Background
The Clty Councll, at ltS meetlng of May 24, 1977,
dlrected thlS offlce to prepare the attached resolutlon. The
attached resolutlon retalns the entlre procedure for maklng
appolntments to Boards and COrnmlsSlons, except that nomlnatlons
are to be subm~tted to the Clty Clerk rather than the Clty
!lanager.
Add~tlonally, because, from t~me-to-tlme, speclal
Clrcumstances occur regardlng the appolntment of persons
to speclallzed Boards and Cornmlsslons, such as the Youth
Advlsory Commlsslon, a prOV1Slon was added to the attached
resolutlon al10wlng the Clty Councll to alter the procedure

to Public Boards and Commissions
Introduction
This report recommends an amendment to Resolutlon 4739 {CCS) dated
April 27. 1976 regarding procedures for making appointments to public
boards and commissions.
Background
At its regular meeting of April 27, 1976. the City Council adopted Resolution
No. 4739 iCeS) regarding procedures for making appointments to public
boards and commissions. Section 1 D provides that: "All nominations
shall be submitted to the City Manager's Office no later than 12 o'clock
noon the Wednesday preceding the Council meeting when the appointment is
to be made. No Council Member shall submit the name of more than one
applic,ant to fill each vacancy. Prior to submitting the name of his nominee

to fill such vacancy. the Council Member shall determine that the person
nominated will serve if appointed. 11
Since the process for submitting nominations and making appointments to
public boards and commissions are fairly definitive in this resolution, and
since the City Clerk under other sections of the resolution has the responsibility
for preparation and publication of a public notice of vacancies on boards and
commissions of the City, it is felt that the City Council should submit their

nominations directly to the City Clerk's Office rather than the City Manager's
Office.
Alternatives
1. Do not amend Resolution 4739 (eCS) thus investing in the City Clerk
all responsibility for the board or commission vacancy. notice publication
and follow-up except that of receiving the nominations from the Council
Members which would still be handled by the City Manager's Office.
Z. Amend Resolution 4739 (CCS) to provide that all nominations shall be
submitted to the City Clerk no later than 12 o'clock noon the Wednesday
preceding the Council meeting wh~ the appointment is to be made. This
would provide continuity in the board or commission vacancy nomination
and appointment process in that after receiving the nominations from the
Council Members the City Clerk would prepare the agenda item staff
reporto.transmitting the nominations to the Council.

It is reco:mxnended that the eity Council direct the City Attorney to prepare
an amendment to Resolution 4739 (eeS) to provide that all nominations for
board and commission vacaucies shall be submitted to the City Clerk's Office

J'.1ENTS TO PUBLIC BOARDS AND cOr~nSSIONS
WHEREAS, the State Leglslature has amended the
Ralph M. Brown Act to requlre that persons appo1nted to an
offlce by the leglslatlve body of a local agency be so
apPolnted 10 open session; and
WHEREAS, lt 1S the deslre and 1ntent of the C1ty
Councll 0= the Clty of Santa Moulca to comply wlth such
provlslons;

SANTA HONICA DOES RESOLVE AS FOI.LO\\lS:
SECTION 1. That the procedure for making
appoHI t:ments to Cl ty Boards aoct ConunlSSlons shall' heocefo:cth
be as follows, except as otherWlse provlded by the Clty CauDell;
a. When a vacancy appedrs on any board or
conuuisslon, t.he C1ty Clerk shall publish at least once 1.n the
Santa MonlCd Evenlng OuLlook a newspaper of general clrculat1on,
a pubJic not1ce of such vacancy. Said publ1.cation shall be
made not less than thlrt:y (30) days pr10r to the date a vacancy
1S to occur 1.n those cases where the vacancy occurs as a result
of the eXp1ratlon of the term of apPo1.ntment, and where
practlcal, like not1ce shall be published where a vacancy
othenvlse occurs. Such not1ce shall request any lnterested
party to submit his or her name and qualifications to the
City Clerk. Such notlce Shd1l also specify the position for
Wh1Ch a vacancy has occurred, the term of offlce for wh1.ch
the pos1tion wlll be filled and a reasonable date by which
lnterested part1.es must submlt app11cat1ons for the

The date for submlsslon shall not be less than flfteen (15)
days prlor to the vacancy unless the appointment is to flll
an unexplred term. Where the appoLnt~ent lS to flll an un-
expired term, the notlce shall be flfteen (15) days prlor
to the contemplated date of appoJntment where practical.
b. ApfJl1Ca tJ ons for the posltlon shall be
made .in wrJ.t1ng to the C1ty Clerk on forms supplied by the
C1 ty Clerk. Appl1c3tlons once subm1tted shall be and remaln
confldentlal personnel documents pursuant to Section 6254 (c)
of the Callfornla Government Code.
c. The City Clerk shall cornplle such ,vTl tten
appllcatlons as are received by the deadl1ne date and shall
thereafter cause the matter of f1ll1ng the vacancy to be placed
upon the Clty Council Agenda and 1n connection therewlth, shall
transmlt to the Clty Councll caples of all wr1tten appllcat10ns
which have been recelved.
d. Al nomlnatlons shall be submltted to the
Cl.fy Clerk no later than twelve o'clock noon the Wednesday
precedlng the CJty Council meetlng when the appolntment 1S
to be made and shall be llsled on th~ agenda. No Councilmember
shall subml-t the name of more than one appll-cant to fill each
vacdncy. Pr10r to submittJng the name of h1S or her nominee
to flll such vacancy, each Councllmember shall determlne that
the person nominated wlll serve lf appo1nted. Thereafter,
the City Counc1l shall consl-der the appllcants for each
respect1ve vacancy at a publ1c hearing.
e. Follow1ng consl-deratl-on of the var10US
appl1cants for each vacancy, the City Council shall take a .;
