CITY aF SANTA MONICA CALL~NG AND GIVING NOTICE
~F THE HOLDING OF A GENERAL MUNICIPAL ELECTIDN
TO BE HELD ON TUESDAY, NOVEMBER 3, 1992
WHEREAS, City Charter Section 1400 provides that a general
municipal electian sha~l be held on the first Tuesday following
the f irst Monday of November of each even numbered year ~or the
purpose of electi.on of elected officers; and
WHEREAS, under the provisions af the City Charter, four
members of the City Council shall be elected f~r a fuli term of
four years; and
WHEREAS, under th~ provisions af the City Char~er, twa
members of the Rent Control ~aard shall be elected for a fu11
term of four years; and
WHEREAS, under the pravisions af the City Charter, three
members of the Santa Monica-Malibu Unified School District Board
of Education shaZ2 be elected for a full term of four years; and
WHEREAS, under the pro~isions of Chapter 365 of the
California Statutes of 1982 and resolutions adapted by the Board
of Trustees of the Santa Manica Community College District, three
members of the Santa Monica Community College District Baard af
Trustees shall be e~ected for a full term of four years; and

WHEREAS, EZectians Cade Section 17050 authorizes the City
Cou~cil ta pravide that all ballats cast at the General Municipal
Election be counted at a central count~nq place; and
WHEREAS, the Education Code and the Elections Code
authorize the cansolidation of th~ eleatzon af inembers of ~he
Santa Monica-Malibu Unified School District Board of Education
and Santa Monica Callege District Board af Trustees with the
General Municipal Election; and
WHEREAS, the City Council desires to submit to the voters,
pursuant ta Gavernment Code Sectian 34459, ane or more praposed
amendments to the City Charter,

M~NICA DO~S RESOLVE AS FOLLOWS:
SECTION 1. A general municipal election shall be held in
the City of Santa Monica on November 3, 1992, which is the
election required for purpases af electing four members of the
City Council, three members of the Rent Cantrol Board, three
members of the Santa Monica-Malibu Unified Schoal District, and
thre~ members af the Santa Monica Community College District
Baard of Trustees.
SECTION 2. Tl~e text of proposed bailot measures, ba~lot
titles, and related issues shall be cantained in resalutions
appraved by the City Cnuncii.
SECTION 3. The ballats ta be used at the Regular Muna.cipal
Election sha~l be b~th as to form and matter contained therein
such as may he required by law.

SECTIoN 4. The City Clerk is authorized, instructed, and
directed to pracure and furnish any and all official ballots,
notices, printed matter and all supplies, equipment, and
paraphernalia that may be necessary in order to properly and
lawfuily conduct the Regular Municipal Election.
SECTIOK 5. The polls for the Regular Municipal El~ction
sha11 open at 7:00 a.m. of the day of the election and shall
re~ain agen continuously until 8:00 p.m. of the same day when the
polls shall be closed except as provided in E~ectians Code
Section 14301.
SECTION 5. The notice of the time and p~ace of ho~ding of
the Regular Municipal Election as hereby given and the City Clerk
is authorized, instructed, and directed tQ give such further or
additianal notice of the election in the time, tarm, ana manner
required by law.
SECTION 7. Pursuant to EZections Code Section 17050, the
City Clerk is authorized~ instructed, and directed ta give notice
of th~ central counting piace zn the time~ farm, and manner
required by law.
SECTION 8, Pursuant to Electians Code Section 5011, the
City C~erk is diracted to transm.it a cvpy of each measure ~o be
submitted to the voters ta th~ City Attorney and the City
Attorney is directed to prepare an impartial analysis of each
m~asure in accordance with the provisions of Elactions Cade
Section ~011.

SECTION 9. An election for members Qf the 5anta
Monica-Ma~ibu unified Schaal District Board of Education and the
Santa Manica College District Baard of Trustees shal~ be
conso~idated with the General Municipal Election. Separate
ba~lots sha~l be pravided for those vaters who reside outside the
City af Santa Manica pu~suant to Elections Code Section 23304.
SECTION 10. The City Clerk is directed ta send a copy of
this Resolution to the Board of Supervisors of the Caunty of Los
Angeles and to the Registrar of Voters.
SECTION 11. In the event the Regu~ar Municipal Electian is
consolidated with the Statewide General Electian on the sa~e
date, the provisions of this Resolution applicable anly in the
event the election is conducted by the City shall be of no farce
or ef f ect .
SECTION 12. The City Clerk shall certify to the adoption
af this Resolutian, and thenceforth and thereafter the same shall
be in fuil force and effect.

This Staff Report transr~Yts to the City Council four
resolutions for adoption in connec~ian with the Regular Municipal
Election tv b~ held on November 3, 1992.
At its meeting on July 7, 1992, the City Council d~rected ~.he
City Attorney to prepare t~~o ballot measures amending the City
Charter. This Staff Rep~rt transmits ~he various resoZutions to
effec~uate the City Council's direction.
1. Resolution Submi.ttinc{ to ~he Voters Two Ballot Measures.
This Resolutlon submit~ to the voters the follawing ballo~
m~asures:
a. Praposal to Amend City Charter ta Provide City
Council Co~pensataon and ~o Lir~it the Term af Office.
This propasal ar.lends Sections 601 and 602 of the City Charter.
Section 6~1, ~rhich relates to the eligi~ility for City
Council, has been revised to 11r~~t a person from holding more than
three cansecutive terms an the City Council. In additian, this
Section has been revised to :nake it gender neutral. In addition,
a portion of this Sectior~ requirang a t:aa year residency
~ l~ ~

requirement for ca~d~~ates for City Couneil has been de~eted. This
residency requirement violates bath the United States and
California Constitutions. (See Johnson v. Hamilton, 15 Cal. 3d
461, 541 P.2d 881, 125 Cal. Rptr. 129 (1975); Thompson v. Mellon,
9 Cal. 3d 96, 507 P.2d 628, 1Q7 Cal. Rptr. 2D (1973} ; Daniels v.
Tergeson, 211 Ca~. App. 3d 120~, 259 Cal. Rptr. 879 (19$9). As
zevised, City residency ~s required at the time nomination papers
are filed.
Sectian 602~ r~~hich re~at~s to compen5atian, has been revised
to authorize City Council compensation and medical and dental
benefits. (The current cost to the City for hea~~.h insurance
benefits is $376 per :nonth per employee.) The City Council needs
to specify the dollar amount af the cor~pensation.
b. Propasal to Amend City Charter to Implement the
Recammendatians of the Charter RevieV~ Commission.
This proposal makes nur-~erous changes ta the City Charter to
implement ~he recommendations of the Charter Review Comma.ssian.
5ection 608. This Section ~47as rev~s~d tv ~mplement the
recommendation concernzng procedures far cantracting.
Section 612. This S~ction was revised to impl~ment the
recommendation concerning special and emergency meetings.
Section 613. This Sect~on was revised to implement ~he
recommendation concerning open meetings.

recommenda~~on eoncerning the elimination of the position of Health
Officer.
Section 701.. This Section was revised to change the title of
the Directar of R~cr~ation to the Director of Cu~tural and
Recreation S~rvices.
5ection 717. This Section was de~~ted to implement the
recom3mendatian to eliminate ~he pos~tion of Health Officer.
Sectidn 7~8. This Section was reva.sed to change the title of
the Director of Recreatian to the Director of Cultural and
Recreation Services and to change the title of the Recreation
Commission to the Recreation and Parks Commission.
Section ~007. This Sect~on was revised to implement the
recommendation concer~ing P~anning Commission composition.
Section 1013. This Sectian was revised to change the title of
the Recreation Commission ta th~ Recreation and Parks Commission.
In addition, this Sec~~an was re~ised to make the same changes that
were made to the campositian of the Planning Commission. The
change eliminates the provision that a member of the City Council
b~ a member of the Comr~issian and changes eligibility fram electars
to residen~s of the Ca.ty.
Section 1014. This Sectaon was revised to change the title of
the Recreation Commissian ta ~.he Recreatian and Parks Commission.

recammendation to delet~ the provis~ons considering presentation of
demands.
sect~on 157.5. 'This Section iaas revised ta implement the
racommenda~ion concerning actions against ~h~ City.
Section 1803. Subdivision (m} of this Section uras revised to
provide that vacancies in the Rent Control Baard sha11 be f~lled at
the next general municipal election.
One of the general recpmmendatipns of the Charter Review
Commission was ta ensure gender neutra~ language. In revising
Sections to accomplish this objective, we identified some
additional changes that ~Vere legally requix-ed. The following is a
list of the Sections which have been revis~d ta provide gender
neutral ~anguage along ~tiT~.th infarmation on any additional changes
that were made:
Section 600. This Section was revised to make it gender
neutral. In addYtion, language describing the manner of the first
City Council under the City Charter has been deleted.

The City Cauncil also requested that the City Attarney review
the recommendatzans af the Charter Review Commissian to establish
an Environmental Commission and ta prnvide for periodic review of
the City Charter. In ~ur o~inion, both Qf these is~ues are best
addressed by ordinance rather than by add~ng provisions to the City
Charter.
2. Resalution Authorizinc{ Mer~bers o~ ~he City Council to
Submit Arquments Concerninq Various Propositions.
The purpose of ~.his ResoZution is to give members of the City
Cauncil an opportunity ta subr-~it arguments in favor of or against
the two propositions to be submitt~d ta the vaters. By ~irtue of
Elections Code Section ~016, the City Council or its members
authorized by the City Caunci~ hav~ priority in submitting
arguments in favor af or against a ballot measure. If the City
Cauncil desires ta permit its members to subr.-i~ arguments in favor
of or against any propasition, the members so authorized should be
inserted in Sect~on 1.
~lections Cade Section 5414.5 autharizes the submittal af
rebuttal arguments if the legislatzve bady, no~ later than the day
on which it calls an election, ad~pts the pravisians of Elections
Code Section 5014.5. In connect~.on ~rith the 1981 General Municipal
Election, the City Cauncil adopted Resolutzon Number 6180 (CCS}
adopting the prov~.sions ~f Elections Code Section 5014.5. The
resalution provided in Sect~.on 2: "That the provisions of Section
]. shall appZy at the next ensuing municipal election and at each

municipai electian thereaft~r, unless repealed by the lagislative
body." Thus, unless the City Council repeals Resolution Number
6180 (CCS), the authars of the argument in favor of any proposition
cai11 be permitted to prepare a rebuttal to the argument against
such prvpasition and the authors of the argument against any
proposition will be permitted ta prepare a rebuttal to the argument
in favor of such propasition.
3. Resolution Requestinq Consolidatian of Election.
This Reso].ution requests the Board of Supervisors to
consalidate the R~gular I~:unicipal El~ction with the statewide
general el~ction,
4. Resolution Authorizinq Election Services.
This Resolution au~harizes ~he City Clerk to retain the
services af Martin & Chapt~an Co. to provide variaus election
services. For example, the County has inform~d the City C~erk that
the City will be required to prepare and distribute the ballot
pamphlet.
RECOP~IMENDATION
It is respectfully recor~mended that the City Council take the
foilowing actions:
1. That the City Council adapt the Resa~ut~on submitting to

TO BE SUBMITTED TO THE VOTERS OF PR~POSED AMENDMENTS
TO THE CHARTER OF THE CITY OF SANTA MONICA, CALIFORNIA
Section 502 of the City Charter of the City of Santa Manica is
amended to read as foll~ws:
Section 602. Compensation, The mem}aers
of the City Council shall receive
reimbursement for necessary travel and other
expenses when on official duty out of the City
on order of the City Council. The members af
the City Cauncil shall receive no comp~nsation
for their services as such, except as provided
below:
(a) The ~nembers ~f the City Council
shall receive compensatian in the amount of
$540.00 per month. Pursuant to an ordinance
duly adopted by the City Council, the amount
of the month].y compensation received by the
members of the City Council may be increased
anly Qnce annually in an amount not to exceed
five percent of the compensation in effect
when the ordinance is adopted. Any ordinance
increasing the monthly compensation shall be
effective no earlier than January 1 of the
year following the year in which the ordinance
is adopted.
(b) The members of the City Council
shall receive medical and dental benefits paid
by the City, pro~ided the same benefits are
available and paid by th~ City far City
departmental dir~ctors. Any a~r-ount paid fvr
medi.cal and dental benefits shall not be
included far purposes ~f determining
compensatior- under this Section.
Sectian 601 of the City Charter of the City of Santa Monica is
amended to read as f~ll~ws:
Section 601. Eliqibility.
(a) No persan shall be eligible ta hold
office as a member of the City Council unless
that person shall be a qualified electar af
the City at the time of nomination.
(b) No member of thE City Caunci3 may
serve more than three (3) consecutive fuil
terms in office. For purposes of this
Section, a term shali be considered a fu11
term if a Councilmember serves at least two
calendar years of the term in o~fice.
Cansecutive full terms served prior to the
adoption af this Section shall be counted
taward the term limitations established by
this Sect~on. However~ no Councilmember
elected to serve on the City Council at th~
November 3, 1992, electian shall be precluded
from serving an the City Council for the full
term fallowing this electian.

Resolutions. With the sole exception of

hereinafter referred to~ no ordinance shalZ be
adopted by the Gity Council on the day of its

bills, invoices, pay~olls, demands or charges
against the CYty government and, with the
advice of the Caty Attorney, determine ~he

The Soard shal~ cansist of fiv~ (5) elected
Commissianers. The Board shall elect annually
as chairperson, one of its me~be~s to serve in
that capacity.
(by Eligib~l~ty. Duly qualified
electoxs of the Cl~y of Santa P~onica are
eligible to ser~e as Co~~miss~onErs of the
Soard.
(c) Fu~l Disclosure of Holdings.
Candidates for the position of Commissioner
shall submit a verified state~ent lzsting all
af their interests and dealings ~n real
property, ~ncluding but not ~~Mited to its
ownership, sale or management, during the
previaus three (3} years.
{d} Election of Commissioners.
Commissianers shall be elected at general
municipal el~ctions in the same manner as set
forth in Article XIV af the San~a Monica
Char~er, except that the first Commisszoners
shall be elected at a special mu~icipal
election he1.d cti~ithin ninety (9~) days of the

rece~ving the rlost votes shall serve until
April 15, 1985 and the rer~a~ning three (3)

1983. Comm3ssioners shall se~ve a rnaximum of
two (2} full terms.
(f) Powers and Duties. The Board sha~l
have the following po~,=ers and duties:
(1) Set the rent ceilings for al~
controlled rental units.
(2) Require reg~.stratzon of all
contralled rencal units under Section ~.803{q).
(3) ~stablish a base rent ceiling
on rents under Section 1804(b).
(4) Ta make adjustments in the rent
cei~ing in accordance with Section 1805.

(6} Hare and pay necessary staff,

publicize its rules and regulations p~iar ta
promulgat~on ir at least one newspaper of
gen~ral circulation in the City af San~a
Monica. The Board shall hold at least one
public h~ar~~g to cansider the views of
interested parties pr~or to th~ adoption af
general ad~ustments af the decision to
decontrol or rei~pose contro~ far any class of
rental units und~r S~ction 1803(r}. Alk rules
and regulat~ons, internal staff inemoranda, and
wr~tten corr~spondence explain~ng the
decisions, ard~rs, and policies of the Board
shall be kept ~n the Boardrs of~ice and shall

be availabl~ to t~e pub~~c for lnspectian an~
copying. The Board shall publicize this
Article so that all residents of Santa Monzca
wi11 have the opportunity to beco~e informed
about the~r l~gal r~gh~s and duti~s under Rent
Control zn Santa r7onica. The Board shall
prepare a brochure t~hich fully describes the
legal rzghts and duti~s of landlords and
tenants under Rent Control in Santa Nonlca.
The brochure ti.~ll be avallable ta the publxc,
and each tenant of a contralled renta~ unit
shall receiv~ a copy of the brochure from his
ar her landlard.
(h) M~etings. The Baard shall hold such
regularly scheduled meet~ngs as are necessary
to ensure the ti~ely performance of ~ts duties
under th~s Art~cie. All ~egular and special
meetings shall be ca~led and canducted in
accordancE with Sta~.e ].a~:.
(i) Quorum. Three (3) cammissianers
shall constitute a quorum for ~he B~ard.
(]) V~tinq. T'he affirmative vote of
three (3) Camr~issioners of ~he Board is
required for a decision, includ~ng al~
motions, regulations, and orders of th~ Board.

(k) Campensation. Each CommissionEr
shal~ receive for ev~ry meeting at~ended
seventy-five dallars ($75.a0}, but in no e~ent
shall any Commissioner rece~.~e zn any t~Telve
(12) month period r~ore than forty-seven
hundred and fif~y do~lars ($4,750) for
services rendered.
(1) Dockets. The Board shaJ.l maintain
and keep in its office ail hearing dackets.
(m) If a vacancy shall accur on the
Bnard, the Board shall ~,rithin thirty (30) days
appoint a qualified persan ta rill such a
vacaney unt~~ the follo~,~ing gen~ral mun~czpal
election wh~n a qualifi~d pers~n shall be
elected to serve far the remainder af the
term,
(n) Financing. The Board shall finance
its reasonable and necessary expenses by
charging landlords annual registrat~.on fees in
amour~ts deeMed reasonable by the Board. The
Board may direct that all ar part af such f~es
may be passed through from landlards to
tenants and may establish applicable
conditions and procedures. The Board is also
empowered to request and receive funding ~,~hen

and if necessary from any available source for
its reasanable and necessary expenses.
(o) Reca12. Commissioners ~ay be
recalled in accor~ance Y4r~th the provisions af
Article XI~' of the Santa I47~nica Charter.
{p) 5taff. Tha Board shaZl er~ploy
and pay such staff, including hearing
examiners and inspectors, as r~ay be necessary
to perforr~ its funct~on efficien~ly in order
to fu1fi11 the purpose af this Article.
(q) Registration. Uti~ithin sixty (60)
days af~ar the adoption of this Art~cle, the
Board shall require the registration of all
controlled rental units, ~~~hich shall be re-
registered at tir,3es deeried appropriate by the
Board. The ~nitial registration shall include
the rent in effec~ at the time on the date of
the adoptiion of this Article~ base rent
ce~J.ing, the address of the renta~ unit, the
name and address of the landlord, the housing
services prov~ded to the unit, a statement
indicating all operat~nq cost ~ncreases since
the base rent ce~ling date, and any ather
information deemed relevant by the Board. Th~
Board shal~ r~quire the ~andlord to report
vacancies in th~ controlled rental units and

shaZ3 make a list of vacant can~roZled rental
units available to the public. If the Board,
after the landlord nas proper notice and after
a hearing, ~~t~r~~nes that a ~and~ord has
wiltully and kna~ringly fai~ed to register a
controlled rental unit, the Board may
authorize the tenant of such a nan-registered
controlled rental unit to ~.ithh~ld all or a
porti4n of the r~nt for ~he unit until such
time as the rental unit is properly
r~gistered. After a rental unit is properly
registered, the Baard shall determine ~Jhat
portion, if any, of the ~~ithheld rent is o~,red
ta the landlord for the period ~n 4~hich the
rental unit ~~,as not properly r~g~stered.
Whether or not the Board alloGls such
withholding, no landlord who has failed to
register prope~-ly ~ha~l at any t~me increase
rents for a controlled rental un~t untzl such
units are properly registered.
(r) Decontroi. If the average annual
vacancy rate ~n any category, classification,
or area af con~rolled rental units exceed 5
percent, the Baard ~s empocaered, at ~ts
discretian and zn order to achieve the
objectives of this Artic~e, to re~rove rent

controls from such category, classification ar
area. 'The Board may determine such
categories, classirications, or areas for
purposes of d~control cons~stent ~•~~th the
objectiv~s of this Article. In determining
the vacancy rate for any category,
classification or area of controZled rental
units, ~h~ Board shali consid~r a1~ available
data and shall conduct ~ts a.an survey. If
units are decontrolled pursuant to this
Subsection~ controls shall be reimposed if the
Board finds ~hat the average annual vacancy
rate has thereafzer fallen bela~~ ~ pe~cen~ for
such ca~egary, classification or area.
(s) Security Deposits. Any paym~nt ar
deposit of maney th~ primary function of which
is to secure the performance of a rental
agreement or any part af sueh agreement,
including an advance payr~ent af rent, shall be
piaced in an znterest bearing accaunt at a
federally insured financaal institution until
such ta.me as it is returned to the tenant or
entitled ta be used by the landlord. Unless
and untll th~ Board enacts regulations
directing that the interest on such accounts
be paid d~rectly t~ the tenant, the landJ.ard

tenant or use lt ta offset ~p~rating expens~s,
in which case the offset sha].1 be a factor in
making individual rent adjustr-~ents under
Section 1805. The Board may r~gulate the

with the purposes of th~s Article and State
law.
(t} Removal of Controlled Unit frvm
Renta~ Housing Marke~.
(1} Any landlord ~JYlO desires to
remo~e a controlled rental unit fror~ the
rental hous~ng rlarket by der:~olitlon,
canversion or other m~ans is required to
obtain a perm~.t frar~ the Board prior ta such
removal fram the r~ntal housing market in
accordance with rules and regulations
promulgated by the Board. In order to approve
such a permit, the Board is required ~o find
that ~ne landlord cannot make a fair return by
retaininq the cantrolled rental unit.
(2} Not~~ithstanding th~ foregoing
provisions of this Subsection, the Board may
approve such a permit:
(i} If the Board finds that
the c~ntroll~d rental un~t ~s un~nhabitable

and is incapable of bei.ng made habitable in an
econom~.call.y feasible manner; ar
(iiy If the permit is being
saught so that the praperty may be d~v~ioped
with multifamily d:•relling units and the permit
applicant agrees as a cond~.tion of approva~,
that the units ~aill not be exempt from the
provisions ~f this Article pursuant ta Section
1801(c} and that at least 15 percent of the
eontrolled rental units to be built on the
site ~~~ill be at rents affardabl~ by persons
of low ~ncome.
(3) The Housing ~ler~~ent of the
General Plan of the City of Santa F~!onica shall
at a~l times contain a pravlsion tnat neither
the City Council nor any City agency shaZl
approve an applicatian for tentative
subdivision map or tentative parcel map for a
canverted unit until and unless the applicant
first obtains a removal permit as required by
this Section. This Subsectian sha11 no~ apply
to any tentative subdivision map ar tenta~ive
parcel map approved in accordance caith Article
XX relating to tenant o~•rnershap rights.
(~) Th~ Board sha11 render its
final decis~on 4:ithin one hundred and tE,renty

WHEREAS, the City Council of the City of Santa Monica has
called a Regular Municipal Election in the City of Santa Manica,

SECTION 3. The Registrar of Vvters is hereby authorized ta
canvass the returns of the Regular Municzpal Election which it is
hereby requested ta consolidate with the Statew~de General
Election and said electi~n shall be held in all respects as if
there were anly one election, and only one form af ballflt shall
be used.
SECTION 4. The Board of 5upervisors of the County of Los
Angeles is hereby requested to i.ssue a.nstructions to the

Registrar of Voters ta take any and all ~teps necessary for the
holding of the consolidated election.
~ECTION 5. The City of Santa M~nica recognizes that
additional costs shall be incurred by the County of Los Angeles
by reasan of this consalidatian and agrees to reimburse tha
County of Los Angeles for any such costs.
SECTION 6. The City Clerk is directed to transmit and file
a certified cogy Qf this Resolution ~ith the BQard of Supervisars
of the County of Los Angeles and to the Registrar of Voters.
SECTION 7. The City C~erk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

WHEREAS, a General Municipal Election is to be he~d in the
City of Santa Monica an Navember 3, I992.
WAEREAS, in the course of cond~ct of the election i~ is
necessary for the City Clerk t~ abtain the services of a
professional election supplier; and
WHEREAS, all necessary expenses in performing these
services shall be paid by the City of Santa Monica,
NOW, THEREFORE, THE CITY COUNGIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE, DECLARE AND ORDER AS FOLLOWS:
SECTION l. That the firm of Martin & Chapman Co., being a
sole source, is appraved to f~rnish to the City a11 necessary
services and supplies atithorized by the City Clerk to conduct
either a concurrent or consolidated election, consisting af the
following s~rvices:
1. Provide a Calendar of Election Events setting out dates
and requirements af the Election Code,
2. Pravide suggest~d forms of resolutions and notices
required for the e~ection.
3. Provide necessary ballots, supp~ies and instructions
far voting in the precinct and for absentee voting.
4. Provide Self-Mailer Sample BaZlot & Voters Pamphlet
with candidates statements, mea~ures and absent voter
application.

5. Prepare and attach special labe~s to 5elf-Mailer
pamphlet and arranq~ for delivary ta the past office.
6. Have a qualified person available by telephone or in
person at al~ tzmes to assist the City Clerk should
problems a~ise at any time during the election process.
7. Furnish general guidance throughout the election.
SECTION 2. That the City Shall pay Martin & Chapman Co.
for a1Z election supplies and services rendered. In the event
any eZection supplias requested by the City and furnished by
Martin & Chapman Co. are not correct, or contain errors so that
the same are nat acceptable to or usable by the City, there shall
be no charge therafore made upon zhe City.
SECTIDN 3. That Martin & Chapman Ca. shall submit an
itemized invoice to the City d~tailing the supplies furnished.
The City sha11 pay a~.l sums due and owing within 15 days of the
receipt of th~ statement,
SECTI~N 4. That ~.he total amount af these services shall
not exceed $I.00,00~.
SECTION 5. That the City Clerk shall certi~'y to ~he

This Supplemental Sta~f Report transmits an addit~onal
resolution relating to the November 3~ 1992 Municipal Election
for City Counci~ approval. The acco~panyzng resolution requests
that the Board of Supervisors of the County of Los Angeles
provide variaus elect~on related services ta the City including,
among other servic~s, the furnishing of a computer record of the
names and addresses ^f eligib~e registered voters in the City and
in thE School District and the Community Coll~ge District.

SECTION 1. Pursuant to Electians Code Section 22003, the
City Cauncil requests ~hat the Board of Supervisors af the County
of Los Angeles permit the Registrar of Voters to pravide the
fQllowzng s~rvices to the City to the extent d~termined necessary
by the City Clerk: (ly prepare and furnish to the Ci~y af Santa
Manica for use in conducting its Regular Municipal Election the
computer record of the na~es and addresses of eligible registered
voters in the City of Santa ~ionica and in the Santa Monica-Malibu
Unified School Distrzct and Santa Monica Community Callege
District lying autside the City of 5anta t~onica in order that the
City of Santa i~onica may print labels to be at~ached to
self-mailer sample ballot pamphl~ts; (2) furnish ~o the City of
Santa Monica p~inted ~ndices of the voters to be used by the
precinct baard at the poll~ng place; (3) ~ak~ availab~e ta the
City of Santa Monica additional electipn equipment and assistance
according ta stat~ la~T; and (4) such ather services as may be
provided and deemed necessary to reduce the expense and
administrative burd~n of the election.
SECTION 2. The Ci~y of San~a rionica shall reimburse the
County of Los Angeles for serv~ces performed when the work is

comp~eted and upon presentation to th~ Cz~y of Santa Manica of a
properly appraved bill.
SECTION 3. The City Clerk is direct~d to forward withou~
delay ta the Board of Supervlsars of the County of Los Angeles
and ta the Registrar of ~~oters a certified copy af this
Resolution.
SECTION 4. The C~ty Gl~rk sha1~ certify to the adoptian of
this Resolution, and thenceforth and thereafter the same shall be
in full force and eff~ct.
