SUBJECT: Recommendation to Authorize City Manager to
Negotiate and Execute Operating Agreement with
Santa MonicajMalibu Unified School District for
the Marine Park Child Care Center
INTRODUCTION
This report requests authorization for the City Manager to
negotiate and execute an Operating Agreement with the Santa
MonicajMalibu Unified School District (SMMUSD) for the operation
of the Marine Park Child Care Center for FY 1991-92, contingent
upon Council approval of the recommended related budget action on
June 25, 1991. This first action is requested to give adequate
time to execute the Agreement prior to July 1, 1991.
BACKGROUND
On June 26, 1990, the City entered into an Operating Agreement
with SMMUSD to operate the City's child care center at Marine
Park for FY 1990-91. This represented the first venture by both
entities to jointly address community and employee childcare
needs.
The 1990-91 agreement provided for an annual operating subsidy as
well as use of a specified portion of the Marine Park Community

Center for the childcare center. The center opened in september
of 1990 with space available for up to 53 children, 3 months
through five years of age. Enrollment targets for each age group
have been met or exceeded and the third quarterly reports
indicate that projected revenues from parent fees as well as
program expenditures are within estimated amounts.
DISCUSSION
The FY1990-9l Operating Agreement provided for a renewal of the
agreement in subsequent years. SMMUSD has indicated its desire
to continue as operator of the program and presented a budget
request for the FY 1991-92 operating subsidy as a part of the
City's budget process. This amount, $272,112, has been included
in the city Manager's Proposed city Budget to be approved on June
25, 1991. This level of subsidy will support the same staffing
levels and program expenses as the current year, with additional
funds only for cost-of-living and merit increases for staff
salaries and fringe benefits mandated by SMMUSD agreements with
its certificated and classified bargaining groups.
Major provisions of the FY 1991-92 Operating Agreement will
remain the same as those approved by the City Council for the
current year. provisions include: (1) lease term of July 1,
1991 through June 30, 1992, (2) staffing ratios that meet or
exceed state mandated levels, (3) priority enrollment for City
employees and residents of the surrounding neighborhood, (4) a
fee schedule set at market rates with a pcholarship program for

for low-income families, (5) provisions for parental involvement,
and (6) use of the facility at no cost to SMMUSD.
FISCAL/BUDGETARY IMPACT
$272,112 has been recommended at account number
01-200-262-00000-6700-00000 in the Proposed FY199l-92 City
Budget, therefore no appropriation is needed at this time.
RECOMMENDATION
City staff recommends that the City council authorize the city
Manager to negotiate and execute an Operating Agreement with the
Santa MonicajMalibu Unified School District for the operation of
the Marine Park Childcare Center for FY 1991-92, contingent upon
approval of the proposed budget appropriation on June 25, 1991.
