INTRODUCTION
Thls report transmits for City Council approval a Flnal Map for the
following Tenant-?artlclpatlng Conversion project:

BACKGROUND
The C1ty Planning Corrm1SSlon approved the Tentatlve Map and the Ten-
ant-Partlc1pating ConverSlO~ for the above proJect on May 4, 1994:,
after a publlc hear1ng and a careful review of the record and sta=f
recommendat~ons. The act10n of the Planning CommlSSlon was based
on the Commission I s flndlngs that the proposed Tenant-Part1clpating
Conversion meets the requireMents of Art1cle XX of the City Charte~
and that the proposed subdivision is cons1stent with applicable
general and specif~c plans as adopted by the C1ty of Santa Monica
along w1th all mandatory requirements of the Subd1vision Map Act of
the State of Callfornia.
The owners have subm1tted ~o the C1ty a Written Consent Agreement
binding the owners and any successors lD interest LO each condltlon

imposed in connec~ion W1t~ approval of thlS Tenant-Partic1pating
Convers1on. This ~'iTr1tten Consen.1: has been approved by the Clty
Attorney and the Clty Manager. Each part1cipatlng tenant has been
informed in wrlt1ng of h1S or her r1ghts under Article XX of the
Ci ty Charter. The L1cense Dlvlsion reports that proper arrangements
have been made to e~csu::::-e payP1.ent of the Tenant-Part1cipatir.g
Conversion Tax.
The Final Map conforms to the Tentatlve Map. The =ir.al Map has been
certified by the Clty Eng1neer for conformance wlth the Tentative
Map and CO!ld:.tlons thereon I the Subd1vision Map Act and local
ord1nances. The C1ty Attorney's offlce has approved a Declaration
of Covenants, Conditions, and Restr1ctionsl o~ equlva~ent docuwent,
for th1s proJect as complY1ng w1th the condit1ons of the Tentative
Map and the Tenant-Particlpatlng ConverSlon.
Council approval of a f1nal map for a Tenant-Part1c1pating
Conversion represents one of the last steps necessary in the
conversion process. Following C:.ty Council actlon and approval by
the Ca11fornla DeparLment of Real Estate the app11cants may begin
selllng their un1ts to the tenants. As each urn t is sold a
converS1on tax per Section 2008 of Article XX 1S due 1n an amount
equal to twelve tlIDes the monthly maXlmum allowable rent for that
unlt. These taxes wlll be used to assist low and moderate income
households to purchase or improve their un1ts subject to affordable
repayment per Section 2009 of Article XX

BUDGET/FISCAL IMPACT
The recommendatlon presented ln thlS report does not have an immedi-
ate budget or flscal lmpact. If and as unlts In the project are
sold In the future, Tenant-Participating Converslon Taxes will be
collected pursuant to the prov1s1ons of Ar=lcle XX of the Clty
Charter and some lDcreased property tax revenues may be generated.
RECOMMENDATION
It is respectfully recommended t2at the Flnal Map for thlS Tenant-
particlpating ConverSlon be approved by adoptlon of the accompanYlng
resolutlon.

A FINAL SUBDIVISION MAP FOR TRACT NO. 51855
AT 2233 FOURTH STREET
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map for Tract No.SI8SS 1n the C1ty
of Santa Mon~ca hereby lS accepted and approved.

directed to endorse upon the face of sald Map this order
authenticated by the Seal of the City of Santa Monica.
