(A correspondlng change was made ln the school board electlon by the adoptlon of Proposltlon Z.) In order to ensure that the nOffilnatlon procedures for candldates at XoveQber munlclpal electlons are flled ln a tlnely manner to ensure consolldatlon with the statewide munlclpal electlon held on the same date, lt is necessary to amend Munlcipal Code Sectlon 11000. Currently, Munlclpal Code Sectlon 11000 reqUlres that nomlnatlon papers be flled not earl1er than the 89th day before an electlon nor later than the 68th day before an election. In consultatlon wlth the Clty Clerk, it 15 necessary to change thlS Section to provlde that naUlnatlon papers be flied not earlier than the 113th day before an electlou nor later than the 88th day before an electlon. Flnally, to be conSlstent with state law and TO avold confusion, the flllng deadline has been changed from 12:00 p.m. on the last day to 5:00 p.m. on the last day. Section 11000 of the Santa Mon.:tca nunic~pal Code is hereby amended to read as follows: Sect.:ton 11000. Nominatlon of Candl.dates. Not earlier than the 113th day nor later than 5:00 p.m. on the 88th day before a municipal electlon, the voters may nominate candldates for election by signing a nOffilnation petitlon. If n~ination papers for an incumbent officer are not flIed by 5:00 p.n. on the 88th day before the election, the voters shall have unt2l 5:00 p.m. on the 83rd day before the elect.:ton to nOffilnate cand~dates other than the incumbent for the electlve offlce. ~ach cand~date shall be proposed _ I ~ . . by not less than 100 registered voters, but only one cand~date may be named ~n any one nom~natlon pet~tion. Any person registered to vote at the elect~on may circulate a nomination petition. \fuere there are full terms and short terms to be filled, the term shall be speclfied in the naminatlon petition. SECTION 2. Any provlslon of the Santa Monlca Munlcipal Code or appendices thereto lnconsistent with the provislons of thlS ordinance, to the extent of such inconslstencies and no further, are hereby repealed or modifled to that extent necessary to affect the provisions of th~s ordinance. SECTION 3. If any sectlon, subsectlon, sentence, clause, or phrase of thlS ordinance is for any reason held to be invalid or unconstitutlonal by a dec~sion of any court of any competent jurlsdiction, such decision shall not affect the val~dity of the ra~aining port~ons of the ordinance. The C~ty Council hereby declares that it would have passed this ordinance and each and every section, subsectlon, sentence, clause or phrase not declared invalld or unconstitutional wlthout regard to Whether any portlon of the ordinance would be subsequently declared ~nvalid or unconst~tut~onal. 2 -- . . SECTION 4. The Mayor shall sign and the city Clerk shall attest to the passage of this ordinance. This City Clerk shall cause the same to be published once in the offlcial newspaper withln IS days after lts adoption.
