Many sectIons of the Muncipal Code are obsolete or preempted by state law. The accompanYIng ordinance has been prepared to repeal various sections of the Municipal Code not requIring replacement at thlS tIme. ANALYSIS The following is an outline of the sections proposed to be repealed. (The accompanYIng attachment contains each section proposed to be repealed.) Section 3320. ThlS section contains a definltIon of a street car. SectIons 3358-3360. These sectIons relate to driving under the influence of alcohol, drugs, or glue, reckless driving, and passenger intoxication. ThIS area IS currently covered by the Vehicle Code (Vehicle Code Sections 23102, 23103, 23121, 23121.5, 23122, 23122.5, 23123, 23123.5, and ~-B l:"'. '" -~ jI t "'"' r". Section 3380. This section concerns a prohIbition against railway trains and street cars blocking public streets. Section 3381. ThIS sectlon concerns a prohibition agaInst nlghttime raIlway switching without the placement of flares. Sections 3501-3504 and 3507-3508. These sections relate to the possession of concealed weapons and to the terms and condItions of retail licenses for the sale of con- cealed firearms. This area is currently the covered by the Penal Code (Penal Code Section 12020 et seq.) and IS not the appropriate subject of municipal regulation. The Munlcipal Code will retain a section prohibiting the discharge of fire- arms in the City (Section 3500), a section designating the Chief of Police as the issuing authority for firearm permits (Section 3505), a section specifying permlt fees (Section 3506), and sect10ns concerning the sale to and possession of weapons by m1nors (Section 3509-3511). Although some of these sections may reqUIre modiflcation, they should not be repealed at this time. Sections 3700-3709. These sections concern the regis- tration of communists. -2- ... ~ , Sections 3800-3807. These sections concern the regis- tratlon of subversives. Sections 3900-3907. These sectIons concern the regis- tration of advocates of rule by force. Sectlons 4203 and 42l2. These sections concern lit- tering and are currently covered by the Penal Code Penal Code SectIon 374 et seq.); It 1S not the proper subject of munICIpal regulation. SectIon 4203B. This section prohibits an adult from beIng In a municipal playground when not accompanIed by a chIld. Although the purpose of this sectIon is understand- able, its scope is much too broad. Section 4204. This sectIon deals with dIsorderly conduct and IS currently the subject of various state laws (e.g., Penal Code SectIon 415); it is not the proper subJect of municipal regulation. Sections 4204b and 4204e-42049. These sections deal with loitering and lewd conduct and are currently covered by the Penal Code (Penal Code Sections 314, 647(a), and 647{d)); It lS not the proper subJect of municipal regulation. SectIon 42041. ThIS section concerns public intoxica- tion and is currently covered by the Penal Code (Penal Code SectIon 647(f)); 1t is not the proper subject of municipal regulation. Section 4207. This sect10n prohibits illicit sexual Intercourse. -3- "'I , :I . , Section 4208. This section prohibits the solicitation of a lewd act. This area lS covered by the Penal Code (Penal Code Section 314 and 647(a)) and is not the proper subject of municIpal regulation. section 4209. This section probibits resorting to immoral purposes. To the extent this area may be regulated, It is covered by the Penal Code and is not the proper subject of muniCIpal regulation. Sectlon 42l3. This sectIon prohibits damaging property and is currently covered by varIOUS state laws (~.g., Penal Code Section 594); it is not the proper subject of mun1cipal regulation. Section 42l4. This sectIon prohibits "tramps" from solIciting alms or money and is currently covered by the Penal Code (Penal Code Section 647(c)); it IS not the proper subJect of municipal regulation. Sectlon 4217. ThIS section prohib1ts ambulance chaSIng by various persons. section 42l9. This section concerns the enforcement power of the City Electrician and IS currently covered by the Uniform Buildlng Codes. Section 4220. This sectIon prohibits certaIn business transactions on the Sabbath Day. Section 4221. ThIS section concerns trespaSSIng and IS currently covered by various state laws (e.g., Penal Code Section 602). -4- , , I , , Sect~on 4224. This section establishes a curfew for persons under the age of 18. Sections 4226-4228B. These sectIons concern gambl~ng and bettIng. This area is currently covered by the Penal Code (Penal Code Section 330 et seq.) and is not the proper subject of municipal regulation. Section 4251. ThIS section concerns dlstributlon of written materials that tend to inclte riots or other public dIsorders or which advocates disloyalty to or the overthrow of the United States. Sections 4252-4252.l. These sections concern obscene materials and are currently covered by the Penal Code (Penal Code SectIon 31l et seq.). SectIon 4253. ThIS section prohibIts massages by members of the opposite sex. This section, which is unrelated to the City's regulatIon of massage operators, 1S constitutIonally defectlve.
