SR-010996-8A f:\atty\muni\strpts\mhs\tempa2.sr city Council Meeting 1-9-96 8A -- Santa Monica, California JAN 0 9 1996 TO: Mayor and city Council FROM: City Attorney SUBJECT: Ordinance Amending Municipal Code Section 4.36.120 Regarding Temporary Relocation Payments At its meeting on December 12, 1995, the City council directed the city Attorney to prepare an ordinance clarifying the obligation of owners to pay relocation benefits to tenants displaced as a result of owner compliance with the retrofitting requirements imposed by Ordinance Number 1748 (CCS) (the potentially hazardous structures ordinance). In response to this direction, the accompanying ordinance has been prepared and is submitted to the city Council for its consideration. The accompanying ordinance amends Municipal Code section 4.36.120 governing relocation benefits. The proposed amendments ...- provide that the obligation to pay relocation benefits does not apply where a tenant is displaced and relocated so that the landlord can comply with the repair and retrofitting requirements of Municipal Code Section 8.04.040.050. However, if the displacement exceeds a specified time period, the landlord must pay to the displaced tenant the difference between rent actually paid by the tenant for temporary accommodations during the period of displacement and the rent which would have been payable to the 1 8A JAN 0 9 1996 landlord had the displacement not occurred. The Ordinance authorizes the Building Official and Director of Planning and Community Development to jointly extend the period of time in which to complete the required repairs and retrofitting, thereby extending the period of time before the payment requirements described above go into effect. These circumstances are: (1) prior to tenant displacement the Building Official and Director determine that repair and retrofitting will take longer than the time periods allowed due to circumstances unique to a particular building; and (2) after displacement they determine that the landlord is diligently proceeding with required repairs and is unable to complete them within the designated time period due to the occurrence of events which are unforeseeable by and out of the control of the landlord. Finally, the ordinance provides that the landlord's inability to finance the required repairs and retrofitting to his or her building is not grounds for an extension. RECOMMENDATION It is respectfully recommended that the accompanying ordinance be introduced for first reading. Section 4. 36. 120 of the Santa Monica Municipa 1 Code is amended to read as follows: 4.36.120 Inapplicability of Chapter to certain evictions. (a) Notwithstanding Section 4.36.110, the requirements set forth in this Chapter shall not apply to any tenant whose tenancy is terminated pursuant to a lawful notice to terminate tenancy pursuant to Section 1806 (h) of the City Charter served on or before June 10, 1986. (b) Section 4.36.100 shall not be applicable if the displacement and relocation of the tenant is the result of a fire not caused by the landlord, earthquake or other natural disaster. (e) Except as provided in Section 4.36.030(b), the requirements set forth in this Chapter shall not apply to any 1 tenant whose tenancy is terminated or caused to be terminated on the ground that the landlord seeks to withdraw all rental housing uni ts from the rental market as provided in Government Code Section 7060 et seq., unless the tenant qualifies as a lower income household pursuant to Health and Safety Code Section 50079.5. :. Any provision of the Santa Monica Municipal Code or appendices thereto, inconsistent with the provisions of this Ordinance, to the extent of such inconsistencies and no further, are hereby repealed or modified to that extent necessary to effect the provisions of this Ordinance. SECTION 3. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. 3 SECTION 4. The Mayor shall sign and the city Clerk shall attest to the passage of this Ordinance. The city Clerk shall cause this ordinance, or a summary thereof to be published once in the official newspaper within 15 days after its adoption.
