Introduction
Councilmember Greenberg tendered her resignation fram the City Council effect~ve
S~ptember 25. 1998, due to her move outside of tlne Cfty boundar~es At ~ts regufar
meeting of Octaber 13, 1998, the City Council accepted Councilmember Greenb~rg's
~esrgnation and declared her seat ~acant Section 603 af tt~e City Charter states, in
part, that any ~acancy on the City Council shall be filled by appointment withm thirty
days after the office is decfared vacant, and shall Council fai! to fifl the ~acancy, Council
s~all forthwith cause an election to be held to fill such ~acancy
Co~ncit has he~ci dGSCUSSions during the ~ctober 13, and October 27. 199$, meetings
regard~ng the procedure for filling the vacancy. and candidates #~a~e been inv~ted to
submrt letters of interest and applications Th~s staff report recommends that Council
delrberate and take action to f~lf the vacant seat or adopt the attached ordinance and
resolutions necessary to call a special el~ction to fill the vacancy
Election Scheduiinq Procedures
Section 1403 of the C~ty Charter provides far all eiections to be held m accordance w~th
the provisions of the Electtor~s Code of the State of Calrfomia, un~ess otherwise
prawdec~ by ordmance The Hections Code estabiishes March 2, 1999, as the next
appropnate date for an election Staff recommends that if a special election is called, ~t

be scheduled for March ~ 6. 1999, for two reasons The first is t#~at on March 2, 1999, a
large number of c~ties wif! be hofc~~ng stand-alone electior~s and will be using the
services of the oniy election suppiier focated in So~them California Second, this will
be the first stand-alone election the City Clerk's Office w~li admin~ster in 15 years, and
w~ll reqwre a substant~al amount af work in a short period of t~rne The additional two
weeks af time will provade some rel~ef to staff
Attacfi~ed are the followmg Exh~bit A~s an emergency ord~nance for adopt~on sett~ng
the date of the speciaf election. pursuant to Section 14p3 of the City Charter, Exhibit B
is a resolution calling a special eiection to fill an unscheduled ~acancy on the City
Councif to be F~eld on March 16, 1999. Exhibit C is a resoiut~o~ requesting the Board of
Supervisors of the County of Los Angeles ta render spec~fied services to the C~ty
relating to the special efection. Exhfb~t D is a reso~ution author~zing servrces, s~pplaes
and equipmer~t from Martin & Chapman Company far the specral elect~on, and,
Exh~b~t E is a resolut~on ardering the can~ass of the specEa! electian be made by the
CEty Clerk
BudqetlFinanciaf impact
There are no appro~ed funds m the City Clerk's Office elections budget for Fisca! Year
1998-1999 Martin & Chapman has given an est~mate of $1 per ~oter for senrices,
supplies and equipment There are 55.237 registered ~oters in the City as of
October 5, 1998 Staff is reques#~ng fiunds fior services and supplies from Martin &
Chapman in t~e amount of $60,000, ir~clud~r~g ap~roxfmately $4,163 for cont~ngertcies
Staff is also requesting $20,000 ir~ fundmg for services ~rom Los Angeles County
Although it ~s not antrc~pated that the cost will be that h~gh, it ~s difficuft to estimate a
more precise amount smce this is the first stand-alone election in a long time The
County charges $1 36 per ver~ication of voter's s~gnatures Dunng the Novemtaer 1996
electtor~ there were 5,589 absentee balfots received for City candidates and measures

If a similar number were recei~ed for this elect~an, the ~erificatton of these signatures
would accouRt ~or $7.600. ~n add~t~on to the cost for the othe~ servECes requested from
the County
Staff ~s request~ng $15,000 for postage and $9,500 for labor costs to ma~l o~t ~ater
pamphlets This estimate ~s based on the cost for maif~ng pamphlets for the 199fi
e4ect~on The pamphlet for the special election would contam fewer pages than the
1996 pamphlet and cost less Howe~er. there will be the added cost of ma~lmg out
absentee ballots d~rectly from our office, and not #ram the County Finally, staff ~s
requestmg $22.50~ for various other costs incl~ding. but not I~mited to stipends for
precinct workers and fees for usmg precmct sites, wages for temporary and election
day workers, o~ert~me funds for City Clerk's staff. legal publ~shmg costs, and,
miscellaneous supplEes ar~d expenses

ta adop# an ordinance ~f it desires to set an electivn on a date other than that set forth irt
the Cal~fornEa Elect~ons Code, and
WHEREAS, when a C~ty Counc~l vacancy occurs which cannpt be filled e~ther at t~e
next generai elect~on due to the timing of the vacancy nor by appointment, a special
election must be set ta fill that vacancy,

SECTION 3 Any pro~ision af the Santa Mornca Mur~icipaV Code or appendf~es
thereto ~ncons~stent with tt~e pro~ESions of this OrdEnance, to tl~e extent af such

At its meeting af November 24, 1998. the C~ty Co~ncil directed staff to return with
mfiormation an alternative dates for fhe spec~al election, ir~cfuding a Saturday electEOn, a
Sunday electiort. a two-day SaturdaylSunday e~ect~on. additio~al costs. input from tt~e
publ~c and relrg~ous leaders regardmg the alternative election dates, and ways of
~ramoting such an elect~on
Alternative Dates
Sectiort 1403 of the City Charter pro~ides for all electio~s to be held in accordance with
the provisions af the Elections Code of the State of California. unless atherwise
provided by ordinance Consequentky. the City Cour~cil may call an election on a
Saturday or an a Sunday. by ordmance The same conclus~on applies to callmg a two-
day election on a Saturday and Sunday
Were Council to set the electior~ date ~t the December $, 1998, meeting, Co~ncil could
caEl the election far any day of the week sta~ting A~ril 1, 1999, and thereafter Were
Counc~l to call the election for a Tuesday, the ~lectian may ~e called for any Tuesday in

Additional Cost
A Saturday or a Sunday e~ection would result in a mi~imal increase to co~er overtime
costs for the County and efection staff A two-day Sa#urday a~d Su~day election woufd
result in an increase of approximately $15,OOQ-20,000 to pay for ~recmct workers and
pal4ing sites and for overt~me for the County and eiection staff There woufd be an
added cost fo~ use af police afficers to guard voted ballots between the end of the first
election day and t#~e begmning of the second day It is expected that most of the
police off~cers would be work~r~g o~ert~me and the total amount would depend on the
opt~on selected for guarding the ballots
There are three possible opt~~ns on secunng ~oted baibts between the first and second
day T~e ~oter~ ballots could remam at the pollmg site This opt~on wou~d requ~re a
police officer at each precmct guarding the ballots from the closang of t~e polis on the
first day and t#~e apen~r~g of the polls t~e second day We estimate there wili be abaut
forty-fi~e to fifty consolidated precmcts The highest hourly rate for a police aff~cer ~s

as an altemati~e, Gity s#aff could deliver the baliot boxes to each precinct the followmg
morning This option would require pol~ce off~cers esco~ting the ballots firom the
precmct worker's veh~cle outs~de of City Hall to thE vault in the C~ty Clerk's off~ce, and
standmg guard outside #he City Clerk's vault o~ern~gF~t, where the voted baliats would
be stored The cast to have three paiice ofF-cers escortir~g ballots ~nto CEty Nall the f~rst
ever~ing and out of C~ty Hall the next morning is abaut $90Q 00, and for one police
officer standing guard fior a 12-hour shift wrll be about $609 00
The third option wouid be to keep t#~e voted baltots at the Cierk's off~ce and ~ssue the
precmct work~rs a second baHot box The ac4ditional cost for poiice officers escort~ng
the bailots into City Hall is abo~t $460 QQ This option, however, allows far the
