Installatlon of New Streetllghts and Replacement of
Streetllghts, and Set a Publlc Hearing for January 9,

INTRODUCTION:
ThlS report requests that the City Council accept petltions
requesting the new lnstallation of streetlights on the following
streets:
23rd Street - from Washington Avenue to Idaho Avenue
Chelsea Avenue - from Washington Avenue to California
Avenue .
Llncoln Boulevard - from Montana Avenue to Alta Avenue
Prospect Avenue - from Marine Street to end of street
(dead end)
Yale Street - from Montana Avenue to Washington
Avenue
The report also recommends that City Council approve the
replacement of streetlights on San vicente Boulevard from Ocean
Avenue to 4th Street and adopt the attached Resolutlon of Intentlon
to set a public hearlng for January 9, 1996 at which the City
declares lts lntention to assess property owners for costs and
issue bonds as security for unpaid assessments for those streets.

BACKGROUND
Procedure for Resldential Streetllqht Installation
In accordance wlth Municipal Code, whenever 60 percent of the
occupants of residential unlts in any area petition the City
Councll to install residential streetlighting, the City Council
shall institute proceedings under the Improvement Act of 1911 to
provlde resldential streetlightlng to such area.
All property owners are assessed for streetlighting based on the
dimensions of each property. Residentlal property owners are
assessed 50% of the cost unless they are located on a corner lot.
Owners of corner lots where the legal address is the street where
the streetlight lS being installed pay 50% of the applicable work.
If the legal address of the corner lot is on the adjacent street,
the property owners pay 20% of their side footage costs. The Clty
pays the remainlng 50% or 80% of appllcable costs. Commercial
property owners are assessed 100% of their front footage, and for
corner lots, 40% of the adJacent street footage costs, with the
Clty paying the remainlng 60% of the adjacent street footage costs.
Successful streetllghting petltions contain the signatures of a
mlnl~um of sixty percent (60%) of each area 1 s occupants. Petitlons
are then presented to the City Council and a publlc hearing to hear
protests lS set. After the public hearing the City Council may
order the work to begin. The project wlll be competitlvely bld
and a contract will be awarded by Clty Council to the lowest and
most responsible bidder. Owners may pay for the improvements in

full or they may pay over ten (10) years at an interest rate of
8.75% per annum. Bonds will be authorized by City Council to be
sold for installment payments.
The Petitlons for Streetliqht Installatlon
At the request of resldents, staff prepared streetlight petition
packets for the neighborhood representatives of:
23rd Street - from Washington Avenue to Idaho Avenue
Chelsea Avenue - from Washington Avenue to Callfornia
Avenue
Llncoln Boulevard - from Montana Avenue to Alta Avenue
Prospect Avenue - from Marine Street to end of street
(dead end)
Yale Street - from Montana Avenue to wash~ngton Avenue
A minimum of Slxty percent (60%) of occupants of these streets
requested the lnstallation of streetlights. Rent Control staff
revlewed the petitions and determined that they conform with Rent
Control Regulations for pass-through of assessments to tenants.
A meeting between staff and owners and residents was held on August
l7, 1995 to discuss the locat~on of streetlights, types of
streetl~ghts (decorative versus standard) avallable and the
approXlmate costs to the property owners. The property owners on
Yale Street and Chelsea Avenue requested the more expens~ve
decorat~ve streetllghts for their block. Hence, their assessment
wlll be hlgher than those on other blocks who requested the
standard streetllghts. The City pays only 50% of the cost for the
standard streetlights and property owners choosing the decorative

streetlights will be required to pay the difference between the
standard streetlighting and the decoratlve streetlighting.
Staff 18 presenting these pet1t1ons to City Council for acceptance,
requestlng that a public hearing be set for January 9, 1996, to
hear protests, 1f any, and approve the establishment of an
assessment district ln accordance with the Improvement Act of 1911
of the Streets and Hlghways Code. Notices wlll be posted and
property owners and occupants wlll be notified by mall 45 days in
advance of the public hearing and a notice will be advertised in
The Outlook in the manner prescribed by State Law.
Staff recommends that streetllghts be installed on these streets
for the safety and convenience of the residents. Coples of the
slgned pet1tlons, a list of property owners and occupants and a
diagram of the proposed assessment dlstrict will be available in
the Councll Chambers at the tlme of publlc hearing. The Public
Works Assessment Asslstance Program, available through the
Community Block Grant Program, will be available to financially
assist low-to-moderate income households.
The Proposed Streetliqht Replacement on San Vicente Boulevard
The capital Infrastructure Needs Assessment Study, completed in
February of 1984 and presented to City Council, recommended that
deter10rated and energy inefficient streetllghts be replaced at
varlOUS locations throughout the City. Several streets needing

circu1t and pole replacement were 1dentified in the study and staff
has determined that the streetlight system on San Vicente Boulevard
from Ocean Avenue to 4th Street 1S 1n greatest need of replacement.
Th1S determinat10n was based on the number of actual repalrs made
and the number of repa1rs planned to maintain the 75-year old,
badly deter10rated system on San Vicente Boulevard. In FY 1994 -95,
streetlights on San V1cente Boulevard between 4th Street and 7th
Street were replaced. Th1S 1S a continuation of that project.
Preliminary notlces were ma1led to property owners on August 23,
1995. Assessments for San V1cente Boulevard are proposed to be
d1vlded equally between property owners and the Clty since staff
dec1ded to replace the existing decoratlve streetlights with
similar decoratlve ones. Notlces will be posted and property
owners wlll be notlfled by mall 45 days ln advance of the public
hearing of the time and place of the public hearing. There will be
no pass-through of costs to tenants Slnce thls lS not a tenant
lnltiated petition.
In the past the Clty has lnltlated other streetlight replacement
projects lncludlng La Mesa Drive ln 1985 and a portion of San
Vicente Boulevard In 1994
BUDGET FINANCIAL IMPACT
The total estimated cost for the proJect is $410,000 which includes
incldental costs such as staff time for engineering surveys,
publJ..c notlflcatlon, advertisement, construction management,

1nspections and construction costs The estimated construction
cost 1S $356,500 The total estimated assessment is $32.00 per
foot of property frontage for standard streetlights. The estimated
prorated assessment for residential property owners is $16.00 per
foot of property frontage with the C1ty paying an equal amount, and
$32.00 per foot of property frontage for commercial property
owners. The est1mate for a typical assessment of a 50-foot
resident1al lot 1S approxlmately $800.00 with the City contributing
an equal amount The est1mate for a typical commercial property is
approximately $1,600 for a 50-foot lot. The cost for decorative
llghts on Yale Street and Chelsea Avenue is $38.00 per foot with
the res1dent1al property owners paY1ng $22.00 per foot and the City
paY1ng $16.00 per foot. San V1cente Boulevard property owners will
be assessed $29.00 per foot w1th the City paying an equal amount.
The proposed cost breakdown 1S as follows:
Estimated Property Owner Assessment $ 215,600
Est1mated C1ty Contribution $ 194(400
Total Cost $ 410,000
The City! s share for th1S project is available in the amount of
$191,146 in CIP Account No. 01-770-453-20094-8905-99155 and the
amount of $3,254 in CIP Account No. 01-770-453-20095-8905-99155.
The balance of $215,600 w1ll be paid through the property owner
assessments. Assessments will be paid upon completion of the work
and w1ll be held in Trust Account No 80-000-000-00000-9750-04289
pending payment to the contractor. Bonds are issued for any unpa1d
assessments. Bond proceeds are paid to the Contractor or assignee,

the Contractor or ass1gnee, and the property owner{s) then payoff
the bond holder(s) over t1me
RECO~MENDATION
It is recommended that the C1ty Council:

OF SANTA MONICA SETTING A PUBLIC HEARING ON JANUARY 9,

WHEREAS, Streets and Highways Code BectloD 2804 provides that
the "Special Assessment, Investlgation, Limitation and Majorlty
Protest Act of 193111 shall not apply to any proceeding otherwlse
subJect thereto when said improvement proceeding is by a charter
Clty and sald city has compIled the provisions of Bectlon 19 of the
Article XVI of the California Constitution; and

SECTION 2. The Clty Councll proposes to initlate proceedings
for the replacement of deteriorated streetlighting and appurtenant
work on the street shown on City Drawings No. 10061 and generally
known as:

SECTION 3. The total estlmated cost of the proposed
~mprovement is $410,000. The property owners I share of cost is
estimated at $215,600
SECTION 4 Improvements shall be conducted under the
Improvement Act of 1911, whlch is Division 7 of the Streets and
Highways Code of the State of Callfornla.
SECTION 5 The proposed work or improvement ln the opinion
of C~ty Counc~l of the City of Santa Monica is of more than local
or ordinary public beneflt, and City Council hereby proposes that
the distr~ct ln the City of Santa Monica to be benefitted by said
work or lmprovement and to be assessed to pay one-half of the cost
and expense thereof, at approxlmately $16.00 per front footage for
standard streetlights, $29.00 per front footage for San Vicente
Boulevard, but for decorative streetlights on Yale Street and
Chelsea Avenue, the City wlll pay approximately $16.00 and the
property owners will pay approxl.mately $22 _ 00 per front footage, is
shown upon a certa~n map indicatlng the exterlor boundary thereof,
wh~ch said Drawlng No. l0061-A is on fl.le in the Office of the City
Engl.neer. The map hereby ~s referred to and shall govern for all
details as to the extent of said assessment district. The
assessment dlstrict lncludes in general the lots and parcels
descrlbed In Section 1 above but reference hereby is made to said
Drawlng for all details as to the extent of sa~d assessment
d~strlct and for any variat~on between the last mentioned general
descrlptlon and the extent of said assessment dlstrict as shown on
sald map. All public streets or alleys, or portions thereof,

SECTION 6. The City w1l1 pay a port1on of the cost and
expenses of the work descr1bed herein, and the City Controller is
author1zed and directed to pay the same 1mmediately upon
conf1rmation of the assessment by City Council
SECTION 7. Serial bonds bearing interest at the rate 8.75%
per annum shall be issued to represent each assessment of One
Hundred Fifty Dollars ( $15 0 . 0 0 ) or more remaining unpaid for thirty
(30) days after the record1ng of the warrant. Each serial bond
shall extend over a period end1ng n1ne (9 ) years from the second
day of January next succeeding the next September 1st follow~ng its
date Payments on the principal of unpaid assessments and interest
shall be made by property owners to the City Treasurer and the same
shall be d1sbursed by him/her or as provided in the 11 Improvement
Act of 191111 herelnafter referred to. In accordance with Streets
and H~ghways Code Section 6442, the first two percent (2% )
dellnquency penalty authorized by such section may be retained by
the City Controller as the cost of servicing the de11nquency.
Th1S bond may be redeemed by the owner or any person interested 1n
any lot or parcel of land described herein, at any t1me before
maturity, and before commencement of proceed~ngs for sale, upon
payment to the Treasurer, for the holder of th1.s bond, of the
amount then unpa1d on the prlncipal sum, together w1th a prem1.um of
f1ve (5 ) percent of sald unmatured principal, thereof with interest
thereon (if not previously paid) up to the next succeeding January
2 or Jul y 2, as the case may be, at the rate named ~n this bond,
and all penalt1es accrued and unpaid.

SECTION 8. Notice is hereby given that on Tuesday, the 9th
day of January, 1996 at 6:30 p. m. , in the City Council Chambers
located in City Hall, 1685 Main Street, Santa Monica, Callfornla,
there shall be a public hearlng before said City Council for the
purpose of determlnlng whether the public convenience and necessl.ty
requlre the above-described lmprovement and for the purpose of
allowlng any and all persons hav1ng any objections to the proposed
work or 1mprovement to appear and show cause why the said proposed
work or 1mprovement should not be carried out in accordance with
sald Resolutlon of Intentlon. Inquiries concerning this public
hearlng should be dlrected to the Department of Environmental and
PubllC Works Management, Englneering Divislon, at (310) 458-8721.
SECTION 9. The City Clerk shall give notice of the hearlng
by postlng a copy of thlS Resolution in the manner described by
Streets and Hlghways Code Section 5065 and by publication as
herelnafter provided. Any interested person may protest against
the proposed improvement ln wrlting filed with the City Clerk at
any tlme not later than the hour set for the hearing in the manner
provlded by Streets and Hlghways Code Section 5220.
SECTION 10. The Superlntendent of Streets shall cause to be
conspicuously posted along the line of sald contemplated work or
lmprovement and also along all the open streets wlthin the sald
dlstrlct, notlce of the passage of thlS Resolutlon of Intention ln
the manner and form prescribed by law.
The Clty Clerk hereby 1S dlrected to mai I notices, in the
manner and form prescrlbed by law, of the adoption of this
Resolutlon to all persons ownlng commerclal, industrlal, or

resident~al real property in the here~nbefore described assessment
district, whose names and addresses appear on the last equalized
assessment roll for the C~ty taxes or as known to the City Clerk.
SECTION 11. The City Clerk hereby is directed to publish this
Resolution, in accordance with Government Code Section 6063, in The
Outlook, once a week for three successive weeks, with at least five
days interven~ng between the respective publ~cat~on dates, not
counting the first day of publication and terminates at the end of
the twenty-flrst day, including therein the first date. The f~rst
publication is to be made not less than forty-five (45) days prior
to the date of the above public hearing.
SECTION 12. Pursuant to Publ~c contract Code Section 20433,
the C~ty Councll hereby states that the property owners may not
contract for the lmprovements and that the City shall be
responsible for lettlng and administer~ng the construction contract
for this d~str~ct.
SECTION 13. The City hereby declares that Community
Development Block Grant (CDBG) funds may be applied for payment of
assessments on property owned by low-to-moderate income households.
