Introduction
ThiS report recommends that the City Council adopt Addendum No 1 tD the Final
EnvlrDnmental Impact RepDrt (FEIR) and approve the final design for the Cloverfleld
Boulevard Widening ProJect. Phase II ThiS repDrt alsD recDmmends that the City Council
authonze the City Manager to negotiate and execute an agreement and adopt related
resolutions to allow the purchase and sale of adjOining property necessary to the
Cloverfleld Boulevard Widening Project
Background
As part ofthe enVIronmental review for the Colorado Place. Water Garden, and Arboretum
developments. various alternatives were analyzed to mitigate traffic The Widening of
Cloverfleld Boulevard was Identified as the best mitigation measure to Improve traffiC
Circulation In the Special Office District The City prepared an Environmental Impact
Report and. follOWing evaluation Df comments and a public heanng Dn August 11, 1992,

the City Council certified the FEIR forthe widening of Cloverfleld Boulevard from the Santa
Monica Freeway (Route 10) to 390' north of Colorado Avenue
New Sidewalks, street trees, street lights, upgraded and synchronized traffic signals, and
modifications to the eXisting storm drainage system to accommodate the Widening are part
of the project Onglnally proposed Phase II Improvements consisted of Widening
Cloverfleld Boulevard from Michigan Avenue to north of Colorado Avenue and narrowing
26th Street between Cloverfleld Boulevard and OlympIC Boulevard The onglnal design
required removal of nine Tlpuana "Tlpu" trees along the west Side of Cloverfield Boulevard
north of Colorado Avenue on property owned by the State of California, Department of
Motor Vehicles Due to the low survival rate anticipated In removal and relocation of these
well established trees, the Impact of mamtainlng the current Width north of Colorado
Avenue was subsequently analyzed In the attached Addendum to FEIR As Indicated
below, It IS now recommended that no Widening occur north of Colorado Boulevard
Smce only mmortechnlcal changes or additions are necessary to make the FEIR adequate
under CEQA. and conditions necessitating preparation of a subsequent EIR have occurred,
the City has determined that an Addendum to the FEIR is appropnate Proposed changes
to the project are not substantial and Will not result In Significant new environmental effects
or a substantlalmcrease m the seventy of preViously Identified Significant effects
The Addendum evaluated whether the reduction In the number of southbound approach

lanes to the Intersection of Cloverfield Boulevard and Colorado Avenue would result In a
significant traffic Impact USing the traffic forecasts for the year 2002 as developed In the
Project EI R for the AM and PM peak hours, the analysIs examined whether the elimlnalion
of the Widening on the west Side of Cloverfield Boulevard north of Colorado Boulevard
would create a significant Impact on the level of service at the Cloverfield/Colorado
intersection and determined that there would be no change In the level of service from the
onglnally cerilfled project There are no other changes to the environmental Impacts
Identified In the Final EIR or any significant new Impacts and therefore approval of the
proposed project change would not result In any Significant environmental Impacts
Property Purchase and Sale
As part of the overall settlement of one of the eminent domain actions filed by the City for
property acquIsition necessary to Phase I of the Cloverfleld Boulevard Widening Project,
staff negotiated the sale of surplus City Yard property and excess street right-of-way to the
affected private property owner City Council conceptually approved thiS settlement In a
closed session on January 12, 1999, subject to all necessary public actions by City Council
for approval of the acquIsition and settlement The Superior Court was Informed of the
potential settlement on January 19, 1999
DISCUSSion
When Phase II of the Cloverfleld Boulevard Widening project was last before the Council
In December 1 997. one commercial property owner along Cloverfleld Boulevard expressed
concerns about the Impacts of the proposed Widening on eXisting drainage, loss of on-site

and off-sIte parking, and site security As a result of the discussions with this property
owner. a portion of whose property will be acquired by eminent domain for the prOJect, the
following design modifications have been made
26'h Street between CloverfJeld Blvd and Olympic Boulevard will accommodate 14
on-street metered parking spaces along the west side of 26th Street
Seven additional parking spaces will be created along 26th Street, requIring vacation
of approximately 1200 sq ft of excess pavement to the adjacent property owners
to replace lost parking
A chain link fence will delmeate the private property at 1723 Cloverfield Boulevard
Drainage problems on 26t" Street will be resolved
Another design feature for thiS area along 26th Street IS the elimination of excess paving
In favor of landscaping ThiS area will be Irrigated and planted with Mediterranean Fan
Palm. Queen Palm. Pink Melaleuca. and a variety of drought-tolerant shrubs and
ground cover
Property Purchase and Sale
The City hired an appraiser to value all of the properties required for Phase I of the
expansion proJect. including a portion of property along Delaware Avenue The appraised
amount of S 10,500 for the Delaware property was deposited with the Court as payment to
the property owner As ItS bUSiness operations would be affected by the City's acqUISition
of a portion of that property. the City conSidered the sale of ItS surplus contiguous property

Negotiations with the property owner resulted In agreement to sell a portIon of surplus City
Yard property and a portion of the excess right-of-way at the southeast corner of Delaware
Avenue and High Place, subject to obtammg all necessary approvals of the City Council
(City staff has confirmed that the City obtamed the fee title to the High Place property at
the time of two subdivIsions, In 1906 and In 1923) These approvals Include adoptmg
Resolutions Walvmg Advertising ReqUIrements for each ofthese parcels, and commencing
street vacation proceedings to allow for the sale of the excess right-of-way Descriptions

A. INTRODUCTION
Document Purpose.
This Addendum NO.1 ("Addendum") to the Environmental Impact Report concems the
proposed redesign of the Cloverfield Boulevard Widening Project to eliminate the third
southbound approach lane north of the Colorado Avenue intersection The information In
this Addendum IS a companion document to the Final Environmental Impact Report
("FEIR"), published in July 1992. The FEIR includes the Draft Environmental Impact
Report, the comments and responses to comments received on the DEIR, and the
Mitigation MOnitoring Program.
The Cloverfield Boulevard Widening Project was proposed to Widen Cloverfield Boulevard
between Broadway and the Santa Monica Freeway, plus modifications to Side street and
ramp terminal approaches to intersections along this segment of Cloverfield Boulevard
South of Colorado Avenue, Cloverfield Boulevard IS proposed to be Widened to
accommodate three lanes In each direction. The portion of Cloverfield Boulevard north of
Colorado Avenue IS proposed to be Widened to accommodate a third southbound lane. but
only two northbound lanes Due to environmental concerns related to tree removal along
the west Side of Cloverfield Boulevard north of Colorado Avenue, the City proposes to
delete the Widening north of Colorado Avenue so that there will continue to be only two
southbound through/approach lanes on Cloverfield Boulevard at Colorado Avenue The
Impact of thiS change IS analyzed In thiS document for any potenllallmpacts It may have
on the enVIronment ThiS information. presented herein as an Addendum to the EIR,
constitutes an addition to the DEIR and the FEIR, and shall supersede statements
contained In the FEIR, If In conflict
Environmental Procedures.
ThiS Addendum to the project EIR has been prepared pursuant to the requirements of
Section 15164 of the California Environmental Quality Act (CEQA) GUidelines and as
administered by the City, as the Lead Agency, to prOVide additional analYSIS to Insure
compliance With CEQA.
Section 15164 of the State CEQA GUidelines states that:
(a) The lead agency or responsible agency shall prepare an addendum
to a previously certified EIR If some changes or additions are necessary but
none of the conditions desCribed In Section 15162 calling for preparation of

a subsequent EIR have occurred.'
(b) An addendum to an adopted negative declaration may be prepared
If only minor technical changes or additions are necessary.
(c) An addendum need not be circulated for public review but can be
Included in or attached to the final EIR or adopted negative declaration.
(d) The decision-making body shall consider the addendum with the final
EIR or adopted negative declaration prior to making a deCISion on the
project
(e) A brief explanation of the deCISion not to prepare a subsequent EIR
pursuant to Section 15162 should be Included In an addendum to an EIR,
the lead agency's reqUired findings on the proJect, or elsewhere- In the
record. The explanation must be supported by substantial eVidence
Since only mmortechnlcal changes or additions are necessary to make the FEI R adequate
under CEQA, and none of the conditions described In Section 15162 calling for preparation
of a subsequent EIR have occurred, the City has determined that an Addendum to the
Section 16162 of the State CEOA GUIdelines proVides

When an EIR has been certified or a negatIVe declaration adopted for a proJect, no subsequent EIR shall be prepared
for that project unless the lead agency determines. on the baSIS of substantial evidence In the light of the whole record.
one or more of the follOWing
(1) Substantial changes are proposed In the project which will reqUire major reVISions of the prevIous EIR or Negative
Declaration due to the Involvement of new slgmficant environmental effects or a substantial Increase In the seventy of

(D) Mitigation measures or altemabves which are conSiderably different from those analyzed In the prevIous
EIR would substantially reduce one or more slgmficant effects on the enVironment, but the project proponents
decline to adopt the mItigation measure or alternative

FEIR IS appropnate More specifically, the proposed changes to the project are not
substantial and will not result In new significant environmental effects or a substantial
Increase in the seventy of previously Identified significant effects.
B. ENVIRONMENTAL ANALYSIS
This Addendum addresses whether any changes to Impacts evaluated In the Draft and
Final EIRs would occur as a result of the elimination of the widening of Cloverfield
Boulevard north of Colorado Avenue. EXisting conditions, mitigation measures and
cumulative Impacts evaluated In the Draft and Final EIRs are incorporated by reference
unless otherwise noted herein.
Since the City proposes to eliminate the Widening of Cloverfield Boulevard north of
Colorado Avenue, the City hired Meyer, Mohaddes Associates, Inc (MMA) to evaluate
whether the reduction In the number of southbound approach lanes to the Intersection of
Cloverfield Boulevard and Colorado Avenue would result In a Significant traffic impact
Level of Service Analysis with Previous Project
Traffic forecasts for the year 2002 were developed In the Project EIR for the AM and PM
peak hours Table 1 below summanzes the levels of service at the Cloverfield/Colorado
Intersection With and Without the previously proposed project.

Cloverfield Colorado Intersection from Level F to Level D In both the AM and PM peak

Level of Service with Revised Widening Project
The levels of service at the Cloverfield/Colorado intersection were evaluated, assuming
that the prevIous forecasts for the year 2002 would still occur (I.e , no diversion away from
Cloverfield due to the reduced capacity on the southbound approach to Colorado), but with
only two southbound lanes on Cloverfield at Colorado. The widening to three southbound
lanes would stili occur south of Colorado Avenue. Table 2 below summanzes the levels
of service at the Cloverfield/Colorado intersection with the revised lane configurations in
companson to the previously proposed proJect.

The elimination of the third southbound lane has no effect on the level of service or V/C
ratio In the AM peak hour because the northbound traffic volumes are the more cnllcal
volumes In the PM peak hour, the level of service does not change from level of service
o as a result of the elimination of the third southbound lane, but the V/C rallo could
Increase by 0 012, Ifthe southbound volume of traffic on Cloverfield Boulevard remains the
same Without the third lane If the V/C ratio Increased by 0012. this would not be
considered a significant Impact The threshold of significance that was used In the
Cloverfield Widening Project EIR to evaluate this project's Impacts was a change In V/C
ratio of 0 020 or greater at an intersection which would be operating at LOS E or F Had
the third southbound through lane not been Included In the onglnal project descnptlon, the
Intersection would have been forecast to operate at LOS D, with a vie ratio of 0839. an
Improvement of 0.196 In the V/C ratio In companson to the No Project Alternative The
change In the proposed project descnptlon therefore does not result In a negative traffic
Impact It stili provides a Significant Improvement over the No Project Alternative.
It should be noted that the traffic forecasts mcluded In the EIR assume that additional traffic

will be attracted to Cloverfield Boulevard as a result of the capacity enhancement and
congestion reduction associated with the proposed project. A total of 280 additional
vehicles are added to the southbound approach at the Colorado Avenue intersection In the
AM peak hour and 351 are added in the PM peak hour as a result of the widening of
Cloverfield Boulevard. Without the widening north of Colorado, some of these vehicles
which would have been diverted from alternate routes to southbound Cloverfield, between
Broadway and Colorado, may deCide to remain on the altemate routes. If only 10% of the
southbound traffic added to Cloverfield, north of Colorado, as a result of the Widening
project were to remain on those alternate routes, the change in VIC ratio in the PM peak
hour associated with the elimination of the third southbound lane would be reduced to
0001
There are no other changes to the environmental Impacts Identified In the Draft and Final
EIRS or new Significant environmental Impacts which would occur as a result of the
elimination of the third southbound lane north of Colorado Avenue.
C. CONCLUSION
Level of Significance of Potential Environmental Impacts Resulting from Proposed
Modifications to Project.
The proposed change In the design of the Cloverfield Widening Project Will not result In a
significant traffic Impact. There Will be no change in the level of service at the
Cloverfleld/Colorado Intersection as a result of the elimination of the third southbound
approach lane. It Will continue to operate at LOS D In both the AM and PM peak hours in
2002 With the revised proJect, as compared to LOS F In both peak periods Without the
project There Will be no change In the V/C ratio In the AM peak hour and a less than
significant change In the VIC ratio in the PM peak hour. Furthermore, If only 10% of the
traffic attracted to southbound Cloverfield Boulevard by the Widening project were to
remain on the alternate routes forecast for the No Project Alternative, the change In V/C
ratio would be Imperceptible (+0 001) Therefore approval ofthe proposed project change
would not result In any Significant envIronmental Impacts

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
WAIVING ADVERTISEMENT REQUIREMENTS AND AUTHORIZING
THE SALE OF SURPLUS PROPERTY LOCATED AT THE CITY YARDS IN BLOCK
29 OF ERKENBRECHER SYNDICATE SANTA MONICA TRACT
WHEREAS, the city of Santa Monica ("City") has determined that
the real property described in Section 2 of this Resolution (the
"Property") is no longer needed for any City Yards purpose and that
said property is not needed for any public purpose; and
WHEREAS, the city has received from Samuel Kardashian, doing
business as Southern Cal~fornia Disposal company and owner of real
property adj acent to the Property, an offer to purchase the
Property for the sum of THIRTY-EIGHT THOUSAND EIGHT HUNDRED NINETY
SIX DOLLARS AND NO CENTS ($38,896.00) which is the fair market
value of the Property according to an appraisal analysis conducted
by City'S consultant; and
WHEREAS, pursuant to Santa Monica Municipal Code Section
2.24.110, real property may be sold without advertising for bids if
the City Council, by resolution adopted by at least five
affirmative votes, determines that to advertise for bids would be
to no avail and would cause unnecessary expense and delay or would

not be in the best interest of the City; and
WHEREAS, since the Property is less than 5,000 square feet in
area, it is exempted from Government Code Section 54222
requirements that written offers to sell or lease the Property be
sent to state and local recreation and housing agencies;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Public advertising for bids on the Property
described in section 2 of this Resolution is hereby waived because
the adjacent property owner, Samuel Kardashian, has made an offer
to purchase at a price equal to its fair market value, and to
advertise would cause unnecessary expense and delay, would be
unlikely to bring a higher price, and would not be in the best
interest of the city.
SECTION 2. Subject to compliance with all applicable
provisions of State and local laws, the City Manager is hereby
authorized to sell the Property described in Exhibit A and depicted
in Exhibit A-I, Drawing No. 4580, attached hereto and incorporated
herein by reference, to Samuel Kardashian.
The purchase price for
the Property is the sum of THIRTY-EIGHT THOUSAND EIGHT HUNDRED
NINETY-SIX DOLLARS AND NO CENTS ($38,896.00). The sale of the
Property shall be SUbject to each and every condition set forth

in the Agreement of Purchase and Sale and Joint Escrow Instructions
between the city and Samuel Kardashian.
SECTION 3.
The City Manager is authorized to execute all
instruments and do all things necessary to effectuate the sale.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
WAIVING ADVERTISEMENT REQUIREMENTS AND AUTHORIZING THE SALE OF
EXCESS RIGHT-Of-WAY PROPERTY LOCATED AT THE SOUTHEAST CORNER OF
DELAWARE AVENUE AND HIGH PLACE IN THE CITY OF SANTA MONICA
WHEREAS, the City of Santa Monica ("City") has determined that
the real property described in Section 2 of this Resolution (the
"Property") is no longer needed for any City street purposes and
that said property is not needed for any public purpose; and
WHEREAS, the City has received from Samuel Kardashian, doing
business as Southern California Disposal Company and owner of real
property adjacent to the Property, an offer to purchase the
Property for the sum of SIXTY-FOUR THOUSAND THREE HUNDRED NINETY
DOT~ARS AND FOUR CENTS ($64,390.04) which is the fair market value
of the Property according to an appraisal analysis conducted by
City's consultant; and
WHEREAS, pursuant to Santa Monica Municipal Code Section
2.24.110, real property may be sold without advertising for bids if
the City Council, by resolution adopted by at least five
affirmative votes, determines that to advertise for bids would be
to no avail and would cause unnecessary expense and delay or would
not be in the best interest of the City; and

WHEREAS, since the Property is less than 5,000 square feet in
area, it is exempted from Government Code Section 54222
requirements that written offers to sell or lease the Property be
sent to state and local recreation and housing agencies;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. Public advertising for bids on the Property
described in Section 2 of this Resolution is hereby waived because
the adjacent property owner, Samuel Kardashian, has made an offer
to purchase at a price equal to its fair market value, and to
advertise would cause unnecessary expense and delay, would be
unlikely to bring a higher price, and would not be in the best
interest of the City.
SECTION 2. Subject to compliance with all applicable
provisions of State and local laws, the city Manager is hereby
authorized to sell the Property depicted on Exhibit "A", Drawing No.
4579, and further described in the legal description set forth in
Exhibit "B", attached hereto and incorporated herein by reference,
to Samuel Kardashian. The purchase price for the property is the
sum of SIXTY-FOUR THOUSAND THREE HUNDRED NINETY DOLLARS AND FOUR
CENTS ($64,390.04). The sale of the Property shall be subject to
each and every condition set forth in the Agreement of Purchase

and Sale and Joint Escrow Instructions between the city and Samuel
Kardashian.
SECTION J.
The City Manager is authorized to execute all
instruments and do all things necessary to effectuate the sale.
SECTION 4. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

WHEREAS, the City of Santa Monlca has determlned that the real
property (the "Property") descrlbed In Section 1 and the attached
Exhlbits A and B of this Resolution lS no longer needed for the
purpose acquired and that said surplus parcel is not needed for any
publlc ~se or street purpose; and
WHEREAS, Slnce utillty llnes and appurtenant structures are
located on, above or beneath the Property, the Clty Councll of the
Clty of Santa Monlca wlII reserve easements In favor of public and
prlvate utlllty companles and thelr respectlve agents, employees
and representatlves for purposes of constructlon, operatlon,
malntenance, repalr, removal and replacement of all sewer, water,
storm draln, street Ilghts, trafflc signals, electrlcal, gas,
telephone, cable TV and other utility facilltles and lmprovements,
and
WHEREAS, the sale of the Property to the adJacent property
owner. Samuel Kardashlan, has been authorlzed; and

sale of the Property occurs;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The Clty Councll of the City of Santa Monlca
declares l ts lntention to order vacatlon of the excess street
rlght-of-way parcel located at the southeast corner of Delaware
Avenue and Hlgh Place deplcted on Exhlbit "A", Drawlng No. 4579 and
further described In the legal descrlptlon set forth In Exhlblt
"Bn, both of which are attached hereto and incorporated hereln by
reference.
SECTION 2. The Clty Councll of the Clty of Santa Monlca In
vacatlng the Property described In Sectlon 1 of thls Resolution,
elects to proceed in accordance with the provlslons of the
Californla Streets and Hlghways Code, Part 3, "Publlc Streets,
Hlghways and Servlce Easements vacatlon Law", Chapter 3, "General
Vacatlon Procedure".
SECTION 3. The hour of 6:30 p.m. on the 13th day of April,
1999, In the temporary Councll Chambers located In the Maln Llbrary
audltorium at 1343 6th Street in the City of Santa Monlca be and
the same hereby is flxed as the tlme and place when and where all

persons interested in or objecting to the proposed vacation may
appear before the City Council and offer evidence in relation
thereto.
SECTION 4. The Director of Environmental and Public Works
Management Department is hereby directed to cause notices of street
vacation to be posted as required by California Streets and
Highways Code section 8323.
SECTION 5.
The city Clerk of the City of Santa Monica is
directed to cause notice of the date, hour and place of the public
hearing to be published once a week for at least two consecutive
weeks prior to the hear1ng as required by California streets and
Highways Code section 8322.
SECTION 6. The City Clerk shall certify to the adoption of
th1s Resolution, and thenceforth and thereafter the same shall be
in full force and effect.
