This report transmits f4r City Council appro~al a Final Map for the fallowing Tenant-
Participating Conversion pro~ect.

The City Plannmg Cammission approved the Tentative Map and the Tenant-Participating
Conversion for the abo~e pro~ect on August 19, 1992, after a public heari~g and a careful
re~iew of the record and staff recommendations The action of the Planning CammissEOn
was based on the Commission's fndings that the proposed Tenant-Participating
Conversior~ mee#s the requirements of Article XX of the City Charter and t~at the proposed
subdivision is cons~stent with applicabfe general and specific plans as adopted by the City
of Santa Manica along with alf mandatory requirements of the Subdi~ision Map Act of the
State of California On March 25, 1998, the Planning Commiss~on approved a one year
extens~on of the Tentative Tract Map

and any successors in interest to each condition ~mposed in connectian with approval of
this Tenant-Participat~ng ConversFan This Written Consent has been appro~ed bythe City
Attorney and the City Manager Each partic~pating tenant has been informed in writing of
his or her rights under Article XX of the C~ty Charter The License Division reports that
proper arrangements ha~e been made to ensure payment of the Tenant-PartECi~ating
Con~ers~on Tax
The Fina! Map conforms to the Tentative Map The Final Map has been certified by the
C~ty Engineer for conformance with the Tentati~e Map and conditions thereon, the
5ubdivision Map Act and lacal ordinances The City Attorney's office has approved a
Declarafion of Covenan~s, Conditians, and Restricfions, or equi~afent document, for this
pro~ect as complying with the conditions ofthe Ter~tati~e Map and the Tenant-Participating
Conversion
Cauncil appraval of a fmal map for a Tenant-Part3apating Con~ersion represents one of
the last steps necessary in the con~ersion process Follow~ng City Council act~on and
approval by the Cal~fornia Department of Real Estate, the applicants may begin sell~ng the~r
units to the tenants As each unit is sold, a convers~an tax per Sectian 2008 of Ar~icle XX
is due ~n an amaunt equal to twelve times the r~nanthly max~mum allowable rent for #hat
unit These taxes wifl be used to ass~st low and moderate income households ta purcf~ase
or improve their ~nits sub~ect to afFordable repayment per Section 20D9 of ArtECle XX

BUDGET/FISCAL IMPACT
The recommendation presented in this report does nat have an immediate budget orfiscal
impact If and as units in the pro~ect are sold in the future, Tenant-Participating ConWersion
Taxes will be collected pursuant to the pro~isions of Article XX of the City Char~er and
some increased property tax re~enues may be generated
RECOMMENDATION
It is respectfully recommended that the Final Map farthis Tenant-Participating Conversion
be approved by adoption of the accompanying resolution
