INTRODUCTION
This report provides the following information
1 Results of the atywide sign inventory,
2 The proposed procedure for notification of business and property owners of the
nonconforming status of signs,
3 The general process for removal of nonconformmg signs and approval of new or
modified signs
The report further recommends that Council approve a process and standards for
designation of ineritorious signs, as developed with input from the Planning Commission,
Architectural Review Board, Landmarks Commission, the business community and the
community at-large
BACKGROUND
Section 9 52 210(d) of the City's existmg Sign Code, adopted in 1985, establishes a time
frame for removal of signs that were lawfully installed before adoption of the code and

Removal of Nonconforminp Siqns and Compensation
California Business and Professions Code Sections 5490-5497 limit the extent to which
cities can regulate "on-premises advertising displays " Section 5491 states that "no on-
premises advertising display shall be compelled to be removed or abated without
payment of fair and ~ust compensation " There are a number of statutory exemptions to
the requirement of~ust compensation For instance, a aty can require that signs located
m redevelopment pro~ect areas be removed without providing compensation Additionally,
compensation is not requued for signs which meet all of the following (a) the display is
located within an area shown on a local general plan as being residential, (b) the d~splay
is located in an area zoned for residential use, (c) the display is not required to be removed
due to an overlay zone, special sign zone, or olher speaal zoning district, and (d) the
display is allowed to remain in existence for a fifteen year period from the date of the
adoption of a local sign ordinance
Siqns In Redevelopment Areas
A total of 596 of Santa Monica's nonconforming signs are located in redevelopment areas
(Attachment B) Of these nonconforming signs, 377 are freestanding signs, 92 are roof
signs, 24 are upper level signs, and 103 are pro~ecting signs
Siqns in Residential Areas
A total of 84 of Santa Monica's nonconformmg on-premises signs are located in residential
areas Of these, 73 are freestanding s~gns, 6 are roof signs, 4 are pro~ectmg signs and 1
4
is an upper level sign
As stated, State law provides certain other exceptions to the compensation requirement
Staff is assessing whether any of the City's nonconforming signs faii withm these other
exceptions
Different state statues regulate bdlboards Pursuant to Business and Professions Code
Section 5412, compensation is generally required before a billboard must be removed As
with on-premises signs, however, there are several exceptions to this compensation
requirement, although these exceptions tend to be more limited Staff is rewewing whether
any of these exceptions apply to the limited number of billboards m the City
Notification of Business and Property Owners
Phase II wdl consist of the following steps to ensure that business and property owners are
appropriately notified
1 Notification of affected business and property owners Staff is prepared to send
the notification in Attachment F in early April Each notification letter wdl indicate
the category of nonconforming sign(s) together with a copy of the photograph
of the nonconforming sign Additionaily, staff has worked collaboratively with the
Chamber of Commerce in an effort to minimize the impact of compliance on
businesses, and to prowde them a clear direction and unambiguous process
To this end, the notification packet will include a separate letter from the
~
Chamber to convey this collaboration
2 Outreach to the business community Since early 1998, the Santa Monica
Chamber of Commerce has participated in discussions regarding the sign
inventory and the requirement to remove nonconforming signage m Apnl 20D0
The Chamber of Commerce has created a Sign Enforcement Task Force to
address busmess concerns regarding the removal of nonconformmg signs The
City Planning Division, as part of an ob~ective in the 1998/99 budget, included
funding to contract with a consultant who is attuned to the needs of the business
commurnty and with the ability to act as liaison between the business community
and the City process The consultant wdl make presentations to vanous
business groups, the Chamber of Commerce, and local merchants' groups and
will be available from the time the first letters are sent through the entire
processing penod
3 Second Notification Letter A reminder letter wdl be sent out to property and
business owners in late September 1999, approximately six months prior to the
conformance date with detatled information regarding the application procedure
to obtain approval of new or modified signs
Process for Removal of Nonconforminp Sipns and Approval of New or Modified Siqns
Since the adoption of the 1985 Sign Code, staff has advised ARB applicants of the
reqwrements for removal of nonconforming signs Under the current Sign Code,
businesses have planned their sign programs with the understanding that any

nonconforming signage specified in Section 9 52 210(d) is required to be removed or
modified by April 2000 The Sign Code allows nonconformmg signs to be refaced unfd the
conformance date, if the sign has not been abandoned for more than 90 days and the sign
was not remodeled, except for normal repair or maintenance
In addition, the application forms for new busmess licenses and business license renewals
given to all business owners have contained a notice regarding the year 2000 conformance
for nonconforming signs every year since the 1997-98 fiscal year
The Planning Commission discussed the process for removal of nonconforming signs at
their February 10 and 17, 1999 meeiings (Attachment C) The Planning Commission
expressed the need to establish a clear and timely process for business and property
owners to follow in removal, modification and replacement of signs The Planning
Commission also expressed the need to provide adequate education regardmg the
process to give business and property owners ample opportunity to conform to the Sign
Code with the least amount of negative impact on their business The Planning
Commission was concerned with the large number of signs that will require some sort of
City processing and suggested that either a lottery system be implemented to determine
the order of review, or that the city establish an administrative process to review sign
applications
Staff expects a substantial increase in the number of sign applications associated with
bringmg 680 nonconforming signs into conformance (596 in redevelopment areas and 84

in residential areas) Applications for new signage or modified signage must be reviewed
and approved For some businesses with multiple signs, conformance may be as simple
as removal of one sign For businesses with multiple nonconforming signs or whose only
signage is nonconforming, approval of new conforming signage will be necessary
5ome business owners may request approval of a sign ad~ustment to retain their
nonconformmg signs Two findings must be made to grant a sign ad~ustment (a) that the
strict application of the Sign Code would result in practical difficulties or unnecessary
hardships inconsistent with the general purpose and mtent of the Sign Code or that there
are exceptional arcumstances or conditions applicable to the proposed sign that do not
apply generally to other signs and (b) that the grantmg of a sign ad~ustment would not
adversely affect public safety or public welfare and would not be detnmental or in~urious
to property and improvements in the surrounding area, and that the sign will be harmonious
with the site Staff believes that only a small number of nonconforming signs will meet the
required findings for an ad~ustment
Planning staff is working to develop a recommended procedure for approval of
replacement signage or modification of nonconformmg signs Staff expects to bnng this
recommended procedure to the City Counal in early summer
Contract Amendment
Establishing the procedure for replacement signs, together with the thorough notification
process outlmed above, will reqwre additional professional services on the part of
Larkm/Lamb Assoaates Larkin/Lamb's onginal contract amount was $80,000 The

additional services are beyond this origmal scope of work These additional serwces are
estimated not to exceed $25,000 Funds exist in the current budget FY 98/99 to provide
funding for this phase of the pro~ect
Mentorious Siqns
In February 1998, the Planning Commission expressed concern that there may be
nonconforming signs worthy of preservation due to their historic, cultural or aesthetic merit
In discussion, the Plannmg Commission referred to these potentially significant signs as
"meritorious " The Planning Commission requested that the Architectural Review Board
and the Landmarks Commission consider possible critena for a mentorious sign category
and return to the Planning Commission with their recommendations The
recommendations of the Architectural Review Board and Landmarks Commission to the
Plannmg Commission and the subsequent Planning Commission recommendations are
included as Attachments C, D and E The following summanzes their comments
Architectural Rev~ew Board (ARB)
• Use a procedure similar to a variance appiication, with the ARB as the
decision-making body
• In order for a sign to be eligible to qualify for consideration as a meritorious
sign, it must fall withm at least two of the following categories
1 Histoncal/dated and antique or aged signs
2 Techniques and craftsmanship
3 Icons
4 Integral
5 Beach signs
. If the sign fits into two or more categones, the application would be brought

before the ARB, or Planning Commission on appeal, and at least one of two
findings must be made in order to approve the mentorious sign and allow
preservation of the otherwise nonconforming sign
1 The sign is well designed, well-constructed and aesthetically
pleasing, contnbutes to the overall image of Santa Monica as a
place of beauty, creativity and individuality, or contnbutes to the
visible and histonc built environment
2 The sign has an inherent character or quai~ty which may be
considered aesthetically qwrky, funky, representative of pop art
or humorous and contributes to the overall image of Santa
Monica as a place of interest and folklore, exhibitmg distinct
wsual or textual examples of social and cultural development
• Mentorious sign designation should not reqwre the sign to be preserved
without the business owner's approval
Landmarks Commissron
. Focused on histonc signage
• Recommended that histonc signs be addressed m a manner simdar to the City
of Pasadena's ordmance for designation of historic signs
. Suggested modification of the Pasadena ordinance by adding a provision for
the Commission's histoncal significance review of nonconforming signs
installed pnor to 1975 (rather than 1960 in the Pasadena ordinance)
• Recommended at least one of two criteria listed m the Pasadena ordinance
must be met m order to designate a sign as historically significant
1 The sign is exemplary of craftsmanship, design, or style consistent
with the penod dunng when it was constructed if the sign has been
altered, it must be restorable to its historic function and appearance
2 The sign possesses extraordinary aesthetic qualities, creativity or
innovation, and findings to that effect are made to the Landmarks
Commission

. Critena should focus more on the specific design of the sign and less on the
materials used to fabricate the sign

• Limit the extent to which techniques and craftsmanship and icons are used as
criteria for meritorious signs
• Nonconforming signs should be considered on their individual design ment
• Signs categorized as icons should be limited to signs whose busmesses are
unique to Santa Monica or Southern California
. Use Pasadena cntena of any sign mstalled prior to 1960
• Important to establish clear definition of a mentorious sign and identify
potential mentorious signs early in the process to eliminate any false hope on the
part of business owners that their sign could remain due to its meritorious status
. The number of inentorious signs is relatively small, possibly as few as 20
signs
Although no exact number has been determined yet, staff agrees with the Planning
Commission that the number of potentially mentorious signs is small To properly identify
and fairly evaluate mentorious signs, staff will retain an expert m the field of signs and
environmental graphics within the next two months This expert wdl help to identify unique
or meritorious signs
Staff has synthesized the input of the Planning Commission, ARB and Landmarks
Commission and reviewed the sign codes of several cities, including West Hollywood,
Riverside and Pasadena Based on this synthesis and further review, staff proposes the
following cntena for designating mentonous signs
A sign shall/may be designated as "meritonous° if the sign was installed prior to
January 1, 1960, and meets one or more of the following cntena
1 The sign exemplifies technology, craftsmanship or designs of the period when
it was constructed, and may contain neon, unusual lighting techniques, hand
pamted lettering or graphics or sculpted elements
2 The sign is an icon representative of a certain era or generation of popular
culture that exemplifies the history, ideals, or particular aesthetic of the City of
Santa Monica and/or southern California, including mventive representation of

the use, name or logo of the bwlding or business, or
3 The sign is integrated into the architecture of the buddmg or enhances the
architecture of the budding
Staff recommends that the Councd establish a streamlined review and designation process
for mentonous signs Given the complexity of the issues, staff proposes that the City
Council establish a review board composed of the following five representatroes
• Member of the Architectural Review Board (appointed by the Board)
• Member of the Landmarks Commission (appointed by the Commission)
• Member of the Planning Commission (appointed by the Commission)
• Member of the busmess community (recommended by the F~cecutive Committee
of the Chamber of Commerce)
. Community representative at-large (appointed by the Counal)
The Review Board would identify all the signs eligible for mentorious designation at one
time Once the list is established, all business and property owners wili be sent the list of
mentorious signs and advised of the application procedure for a meritorious sign if they feel
a sign was overlooked The list will then be certified by the Plannmg Commission,
appealable to Councd By September, when the second notification letter is sent, all
potential meritorious signs wdl have been reviewed and, if appropriate. designated The
Mentorious Sign Review Board would be dissolved after the final designations have been
certrfied
Should Councd agree to the process outlined above, staff wdi reiurn within the next 90
days with ordinance amendments to implement the process

BUDGET/FINANCIAL IMPACT
If compliance is reqwred citywide, those property owners and businesses located m
commeraal areas, and outside redevelopment areas, must be compensated for the cost
of removal and replacement of signage Depending on how costs are estimated, the funds
required to compensate these business and property owners would be significant
The City Council appropnated $200,000 in FY 98/99 in account 01-210-266-00000-5506-
00000 with which to fund Phase II (current phase) of the sign pro~ect As noted above,
Larkin/Lamb Associates' scope of work will require a contract amendment in order to
establish the procedure for replacement signs and implement the notification process This
amendment is estimated at $25,000 This contract amendment would be funded through
the FY 98/99 appropnation Staff recommends that the City Council authorize the City
Manager to negotiate and execute a contract amendment with Larkin/Lamb not to exceed
$25,000 Staff are evaluatmg the possible need for additional funding to be included in the
City's Proposed Budget for FY 1999/00
RECOMMENDATION
It is recommended that the Councd
1 Provide input on the mentonous sign criteria
2 Direct staff to mitiate an amendment to the Sign Ordinance to exclude
meritorious signs from the reqwrements of Section 9 52 210 (d) and create
the designation and certification process for meritonous signs
3 Authonze the City Manager to negotiate and execute a contract amendment
with Larkin/Lamb Associates not to exceed $25,000

SUBJECT Planning Commission Recommendations Regarding Nonconforming Sign
Removal Process and Mentonous Sign Cnteria
This memorandum contains the Planrnng Commission's comments and recommendations
from the February 3, 1999 and February 10, 1999 Special Meetings regarding the process
of removal of nonconforming signage per Section 9 52 210 (d) of the Santa Monica Municipal
Code and recommendations regarding cntena for a meritonous sign category
Process
The Planning Commission felt that development of a clear process by which businesses and
property owners wdl remove or modify nonconforming signage was key in order to be
business-fnendly and necessary to address and process the volume of nonconformmg signs
?he Commission believes that an important part of the process is education, includmg
information to businesses and property owners regarding which signs are nonconforming,
when removal or modification must occur, and which signs may be able to be retained due
to their mentonous status The Commission believes that it is important to not create false
expectations regarding meritonous sign status For most businesses the only options wdl be
removal or modification of nonconforming signs The Commission noted that businesses and
property owners must be given sufficient time to plan and prepare new or modified signage
for the business The Commission felt that it would be unfair to deprive businesses of
signage for any length of time and this consideration should be included m planning the
process
The Planning Commission expressed concern regardmg the number of businesses that will
have new, modified or potentially meritorious signs requiring review and approval One
suggestion for dealmg with the volume was a lottery system to assign the date for public

heanng and/or processing of applications Another suggestion was some sort of incentive
for early conformance such as a staff level approval, rather than Board review The Planning
Commission was concerned that the number of signs involved could not be handled by the
ARB, especially given the average number of items regularly before the Board The Plannmg
Commission suggested that careful consideration be given to whether ARB, staff or a created
body review and approve new and modified signs as part of the conformance requirements
Meritonous siqns
The Planning Commission had specific comments regarding the recommendations of the
Architectural Review Board and the Landmarks Comm~ssion Overall, the Commission noted
that the purpose of the nonconforming section is to get all nonconforming signs modified or
removed, and that only a very few, perhaps 20 signs, may qualiTy for retention as mentorious
signs The Planning Commission stated that a clear definition of ineritonous signs and early
identification of potential mentonous signs is essential so that business owners do not
assume that their signs can be retamed
Specific Planning Commission comments related to the ARB criteria
Item 1(H~storical/dated and Antrque or aqed s{qns) The Planning Commission found this
category to be the most problematic, particularly 1(c) Some members felt that meritorious
status should be specific to design and not focus as much on the materials One issue is
whether or not the materials are an integral part of the sign The Commission expressed
concern regarding weaihering as critena for mer~torious sign status A beloved sign that is
weathered may have charm, but inclusion of weathering alone is not sufficient criteria
Item 2(Techniques and craftsmanshrp (h~stonc or penod)) The Plannmg Commission felt
that the use of technology or sign type as critena could be too broad They feit the case
might be made that any pole sign is a type of sign from a specific period of time/technology
and is therefore worthy of preservation
ltem 3(lcons) The Planning Commission believes this category needs to be more narrowly
defined Icons such as McDonald arches or Kentucky Fried Chicken bucket are not speafic
to Santa Monica or southern California alone An icon would only be significant as a
meritonous sign if it was the ongmal or the only one of its kind The Planning Commission
thought that this category should only include icons specific to Santa Monica or southern
Cahfomia The Pengwn sign, as an example, may be mentonous for the Penguin itself, but
not for the associated signage The Norm's sign may be mentorious since Norm's is a
southern California chain of restaurants
Item 4(Integra!) The Planning Commission supported this category If a sign is part of the
architecture of a building, it should be considered as a possible meritonous sign

Speafic Plannmg Commission comments re Landmark Commission recommendations
The Planning Commission felt that the cnteria outlined by the Landmark Commission are
reasonable but favored the Pasadena standard that includes consideration of any pre-1960
sign
Beyond those comments, the Planning Commission felt there should be some "front-end"
winnowmg process or proactive approach that could identify mentonous signs Some
Commission members felt that meritonous signs should be identified prior to the mailing of
notification letters to businesses A business would be notified that an additional option to
removal or modification might be designation as a meritonous sign
Several Planning Commissioners expressed concern regarding the process of identifying
meritonous signs Commissioners suggested that an early review of the sign inventory could
identify possible meritonous signs An urban planner or architect hired as a consultant, or a
review board composed of several disapl~nes, including members from the Landmarks
Commission, ARB and Planning Commission could perform this early review Another
suggestion was an internal review by staff of the sign inventory to determine which signs
might qualify for meritonous status An appeal process was discussed with appeals either
referred to the Architectural Review Board or to the Plannmg Commission
Another suggestion was a"charette" (a French word used by designers to mean a wsual
brainstorming session) process where through a slide show of the nonconforming signs, a
panel of board/commission members, staff, hired consultants and the public identified signs
worthy of preservation The Planning Commission also suggested that meritorious signs
should be looked at all at the same time to ensure consistency in the measure of worthiness
The Commission felt if the charette process was utilized, the ARB criteria might be more
appropriate because it does allow for broader interpretations than the Landmark Commission
criteria

to recognize and preserve non-conforming "mentonous" signs which, d not specifically
approved by the Architectural Review Board under codified cntena, would be required
to be removed in the year 2000
At several meetings, the Architectural Review Board discussed the vanous types of
nonconforming signage which exists m the city and the critena that might be used to
ascertain wh~ch signs are worthy of preservation The Board determined that a method
is necessary to screen potential applicants to a~oid a barrage of inentorious s~gn
applications which must then be reviewed by the Board The Board suggests that a
procedure similar to a vanance request be used On Apnl 6, 1998, the Board approved
the following outline for consideration of ineritonous signs
DRAFT "MERITORIOUS" SIGN LANGUAGE
A mentorious sign permit may be approved by the Architectural Review Board in order
for specific existing non-conforming signs to remain in place after the year 2000 In
order for a sign to be eligible for Architectural Review Board approval as a mentonous
sign it must fall within two or more of the foliowing categones based on its aesthetic
value and contnbution to the specific visual context of Santa Mon~ca

or business inception, etc

aged the paint is weathered, worn, faded, or peeling, the metal work is
rusted, oxidized or patina-finished, such as bronze, silver or gold which is
worn and antique in quality, etc The lightmg may be weak, and if it is
defined under this category, is not reqwred to be renovated, repainted or
repaired

2. Techniques and craftsmanship {histor~c or period)
The sign is exemplary of technology, construction, craftsmanship or
design of a past oenod when it was constructed using methods which are
no longer typical The sign uses penod materiais and means of
illumination, and is not significantly altered from its ongmal (or histonc)
form In some cases, the sign m4~ have been created by means that no
longer exist as m a lost art or craft (We have used the word "histonc" but
we may want to consider a word that is more specific )
Histonc or penod sign matenals may include sheet metal, iron, solid
metafs such as bronze, porcefam enamei, wood, etc Histonc or penod
means of dlumination shail include exposed incandescent light fixtures
and neon tubmg In some cases, animation of lightmg is part of the
onginal design If a sign is chosen to be mentorious, then all originally
intended illummation must be renovated and m good workmg order if a

The sign is representative of a certam era or generation of popular culture
that exemplifies the history, ideals or particular aesthetic of the City of
Santa Monica, and/or Southern California More often than not, this
category would make it possible to preserve signs which may be
considered oversized signs or environmental designs that typically portray
a business logo, logotype or imagery system that is easdy recogrnzable to
the public Typically such a sign becomes a popular icon, representing an
image that is a metaphor for more than the origmal business logo, and
that represents the era, or the generation, when the sign was produced
In some cases, the graphic design, quality, colors or lighting could
possibly be considered "kitsch" or "in bad taste" by the general public, but
appropnate when taken in the context of the bigger picture of preserving
the popular cultural icons that reinforce our past, and exemplify the
"urban-fabnc" and the unique appeal of the City of Santa Monica

categones, the application for a meritonous sign may be brought to the Board for
approval The Architectural Review Board, or the Planning Commission on appeal,
must make one or both of the following findings m order to approve a mentorious sign

The sign is well designed, well constructed and aesthetically pleasing,
contr~butes to the overall ~mage of Santa Monica as a place of beauty, creatiwty

whether or not to leave the sign in place, but approvai of the permit does not require
