SR-010996-6G Contnuf- -:iF 7/fr4 6G ( CCS) - f:\atty\muni\strpts\mox\socaldis.1 JAN 0 9 1996 City Council Meeting 1-9-96 Santa Monica, California TO: Mayor and City Council FROM: City staff SUBJECT: Agreement with Southern California Disposal Company to Provide As-Needed Solid Waste Transfer station Services Introduction This report recommends that the City Council waive competitive bidding requirements and authorize the city Manager to enter into an agreement with Southern California Disposal company to provide solid waste transfer station services on an as-needed basis to the city. Discussion Southern California Disposal Company operates a solid refuse transfer station at 1908 Frank Street, approximately 1 block from the City's solid waste transfer station. It would be useful for the City to use the SCD transfer station from time to time in the future as a backup to the city transfer station, whenever the city transfer station is overloaded or inoperable as a result of vehicle or equipment outages, personnel shortages, or for any other reason. SCD currently owes the City the sum of $73,504.63 for use of the City's transfer station prior to construction and permitting of its own transfer station. SCD has agreed to accept 1,671 tons of the City'S solid waste at no charge, which will relieve SCD of .tAN 0 9 1996 1 6G -:r - outstanding obligation to the city. Additionally, SCD has agreed to accept a portion of the City's solid waste at a specified rate after the above-described obligation has been satisfied. The rate to be paid by the City will be below the city's transfer station public rate and will reflect current costs for processing, transportation and disposal of solid waste in the region. Before the city can deliver solid waste to the SCD transfer station, SCD will require a permit review by the County of Los Angeles, Department of Health Services, which, is the Local Enforcement Agency for transfer station permitting. The County, in turn, will require a resolution from the City Council, confirming that the City agrees to a revision to SCD's permit to allow them to accept solid waste from City vehicles. This permit revision process should be completed within the next two months. An agreement has been prepared between the City and SCD. It provides the City flexibility and reliability in handling solid waste, while protecting the city's interests with regard to SCD transfer station operations. BUDGETARY/FINANCIAL IMPACT Entering into this agreement will provide a means for the City to recover the $73,504.63 obligation owed by SCD, without the necessity for legal action. Additional utilization of SCD's services on an as-needed basis will be paid for from existing 2 budgeted funds in Solid Waste Management account number 27-500-441- 00000-5507-00000. RECOMMENDATION Since there are no other transfer stations reasonably able to accept solid waste from City vehicles, it is recommended that the City Council adopt the attached resolution waiving the competitive bidding requirements for transfer station services, and authorize the City Manager to enter into an agreement with SCD to accept solid waste from City vehicles at SCD's transfer station at agreed prices. CA:MM:muni\atty\laws\mox\socal City Council Meeting 1-9-96 Santa Monica, California RESOLUTION NUMBER 8985 (ecs) (city Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA WAIVING THE REQUIREMENT FOR COMPETITIVE BIDDING AND AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH SOUTHERN CALIFORNIA DISPOSAL COMPANY FOR AS-NEEDED SOLID WASTE TRANSFER STATION SERVICES WHEREAS, the City owns and operates a solid waste transfer station located at 2500 Michigan Avenue, Santa Monica, California, and Southern California Disposal Company (hereinafter referred to as "SCD") owns and operates a refuse transfer station located at 1908 Frank street, Santa Monica, California; and WHEREAS, the City desires to use the SCD transfer station from time to time in the future as a backup to the City transfer station, whenever the City transfer station is overloaded or inoperable as a result of vehicle or equipment outages, personnel shortages, or for any other reason; and WHEREAS, SCD has offered to accept City solid waste at its transfer station, as the needs of the City dictate, at rates which the City considers to be reasonable and fair; and WHEREAS, there are no other suppliers of transfer station services located within the City, or within a reasonable distance of the city; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA 1 - , . DOES RESOLVE AS FOLLOWS: SECTION 1. That advertising for bids for as-needed transfer station services would be to no avail and would cause unnecessary expense and delay. SECTION 2. That the City Manager is authorized to enter into an agreement with SCD for as-needed transfer station services. SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
