Every three years, new editions of ~.he various uniform technical codes are pro~nulgated and published by the delegated conferences of regulatory officials and subsequently adapted by the State of California and local jurisdicti~ns as req~ired by state Iaw. These codes govern the method of building construction within the City. , 1 ' . ,~ ~ ~ ~ 2 8 #995 This staff report recommends adopting the 1994 editions of the Codes, along with amendments to the Codes previously appraved by the City Cauncil. A resolution making findings of local conditions is necessary to adapt the local amendments. Additionally, new standards are recammended relating to the inspection and repair of steel frame buildinqs, building permit terms, and minor technical adjustments. BACKGR~UND The foilowing are local amendm~nts to the unifarm technical cades. Most are identical ta the prev~ous local amendments made by the City in approving the 1991 and earlier editions of these codes, or have been recently adopted by ordinance by the City Council and are naw being ~ncluded in the uniform technical codes. Accarding ta State law, local amendments to th~ codes are required to be based on findings that "such changes are reasonably necessary because of laca~ climatic, geo~agica2 ar topagraphical cvnditions" ~n the C~ty. A resolution is attached ~ox adaption making those findings. The new issues befare the Counci~ far adoption inc~ude the requirement for steel frame building retrafitting, and the establishment of building permit terms, both discussed in more detail below. 2 REORGANIZATION OF CODES As part ~f the adoption of the 1994 uniform technical codes, the Ordinance is being reorganized in order to make the local amendments follow the section they amend. Staff believes this will clari~y the Ordinance and allow for better understanding and interpretation of the local amendments. This rearganizatian includes r~numbering of the sections. Some local amendments ha~e also been deleted because they are now included in the uniform technical codes. In addition, the Fire Sectian has been reorganized based upan the recent council actian on the integrated sprinkler ordinance to clarify chang~s and remove outdated requirements. ADMINISTRATION CODE AMENDMENTS It is recommended that the Uniform Administrative Code be amended for local conditions in the following three areas: o Boards of Appeal o Building Permit Terms ~ Permit Faes Boards o€ Appeal The City of Santa Monica has a number of unique Zocal conditions related to seismic activity and fire hazards that are out~ined in detail below. Du~ to the unique cond~tions in the City, it is necessary to amend the Administrative Code section relating to Boards of Appeal to ensure reasanable interpretation af the Cades for the City of Santa Monica and establish appropriate appeals and 3 advxsory boards. The City has the following appeals and advisory boards per this amendment: the Building and Safety Commission, Accessibility Appeals Board, Electrical Appeals Baard, and Plumbing/Mechanical Appeals Boaxd {see Section 8.04.02Q.020). Bui~c3ing Permit Terms The City has experienced a number of situations where minimal construction raork is perfarmed under a building permit, and completion of the project stretches over a period of years. This practice raises a number of concerns. In addition to neighbors af such sites being impacted by canstructian activity, by safety issues associated with construction sites, and by aesthetic impacts aver a long time period, both building and planning codes may have changed since the permit was issued due to unique local conditions, resu~ting in concerns about public safety and consistency with community planning abjectives. For example, as a result of the 1994 earthquake and the threat of seismic activity in the City as described in detail below, technical changes to the building code have been and will be made; older permits wauld not be impacted by these code changes, Similarly, evolution of the planning reg~lations is an angoing process, and older permits are sometimes inconsistent with currer-t city policy addressing unique local conditions. 4 To address these issues, staff has incorporated regulations which establish maximum time periods allowed to complete construction, with varying time p~riads based on permit valuation {see Sectian 8.04.020.030). This approach is modeled on that used in San Francisco's building code. The City of Irvine also uses this type of approach for residential remodeling prajects, and staff has incorparated some features of Irvine's reguZations. The recommend~d time periods vary. Projects with higher permit naluations are allocated longer time periods to complete construction. In addition, thr~e extensions af the time periads may be granted by the Building Official, providing additional flexibility to addr~ss special situations. Permit Fees Permit fees wi2~ no langer be set as part of the uniform technicaZ cades, but instead will be set by separate resolution. Updated fees were recently adopted on February 28, Z995 by the City Council, and no changes to that fee structure are recommended at this time {See Sectian 8.04.020,050). FIRE $AFETY The amendments to the Unifar~ Building Code for Fire Safety and Prevention Requirements, and ~ire safety Duties and Procedures, are necessary for a number of unique iocal conditions. These conditions include the following: 5 o The Safety Element of the General Plan, adopted in January, 1995, shows the high risk of seismic activity in the City due to the ciose proximity of the City to the Santa Monica-Malibu Coast fault, the Newport-Inglewaod faul.t and the San Andreas fault. The Safety Element discusses the damaging effect local. seismic activity would have an street, raadways and overpasses at the Santa Monica Freeway which wot~ld hamper and delay e~nergency vehicle response. o The Safety Element also identifies that many af the structures in the City are older structures which are prone to the quick spread of fire from adjacent structures due to the ~ateriais used ir~ eonstruction anc~ less stringent fire resistant technology available at the time they were built. o The Master Environmental Assessment (MEA), adopted in September, 1993, shows that Santa Monica's climate is primarily influenced by the Pacific Ocean and is characterized by infrequent rainfall and winds which come from the west during the daytime and from the north and northeast during the nighttime, with intermittent Santa Ana winds accurring from September to March. These canditions create the potential foar high velocity winds with high temperatures which are conducive to uncontrolled wind driven fires. o The MEA also shows that structures in the City are situated in close proximity to each other, with only about l~ of the 8.3 square miles that th~ City occupies ~acant. In addition, these lots are often very narrow or an hil~y terrain, which limits access to side yards for fire suppression and placement of ladders for rescu~ operations. These conditions increase the threat to life and property and cantributes ta the ability of ~ires ta spread quickly between buildings because of their proximity to each other. o Analysis of the eme~gency response to the January 17, 1994 earthquake shows that the need for emergency fire services in the City greatly exceeded the available resources of the Fire Department and ther~ remains the significant possibility that multiple fires fallowing a future earthquake will exceed th~ available resources af the Fire Departmen~. In order to address these climatic, topographical and gealogical canditions that places demands on emergency services, the City has 6 adopted Supplemental Fire and Sa~ety Prevention Requir~ments for a number of years, and recently expanded the f ire spr~nkler requirement to apply to all new construction. Based primarily upon an 1988 Attorney General's Opinion, thare has been some ambiguity regarding a city's ability to adopt fire and panic safety requirements more stringent than thase adopted by the Stat~ Fire Marsha~, even when findings regarding local conditions could b~ made. Legislation was adapted in 1990 to attempt to resolve this ambiguity (Health and Safety Code Section 13143.5). While clarifying a city's xight to regulate more stringently with resp~ct to fire and panic safety in general, unfortunately the legislation specifically left open the question whether such local authority includes the right to mandate installation of residentia~ fire sprinkler systems within newly constxucted dwelling units (Section 13143.5(by). Litigation regarding the issue has occurred at the tria~ court level, and different caurts have reached different resuZts. Sometimes ordinances mandating the instaZ~ation of residential fire sprinkler systems have been sustained; sometimes they have been aver~urned. The City of Livermore~s residential sprinkler ordinance was recently upheld by the Alameda County Superior Court, and an appeal is pending. This case is being watched closely by numerous ~urisdictions across the State. 7 These fire sprink~er amendments are necessary because in thE event of an earthquake or other major disaster, the Fire Department wi11 be forced ta depend on built-in fire suppression systems ta extinguish or limit fires in those structures so that they da nat spread to the older structures thereby reducing the potential demand from simultaneous incidents an emergency services resources. The following are the local amendments: o Require automatic fire extinguishing and detection systems in all new construction and when there is a change in use to a higher classification (S~e Section 8.04.040.020). o Require fire access in new high rise bui~dings with human accupancy above 55 feet of th~ highest fire vehicle access point (See Section 8.04.040.020 Da.vision 3.a2}. o Require stairway aecess ta the raof for new bu~ldings with four or more stories to ensure safe escape routes in case of a flr2 (See Section 8.04.040.020 Division 3.~3). o Require fire safety procedures, like fi.re alarm systems, fire safety doors, appropriate signage, and evacuation procedures in existing non-residential buildings, and existing buildings used as hotels, apartments, or lodgzng houses with fl.oars more than 30 feet above fire department access (See Section Divisian 3.04). o Require fire safety pracedures, like partial automatic fire sprinkler systems, and automatic shutoff of mechanical systems, and smoke detectars, for existzng non-residentia]. buiZdings, hoteZs, or apartmen~s with floors more than 55 feet above fire department access (See Section 8.04.040.020 Divisian 3.05). o Require automatic fire sprinkler systems far existzng public assembly spaces above 5,OQ0 square feet that protects assembly areas and exit ways (See Section 8.04.040.020 Divisian 3.06). a Require the cannection with control val~es on each floor level with full automatic sprink~er systems in any new building with f~aors more than 55 feet in height (See Sec~ion 8.04.040.020 Division 3.07}. 8 o Require the locatian of sprinklers in any room that apEns directly into the exitway in partial automatic sprinkler systems (See Section 8.44.040.02a Division 3.08). v Require smoks detectars in every dwelling unit or guest room in a hotel, apartment, or lodging house used for sleeping purposes (See Section 8.04.040.020 Division 3.12). o Aequire Class II standpipes in buildings three stories in height or greater (See Section 8.04.040.020 Division 5.00}. o Prohibit the use of non-fire retardant woad shingles or nan-fire retardant wood shakes for new or replacement roofing (See Section 8.04.040.020 Di~ision 6.Q0). The sections requiring a permit to install, remove or modi~y any flammable or cambustible liquid tank and requiring attic draft stop fixtures have been deleted because they are now part of the uniforrt codes. SEI3MIC SAFETY The following amendments to the Seismic Safety provisions of the Unifo~m Building Code have been previously adopted by the City Council. Amendments related to steel frame buildings however are naw availab].e and required far adoption. In reviewing the damage to buildings in the City resulting fram the January 17, 1994 Northridge earthquake, staff identified impravements that needed to be made to building codes in order to strengthen specific types of buildings that sustained cansistent damage. Working closely with the Bui~ding and Safety Commission, s~aff prepared ~n emergency ordinance containing specific standards 9 ~or the repair and retrofitting of a variety of potentially hazardous structures, including the following types: o Unreinforced masonry structures (URM's}; o Soft-story construction o "Tilt-up" pre-cast concrete buildings o Nan-ductile/reinforced pre-cast concrete frame bui~dings. In developxnq these recammendations, staff reZied extensively upon the expert~se and recommendations of the Building and Safety Commzssion, which continues to ana~yze the City's polici~s for improvement. These standards were adopted by the City Council in ordinance #1748 in June, 1994. The reenactment of these previous amendments ta the Uniform Building Code for Seismic Safety plus the new provisions for steel frame structures are n~cessary due to a number of unique local conditions. These conditions include the fo~lowing: o The Safety Element identifies certain serious genera~ community safety problems caused by the number, size, location and present use of unreinforced masonry, precast concrete, sof~ story, tilt-up, and steel frame potentially hazardaus buildzngs. The Safety EZement shows the high risk of seismic activity in the City due to the close proximity ta the Santa Manica-Malibu Coast fault, the Newport-Inglewaod fault and the San Andreas fault, and discusses the damaging effect ~~cal seis~ic activity would have on these potentially ha2ardous buildings and the related potential demands on emergency services needs, since these building structures perform poorly during ground shaking are susceptible to extensive damage and a threat ta the public safety. o The Safety Element alsa identifies shallow ground water within 50 feet of the graund surface along the beach, near the industrial corridor and Marine Park areas of the City. This graund water condition, coupled with 10 unconsolidated youthful sedimentary soils, makes these areas susceptible to possible liquefactifln during strong or moderately strong earthquakes. Liquefaction is a very destructiv~ secandary effec~ of strong seismic shaking where a loss af bearing strength occurs alang with ground oscillations in the supporting soils. o An anaiysis of damage patterns to structur~ in the City due to the January 17, 1994 Northridge earthquake and its aftershocks i.n the staff report adopting the Hazardous Buil.ding Standax-ds amendments to the building CQdE showed that unreinforced masonry structures, portions of soft story structures, tilt-up can~rete buildings pre-cas~ and reinfarced non-ducti~~ cancrete stx-uctures, and steel frame structures were more susceptible to damage ~han other '~ypes of structures. o During the Northridge earthquake, numerous unsecured water heaters throughout the City broke loose from their fittings, same thereby rupturing gas and water ~ines. This condition presented an immediate fire hazard at a time when Fire Department resources were already in significant demand, thereby creating a patential delay in responding to the hazard. In order to address thes~ climatic, tapographical and geological conditions that place demands on emergency services and pose substantial risks to public health, safety, and welfare, it is necessary to reenact previous amendments to the Uniform Building Code in the following manner: o Establish long range retrofitting requirements for pre- 1933 unreinforced masonry (i7RM) buildings (See Section 8.04.04~.030~. o Establish Seismic Hazard Zones and Geologic Hazard Filled Area Zones to require special design requirements (See Section 8.04.100). o Establish standards for the repair, recnnstruction and reinforcement of [TRM buildings (See Sectian 5.04.04.04fl) . o Establish standards for the repair, reconstruction and reinforcement of potentially hazardous structures, including soft story construction, tilt-up bui~dings, and 11 non ductile reinforced cancrete and nonductile pre-cast concrete structures (See Section 8.04.04a.a50). o Require the bracing of water heaters prior to any sale ar in cannectian with any building permit or inspection by the City (See Section 8.fl4.040.060 Division 6.00). a Require that when criticai facilities in the City are damaged in excess of twenty-five thousand dollars as a r~sult of a natural disaster they will be shall be analyzed, designed, repaired and upgraded to the same design and performance standards app].icable to an essential ~acility in compliance with the Unifarm BuiZding Code (See Section 8.0~l.U40.060). Steel Frame Additionally, this Ordinance cantains new provisions for steel frame structures (See Sectian 8.04.440.050 Division 6.50). Subsequent additional analysis of damage patterns due to the 199~ Northridge Earthquake by the City's Building and Safety Commission shaws that the earthquake caused severe damage to ths connections of some steel-frame buildings. The full extent of such damage is difficult to assess due ta th~ fact that damage ~s often nat directly observable, but is concealed and discovered only when steel members are expased. However, analysis of some steel framed buildings has shown that "concealed" damage to these types of buildings has been greater than initially thought after the earthquake. Ordinance 1748 identified steel frame buildings as potential~y hazardous structures, but did nat set standards for the inspection or repair of these buildings. 12 To addr~ss the potential hazards in steel frame buildings, the Federal Emergency Management Agency (FEMA) funded the SAC Joint Venture to provide policy direction in the area af ste~l frame buildings. The SAC Joint Venture refers to joint publications of the following groups: o structural Engineers Assoeiation of California o App~ied Technolagy Council o California University~s for Research in Earthquake Engineering The SAC report 95-02, FEMA pub~icatian 267, is the result of this joint venturer and provides practicing engineers and building officials with ~nformation related to the inspectian and repair of steel frame buildings. On May 8, ~995 the Santa Monica Building and Safety Commissian recommended an additian to Ordinance #1748 in order to require engineering evaluations of steel framed buildings using this report for inspection and repair guidelines. SpecificaZly, the amendment to the Ordinance would require the following: o Within 275 days af the date of natice, the owners of any steel frame structures shall submit an engineering evaluation report by a registered Structural Engineer ~o the Building and Safety Division. o If the structural report concludes that the building does not conform with the standards of the SAC report, or if other significant damage is found, the bui~ding sha~l be repaired according to the schedule in Division 7 of the Ordinance, depending upon the occupancy of the building. 13 It is estimated that there are less than 50 steel-frame structures throughout the City that would be subject to this pravision of the Ordinance. The purpose of the proposed new standards is to significant~y reduce potential damage from future earthquakes by addressing steel fram~ buildings which the Janua~y 17, 1994 earthquake has shown to be susceptible to significant earthquake damage, and which current City code standards do not adequately address. By adopting these standards, the City may help to reduce hazards as well as significantly lessen the devastating economic impact of ~uture earthquakes. In additian, the praposed amendment tv Ordinance #1748 includes language clarifying the engineering report r~quirements for Non Ductile Reinforced Concrete and Nan Ductile Pre-Cast Cancrete Structures. This technical amendment does not change the timing requirement for submitting a report an these typas of buildings, which is 275 days from receipt of ~otice. There are approximateZy 70 Non Ducti~e Reinforced Concrete and 15 Non Ductile Pre-Cast Concrete buildings. SANTA M~NICA CONSTRUCTION PROPERTY MAINTENANCE REQIIIREMENTS Unique local conditions in Santa Monica require an amendment to the Uniform Building Code in arder to address issues that are not included in the Cade, including: 14 o The Safety Element shows th~ high risk of seismlc activity in the City due to the close proxi~ity of th~ City tQ the Santa Monica-Malibu Coast fault, the Newport- Inglewoad fault and the San Andreas fault. These conditions are suitable t~ ~he development of backyard paols in the City, which can lead health and safety risks if not properly fenced. The Uniform Building Code daes r~ot address such issues related to po~ls. o The Master Environmental Assessment (MEA), adopted in September, 1993, shows that Santa Manica's c~imate is primarily in~luenced by the Pacific Ocean and is characterized by infzequent rainfall and subject to daytime breezes from the w~st and Santa Ana w~r~d canditions from Sept~mber to March. These conditians are susceptible to transporting airborne particulates, including those accurring from sandblasting aperat~ons, which can lead health and safety risks if nat properly regulated. o The MEA shows that structures in the City are situated on lats that are aften very narrow or on hilly terrain, which can create drainage hazards from adjacent properties. These conditians increase the threat to life and property, unless adequate drainage systems are required. In order to address ~hese climatic, top4graphical and geologzcal conditions that place demands on emergency services and pose substantial risks to public health, safety, and welfare, a~ong with conditions autlined abave related to local fire canditions, it is necessary ~o reenact previaus amendments to the UniParm Building Code in the followir~g mann~r: 15 o Requ~re appropriate house numbering in order for emergency services to quickly and efficiently respand to disasters (see Section 8.04.040.060 ~ivisian 1.00}. o Require proper drainage regulations for roofs and developed properties, including yards, caurts, pools and parking to ensure proper drainage and reduce impacts to immediate and adjacent properties from flooding (s~e S~ction 8.04.040.060 Division 2.OD}. o Require adequate fencing around paols or other badies of water to ensure safety of children and adults (see 5ection 8.04.040.d60 Division 3.Q0). o Regulate the use of temporary trailers by requiring a permit which ensures their temporary use and not as a p~rmanEnt r~sidence (see Section 8.04.0~0.060 Diviszon 4,00) . o Require a sandbiasting permit fnr any sandblasting work to be done to ensure proper construction activities and limi.ted hours of use {see Section 8.04.p40.060 Divisian 5.00) . The QualiFication and Maintenance certificate section has been e~iminated since these requirements are now adequately covered by State requirements. ELECTRICAL GODE AMENDMENTS The reenactment of local amendments to the Electrical Code are necessary for a number of unique local conditions. These conditions include the faZZowing: o The Nationa~ Electrical Code does nat address electrica~ safety requirements for non--construction related electrical equip~ent, including partable electrical equipment and machinery. The unregulated use af such equipment poses a potential safety hazard to citizens and praperty in Santa Monica by increasing the risk of fire. 16 o The Electric Board of Appeals has approved safety standards for the use of electr~cal appliances, devices, materials and equipment, and has cansidered Iocal problems caused by the improper use of non-metallic sheated wiring and ~se af alvmin~m alloy conductors in sizes smaller than No. 6. Experience of field inspection personnel has shown that certain specific uses of aZuminum based conductors and non-meta~lic sheated wiring has caused ar led to potentially hazardous and nuisar~ce elactrical wiring installations. Based upon the local conditi.ons outlined above, along with the local conditions related to f ire risk detailed earlier in the staf f report, it is necessary to reenact Iacal amendments ~o the electrical code to ensure fire safety and prevent accidents from electrical procedures and appliances. The local amendments inc~ude tha following: o Ensure that any wiring n~t having metal protection over the conductors shall be entirely concealed within the buiiding structure ta prevent and inhibit tampering and restrict the use of aluminum wiring found to be hazardous (see section s.o~.o5o.oao). o Pr~vide the sale and use af any electrical material, device, or equipment unless they comply with provisions af this sectian, including rating and confa~mance with natio~al standards (see Section 8.a4.o50.~30). PLUMBING REQEIIREMENTS The reenactment of local amendments to the Plumbing C~de are necessary for a number of unique local conditions. These conditians include the follawing: o Santa Monica is situated in Southern Cal.ifornia which has extreme arid conditions and periods of severe drought. As outlined in the MEA, the City relies upon water from outside the region which is bought from the Metropolitan 17 Water District, and local groundwater for the City's water supply. Severe draught conditions and potential uncertainty about the availability of future water supplies from autside the regio~ require the proper management of available water supplies. Based upon the local canditions outiined above, along with the loeal conditions ralated ta fire xisk detailed ear~ier in the staff repart, it is necessary ta reenact l~cal amendments to the Plumbing Code to reduce consumptian of scarce raater resources and ensure fire sa~ety by preventing accidents from pressure gas systems and preserving local water supplies. The lacal amendments include the following: o Require initia~ approval and more thorough inspection of medium pressure gas installation to prevent potentially hazardous and confusing systems for em~rgency services which could result a.n fire hazards if not properly insta~led (See Section 8.04.09Q.020). a Require that any new construction, remodel or addition shall insta~l anly ultra-low flush fixtures in order ta reduce the cansumption of scarce water resources (see Sectiqn 8.04.090.030}. MOBILE HOME PARRS Pursuant to Health and Safety Code SectiQn 1830a the Ci~.y may assume the responsibility for the enforcement of state building standards relating to mobilehome parks, and on November 11, 1961 the City Council adopted Resolutian # 2535 by which the City assumed this responsibility. This Ordinance reenacts that provisian (SeE Sectian 8.04.11Q). 18 BUDGET/FINANCIAL IMPACT There is no budget and financial ~mpact to the City of Adopting the 1994 Uniform Codes and lacal amendments. Hawever, as a resuit of the new c~de standards for steel frame buildings, tha appraval af this ordinance may increase costs to repair certain strucGures including City-owned structures. Federal and/or State reimbursements may be available if compliance with the new standards would increase the cost of repairing damaged City structures. The specific casts and cost sharing arrangements for City structure repairs which might be mandated by the new standards are not known at this time. However, tha Council will have the npportunity to review such costs and cost sharing arrangements if repair contracts are needed. RECOMMENDATI~N It is recommended that the City Caunci.l take the following actions : o Adopt the attached resolutian making findings of local. climatic, geological and topographical cpnditions in arder to adopt loca~ amend~nents to the Uniform Codes o Introduce for first reading the attached ordinance adopting the 1994 editions of the Unifarm Codes related tq building canstruction and local amendments thereto, including new standards for the inspection and repair of steel frame buildings, building permit terms, and technical amendments. With respect ta the need far amended or supplemental Fire Safety and Preventa.on Requirements, and Fire and Safety Duties and procedures, the City Counci~ ~uakes the follawing findings regarding local c~imatic, qeologica~, and topographical conditions: (a) The Safety Element of the General Plan, adopted in January, 1995, shows a high risk of seismic activity in the City due to the close proximity of the City to the Santa Manica-Malibu Coast fault, the Newport-Inglewaod fault and the San Andreas fauZt. The Safety E~ement discusses the damaging effect lacal seismic activity would have on street, roadways and overpasses at the Santa Monica Freeway which would hamper and delay emergency vehicle response. {b) The Safety Element also identifies that many of the structures in the Cit~ are older structures which are 2 prone to the quick spread of fire from adjacent structures due to the materials used in construction and less str~ngent fire resistant technology available at the time they were built. (c} The Master Envi~onmental Assessment (MEA), adapted in September, 1993, shows that Santa Monica's climate is primarily influenced by the Pacific Ocean and is characterized by infrequent rainfaJ.l and winds which come from the west during the daytime and from the north and northeast during the niqhttime, with intermittent Santa Ana winds accurring from September to March. These conditions create the potential for high velocity winds with high temperatures which are conducive to uncontralled wind driven fires. {d) The MEA also shows that structures in the City are situated in close proxim~ty to each other~ with only about 1~ of the 8.3 square miles that the City occupies vacant, In addition, these lots are often very narrow or an hilly terrain, which limits access to side yards for fire suppression and placement of ladders for rescue operations. These conditions increase the threat to life and property and cQntributes to the ability of fires ta spread quickly between buildings because af their proximity to each other. 3 (e} Analysis af the emergency response to the January l7, 1994 earthquake showed that the need far emergency fire services in the City greatly exceeded the available resources of the Fire Department and that there remains a significant passibility that multip~e fires fol~awing a future earthquake will ~xceed the available resources of the Fire Depart~ent. (f) Based upon these ~ocal climatic, geological, and topographical conditions which create fire hazards and inhibit fire safety response access and respanse time, it is reasonably necessary to re-adopt pre~ious amendments to the unifornt codes in the following manner: (i) Require autvmatic fire extingu~shing and detection systems in al1 new construction and when there is a change in use to a higher classification so that in the event of an earthquake or other major disaster, the Fire Department may depend on built~in fire suppression systems to extinguish or ~.imit fires in those structures so that fire does not spread to older structures. This will reduce the potential demand from simu~taneous incidents on emergency services resources. 4 f (ia.) Requ~re compla.ance with high rise requirements in buildings with human occupancy over 55 feet above the highest fire vehicle access point to enhance such b~ildings' fire safety and reduce the risk of fires in such buildings spreading to other structures. (iii) Require stairway access to the roof for new buildings with four or more stories to ensure safe escape routes in case af a fire. (iv} Require fire safety procedures, like fire alarm systems, fire safety doors, appropriate signage, and evacuation procedures in existing non- residential buildings, and existing buildings used as hatels, apartments or lodging houses, with floors more than 30 feet above fire department access, to enhance such buildings' fire safety, protect accupants, and reduce the risk that fires in such buildings will spread ta other structures. (v} Require fire safety procedures, like partia~ automatic fire sprinkler systems, automatic shutoff of inechanical syste~s, and smoke detectors, for existing non-residential bua.ldinqs, hotels, or apartments with floors more than 55 fe~t above fire 5 • department access to enhance such buildings~ fire safety, protect occupants, and reduce the risk that fires in such buildings will spread to other structures. {vi~ Require automatic fire sprinkler systems for existing public assembly spaces larger than 5,D00 square feet to protect assembly areas and exit ways. (vii) Require in any new building with floors more than 55 feet in height, connection with control valves on each tloor ievel with full automatic sprinkler systems to enhanca such bui~dings ° f ire saf ety by ensuring adequate de~ivery of required water supply. (viii) Require sprinklers in any room that opens directly ~nto the exitway in partial automatic sprinkler systems to protect occupants by ensuring access ta exitways. (ix) Require smoke detectors in every dwelling unit or guest rovm in a hotel, apartment, or ladging house used for sleeping purposes, ta enhance their fire safety, protect occupants, and reduce the risk that 6 fires ~n such buildings will spread to oth~r structures. (x) Require Class II standpipes in buildings three stories in height or greater to enhance their fire safety by ensuring adequate water supply to the fire department in event of fire. {xi) Prahibit the use of non-fire retardant wood shingles ar nan-fire retardant wood shakes far new or repiacement roafing to reduce the risk of rapid spread of fire between adjacent buildings, SECTION 2. With respect ta the need for amended or supplemental Seismic 5afety Requirements, the City Cauncil makes the following findings regarding lacal climatic, gea~~gica~, and topographical conditians: (a) The Safety Element identifies certain serious general community safety problems caused by the number, size, locatian and present use of unreinforced masonry, precast cancrete, saft story, ti~t-up, and steel frame patentially hazardous buildings. The Safety Element shaws a high risk of seismic activity in the City due to the close proximity to the Santa Monica-Malibu Coast fault, the Newpart-Inglewoad fault and the San Andreas fau~t, and discusses the damaging effect Iocal seismic 7 activity would have on these potentially hazardo~s buildings and the related potential demands on emergency services needs. These structures perform paorly during ground shaking, are susceptible ta extensive damage, and therefore pose a threat to the public safety. (b) The Safety Element also id~ntifies shallow graund water within 50 feet of the ground surface alang the beach, near the industrial corridar and Marine Park areas of the City. This ground water condition, caupled with unconsolidated youthful sedint~ntary soils, makes these areas susceptible to possible liquefactian during strong or moderately strong earthquakes. Liquefaction is a very destructive secondary effect of strang seismic shaking where a loss af bearing strength occurs along with ground ascillations in the supporting soils. (c) An analysis af damage patterns to structures in the City fram the .7anuary 17, ~994 Narthridge earthquake and its aftershocks, as contained in the staff report adopting the Hazardous Building 5tandards ordinance {Drdinance 1748(CCS)} showed that unreinforced masonry structures, portions of soft story structures, tilt-up structures, non--ducti].e pre-cast concrete buildings, non-dt~ctile reinforced concrete structures, anci steel frame structures were more susceptible to damage than ather 8 types af structures. (d} Durinq the Northridge earthquake, numero~s unsecured water heaters throughout the City broke loose from their ~ittings, some thereby rupturing gas and water lines. This condition presented an immediate fire hazard at a time when Fire Department resaurces were already in significant demand, thereby creating a potential delay in responding to the hazard. (e) These climatic, topographical and geological conditions place demands an emergency services and pose substantial risks to public hea~th, safety, and welfare. It is therefore reasanably necessary to re-adopt previous amendments to the Uni~orm Building Code in tha following manner: (i) Establish long range retrofitting requirements for pre-1933 unreinforced masonry (URM} buildings. (ii) Establish Seismic Hazard Zones and Geologic Haaard Zones ta authorize special design requirements for canstruction in such areas. (iii) Establish standards for the repair, reconstructian and reinf~rcement of URM buildings. 9 _ . (iv} Establish standards for the repair, reconstruction and reinforcement of potentially hazardous structures, inc~~xding soft story canstruction, tilt-up buildings, and non ductile reinforced cancrete and non-ductile pre-cast concrete structures. (v) Require the bracing of water heaters prior to any sale or in connection with any building permit or inspection by the City. (vi} Require that when critical facilities in the City are damaged in excess of twenty-five thousand dollars as a result af a natural disaster they wi21 be anaiyzed, designed, repaired and upgraded to the sa~ne design and pertormance standards applicable ta an essential facility in compliance with the Uniform Building Code. (f) Subsequent add~tional analysis af d~mage patterns hy the City's Building and Safety Commission due to the 2994 Northridge Earthquake shaws that the earthquake caused severe damage to the connectians af some steel-frame buildings. The ~'ull extent of such damaqe is difficult to assess due to the faet that damage is often not directly observable, but is concealed and discovered only 10 when steel members are exposed. However, analysis of some steel framed bui~dings has shown that "concealed" damage to these types af buildings has been greater than initially thought after the earthquake. (g) To addr~ss the potential ha~ards in steel frame bui~dings, the Federal Emerqency Management Agency {FEMA} funded the SAC Joint Venture to provide policy directian in the area of steel frame buildings. SAC repart 95-02, FEMA publicatian 267, is the result of this joint venture, and provides practicing engineers and building officials with information re~ated to the inspection and repair of steel frame buildings. (h) On May S, 1995 the Santa Monica Building and Safety Commission recammended an addition to Ordinance,~1748 an order to require engineering evaluations of steel. frame buildings using the SAC report for inspection and repair guidelines. (i} Based on the foregoing, an amendment to the uniform cades is reasanably necessary to accomplish the following: (i) Within 275 days of the date of notice, the owners of any steel frame ~tructures shall submit an engineering evaluation report by a registered 1~ Structural Engineer t~ the Building and safety Divisian. (ii) If the structural report cancludes that the building does not conform with the standards of the SAC report, or if other significant damaqe is found, the building shall be required to be repaired accarding to a schedule dependent upan the occupancy rating of the building. SECTION 3. With respect to the need for amended or supplemental Construction Property Maintenance Requirements, the City Council makes the fallowing findings regarding lacal c~imatic, geolagical, and topographical conditions: (a) The Satety Element shows a high r~sk of seismic activity in the City and idantifies that many of the structures in the City are older structures which ara prone to tha quick spread of fire from adjacent structures as described in Sections 1 and 2 above. (b) The Master Environmental Assessment {MEA), adopted ~n September, 1993, shows that Santa Monica's climate is primarily influenced by the Pacific Ocean and is characterized by infrequent rainfaZl and mild temperatures. These conditions are suitable to the development of backyard pools in the City, which can lead 12 health and safety risks if not properly fenced. The Unifarm Building Code daes nat address pool fencing. (c} The Master Environmental Assessment (MEA), adopted in September, i993, aiso shaws that Santa Monica's climate is subject to daytime breezes from the west and Santa Ana wind conditions from September to March. These conditions are conducive to trar~sportation of airborne particulates, including those occurring from sandblasting operations, which can lead to health and safety risks if not praperly regulated. (d} The MEA shaws that structures in the City are situated on lots that are aften very narr~w or on hiZly terrain, wha.ch can create drainage hazards fram adjacent properties. These conditians increase the threat to Iife and property, unless adequate drainage systems are required. (e) In order to address these climatic, topographical and geological conditions that place demands an emergency services and pose substantial risks to public health, safety, and welfare, along with the canditions related to fire risk described in Section 1, it is reasonably necessary to re-adopt previous amendments to the Tlnifor~ Building Code in the following manner: 13 (i) Require appropriate house numbering in order for emergency services to quickly and efficiently respond ta disasters. (ii) Require praper drainage regulations for roafs and developed properties, including yards, courts pools and parking to reduce impacts to i~m~diate and ad~acent prapert~es from flooding. (iii) Require adequate fencing around pools or other bodies of water to ensure safety of children and adults. (ivy Regulate the usa of temporary trailers by requiring a permit which ensures their temporary use and not as a permanent residence. (v) Require a sandblasting permit for any sandblasting work to be done to ensure praper construction activities and limited hours of use. SECTION 4. With respect to the need for am~nded or supplemental Electrical Code Requirements, the City Council makes the following findings regarding Zoca1 climatic, gealogical, and topographical conditions: 14 . ~ (a} The National Electrical Cade does not address electrical safety requirements for non-construction related electrical equipment, including portable electrical equipment and nnachinery. The unregulated use af such equipment poses a potentia~ safety hazard to citizens and property in Santa Monica by increasing the risk of fire aggravated by the conditions described in Section 1 above. (b) The Electric Soard of Appeals has approved safety standards for the use of electrical appliances, devic~s, materials and equipment, and has considered local problems caused by the improper use of non-metallic sheated wiring and use of aluminum al~oy conductors in sizes smaller than No. 6. Experience af f ield inspection personnel has shown that certain specific uses of aluminum based conductors and non-metallic sheat~d wiring has caused ar led ta potentially hazardaus and nuisance ~~ectrical wiring installations increasing the risk of fire aggravated by the conditions described in Section 1 above. (c) Based upon the local cvnditians outlined above, along with the conditions re~ated tQ fire risk described in Sectian 1, it is reasonably necessary to re-adopt the following local amendments to the Uniform E~ectrical Code 15 r to ensure fire safety and prevent accidents from electrical procedures and appliancas: (i) Ensure that any wiring not having metal protection over the canductors is entirely concealed within the building structure to prev~nt and inhibit tampering, and restrict the use of a2uminum wiring found to be hazardous. (ii) Prohibit the sale and use of any electrical material, devi.ce, or equipment not in campliance with rating and confor~-anee pr~visians. SECTION 5. With respect ~o the need for amended or supplementai Pl~xmbing Code Requirements, the City Council makes the following findings regarding local climatic, geological, and topographica]. conditions: (a) Santa Monica is situated in Southern Cali~ornia which has extreme arid conditions and periods af severe drought. As out~ined ~n the MEA, the City relies upan water frvm autside the regian which is bouqht from the Metr~politan Water District, and local groundwater for the City's water supply. Severe drought conditions and potential uncertainty abflut the availability of future water supplies from outside the region require the proper 15 f ~ management of avai~able water supplies. {b) Based upan this lacal condition, a~ong with the local conditions related to fire risk detai~ed in Section 1, it is reasonably necessary to reenact the fallowing local amendments to the Plumbing Code to reduce consumption af scarce water resources and ensure fire safety by preventing accidents from pressure gas systems and preserving local water supplies: (i) Require initial approval and mare thorough inspection af inedium pressure gas installation to prevent patentially hazardous and canfusing systems for emergency services which could result in fire hazards if not properly installed. {ii) Require that any new construction, remodel or addition install on~y ultra-1ow flush fixtures in order to reduce the consumption of scarce water resources. SECTION 5. With respect to the need far amended or supplemental Administrative Provisians, the City Council makes the fallowing findings regarding local climatic, geological, and topographical conditions: 17 . s (a) The City has a number of unique local conditions related to seis~nic activity and fire hazards as outlined in Sections 1 and 2 above. It is therefore reasonably necessary to re-adapt amendments to the Uniform Ad~ninistrative Code relating to Boards of Appeal to ensure reasonable intexpretatian of the Codes far the City of Santa Manica and establish appropriate appeal and advisory baards. (b) The City has experienced a number of situations where minimal construction work is performed under a building permit, and completion of the project stretches over a period af years. This practice raises a number of concerns. In addition to neighbors of such sites being impacted by canstruction activity~ by safety issues associated with construction sites, and by aesthetic impacts over a long time periad, both building and planning cades may have changed since the pe~nit was issued. These code chanqes are often due to concerns about public safety arising fram unique local condztians. (c) For example~ as a result af the 1994 earthquake and the threat af seismic activity in the City as described in 5ection 2, technical changes to the Unifarm Building Code have been and will be made to enhance public safety. ~l.der permits pursuant to which ~ittle work has been dane 18 ~ over the years would not be subject to these code changes. Sim~larly, evolution of the planning regulations is an ongoing pracess, and older permits are so~netimes inconsistent with current ca~unity planning objectives addressing unique local conditions. (d} It is there~ore reasonably necessary to estalalish maximum time periods in which to compiete canstrt~ction. SECTION 7. The City Clerk shall certify to the adaption of this Resolution and thencefarth and thereafter the same shall be in full force and effect. Division 5.00. Histarical Buildinqs. Buildings designated as historically or architectura~ly signiticant 27 landmarks on national, state or lacal histarical registers shall comply with the Seismic Retrofitting Code. At the Buildinq Official's discretion, modifications to the retrofitting standards set forth in the Seismic Retrofitting Code may be made sa long as such modificatians are cansistent with the pravisians of the State Historic Building Code. Division 6.00 Damolition. An owner desiring to demolish a building must nevertheless comply with the provisions of this Code unless such owner receives permission to demolish the building priQr to the time limits set farth in Division 4.00 herein for the filing of a permit and the submitting of plans ta the Building Official. Such an owner shall submit a Demolition Permit Application to the Building Official and shal~ meet all of the requirements for demoiition impased by this Code including but not limited to those requirements set forth in Section 9.04.10.1s.010 of this Code befare such a demolition shall be permitted. Nothing in this Section or in the 5eismic Retrofitting Code shall be deemed to relieve a building awner of ineeting the requirements for demolition of a building imposed by any othar applicable law or regulation. Division 8.00. Enforcemeat. If the owner in charge or control of the subject building fails ta comply with this Code within any of the time limits set forth herein, the Building Official may order that the entire building be vacated and that the building remain vacated until this Code has been complied with. If compliance has not been init~ated within ninety (90} days after the date the ]nuilding has been ordered vacated or such additional time as may have been granted by the Board of Appeals, the Building Official may (i) commence the build~ng's 29 demolition in accordanc~ with the provisions of Section 203 t~`~3~ of the Uniform Building Codc, 1~~:~~ ~.d~ tit~::, and in accordance with the IIniform Code for the Abatement of Dangerous Buildings, as adopted by the City, or, (ii) undertake and complete such structural alterat~.on of the building as may be necessary in the sale judgment of the Building Official to cause the building to conform to the earthquake standards specified in the Seismic Retrofitting Code, and to cause a lien for the costs af such structural alteration to be placed against the property. Such documentary evidence may include, but shall not be limited to, the owner~s tax returns, general ledgers, rental and lease agreements, pers~nal and corporate income and expense records, and any such other financial documents or informat~on as the owner desires to submit ~or consideration or as the City's Chief Financial ~fficer deems necessary or desirab~e in evaluating the owner's claim of hardship. The failure of the owner to provide any financial document or infarmation requested by the Chief Financial ~fficer shall result in denial of the appeal. Any person denied an appeal by the Chief Financial officer may appeal the denial to a three person Financial Hardship Appea~ Board e~tablished by the City Manager. Any such appeal shall be made in writing within ten {10) days of the denial and shall be based on the evidence supplied to the Chief Financial Officer. Necessary repairs shall be made within 18 months from the date the notice is provided by the City. 33 (2) Except as provided in subsection (c), when any portion af a URM budding such as a parapet, wall or other element has failed or collapsed, repairs shall be made with wood frame or steel constructian, or ather material structurally compatible with the unreinforced masonry. Division 1.00 Definitions. As used in this Sectian, the fo~lowing terms shall be defined as follows: (a) Non Ductil~ Preaast Conarete Buildinq. Any structure designed and constructed with concrete elements that are cast in other than their final positian. {b) Non Ductile RQinforced Concrets Buildinq. Any structure designed and con5tructed with poured in place reinfarced concrete. (c} Soft Story Buildinq. Any structure or portion af a structure classified as soft story in the Uniform Building Cade as adopted by the City ~f 5anta Monica. (d) Stasl Frame ~~ Structure. Any strueture designed or constructed with stee~ frame elements of load bearing and lateral load resistance systems. Division 2.00 Dstarminatioa of OCCLIpilAt Load aad Huildinq Type. Far purposes of this Sectian, the occupant laad of each structure shall be determined by the Building 4fficial in accordance with the Uniform Building Code as adopted b~ the City of Santa Monica and shall be applicable ta bath vacant and accupied structures. Far purposes of this 5ection, the structure type shall be as def ined in the Earthquake Design 1/4L 4i~n ~rov i~ ic~n~ of 37 the Uniform Bui~ding Code as adopted by the City of Santa Monica. Division 3.00 Scopa. The owner of any structure identified in this Section shall, within the time limits set forth in this Section, cause the structure to be evaluated, repaired or retrofitted to conform to the criteria specified in this Section. Division ~.oo soft story canstruction. (aj Within 120 days of the date of notice to the owner by the City, but no later than March 31, 1995, the awner of any soft story structure damaged by the January 17, 1994 Earthquake ar its aftershocks, where the cost of repair is less than 50~ of the replacement value of the structure, shall submit an engineering report prepared by a licensed engineer (~~enqineering report"} to the Building and Safety Division, except that any owner who did not receive notice shall be granted at least an add~tional thirty {30) day extension by City staff from the date the owner is notified of nancomplianc~. The report shall be based on a non-rotational lateral analysis and shall demonstrate whether the building complies with the Earthquake Design V 444f1~+i44i M~ prc~v i~: i e~:i: ~ contained in the Uniform Building Cade in effect at the time the structural ~ngineering report is submitted to the City. If the report concludes the structure does not 38 comply with the ~~~ .'~.~~~ provi~ :vr.~, the structure shall be strengthened within the timelines of Divis~on 7.00 of this Section and according to the following standards: {1) Calculated story drift shall not exce~d D.04/Rw or 0.005 times the story height for structures having a fundamental period of less than 0. 7 seconds . For structures having a fundamental period of 0.7 second or greater, the calcu~ated story drift shall not exeeed 0.03/Rw or O.U04 times the story height. (2) Use R=2.1, the buckling factor for a cantilever column, for the design of the steel columns. (3) Do not al].aw the principle of diaphrag~ rotation in wood frame buildings ta distribute the design laterai force (s) . (b) W~thin 120 days of natice to the owner by the City, the owner of any saft stary structure not damaged by the January 17, 1994 Northridga earthquake or its aftershocks, shall submit an engineering report to the Building and Safety Division. The report shall be based on a non-diaphragm rotational lateral analysis and shall demonstrate whether the structure conforms to the Earthquake Design ~~~: ~~~~~ prc~vis~ion~ contained in the Uniform Bui~ding Code as adopted by the City of Santa Monica. If the report concludes the structure does nat comply with the ~~~~~~~~~ provician~, the structure shall be strengthened within the timelines of Division 7.00 af 39 this Section and according to the standards listed in subsection (a) above. Division 5.00 Tilt-up Buiidinqs Constructed to Pre-1976 Suildinq Coda. Within 275 days of the date of notice to the owner by the City, the owner af any Tilt-Up building constructed to pre-1976 Building Code standards shall submit an engineering report to the Building and Safety Division. The report sha11 demanstrate whether the structure conforms to the Earthquake Design Standards contained in the Unif~rm Building Code in effect at the time the repart is submitted to the City. If the report concludes the structure does not comply with the standards, the structure shall be strengthened to comply with the standards within the timelines of Division 7,00 of this Section. Division b.00 Non Duatile Reinforced Concrete aad Noa Duatila Pre-Cast Concrate Btructures. Within 275 days of the date a~ notice to the owner by th~ City, the Qwner of any non ductile reinforced concrete or non ductile pre-cast concrete structure shall submit an enqineering report to the Building and Safety Divisian. Division 1.00. HousQ N~~+~herinq. (a) Frontage ta be Numbered. All lands and lots within the City now platted or which hereafter 3~e ~~ ,~.,~f p~atted shall have numbers assigned ta each space a€ twenty feet frontage on any street within ar bordering upon the same and such number shall be affixed to all buildings thereon ar which may herEafter be erected thereon. {b} System of Numbering. One hundred numbers shall be assigned to each and every block between streets and avenues and wherever such streets and avenues do not extend through any platted or unplatted lands, the number shall be assigned ta the spaces between such streets if e~ended through such lands. (c) Informatian. The City Engineer shall assign the numbers ta all lands now platted and all lands which may hereafter be platted, and shall indicate the same upon an affic~al city map, and fi~e a copy of the same with the Building Official. The awners af property within the City shall apply to said Buiiding Official and be furnished with appropriate assigned numbers, without 46 charge therefor. Division 2.00. ~rainaqo Requlations. The roof of every building and structure shall be kept wat~rproof, and aIl storm ar casual water therefrom shal~ be praperly drained and conveyed to a street, sewer, storm drain, street gutter or other approved locatian. Temporary Trailer Permits. (a) Hous~-Tppa Trailers. Whenever the expression "house-type trai3ers" is used in this division, it shall mean house trailers, trailer coaches, mobile homes, and such type vehicles as are defined in Section ssaao et seq. o~ the Health and Safety Code. (b) R~qulatioas, The following regulatians shall apply to house-type trailers other than mobile homes located in mobile home parks for uses other than as living accommodations. No person, firm or corparat~on shall use, store, or place a house-type trailer for any purpose or in any manner except as in these regulations provided: 1. No person, firm or corporation shall use a house-type trailer for any purpose or in any manner without first obtaining a written permit from the Building Official authorizing such use, storage, or placement. 2. No person, firm or corporation shall use, stare or place a house-type trailer for any purpose or in any manner in violation of or in non-conformance with any of the terms provided in a permit issued by the Building Official far use, starage, or p3acement of said house- type trailer. 48 3, The BuiZding Official shall be guided by the fallawing standards in the issuance of permits for the use, storage, and placement of house-type trailers: No ho~se-type trailer shall be used in any residential zone far any purpose other than storage thereof, except when used in cannecti~n with the erection of new structures. No house-type trai].er or house-type trailers singly, in connection groups, or otherwise shall be used for any purpose on any lot or parcel, as defined in Article IX of this Cade, for a cumulative time of more than six months in any twelve consecutive months, except as hereinafter provided for any purpose other than storage thereof. Except in connectian with the erection af new structures, no house-type trailer shall be used for any purp~se not directly connected and associated with a business or activity conducted within an enclosed building an the lot or parcel upon which it is used or upon a lot or parcel immediately adjacent or contiguous thereto which is under the awnership operation, or direct control of the persan, firm or corporation to who~n the permit is issued. No permit shall be issued for the use of a house- type trailer unless there are legally provided toilet facilities located within a reasonable distance not to exceed 204 feet from the closest point of said house-type 49 trailer, which toil~t facilities are owned, operated, or under the direct control of the permittee. The total spac~ occupied by a house-type trailer or trai~ers used under such permit shall not exceed ane percent (1~) of the tatal square footage of the enclos~d portion of the buiZding described ab~ve far the activity, pravided that the space occupied by the house-type traiZer may be limited to one house-type trailer used in connection with any business or businesses which are related ta each other and are, directly or indirectly, under a common ownership or management, if the space which would be occupied by any house-type trai~ers in excess of one is normally used for parking of automobiles or has been so used withih three months of the time of the application for the permit, and only if the automobiles so displaced may be accommodated on other off street parking facilities owned or controlled by pern~~ttee . The permit issued hereunder may be extended for a period not ta exceed ane y~ar, provided that in the ~vent of such an extension, no further permit shall be issued for use on the same or adjacent premises or on premises awned, operated, or controlled by the permittee ar his or her successor or successors in interest for a period of two years succeeding expiration of the extended permit. ~ivision 5.00. Sandblastinq Regulatians. 50 (a) Permit Req~ired. No persan shal~ do any exterior sandb~asting within the City without first obtaining a permit. A permit shall be required for each separate work location or contractar. (b) Appliaatian. Ta obtain a permit the applicant shall fi~e an application with the Building and Safety Department Each application shall state the location, name and address of responsible party~ estimated times sandblasting will take place, amount of insurance for property damage and public liability that the applicant carries and the name of the company issuing the policy. Monday through Friday, and before 9:00 am. or after 5:00 p.m. Saturday, nor on a Sunday or legal holiday unless a special permit for such work is issued under pz~~~ Municipal Code Section ~{~~} -~.]~.14~. No dry sandblast~ng shall be permitted except upon special permission of the Building O~ficial. Permission shall be granted on~y in those situations where wet sandblasting cannot be done due to unique circumstances. Any application far dry sandblasting shall state thereon the reasons why wet sandblasting cannat b~ used and the additionaZ precautions that will be taken to protect the public. A minimum of 3 days notice shall be given to owners, tenants and occupants af all structures within 51 150 feet of the site on which sandblasting is to be done. All ~lectrical materiais, devices, appliances~ or equipment designed ar intended for 53 attachment, directly or indirectly to any electrical system, circuit or electrical service for light, heat or power, shall be only those which confarm with the requirements of this ordinance. Each such article shall bear or contain the maker~s name, trademark or identificatian symboZ, together with such rating by the manufacturer as may be necessary to determine the intended use. The carrect operating vo~tage, amperage and total watts shall be stated and na person sha11 remove, alter, deface or obliterate any such marking. 2. Approvals. All electrical materials, devices, appZiances, or equipment cavered by and intended to be regulated by this Ordinance shall conform with the pub~ished National Safety Standards for such materials, devices, appliances ar equipment on file in the office af tha United States Bureau of Standards. Copies of such standards on file in the office of the Chief Electrical Inspector shall be open to inspectian by the public. Listing or labeling by the Underwriter's Labaratories, Inc., ar other recognized testing laboratory whase standards are on file with the United States Bureau vf Standards shall be pri~a facie evidence of conformity with these required standards. Where no such standards exist for any material, device, applianc~ or equipment, the Chief Electrical Inspector may designate a standard for each article submitted, which shall specify the tests 54 necessary to provide the degree of safety to life and property as is generally required by the National Standards for appraved materials, devices, appliances and equipment of simiiar or related character or nature. 3. Rovoeation. Any approval granted by the Chief Electrical Inspector may be revoked if the electrical material, device, appliance, or equipment is found to ba hazardous, unsuitable far the purpose used or intended, or does not conform with the standards under which it was appraved for use. 4. Exc~ptions. The provisions of this Code sha~l not be deemed ta apply to: (a) Safe, substantial, used or second-hand devices ar appliar~ces, provided that all parts or equipments used in rebt~ilding or reconstruction shall conform in all particulars with the National Standards for such article, and provided ~urther that such articles when offered for sale shall have the same degree of safety ta life and property as may then be required in a new article of the same type. Any provision of the Santa Monica Municipal Code or ~ppendices thex-eto, inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified ta that extent necessary to effect the provisions of this Ordinance. SECTI~N 3. If any section, subsecti.on, sentence, clause, or phrase of this Ordinance is for any reasah he].d to be invalid or unconstitutional by a decision of any caurt of any competent ~urisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council her~by declares that it would have passed this Ordinance, and each and every section, subsectian, sentence, c].aus~, or phrase not decZared invalid or unconstitutional without regard to whether any partion of the Ordinance would be subsequently declared invalid or unconstitutional. 69 SECTION 4. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause this ordinance, or a summary thereof to be published once in the official newspaper within 15 days after its adoption.
