Required Permits, B~ild~ng Permit Terms, PErmit Fees. Permit Issuance, 5uspension or Revocat~on. Building Address Numbers, Building Security Pro~isions, Paol Enclosures and RepairlMaintenance -, , Requirements Boards Qt Appeal Previous amendrnents to the ~ 994 Administrati~e Cocfe created requirements and limits of authority for two appeals and ad~isory baards the Building and Safety Commission and Accessibilit~AppealsBoard Thenswamencimentswillclarifythe~ur~sd~ct~onofeachbvard in relation to the NuisanceAbatement Board These amendmentswill gi~e deargoverning ~unsdicfion to the Nwsanc~ Abatement Board for all items broug~t under abatemen# proceedings They will also clanfy the role of the Building and Safety Commission for appeals from all other techn~cal codes except for issues of accessib~fity (See Sect~on 8 Q8 020) Required Permits Current admin~strative provisions in the codes require a separate permit for each building Wh~fe this can be im~ortant when several mair~ builtl~ngs ex~st on a s~te w~t~ d~fferen# responsible parties, it is not germane ta #he large ma~ority of permits Most permits (~75%} relate to the construction or alteration of single family dvuelkings where all respons~ble partres are the same The proposed amer~dment aNows s~mplr~icat~on of the perm~t process by author~zing the City to issue one permit for all related construction T~is procedure will impro~e cus~omer service and reduce the City's costs a~ operation (See Section 8 0$ 040) ~ 8u~ld~ng Permrt Terms In the past, the City experienced a number of situations where minimal construction work was performed under a building permit, and completion of the proJect stretched a~er a penod of years This practice raised a number of concerr~s These mclude (1) neighbors of such sites be~ng impacted by the dust and noise of prolor~ged canstructEan activity, {2} safe#y issues associated with construction sites. (3) extended visual and aesthetic impacts. (4} changes in either building and plannmg codes s~nce the permit was issued due to unique local conditions, resulting in concerns about pub~ic safety and consistency with community pianning ob~ecti~es To address these issues, City Council appro~ed regulations which establish maximum time lim~ts ta complete canstruction, with the amount of time vary~ng based on permit valuation (see Section 8 a8 060) This approach has pro~en to be effecti~e and was modeled on standards used m both San Franc~sco's and Irvine's buildmg code The t~me periods vary Pro~ects with h~g~er permit ~aluat~ons are allocated longer time penods to complete construct~on Ir~ addit~on, three extensrons af the t~me per~oets may be ~ranted by the Building Offic~al, pra~iding additional flexibility to address spec~al si#uatiflns This amendment renews ex~sting law so that it appl~es to the latest ~ersion of the technical codes (See Section 8 08 060) Permit Fees The new Stat~ Seism~c Hazard Mapping Act requires autside review of geo#eci~nical and geologic reports far many of the City's new construction pra}ects State adm~nistrati~e law requ~res the re~~ew of these reports by licensed geotechnical engineers and due to lack i ofsuch qualified staff, the City rnustcontractfor#hese services The proposed amendment au#horizes the City to charge fees based on their direct costs including administratian and overhead certain pro~~s~ons are now bemg added to the admmistrative code to allow the Ci#y ta recoup its reasonable costs as allowed in Health ancf Safety Code Secfion 17960 1(c} for review of geotechnical reports New propased changes in the fee structure should later require se# fees for review of geotechnical reports As in pre~ious amendments, permit fees w~ll not be set by adoption of the technical codes, but instead will be set by separate Gouncil resolution (See Section 8 08 0$0) Suspension of Work Curren#fy, the aufhor~ty ofthe Buifding Officer~o stop construcfion is mosfEy fimited to errors ~n permit issuance or tt~e failure to follow the technical codes Howe~er, other ~iolations of bath Murnc~pai and State iawfrequen#ly occurdurmg canstruction These vivlatrons mciude excessi~e noise and failure to follow City required construc#ion mitigation measures The Un~torm Admrnistrative Code ~s s~lent an the abrl~ty of the Build~ng O~ficer to susper~d wark or revoke a permit for violatians such as thesE To cianfy intent of the City to enforce ~ts ov-rn regulations, the proposed amendment w~ll authorize the Bwfding Officer tv suspend or revoke a perm~t when CEty related construction requirements and standards are n~t being followed (See Section $ O8 070} Build~ng Address Nurnbers Frequently, commercial buildings may use se~era~ numerical addresses Th~s pract~ce 6 poses two areas of concerr~ With~~at adequate restr~ct~ons, addresses can char~ge over time for the same portion of a building Ar~dresses can also change ta a different build~ng on the same parcel Reasonable rules are necessary to protect record mtegrity for build~ng and land use a~provals Another area af concern ~s the al~ifity to quickly ident~fy a building for emergency services When a building f~as several addresses, eme~g~ncy personne! mus# often review addresses at each mam entrance on one or mare burldmgs to frnd the address m questian A remedy to these problems is to limit the address for any main build~ng ta ane main numeric address during its lifetime Tl~is provision wil! Staff believes t~a# the thresholds shown in the Appendix Chapter appiy to all buildings in need of repair This wili ensure that aid is available to repair darnaged s#ructures ~rom any source and fhat outimed irt Attachment A ln order to address c~imatic, tapographical anct geological conditions that place demands on emerg~ncy se~vices, the City has adopted Su~plemental Fire and 5afety Prevention Requirements for a number of years, mcluding a fire spr~nkler requirement thaf a~pl~es ta all new construction The fire sprinkler amendmen~s arE necessary because in the event of an earthquake or other ma~or d~saster, the Fire ~~~artment must depend on built-in fire suppression systems to e~ctmgu~sh or limrt fires m those structures so that they da not spread to the older structures This reduces the potential demand from simultaneous inc3dents on emerge~cy services resources The following are the local amendm~nts • Continue to requ~re automatic fire extinguishing and detection systems in a11 new construction and wh~n there is a change in use to a higher classificatian (SEe Section 8 44 050) • Continue to require compiiance with the high-rise pra~isions of the CafEfornia Buildtng Code in new high rise buifdings with human accupancy abo~e 55 feet of fi~e lowest le~el of fire ~ehicle access point in accordance w~th authority granted to the City in the California Health and Safety Code Sec#ion 13215 (See Section 8 44 090} • Cantinue to require automatic fire sprmkler systems for existing public assembly spaces above 5,D00 square feet that protect assembly arsas and exit ways (See Section 8 44 050) ~ Continue to requ~re the connectian with control val~es on each floor le~el with full au#omatic sprinkler sys#ems in any new building with floors mare than 55 feet in height (See Sectian 8 44 090) ll + Continue to prohib~t the use of non-~~re re~ardan# wood shingles or non-fire retardant woad shakes for new or replacement raafing and require a moderate le~el of local amendments to the Cafifornia Electrical Code are n~cessary for a number of urnque local conditions The California Electrical Code does not address electncal safety requirements for non-construction related alectrical equipment, including portable electrical equipment and machinery The unregukated use af s~ch equipment poses a potential safety ~azard to c~tizens and property in Santa Monica by incr~asmg the risk of fire Based upon the local conditions outlined in Attachment A, it ~s necessary to enact local amendments to the electrical code ta ensure fire safety and prevent acciden~s fram electricaf procedures and appliances The local amendments include the following + Ensure that ar~y wirmg not ha~ing metal protection o~er t~e conductors sf~ai~ t~e entirely cancealed r-vith~n the buifdmg structure to pre~ent and Enhibit tampermg and restrict the use of aluminum wiring found to be l~azardous (see Section 8 24 030) • Proh~brt the sale and use of any electrrcal materral, de~rce, or equipment unless rt complies w~th pro~isions of this section, including rating and conformance wEth national standarc~s (see Sectian 8 24 040) ~ Pro~~de regulat~or~s for temporary Section 8 32 050) SEISMIC RETR4FIT STANQARDS The California Buildmg Cade is a se# o# buifding standards whose pnmary use is for the des~gn and construct~on of new structures Because it ded~cates only one chapter to ex~st~ng bu~ldings, this code does not speak to tl~e ~n~que er~g~neer~r~g cha!ler~ges presented dur~ng the repair ar rehab~l~tation of buildings These challenges ~nclude equi~afency of aiternaf~ves and the extent of repair requireci fo meet the ~ntent of the code State law, in recognizmg these facts, mandated a11 cities and counties ta ~se the Uniform Gade for Butiding Conservation (U C B C), Appendix 1 for the se~smic rehab~litation of structures w~th unre~nforced masonry bearin~ walls ThES code g~ves alternatxve values for materials no fonger allowed ~n the current Cal~forn~a Buildmg Code The most current edition of the U C B C now also gives gu~dance for the retrofit vf concrete tilt-up buiidings The next ed~t~on, due to be publ~shed ~n September 1999. wiil also mclude retrafi# standards for non-duct~le concrete and saft story apartments These standards are essentiai~y compfete and are proposed as the retrof~t standards to be adopted by this ord~nance Modificataons are made to the language of these standards ta accommodate the mandatory status 14 Because the City already has mandatary retrofit programs for its seismically wlr~erable structures, [t ~s naw necessary to adopt standards that reflect ach~evable goais for #hese existir+g huildings These standards were develaped m conce~t with and by the Structural Engineer's Associat~on of Cafifornia (SEAOC} SEAOC is responsible for de~eloping the earthquake regulations that appear ~n the Uniform Bu~lciing Code Th~rr ~xperrence m creating and their suppart in adoptmg these standards will ensure thatthe retrafitstandards are thorough, ach~evable and will meet the C~ty's mtent ta protect the life safety of ~ts c~tczer~s durtng earthquakes Certain admmistrat+ve features are being added to the existing requirements to enhance the~r +mplementatron These fea#ures ~nelude • improv~ng defirnt~ons of the building types affected • requir~ng all alterat~on permits ta include the retrofEt work unless minar m nature • recording not~ces on properties so that future owners will understand their obligat~on ta retrofiit the i~uildmg they are buy~ng • mak~ng ~t unlawful to occ~py bu+ld+ngs that dfl r~at meet tt~eir obl~gat~ans wftY~~n the t~me periods altowed Unre~nforced Masonry Build~ngs In addition #o the aforemen#ioned amendments, new requirements are added to better de~ne the strength af ex~sting unremforced masonry walls Tests of existing wafls afe already requ~red and th~s amendment w~ll better def~ne the test procedure This codification of the test pracedure will ensure that the strength values reported for unreinforced masonry walls are not overestirnated (see Chapter 8 60} 15 Concrete and Reinfarced Masonry Buildings The ex~stmg retroft# requirements address oniy one ciass of bucidmg m w~ich heavy walls are attacF~ed to a flexible roof concrete tilt-up buEldings The proposed amendrnents wiil include reinforced masonry and paured in piace concrete wall buildings when th~y ha~e the same madequate roof connectroRS As was demonstrated durmg the Nort~r~dge Earthquake, heavy mass wails, whether concrete or masonry, will accelerafe away from lighter flexilale roofs unless adequate connections exist Adding the smalf number of bu~ldirtgs ~ncfuded rn #hese two other classes, w~ll ensure t~at ail bu~ldrng ty~es wtth th~s structural weakness are addressed Th~s will ~mplementthe fegisfati~e intent of the onginal Qrdmance ta protect public safety and welfare a~d reduce the assoc~a#ed demand far emergency servrces One other ~mportant arnendment is to change the year of construct~on for affected bt~~ld~ngs A~ter t~e Sylmar Earthquake, roof cor~nections for these b~~~dmgs were t~rst improved ~n the 1976 Uniform Building Gode As a resul~, most retrofit standards before the Northridge Earthquake. referenced pre-1976 construction as problematic Howe~er. other ~mpartant code req~~rements nave changed for these struct~ares and tY~e~r cor~nect~ons fn 199~, the Uniform Building Code ~ncreased the strength requirementofconnect~onsfifty peresnt for the middle port~on of the roof s#ructure based on actua! acce~erat~on read~ngs of waod roofs in whrc~ ~uild+ngs r~eed to be included tn #he scope of the mandatory requirements (see Chapter 8 64) Wood Frame- Unbolted Hauses and Small Apartment Buildings One new voluntary retrofit standard ~s b~~ng added to the mun~c~pa! code Chapter 8 68 addresses the need to bolt down pre-1940 houses to th~ir faundations and strengthen the weak walls that support ra~sed floor constructian Th~s retrofit standard ~s essent~aJly the same as the draft ~ersion of Appendix 6 of the Uniform Cade for Build~ng Conservation. 20~0 Edition This chapter will set pro~isions for the number of bolts, plywood sheathing and other cannections tha~ wi[I meet the intent of the current building cocie provisions for proper connection of a small wood frame dwellEng to ~ts supports The strengthen+ng provisions af
