~ld be subsequently declared
invalid or unconstitutiona~.
SECTION 4. The Mayor shall sign and the City C~erk shall
attest to the passage of this ordinan~e. The City Clerk shall
caus~ the same to be published once in the official newspaper
within 25 days after its adoption. This Ordinance shall become
effective after 3o days fram its adoption,

the TMP. Thls balance doesn't inciude the $144,916
already budgeted for Fiscal Year 1991/92 for
staffing transportat~on managen~ent effarts in the
City, a significant part of which wi11 be used for
~.:~plement~ng the Ordinance.

Res~onse: The c3evelopment of txzp generation rates and the

customer/visitor/employee trip breakdawns. A~so,
trip generaticn rates should be develflped for
~ariQUS land uses w~th a survey of dzfferent sites
around the City, and is a process that raquires
greater accuracy than is pravided by empioyers in
their annual suXVey and report. It should be noted
that the City is currently doing a trip generation
rates case study ta verify localized trip
generation rates ~n Santa Mon~ca with SANDAG and
ITE rates.
