INTRODUCTION
Proposed is a Text Amendment to allow existing legal non-conform~ng auto repair uses
located in the Bayside Commercial District-3 (BSC-3), which mcludes praperties on the
east side of Fourth Street, between Vllilsh~re Boule~ard and Broadway, to be expanded,
pro~ided physical impro~ements are made i~ conformance with current Bayside District
special pro~ect design and de~elo~ment standards and the special conditions for auto
repair uses
BACKGROUND
New auto repair businesses are nat permitted or conditionally perm~tted in the BSC Distr~c~
Accord~ngly, existing auto repair businesses are considered `'legal non-canformmg uses "
Santa Monica Municipal Code (SMMC} Section 9 04 18 030 allows legai non-conform~ng
uses to rema~n provided the use is not expanded or intensified This pro~is~on al[ows
r~onconformmg uses to continue their existing le~el of operation until replaced by a
cor~forming use_ In some cases, however, this standard can also prevent business owners
from modifying legal non-conforming usES to meet current design and de~elopment

standards
On July 8, 1997, James Taylor, AIA, an architect representing Grigsby Automotive
Company, advised the City Council that his client wanted to upgrade his auto re~air
business at 401 Broadway, but was preWented #rom doing so because auto repair is
considered a nonconforming use m the BSC District In response to Mr Taylor's request
to amend the Zoning Ordinance, the City Council directed City staff #o research and
prepare appropriate zoning ordinance amendment language to allow existing lega! non-
conform~ng auto repair uses, located in the BSC Zon~ng D~str~ct ta be expanded, prov~d~ng
they make physical improvements to cor~form with current downtown urban design
standards
ANALYSlS
This amendment would allow, sub~ect to a ConditEOnal Use PErmit, the expansion or
tntensification of exist~ng legal non-conforming auto repair businesses located in the BSC-3
Zoning District, provided such property is phys~cally impro~ed ta comply with current
Bayside Distr~ct special pro~ect des~gn and develapment standards conta~ned in Section
9 Q4 O8 '~5 07D The amendmentwould also require campliance with Pedestnan-Oriented
Design Standards specified in Section 9 D4 10 02 440 ~Attachment B) and the special auto
repa~r fac~ltty condit~ons for auto repair uses set forth in Section 9 04 14 0~0,

The proposed Text Amendment would add the following subsection to the conditionally
perm~tted uses section af the BSC Zoning Ordmance
Section 9 04 08 1 5 040 Condit~onally permitted uses
(3) !n addifion to those uses specifred in Subsecfion (2) of this Section, the
following uses may be permitted in the BSC-3 port~on of #he BSC Distric#
sub,ject to the approval of a condifional use permif:
(a) Expansion or intensi~cation of automvbile repalr facilities existing as
of July 8, 1997, provided such property is phys~cally fmproved so as to
comply with the Bayside specia! project design and development
standards setforth in Secfion 9.04.08.15.070 and the spec~al conditlons
for auto repair uses set forth in Secf~on 9.04.14.050.
A land use survey of the east s~de of Faurt~ Street, between Wilshire Boulevard an~
Broadway (the BSC3 DistrGCt}, identified one {1 } parcel at the northeast corner of Broadway
and Fourth Street which would be directly affected by the proposed amendrnent (shown
on Attachment D} This lacat~on is noteworthy because it is at #he southern boundary of
the BSC District The ad~acent C3C District conditianally permits the expansion or
mtenstf~cation af automobile reparr facrliti~s that existed as o~ July 9 9, 1995 (Sectron
9 04 OS 2Q 040(h}} Therefore, this one affected use is consistent with existing zoning
prov~sEOns that affect properties to the south and east A~lditionally, there is a significant
daytEme commuter workforce in the immediate afea Existing downtown auto repair

facifities pro~ide these commu#ers with facilities to drop their cars off where they can wafk
to work, providing a needed service and reducing vehicfe trips to more distant auto shops
Staff bel~e~es allaw~ng this exGSting use to expand as a result of the text amendment,
sub~ect t~ the approval of a Canditional Use Permit, ~s appropriate as it will pro~ide an
tncentive and set s~andardsto substantially upgrade propert~es in a mannerconsistentwith
the area's pedestrian-or~ented character Compliance with the Bayside special pro~ect
design standards will ensure pedestr~an-oriented uses along the ground floor street
frontage, such as sales affices, product show rooms, ar~d customer lounges Add~t~onally,
any physical impro~ements would be required #o include pedestrian-orfented design

Plann~nq Commission Recammendation
The Pianning Commission held a public hearing on May 27, 1998 to consider this request
and approved a motion recommendmg that the City Council appro~e #he proposed Text
Amendment as recommended by stafF DurEng its discussion of the proposal, the
Commission expressed concern that auto rEpair is not a desirable use in the pedestrian-

oriented Bayside Distr~ct and that the proposed text amendment would allow such a
use to continue indefinitely and at a particularly signif~cant locatian, the corner of
Broadway and Faurth Street There was also concern that some of the ~ustification
used to cansider the praposal is based an the current ownerloperator of the facility,
but future awners or management might not be as consaentious about maintammg
the praperty O~erall, howe~er, the Commission felt th~ CUP requirement would provide
a mechanism to regulate ar~y existing auto servrce use, expansior~ or ~ntens~ficat~on
while pro~iding an opportunity to upgrade the site Minutes of the May 27, 1998

Conclusion

TEXT AMENDMENT FINDINGS
1 The propased amendment is consistent m principle w~th the goals, ob~ect~ves,
polrc~es, land uses, and programs specified in the adopted General Plan in that the
proposed amendmentwould only allowexisting legal non-conforming auto repairuses
located ~n the BS~-3 Zon~ng Dis~r~ct to expand ~f they made phys~cal ~mprovements
to upgrade the development to conform with current Bayside District special pro~ect
design and develapment standards, pedastnan-or~ented design standards, and the
spec~al conditions for auto repair uses Allowing the expansion or int~nsification of
existing fegal non-conforming auto repa~r ~usinesses by CUP will ensure #hat the
Planning Commission, or City Couna] on appeal, has an apportunity to re~iew any
application request to determine whefher the o~erall pro~ect design is suitable for the

Following the staff report, Commissianer Parlee asked for the current FAR
for the property He also commented on the expansion and other non-
conform~ng s~tes ir~ the Bays~de D~str~ct Mr ~.each stated that the current
permitted FAR is 3 0
Commissioner Gruber asked for an explanation as to why this business
can not meet the standards wifhout expar~ding Mr Leach explained that
auto repair standards require certain auto repair ac#i~~ties, such as exterior
auto lifts, which are nat in conformance w~th current auto repair standards
that reqwre ~hese acfivit~~s be inside a build~n~ Compliance would
inWO~~e the expansion of the curren# building
Commissioner Parlee commented on a letter received from the Bayside
District Corpprat~on's Board of Directars Ms Fnck explained the history
of this Text Arnendment, which came about when t~e property owner, Mr.
Grisby, came to City Council with plans to update the facility, which could
not be done because of code requirements She stated #hat #he City
Council directed staff to begEn the process ta consider amending the
ordinance, which is the reason for this hearing
Chair Zinner clased the public hearing
Commissioner Parlee expressed his uneas~ness about this proposal partly
because of the significance of the location [corner of Broadway and Fourth

Street] He acknowledged tnat the currertt auto repa~r bus~ness is a
con~enience, howe~er he expressed concern that this may not be the best
use for the site He s#ated that he is not inclined to allow the use to
continue becaus~ he wauld like to see more of a m~x
Cammissioner Weremiuk expressed su~port for the text amendment She
stated her f~rst reason for support is fhat this ~s long time, ongoing use,
and the awner wants to remain at this locatian She also stated that the
proposal is resppns~ble
Commissioner Gruber expressed his genera[ agreement with Commission
Parlee He commented that th~s is the seckion of Braadway that w~ll soon
be getting a 20 foot wide sidewalk and be part of the ma~or transit area
He also commented that this is a very pedestria~ onented area and
pedestrian onented businesses shot~ld be encouraged He #her~
commented that the current property has a good, clean fence. He stated
his desire that the property have a pedestrian oriented retail, office or
residential use
Comm~ssioner Bradley commented on the existing zoning for the praperty
and expressed his ob~ection to "spot zonmg".
Comrnissioner Breisch commented that the Text Amendment gi~es broad
leeway to regulate any future d~~elopment of the site through the CUP
process He stated that he, too, would like to see more housing in the
downtown area He also stated that the Text Amendment allows a chance
to impro~e the site He commented that the auto repair use has been
there a long trme and he wo~ld fe~l uncomfo~table forc~ng someone oUt
of business Lastly, he stated that this business has contributed to the
community
The architect for GrESby's, Jim Tyler, addressed the Commission He
stated that the arigmal intention was to upgrade the facility, which has
been in businESS for over 40 years and is a family run business He stated
that Mr Grisby does not want to relocate his business, onEy br~ng it into
conformance by having t~e auto lifts/hoists inside a buiEdmg, and by
adding landscaping and making the business handicapped accessible
Charr Zinner expressed agreement with Commrss~oner Bre~sch He stated
the C~ty should allow the window of oppor~unity for this site

concern with micro-designing and stressed the need far more f[exibility
He stated that the CUP requirement will gi~e the City the ab~lity to
determine wi~at w~ll happen w~th the site He also expressed concern
regarding the issue af "homoge~ization" of the Bayside District He stated
that he I~kes the ~ariety, includmg a few ugly gates and dirt He alsa
commented that he likes the "real activity° of this s~te
Chair Z~nner commented that the real risk is that #he praperty could remain
unchanged for another 40 years
Comrnissioner Gruber cammented on the ~mportance of having ~ision for
the neigh~arhood He expressed a preference for the proposed Bayside
