On February 23, 1999, the Counci! modified the Planning Cammission's approval of DR
98-OD2 to allow expansion of Pacific Park`s hours of operat~on, amended the hol~days
when the Park is ~ermitted expanded operating hours, and appro~ed spec~al haurs for
up to 24 pri~ate e~ents at the amusement park annually, based on th~ findings
contained in the attached Statement of Official Action

(c} A s~gn prov~ding notification that the amusement park will be closed to
t~e general public shall be prammently posted on the pier two weeks prior
to a special private party
(d} Pacific ParK shall be directiy responsible for all private party act~v~ties

re~ised hours of operation, the Park operator shall pay thirty thousand dollars
{$3U,OOO,OU} to the City of Santa Monica to fund one-year of these additional
Police ser-rices. Pacific Park's costs for subsequent years will be adjusted
based upon an analysis by City staff of the cost of pro~iding the additional
Police patrol service.
Validity of Permits
12 In the event perm~ttee v~olates or fa~ls to comply with any candi#i~ns o# appra~al of
t~is perrnit, no further permits, licenses, appro~als or certificates of accupancy shalf
be issued untd such violation has b~en fully remedied
13 Within ten days of Planning Di~is~on transmittal of the Statement of Official Act~on,
pro~ect applicant shall sign and return a capy of the Statement of Offic~al Action
prepared by tF~e Plannmg Division, agree~ng to the Conditions of approva~ and
acknowledging that fadure to comply with such condit~ons shall constitute grounds
for potential revocation of the permit appro~al By signing same, applicant shall not
thereby waive any legal rights applicant may possess regarding said conditions
The signed Statement shall be returned to the Planning D~vision Fadure to comply
with this cor~dition shall constitute grounds for potential permit re~ocation

unless, in the case of new development, a building permit has been obtained A

Monitoring of Conditions
15 Pursuant ta the requ~rements of the Public Resources Code Sect~on 21081 6, the
City Planning Di~~sion wdl coordinate a monitoring and reporting program regarding
any required changes to the pro~ect made in con~unction with pro~ect approval and
any conditions of appro~al, including those conditions intencled to m~tigate or avoid
significant effects on the en~ironment This program shall include, but is not limited
to, ensuring t~at t~e Planning Di~is~on itself and other C~ty di~isions and
departments such as the Budding D~~ision, the Departmen# of Env~ronmental Public
Wor~CS Management, the F'ire Department, the Police Department, the Commun~ty
and Econom~c De~elopment Department and the Finance Department are aware
of pra~ect requirements wh~ch must be satisfied prior to issuance of a Building
Permi~, Cert~ficate of Occupancy, or other permit, and that other responsible
agencies are also mformed of conditions relatmg to their responsib~litEes Pro~ect
owner shall demonstrate compl~ance with conditions of approvaf in a written report
subm~tted to the Director of Plannmg and Community Deve[opment and Buildfng
Officer pr~or to issuance of a Bwl~mg Permit or Certificate of Occupancy, and, as
applicab[e, provide periodic reports regarding compl~ance with such conditEOns
