Introduction
This report recommends the City Council approve an Initial Study and Negative
Declaration and adopt a resolution establishing Preferential Parking Zone VV for the
area bounded by Santa MOnica Boulevard, Centrnela Avenue, Colorado Avenue and
Yale Street (excluding Yale Street), and allOWing restnctlons to be posted on blocks
Within this zone where residents have submitted required petitions
DISCUSSion
The resolution establishes Preferential Parkmg Zone W for the area bounded by Santa
MOnica Boulevard, Centrnela Avenue, Colorado Avenue and Yale Street (excludmg
Yale Street, Yale IS part of eXlstmg Zone II) The proposed parkmg restnctlons for Zone
VV are "Two-Hour Parkmg, 800 am to 500 pm and No Parkmg 500 pm to 800 a m
Monday through Fnday, and No Parking anytime Satu rday and Sunday, except by
permit" Parking restnctlons and benefits wlil apply on a gIVen block wlthm thiS zone
after staff has received and venfled petitions as reqUlrf d by the MUnicipal Code At thiS

The resolutIon also amends Exhibit A (Preferential Parkmg Zones) of Resolution 9344
CCS (Resolution of the City Council of the City of Santa MOnica Re-Establlshmg
Vanous Preferential Parking Zones) to Include Preferential Parkmg Zone W
The proposed zone IS a mix of multi-family and smgle family residences Commercial
busmesses are present on Santa Monica Boulevard and portions of Colorado Avenue
Background
Initially, only Franklin Street between Broadway and Colorado petitioned and qualified
for the postmg of preferential parkmg signs However, staff recommends a larger zone
be established (bounded by Santa Monica Boulevard, Centlnela Avenue, Colorado
Avenue and Yale Street) With the anticipation that the residents of surrounding streets
may want to be Included m the zone at a later date ThiS approach of establishing a
larger zone allows those who might be affected by the regulations In the future to be
aware of them and participate In their development It has been successfully
Implemented m the past By establishing a larger zone, preferential parkmg for
adjacent streets can be Implemented when petrtlons are receIved from the residents of
the street Without the need to proceed With the CounCil approval process I n addition,
residents and busmesses Within the larger zone receives mformatlon about the
proposed zone and can conSider and comment on ItS potentIal consequences

Staff conducted parking studIes on Franklin Street on a Tuesday between 700 am and
8 00 pm, on a Thursday between 7 00 pm and 10 00 pm, and on a Saturday between
7 00 am and 3 00 pm DUring the weekday, daytime hours, the average occupancy
was about 53% with a peak occupancy of 69% In the early morning After 5 00 pm, the
average occupancy Increases to 74% with a peak occupancy of 88% On Saturday
between 700 am and 300 pm, the average occupancy was 89% with a peak
occupancy of 107% (indlcatmg Illegal parking) Vehicles associated with the Nessah
Center cause the primary Impact to parking In the area, although reSidents also
comment on Impacts due to employee parking and parking associated with auto repair
facilities Based upon the study results, staff recommends the parkmg restrictions
outlined In this report, with parking restricted to reSidents only dUring the mghtlme, when
demand IS greatest, and two-hour parking during the day, to accommodate some of the
need for commercial and guest parking
Commumty and Business Meeting/Input
A community meeting was held on Wednesday, June 23, 1999 at 700 pm to gather
Input on the proposed preferential parking zone ReSidents and busmesses m the
affected area were mVlted to attend and comment For those that could not attend,
written comments were also accepted
Approximately 50 people attended the meetmg, Including reSidents and
businesspersons The major pomt of diSCUSSion throughout the evemng was the Impact

attributed to the operation of the Nessah Center located at 1515-1517 Franklin Street
Plannmg and Community Development Department staff have provided a summary of
Issues and actions related to the Center as an attachment to thIs report Busmesses,
the Chamber of Commerce and the Nessah Center were notified of and attended the
meetmg One business person was very concerned about negative Impacts on hIS
busmess, because he has Inadequate off-street parking for his employees
By show of hands at the meeting, attendees preferred no parkmg except for residents,
followed closely by no parking restrictions at all Only two attendees preferred the
recommendation of staff Comment sheets submitted by people at the meetmg Included
seven from people who wanted more restrictions than proposed, SIX who felt that more
regulation or enforcement of Nessah Center would eliminate the need for preferential
parking and one who did not want preferential parkmg
Eighteen residents and seven business representatives also wrote to the City on thiS
issue The residents were spilt on whether they supported preferential parking Those
who wanted It generally lived on or close to Franklin Street and felt that the parking
problems are serious Those that were opposed did not live on Franklin Street, felt that
on-street parking IS generally available, and objected to having to pay fees for permits
or go through the Inconvemence of providing permits to guests The businesses were
all concerned about the Impact of parkmg regulations on their busmesses, particularly
on the availability of customer or client parkmg A petition agamst preferential parking
m thiS area was Signed by about 36 residents of the area as well as business

representatives and employees, and submitted by Santa MOnica Chevrolet No
regulations Will be Implemented on any street unless reSidents representing a mlnlmum
of 67% of the unIts on the street support the regulations
Staff recognizes that preferential parking has benefits as well as drawbacks The
recommendation IS Intended as a compromise which balances the need for restrictIons
where the problem IS acute against the negative consequences of very restrictive
regulations throughout the neighborhood The greatest benefit Will be to those who are
disrupted nights and evenmgs by parkers and nOise associated With parkers
Businesses Without long-term employee parkmg, or those With clients and customers
who tYPically spend more than two-hours on Site, or come In the evenings, may be the
most negatively affected It may be pOSSible to modify meter hour and time limIt
restrictions on the commercial parking to address these problems on a location by
location baSIS
An alternative evaluated was proVISion for employee parking on the street, but
employee parking does not appear to be a serious problem for a Significant number of
bUSinesses In the area
EnVironmental ReView
An mltlal study was prepared for the proposed parkmg zone In accordance With the
proVISions of the California EnVironmental Quality Act Based upon the mltlal study, a
negative declaration has been prepared All documents are attached to thiS Staff

obtam permits, and to Issue the permits
Preferential parkmg signs Will be Installed within a week prtor to the desIgnated start
date of enforcement

Initially, It IS estimated that approximately 200 permits will be purchased by area
residents In the proposed zone ThiS Will generate approximately $3,000 annually In
additional revenue In FY 99/00 at accou nt 01415 400290 The preferential parkmg
signs Will be Installed by City crews

It IS recommended that the CIty CouncIl
1 Approve the negative declaration for the proposed zone
2 Approve the attached Resolution establishing Preferential Parkmg Zone Wand

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ESTABLISHING PREFERENTIAL PARKING
ZONE W AND AMENDING RESOLUTION NUMBER 9344 (CCS) BY
REPLACING EXHIBIT A
WHEREAS, the Parking and Traffic Engineer has received a petition requestmg
the establishment of a preferential parking zone, and
WHEREAS, the petItIon has been verified to be signed by residents living In two-
thirds of the dwelling units comprlsmg not less than fifty percent (50%) of the developed
frontage of the proposed preferential parking zone; and
WHEREAS, the Parkmg and Traffic Engmeer has undertaken such studies and
surveys deemed necessary to determine whether a preferential parkmg zone should be
designated In the above area, and
WHEREAS, the Planning DIVISion has prepared the required Imtlal Study and
Negative Declaration, and
WHEREAS, the CIty CounCil hereby finds that the proposed area meets the
designation criteria set forth In Municipal Code Sectron 3 08 040,
NOW THEREFORE THE CITY COUNCil OF THE CITY OF SANTA MONICA
RESOl VES AS FOllOWS
SectIon 1 Preferential Parking Zone VV IS hereby established The regulations
for Preferential Parking Zone VV are as follows
(a) The follOWing named and described streets Within the City
shall constitute Preferential Parking Zone W the area
bounded by Santa MOnlca Boulevard, Centmela Avenue,
Colorado Avenue and Yale Street (excludmg Yale Street)
(b) No vehicle shall be parked or stopped adjacent to any curb
m Preferential Parking Zone W for more than two hours
between the hours of 8 00 a m and 5 00 pm, Monday
through Friday, and no vehicle shall be parked or stopped
adjacent to any curb In Preferential Parkmg Zone VV

between the hours of 500 pm and 800 am, Monday
through Friday, or anytime, Saturday and Sunday
(c) Preferential parkmg restrictions shall be posted In each
eligible block wlthm the zone upon receipt and verification of
a quahfiYlng petition representing two-thirds of the dwellmg

(d) Any vehIcle parked or stopped without a permit when
reqUIred by thiS Section may be removed from the street by
any police officer
(e) The annual fee for each permit Issued for PreferentIal
Parkmg Zone VV shall be $15 00 per permit, or such other
fee as may be established from time to time by resolution of
the City Council

15 an excellent Idea We recently moved to Colorado Avenue from Anzona Avenue The
parkmg permIts that we had over on Anzona A venue helped assure that the resIdents of
that area had suffiCient parkmg Currently, It IS somewhat dIfficult to find parkmg near
our house on Colorado Avenue when we need street parlong WIth all of the new
busmesses openmg on or near Colorado A venue In our area, we are concerned that. III the
near future, It wIll be even more dIfficult than It IS now to find parking near our house

We understand that you may be able to help us Several months ago, we moved
from Anzona Avenue to Colorado Avenue The traffic along Colorado Avenue m front
of our house IS unsafe While we do not have a radar, It seems that dnvers routinely
reach speeds of 50 to 60 miles per hour along this stretch In additiOn to bemg unsafe,
this makes It difficult for us to back out of our dnveway In the morning
We also have two young children who frequently travel In strollers Dnvers who
were traveling at excessive speeds have, more than once, nearly hit these strollers when
makmg nght turns from Colorado onto sldestreets such as Yale or Stanford We believe
that measures are needed to slow these dnvers down
We do recognIZe the work that t ty has done to decrease traffic on Colorado
and m ~afer (e g smgle lanes, no Ims dunng rush hour), and we do appreciate
It ~e ess, thiS stretch has no stop IS or lights from CentlOela to Stewart We
woule late It If the City would plac~ stop SignS at the lOtersectlons of Colorado and
Yale an, mford. at a mlmmum

Dear Mr Fuchlwakl,
I am opposed to the r:estncted parking proposed for my neighborhood.
We are mostly a residentIal' community and on my street In particular It is
the renters who want the parkmg restncted. As a condo owner, ) have my
own parkmg and I will continue to live on thIS street long after the
temporary residents have moved on.
af course...the people on Franklin's 1500 block have sIgned the
petition. I don't blame them' They are all across from the temple or
school or whatever It IS that takes up all the parkmg In the neighborhood
on Saturday mormngs' It /5 a mghtmare dUring the times thIS temple has
a function for people who live here.
But then since I am an owner, I really don't have a parking problem. I
am afraid that once you restrict parking on that block, the people gOing to
that temple Will overflow onto the other surrounding blocks and sadly thiS
WIll only exacerbate the Situation further.
.. The actual problem IS that thiS temple IS inconsiderate to Its
neighbors by not providing some kmd of parkmg With a shuttle service for
Its VISitors Clearly there are parking lots nearby and people could be
shuttled in for the events at this place. ThiS would prevent the .local
reSidents from being inconvenienced by restricted parkmg. and pass the
inconvenience onto the place that has created It. Why should we Impose
restrrctlons that Will annoy the reSidents as well as VISitors, when It IS
thIS partIcular establishment causmg the problem?
If we needed any restriction. I would much prefer no overnight
parkmg except by permit ThiS would guarantee that no one but reSidents
-- renters and owners -- park In the neighborhood. lIke Beverly HIlls does
They manage to keep Crime down that way too. I am senousl opposed to
the severe restrictions opposed In our neighborhood. Please phone or
write me as to the com,ttee's deCISion since' will be out of town for the
meeting.

Nessah Center and this Issue IS, of course, of great Importance to me.
I have lived at this address for eIght (8) years and the parking and
subsequent congestion In our neighborhood has become completely out of
hand.
Although my address reads 3201-B Colorado Avenue, Santa MOnica, CA
90405- My entire bUilding IS situated on the corner of Franklin and
Colorado and entrances for all aoartments In the bUlldlno are solelv on

Franklin Street There IS no off street parklng.1 have worked actively for
the preferential parking and have been assured that our bUilding will be

Our qUiet resIdential neighborhood has been a Victim of the enormous
growth of the Nessah Center (last week alone, I could NOT park wlthm
three blocks of my home on three consecutIve days!) and we feel that as
residents, we deserve the rrght to park.

SInce we are unable to attend the town meetmg on June 23, thiS letter IS m response to the
matlmg we received regardmg preferential parkmg consideratIon 10 the nnd-cIty
neighborhood bounded by Santa Momca Boulevard, Centmela Avenue, Colorado Avenue
and Yale Street
We have lIved on Frankhn Street south of Santa MOllica Blvd and north of Broadway for
the past 13 years and street parking has been a constant problem At first tlus was mainly
due to our close proximity to the boulevard and the Santa MOllica Group automotive
service center on the comer of Santa Momca and Franklin whose workers not only park
their cars on our street but also the cars of their customers These businesses have not
gone away and now the problem has escalated to mclude (#1) The Nessah Hebrew
Academy at 1537 Franklin Not only do they park and walk on weekdays and evemngs
but also on Saturdays, which IS especially horrendous It IS extremely difficult to come
and go and run normal Saturday morrung errands because you wdl not find parking on
the street when you return unttl well mto the afternoon This problem expands to
surroundmg streets as well causing residents to hterally park blocks away from their
homes 'We're sure you're aware that when you're carrying bags of groceries home you
would hke to be able to park as close to the house as pOSSible (#2) The new Chevrolet
dealer on the comer of Santa Momca and Centmela We know for a fact that employees
park on Frankhn then walk to work One day we spoke to a gentleman who was worlang
on hiS car parked on Franklin and he volunteered that he worked at the Chevrolet dealer
He left his car parked there and proceeded to walk to work We believe the problem
could be alleViated by peront parkmg for residents
We know readmg a letter doesn't do Justice to a problem as only hvmg It can, so we
would InVite you to spend some tIme on our street, especially on Saturday mormngs, to
see for yourself but you probably won't find any parkmg Feel free to call if you have

My family have lived In 1437 Franklin Street, Apt 3. since 1980, 19 years In the
same address/apartment, and my children have grew up here, went to school
here, etc
The parking situation has been bad Since my famIly and I moved in In 1980 and
no solutions have been offered/done
1 st - there was that car repaIr shop In the corner of Franklin and Santa Monica
Blvd The company used our street to park the cars they were gOing to repair
and have already repaired only waiting for the owners to pick them up
NOW - There's the church on Franklin Street between Broadway and Colorado
The church goers (by the hundreds) park In our street as well
We come home from work, from runnrng errands, ete and find absolutely no
parking and are forced to park several blocks away' It has been gOing on since
we moved In In 1980
I am glad some outstanding citizens have said "enough IS enough, we need to
claim back our streets", and have now worked to this pOint of getting a resolution
to thiS pressing parking problem We need permit parking

My family have lived In 1437 Franklin Street, Apt 5, since 1978, 21 years In the
same address/apartment, and my children have grew up as "Franklin Street, SM
girls"
The parking situation has been bad since my family and I moved In In 1978 and
no solutions have been offered/done
1 st - there was that car repair shop In the corner of Franklin and Santa MOnica
Blvd The company used our street to park the cars they were gOing to repair
and have already repaired only waiting for the owners to pick them up
NOW - There's the church on Franklin Street between Broadway and Colorado
The church goers (by the hundreds) park In our street as well
We come home from work, from runnrng errands, ete and find absolutely no
parking and are forced to park several blocks away I It has been gOing on since
we moved In In 1978
I am glad some outstanding citizens have saId Uenough IS enough, we need to
claim back our streets", and have now worked to this pomt of gettIng a resolution
to this pressIng parking problem We need permit parkmg

RE Preferential Parking
Dear Mr Fuchlwakl,
On behalf of my company, VVPA CommUnication, Inc , I would Implore the city NOT to
Implement the proposed preferential parking It would place a tremendous burden on my
employees and their quest for parking dunng the week, and In turn, a burden on WPA
Additionally, when clients comes to our Office, It reflects poorly on our Santa Monica
bUSiness If they do not have convenrent parking The parking situation In the Roberts
BUSiness Park, located on the 2900 block of Colorado Blvd, at where our office eXists, IS
inSUffiCient at two spaces per office We must have street parking available to us We have a
difficult time as It IS on Mondays and Thursdays when street cleaning hinders parking from
one Side of the street
We have researched alternatIve parking arrangements, most recently at the MGM complex at
26th and Colorado, but It IS too costly for our small company \^Je sought out the special
parking permits through the City of Santa MOnica, but those deSignated areas are too far
from the office and are not feaSIble for my employees Street parking IS our only resource
As PreSident of VVPA Communications, Inc 1 I urge you NOT to Implement preferential
parking

Our company, SCA Data Systems, is located in the Robert'. Business Park, 2912
Colorado Av If the preferential parking proposal currently under consideration is
adopted, we will be compelled to move our business-most likely out of Santa Monica.
The hardship imposed by this proposal would be componadod because we renewed our
lease a month or so ago, based on the assumption that street pIrkiDs would continue to be
available
Our building has 10 business units and 10 two-tpace tandem ..... slota. We
currently have four spaces, but anticipate beiDa reduced to two (ODe taDdem slot) within a
couple of months. We have five employees DODe ofwhom lives ia tbe ~1IU!diate area or
even near to public transit Now. we use one space of Hiil1lt parking. Shortly, we will
requrre three. There is no long.term pF)-~ of renting Idditional space in our parking
lot. When the currently vacant office units are leasecl no spare slots wiD. be available
We are keenly aware that the local parking Jituatioa is 4iffiaJk. nil it, however, .
mixed-use zone and the proposed parking restridioD does oat properly tab ipto account
the needs of local busine8l. The 'DO parking 5:00 PM to midnight provision is
particularly discriminatory. Very few small businesses in today. economy can operate
on a nine to five schedule. We routinely remaia open until eight or n;~ ~ as do a
number of our buainess neighbors. These propo~~ ~ ~mp1y. untenable for us.
Please reconsider creating this parking zone; I don't believe that it i. in the interest of the
City to cceIto unrentable office space in this now vibrant area.

We the undersigned residents of the area III the proposed preferentIal parkIng zone are
adamantly opposed to the establIshment of thIS zone and want to regIster our strong oppositIon
for the follOWIng reasons
1. As 18 year residents of the area we have never found the parlang to be unduly
inconvenient and most certainly not now particularly during daytime hours.
2. Our condominIum project and we expect most of the other mostly apartments and
condominiums III the area have no proVISIOns for guest parking.
3, With the proposed zone will we then always have to wait WIth permit in hand at the
curb for guests to arrIve? On occasion we have entertaIned a number of couples for dinner
and wIll we now have to provide valet parkmg If we have more cars than pennits in order to
be gracious hosts? We believe the preferential parkmg zone IS an Ulmecessary nuisance
4 The prolIferatIon of preferential parking wIll only make matters worse In adjacent
areas so that ultimately all of Santa Monica will have to be a preferential permit parkmg zone
5. PreferentIal parking is bad for the environment because it encourages residents of
such areas to buy and use more automobIles than they have off-street parkIng spaces for
6. Fmally is this a proposal about parking or is it about bigotry? Both of the proposed
restrIctIons and one in partIcular concern parkIng on Saturdays and Sundays Are the
proposed restrIctions really dIrected at the JeWIsh congregation on Franklm that meets on
Saturdays and other rare relIgious hohdays and the Black congregatIon at comer of Berkeley
and Colorado that meets on Sundays?

SUMMARY OF PLANNING AND ENFORCEMENT ACTIVITIES
RELATED TO NESSAH CENTER
On July 10, 1998 the Southern California Nessah Education and Cultural Center filed a
Conditional Use Permit (CUP) application to allow construction of a 19-space parking lot
on an adJacent lot The project was deemed complete on March 23, 1999 While the
project was onglnally scheduled for Planning Commission review In Apnl, the heanng was
continued to review the site history and eXisting arbitration agreement and IS stili pending
The audItorium was bUIlt In 1958 by the Seventh Day AdventIst Church as a "church and
school recreation bUilding" The sIte was used by the Seventh Day Adventist Church as
a K-8 elementary school and for religious SOCial actiVities In a recent letter to the City, the
Seventh Day Adventist Church states that the actiVities conducted at the subject property
Included "all actiVities associated With a school and all SOCIal actiVities associated With a
church'J (Source Letter from Senior Pastor dated May 12, 1999 )
The Southern California Nessah Education and Cultural Centeroccupled the site sometime
after 1987, and accordmg to their CUP application, operates prrmanly as a place of worship
With nursery school/child care durrng week-days and other educational actiVities durrng the
evenings and on Sunday
The present use of the site for religious and educational activities IS consistent With the
prior use of the site The standards eXisting In 1958 allowed the construction of schools
and churches In thiS district as of right, and no parking was required The use IS now
considered a legal non-conforming use sInce religiOUS Institutions now require a
Conditional Use PermIt In thiS dlstrrct
The site has been the SUbJect of a number of zoning complaints from 1990 to the present
Prrmary Issues Include nOise, hours of operation, Inadequate on-site parking, traffiC, alley
traffiC, and use of a vacant lot for parking FollOWing complaints In 1995, the Nessah
Center and representatives of the neighborhood entered Into an arbitration agreement In
an effort to resolve on-going disputes City representatives also participated In the
arbitratIon sessions Complaints regarding nOise, hours of operation, parking and traffic
problems continue Complaints about the use of the vacant lot adJacent to the Center for
parking were also filed which resulted In the filing of a Conditional Use Permit At the
request of reSIdents, and In an effort to confIrm any potentIal VIolatIons such as nOIse
Violations, nightclub activities or alcohol sales or service, the site was Inspected and
monitored for Code Violations for a continuous 30 day perrod In November and December
of last year DUring the perrod of reView, no Violations were documented Staff continues
to monitor the site but to date, no Violations have been observed
WIth regard to the CUP application currently under reView, the addition of 19 parking
spaces Will not result In compliance With current parking requirements for a place of

worship The Nessah Center apparently uses 80 off-site parking spaces, In addition to 21
on-site spaces, for ItS operations The applicant has been requested to submit Information
regarding the off-site parking used for the Nessah Center pnorto the Planning Commission
