The purpose of each resolution is discussed below: l. Resolution Submitting to the Voters six Proposed Amendments to the City Charter. This Resolution submits to the voters the following proposals to amend the City Charter: a. proposal to add Sections l4 05-l4 07 to the City Charter to provide that City Councilmembers be selected by numbered offices. b. proposal to add Section 1905 to the city Charter to provide a Gann override for police and protective services. c. Proposal to add section 1906 to the City Charter to provide a Gann override for capital improvements. d. proposal to add section 20l5A to the city Charter to provide a Gann override for the Tenant Ownership Rights Charter Amendment. - 1 - q-A MAR 8 1988 e. Proposal to amend Section 602 of the City Charter to provide for increased compensation for City Councilmembers. f. Proposal to amend Section l005 of the City Charter to provide compensation for members of the Planning Commission. 2. Resolution Authorizinq Members of the City Council to Submit Arguments Concerninq Various Propositions. The purpose of this Resolution is to give members of the city Council an opportunity to submit arguments in favor of or against the six propositions to be submitted to the voters. By virtue of Elections Code section 5016, the City Councilor its members authorized by the City Council have priority in submitting arguments in favor of or against a ballot measure. If the City Council desires to permit its members to submit arguments in favor or or against any proposition, the members so authorized should be inserted in Section 1. Elections Code Section 5014.5 authorizes the submittal of rebuttal arguments if the legislative body, not later than the day on which it calls an election, adopts the provisions of Elections Code Section 50l4.5. In connection with the 1981 General Municipal Election, the City Council adopted Resolution Number 6180 (CCS) adopting the provisions of Elections Code Section 5014.5. The resolution provided in section 2: "That the provisions of section 1 shall apply at the next ensuing municipal election and at each municipal election thereafter, unless repealed by the legislative body." Thus, unless the City Council repeals Resolution NUmber 6180 (CCS), the authors of the argument f - 2 - in favor of any proposition will be permitted to prepare a rebuttal to the argument against such proposition and the authors of the argument against any proposition will be permitted to prepare a rebuttal to the argument in favor of such proposition. 3. Resolution Requesting Consolidation of Election. This Resolution requests the Board of Supervisors to consolidate the Special Municipal Election with the statewide direct primary election. 4. Resolution Requesting Election Services from County. This Resolution authorizes the City Clerk to request various election services from the County to assist in such tasks as distributing sample ballots. RECOMMENDATION It is respectfully recommended: 1. That the City council adopt the Resolution submitting to the voters six proposed amendments to the City Charter. 2. That the City Council adopt the Resolution authorizing members of the City Council to suhmi t arguments concerning the various propositions. 3. At the Special Municipal Election called for June 7, 1988, the following proposition shall be submitted to the qualified electors of the City of Santa Monica: PROPOSITION" " Shall the city Charter be amended by addinq Section 1905 to increase the City's expenditure authorization by $6,000,000 for each fiscal year durinq the four year period ending June 6, 1992, for the purpose of maintaining and providing increased police and other protective services, for improving the safety of streets and neighborhoods, and for encouraging public involvement in the reduction of crime? YES NO The City Clerk shall cause the text of the proposition, which is contained in Exhibit 2 attached hereto and incorporated by reference, to be mailed to all qualified voters with the sample ballot. In addition to other notices and publications required by law, the City Clerk, not less than 40 days and not more than 60 days before the Special Municipal Election, shall cause the text of the proposition to be published once in the official newspaper and in each edition thereof during the day of publication. - 3 - SECTION 3. At the Special Municipal Election called for June 7, 1988, the following proposition shall be submitted to the qualified electors of the City of Santa Monica: PROPOSITION" ." Shall the city Charter be amended by adding section 1906 to increase the City'S expenditure limitation by $9,500,000 for each fiscal year during the four year period ending June 6, 1992, for the purpose of capital improvements and outlays for certain specified purposes including parks, pier preservation and improvement, street lighting and street maintenance, libraries and police facilities? At the Special Municipal Election called for June 7, 1988, the following proposition shall be submitted to the qualified electors of the City of Santa Monica: PROPOSITION" II Shall the City Charter be amended by adding section 2015A to increase the City's expenditure limitation for each fiscal year during the four year period ending June 6, 1992, by an amount equal to the monies received from landlords in connection with tenant-approved conversions of rental units to be used for the purpose set forth in the Tenant Ownership Rights Charter Amendment? At the Special Municipal Election called for June 7, 1988, the following proposition shall be submitted to the qualified electors of the City of Santa Monica: PROPOSITION" " Shall section 602 of the city Charter be amended to increase the monthly reimbursement for Councilmembers from $50 per month for Councilmembers and $150 per month for the Mayor to $600 per month for councilmembers and $700 per month for the Mayor and to provide that the City Council may, by ordinance, increase those amounts once annually not to exceed either the amounts paid Councilmembers under state law in general law oi ties of the same population as the City of Santa Monica or five percent of the amount in effect at the time of passage of the ordinance? Shall Section 1005 of the City Charter be amended to allow the City Council, by ordinance, to provide for compensation of Planning Commissioners in the amount of $25 per meeting not to exceed $100 per month and to provide that the City Council may, by ordinance I increase this amount by the annual increase in the Consumer Price Index? MYERS 0 City Attorney - 8 - EXEIBI':' 1 PROPOSAL BY THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO THE VOTERS OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Sections 1405-1407 are added to the city Charter of the City of Santa Monica to read as follows: Section 1405. Council Offices. Numberinq of City (a) On or before July 15, 1988, each member of the City Council shall draw a lot to determine the nQmper of the City Council Office he or she holds. Each member of the City council whose term of office expires in 1988 shall draw one lot from lots numbered City Council Office Numher 1, City Council Office Number 3, City Council Office Number 5, and City Council Office Number 7 and each member of the City Council whose term of office expires in 1990 shall draw one lot from lots numhered City council Office Number 2, City Council Office Number 4, and City Council Office NUlTlher 6. The City Clerk shall conduct the drawing of lots, which shall take place at a regular or special meeting of the City Council. (b) The offices nlJlTIJ:'lered pursuant to subsection (a) shall maintain these numbers in all subsequent City Council elections. (c) The incumbent of a numbered City Council Office shall be identified on the ballot as the incumbent of that office if he or she seeks reelection to that office. section 1406. Council Elections. Timing of City (a) Elections for City Council Office Numbers l, 3, 5, and 7 shall be held at the general municipal election in 1988 and every four years thereafter. (b) Elections for City Council Office Numbers 2, 4, and 6 shall be held - 1 - at the general municipal election in 1990 and every four years thereafter. Section 1407. Filing Nomination Petitions For City Council Office. (a) A candidate tor the City Council can only seek nomination for one City council Office. At the time that a nomination petition is issued to a candidate, the city Clerk shall fill in the candidatels name and the number of the City Council Office which the candidate seeks. (b) Once a candidate is issued a nomination petition for a City Council Office from the City Clerk, the candidate cannot seek nomination for a different City Council Office unless, before the time for filing nomination petitions expires, the candidate (1) returns the nomination petition to the City Clerk, (2) requests in writing that the nomination petition be voided, and (3) obtains a nomination pet! tion for a different city Council Office. (c) Once a candidate has filed a nomination petition for one City Council Office, that candidate cannot file a nomination petition for any other City Council Office during the nomination period. (d) Except as provided in subsection (e), all petitions required for nomination shall be properly completed and filed with the City Clerk in the time period established by law. (e) If the incumbent of a City council Office does not file a nomination petition for that City Council Office within the time period required by law, any person, other than the incum.bent and other than a person who has filed a nomination petition for any other City Council Office, may file a nomination petition for that city Council Office within any additional time period permitted by law. ef) The candidate receiving the highest num.ber of votes for a City Council - 2 - Office shall be the elected city Council member for that office. (9) The provisions of this section shall apply to all general and special elections at which members of the City Council are elected. barl82jhpadv - 3 - EXHIBIT 2 PROPOSAL BY THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO THE VOTERS OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Section 1905 is added to the city Charter of the City of Santa Monica to read as follows: SECTION 1905. Expenditure Limitation Increase ~or Police and Protective Services. (a) Pursuant to Section 4 of Article XIIIB of the California Constitution, the City'S expenditure limit for each of the fiscal years during the four year period beginning June 7, 1988, and ending June 6, 1992, is increased, in addition to any other voter-approved increases, by Six Million Dollars ($6,000,000.00). This increase shall be adjusted each year for changes in population and the lower of changes in cost of living or personal income as is provided for in State law, or as otherwise provided for by the state Constitution. (b) Appropriation of funds that may be made for spending by reason of subsection (a) shall be made for maintaining and providing increased police and other protective services, for improving the safety of streets and neighborhoods, and for encouraging public involvement in the reduction of crime. nnd654jhpca EXHIBI'I 3 PROPOSAL BY THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO THE VOTERS OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA section 1906 is added to the City Charter of the City of santa Monica to read as follows: SECTION 1906. Expenditure Limitation Xncrease for capital xmprovaments and outlays. (a) Pursuant to Section 4 of Article XIIIB of the California Constitution, the city's expenditure limit for each of the fiscal years during the four (4) year period beginning June 7, 1988, and ending June 6, 1992, is increased, in addition to any other voter-approved increases, by Nine Million Five Hundred Thousand Dollars ($9,500,000.00). This increase shall be adjusted each year for changes in population and the lower of changes in the cost of living or personal income as is provided for by state law, or as otherwise provided for by the State Constitution. (b) Appropriation of funds that may be made for spending by reason of subsection (a) shall be made for providing capital improvements and outlays for street maintenance, sidewalks, street light circuit replacement, new street lights, energy conservation, traffic signals upgrade, park maintenance, pier preservation and improvement, vehicles and other equipment, and various one time capital needs for libraries, publicly owned recreational facilities in the City, park development, police and fire facilities, and other capi tal improvements and outlays required for the protection of public health and safety, and for maintaining and improving the quality of basic police and fire protection, library, recreation and parks, City planning, engineering and associated administrative support services. EXEI3IT 4 PROPOSAL BY THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO THE VOTERS OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Section 2015A is added to the City Charter of the City of Santa Monica to read as follows: SECTION 2015. Expenditure Authorization. The expenditure limitation of the City established pursuant to Article XIIIB of the California Constitution is increased, in addition to any other voter-approved increases, for each of the fiscal years during the four year period beginning June 7, 1988, and ending June 6, 1992, by an amount equal to the amount of the monies received in each such fiscal year pursuant to section 2008 of this Article. EXHIBIT 5 PROPOSAL BY THE CITY COUNCIL OF THE CITY OF SANTA MONICA TO BE SUBMITTED TO THE VOTERS OF A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA Section 602 of the City Charter of the City of santa Monica is amended to read as follows: Section 602. Compensation. The members of the City Council shall receive reimbursement for necessary travel and other expenses when on official duty out of the City on order of the city Council_ The members of the City Council shall receive no compensation for their services as such, except as provided below: (a) until January 1, 1989, the Mayor shall receive the sum of $150.00 per month, which amount shall be deemed reimbursement of out-of-pocket expenditures and costs imposed upon him or her in serving as Mayor, and all other members of the City council shall receive the sum of $50.00 per month, which amount shall be deemed reimbursement for out-Of-pocket expenditures and costs imposed upon them in serving as members of the City Council. (b) Commencing on January l, 1989, the Mayor shall receive the sum of $700.00 per month, which amount shall be deemed reimbursement for out-of-pocket expenditures and costs imposed upon him or her in serving as Mayor, and each other member of the City Council shall receive the sum of $600.00 per month, which amount shall be deemed reimbursement for out-of-pocket expenditures and costs imposed upon them in serving as members of the City Council. Pursuant to an ordinance duly adopted by the Ci ty Council, the amount of the monthly reimbursement recei ved by the Mayor and City Councilmembers may be increased only once annually as follows: (1) up to the maximUM amount of compensation provided by state law for councilmembers in general law cities of the same population as the City of Santa Monica: or (2) in an amount not to exceed five percent of the compensation in effect when the ordinance is adopted. Any ordinance increasing the monthly reimbursement shall be effective - 1 - no earlier than January 1 of the year following the year in which the ordinance is adopted. The members of all boards and commissions, except the Planning Commission, shall serve wi thout compensation for their services as such, but shall receive reimbursement for necessary traveling and other expenses when on official duty out of the City on order of the City council. Pursuant to an ordinance duly adopted by the City Council, the amount of compensation for Planning Commissioners may be increased by an amount equal to the increase in the Consumer Price Index for each calendar year from the operative date of the last adjustment of the compensation in effect when the ordinance is adopted. The Consumer Price Index (CPI) shall be the CPI for All Urban Consumers for the Los Angeles, Long Beach, Anaheim Metropolitan Area (All Items), provided by the United states Bureau of Labor statistics or other comparable index determined to be appropriate by the City Council. State Law Applicable to General Law Cities State law allows city councils in general law cities to provide for council salaries by ordinance. The amount that a city council may authorize is established according to the population of the city. For example, city councils in cities with populations between 75,000 and 150,000 may authorize compensation up to and including $600 per month pursuant to state law. Government Code Section 365l6. state law further provides that an elective mayor may be provided with compensation in addition to that which he or she receives as a councilmember. A specific increment is not established. Government Code Section 36516.1. In addition, state law provides that councilmember compensation may be increased by ordinance but in an amount not s~~ 1"0 - 1 - ~~A MAR 8 1.988 to exceed 5 percent for each calendar year. The language of state law appears to allow "banking" of such increases. state law further provides that council pay can be increased beyond the amount established by population size by majority vote of the electors. other Cities Different cities provide different levels of compensation for councilmembers. The lack of uniformity is demonstrated by looking at a few cities as examples: l. Beverly Hills (Population 32,367): As of April, 1988, all councilmembers including the mayor will earn $330.00 per month. 2. Burbank (Pop. 88,659): The basic pay is $600.00 per month for all councilmembers incl uding the mayor. All councilmembers receive medical insurance and life insurance policies (the latter in an amount of $50,000) as well as car allowances as follows: counci1members - $125.00 per month~ vice mayor - $150.00 per month~ and mayor - $l75.00 per month. 3. Culver City (Pop. 38,900): All councilmembers including the mayor currently receive $400 per month. 4. Glendale (Pop. 146,110): All councilmembers including the mayor receive $800.00 per month, plus medical insurance and an auto allowance. 5. Hawthorne (Pop. 56,447): All councilmembers including the mayor receive $250.00 per month. 6. Long Beach (Pop. 375,467): The councilmembers receive $1,102.50 per month~ the mayor makes $100 more (or $1,202.50). - 2 - 7. Pasadena (Pop. 125,063): All councilmembers including the mayor receive $50.00 per meeting. The Council schedules four meetings per month. 8. Torrance (Pop. 129,5l1): All councilmembers including the mayor receive $lOD.DO per month. These amounts do not include additional compensation which is paid to councilmembers in some cities, including santa Monica, for service as the Redevelopment Agency or the Parking Authority. Ballot Proposition: City Council Pay As drafted, the ballot proposition provides that as of January 1, 1989, city Councilmembers will receive $600 per month while the Mayor will receive $700 per month. These amounts cannot be increased before January 1, 1990 and they can only be increased once annually. The proposition specifies $600 per month rather than merely referring to the compensation authorized for general law cities, pursuant to Council direction. Since the Council did not specify the increment by which the Mayor I s compensation should exceed that of councilmembers and state law does not specify an amount for mayor, $700 was used because it reflects the same differential that currently exists. The established amounts can be increased by ordinance in one of two ways. First, the council is authorized to provide for an increase up to the amount provided by state law. This addresses the situation in which state law increases the maximum salary levels allowable for general law cities whose population size is the same as that of Santa Monica. Second, like general - 3 - law cities, the council is authorized to provide for a 5 percent salary increase above the amount being received at the time of the ordinance. Unlike state law, this provision does not allow the council to "banktl salary increases. The ballot measure states the current level of compensation because the Charter must specify the compensation level that applies until January 1, 1989 when the $600/$700 levels would take effect. In addition, the voters must be informed that the $600/$700 levels reflect a change from $50/$150 levels. Ballot Proposition: Planning commissioner Pay As drafted, this proposition allows the City Council, by ordinance, to provide for compensation to Planning commissioners in the amount of $25 per meeting, not to exceed $100 per month. The proposition further provides that the council may increase this amount in an amount equal to the increase in the CPI from the time of the last adjustment. As currently worded, the CPI increase can be adopted at any time.
