Introduction
This report recommends that the City Council adopt a resolutIon of mtentlon to vacate
public utility and nght-of-way easements located at Wilshire Place and Fifteenth Court
alleys adjacent to the Santa MOnica-UCLA Medical Center The resolutIon sets a publrc
hearmg on the proposed vacatlon of these easements
Back~round
From Its inception m 1926, Santa MOnica Hospital Medical Center functioned as a non-
profit, full-service, community-based medIcal center As a result of the 1994 Northndge
Earthquake, the hospItal suffered Significant structural damage, reqUlnng temporary
closure FollOWing substantial mtenm structural repairs, the hospital tower reopened In
1995, with requirements established by the Office of Statewide Health Planning and
Development that the hospital tower must either be replaced or upgraded to current codes
by 2003
In August 1995, the hospital was acquired by the UmverSlty of California (UCLA), and
renamed the Santa MOnica-UCLA Medical Center (SM-UCLA-MC) Followmg a detailed

assessment of the earthquake damage, and completIon of the SM-UCLA-MC Master Plan
Study, UCLA determined that repairing the hospItal tower would prove unacceptably
disruptIve to patient care and not be cost effective Instead, they recommended the
replacement of the tower and the acqUisition of three commerCial properties fronting
Wilshire Boulevard which would accommodate this bUIlding In conjunction With the
acqUIsition, UCLA has requested that the City take action to vacate the publiC utility and
right-of-way easements located In Wilshire Place South and Fifteenth Court alleys (see
Attachment A for a map of the subject area)
DIScussion
The proposed site for the replacement medIcal faCIlity encompasses the entire City block
bounded by Wilshire Boulevard and Arizona Avenue, between 15th and 16th Streets In
conjunction With Its acquIsitIon of the parcels along Wilshire Boulevard, UCLA requests
that the City vacate Its public utility and rlght-ot-way easements located In Wilshire Place
South In addition, they request the vacation ot publIC utility easements reserved by
Resolution Number 3610 (CCS) adopted In 1967 In connection With the vacation of the
rlght-ot-way easement In a portion of 15th Street Court
Legal deSCriptions of properties are deSCribed In Exhibit A ot the attached Resolution
Completion of the vacation proceedmgs shall be contingent upon 1) UCLA obtammg
ownership otthe properties located at 1512-1524 Wilshire Boulevard and 1502 WIlshire
Boulevard I and 2) taking all steps necessary to relocate eXisting utility faCilities to the
satisfaction of each utility proVider The relocatIon Will be performed at UCLA's sole

As required by law, the City will publish and post notices of the publIc hearing regarding
the proposed vacation of these easements to take place at 7 00 P m on August 10, 1999

No financial Impact to the City IS anticipated as a result of the vacation of these public
access and utility easements
Recommendation
Staff respectfully recommends that the City Council adopt the attached Resolution of
Intention which Will set a public hearing on the proposed vacation of public utility and rlght-
of-way easements In Wilshire Place South and 15th Court alleys

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DECLARING ITS INTENTION TO ORDER VACATION OF EXCESS STREET
RIGHT.OFwWAY AND PUBLIC SERVICE UTILITY EASEMENTS IN WILSHIRE
PLACE SOUTH AND 15TH COURT ALLEYS IN THE CITY OF SANTA MONICA
WHEREAS, the City of Santa MOnica has determined that the publiC nght-of-way
and publIC servIce utl/rty easements rn the real property descrrbed In Sect/on 1 and the
attached Exhibits A and B (the "Property") of thiS Resolution are no longer needed for the
purposes acquired and that said excess public nght-af-way and the publiC service utility
easements located therem are not needed for street or any other public use; and
WHEREAS, The Regents of the University of California, a Callforma Constitutional
corporation ("University of Call forma") owns or will acquire certam real property abutting the
Property and has requested that the City vacate the street nght-af-way easements and
publIC service utility easements located on, above, or beneath the Property m order to
faCilitate Its construction of a replacement facility for the Santa MOnica-UCLA Medical
Center (the 'ProJect"), and
WHEREAS, there are currently active publiC service utility lines and appurtenant
structures ('Utility Faclhtres") located on, above or beneath the Property, which WIll reqUIre
relocation, and
WHEREAS, the Envrronmentallmpact Report ("EIR") for the Project provides that
the University of California Will relocate Utility FaCilities affected by the Project at Its sole
cost and expense,

WHEREAS, as a conditIon to the vacation of the publIc right-of-way and public
service utility easements located on, above or beneath the Property the City will require
that the University of California, at Its sole expense, take all steps necessary to assure
relocation of the Utility FaCilItIes to the satisfactIon of each respective utIlity proVider, and
WH EREAS, vacation of the Property must be completed In order that the Umverslty
of Callforma may proceed With the constructIon of the Project In accordance With the EIR,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS
SECTION 1 The City Council of the City of Santa MOnica declares Its intention to
order vacation of the excess publIC street right-of-way easements and publiC service utility
easements located on, above and beneath WIlshire Place South and 15th Court alleys In
the City of Santa Monrca, as more particularly described In the legal descriptions set forth
In ExhIbit uA'j, and depIcted In the draWing attached as ExhibIt "B", both of which are
attached hereto and Incorporated herein by reference
SECTION 2 Completion of the vacation proceedmgs and recordation of a
resolution ordenng vacation of the public right-of-way and publiC service utlhty easements
shall be contmgent upon the UniversIty of CalIfornia (I) obtaining fee Simple ownership
of the properties located at 1512-1524 Wilshire Bou levard and 1502 WilshIre Boulevard,
and (rr) taking all steps necessary to relocate eXlstmg Utility FaCIlities to the satisfaction of
each respective utility proVider and the University of California's bearing of all costs
associated With the relocation of the Utility FaCilities
SECTION 3 The City CounCil of the City of Santa Monrca In vacating the Property
described In Section 1 of thiS Resolution, elects to proceed In accordance With the
prOVIsions of the CalJforma Streets and Highways Code, Part 3, "Public Streets, Highways
and Service Easements Vacation Law", Chapter 3, "General Vacation Procedure"

Interested In or objecting to the proposed vacation proceedings may appear before the City
Cou nC11 and offer eVidence In relation thereto
SECTION 5 The Director of EnVironmental and PubliC Works Management
Department IS hereby directed to cause notices of street vacation to be posted as required
by California Streets and HIghways Code Section 8323
SECTION 6 The CIty Clerk of the CIty of Santa MonIca IS dIrected to cause notIce
of the date, hour and place of the publiC heanng to be published once a week for at least
two consecutive weeks pnor to the heanng as required by California Streets and Highways
Code SectIon 8322
SECTION 7 The City Clerk shall certify to the adoption of thIS ResolutIon, and
thenceforth and thereafter the same shall be In full force and effect
