INTRODUCTION
This report recommends that the City Council uphold the appeal, and modify the
Plannmg Comm~ssion's appro~al of DR 98-~02 to allow expansion of Pacific Park's
e~ening and early rnorn~ng hours of operation, to increase the number of holidays when
the Park is permitted expanded aperating hours, and fo allow speaal hours for up to 24
pr~vate events at the amusement park annuaNy Alt~ough staff recammended matiest
increases in Pacific Park's operating hours, the Planr~ing CommFSSion determined that
the applicant's request would be compatrble wrth nearby residential land uses and
approved the mcreased operating hours on July 1, 1998 Attachment A provides a

BACKGROUND
Pacific Park was appra~ed by the City Council on April 28, 1992, as a key elemen# of
City efforts to revitalize the Santa Monica Pier The amusement park was de~eloped
and has been operated by Pacific Park, L L C since #he Park apened to the public m
1996 The approval of the Park was opposed by nearby residents due to traffic and
noise impacts The City Councd approved the pro~ect and establ~shed very spec~fiic
operating haurs and operating conditions to minirnize neighborhood impacts The Pier
pra~ect's design and conditions of approval also addressed potential advarse
env~ronmental impacts, which were ~~entified in the pro~ect's Environmental Impact
R~port
Efforts to revitalize the Pier began ~n 9981 with the goal of preservrr~g #he Pier's unique
character be preserved while also ensuring that the Pier continue to serve residents
and ~isitors of all income groups The scale and character of development on the Pier
is guided by the Pier's role in the City's history and its location ad~acent to beachfront
res~dential dwefling units
ANALYSIS
Applicant's Request
The applicant requests the expansior~ of the amusement park's operatmg hours as

follaws
- During the peak season, which rs defined as the period from Memorial Day to Labor
Day, the Park would close at 1 a m on Friday and Saturday, midnight on Sunday
and Th~rsday, and 11 p m Monday thraugh Wednesday
- During the off peak season, the Park would close at midnight on Friday and
Saturday, 11 p m on Sunday, and 10 p m Monday fhrough Thursday
- The number of days with holiday hours, which also includes a request to operate
until 1 a m, would mcrease #ram 8 ta 11 days,
- Up to 24 private party events per year would be allowed to operate until 1 a m on
any day of the week dur~ng the off-peak season, and
- Allaw peak season hours for up to faur weeks durir~g Easter break and up to three
w~eks during ChrEStmas break, depend~ng on the Santa Monica-Malibu & L A
Unif~ed School District schedules
In filmg its request to increase the amusement Park's operatmg hours, the applicant
ind~cates #he amusement park has nat generated sufficaent revenue to cover operating
costs, compensate investors and allow reinvestment to upgrade and renew Park
attractions Upgrading the park is considered key to attracting repeat patronage The
applicant s#ates the additianal operating haurs are needed to capture "last business,"
which is turned away when the Park "closes early " They point out that the operating
restrictions were established before the Park was open, and state that the proposed
operating hours are based on their experience managing the Park dur~ng the past two
years The applicant believes that "this modest request would enable Pacific Park to
capture a significant amount of #he lost business which management has learned is

aiready present at fhe P~er, but whicF~ is currently turned away by ~irtue of tF~e Cify's
existing operating restrictions "
The applicant cflmmissioned an independent noise study the findings of which were
consistent with the environmental impact analysis prepared for the origmal pro~ect
Howe~e~, the applccant's acoustical engmeer determined that, althaugh patron noise
from the roller coaster would be hearc! by neighbors (62 to 65 dBA), the roller coaster
could operate later because noise from the safety ratchets and screams fram riders
would occur for less than ~4 seconds of each rrde cycle, represent~ng less thar~ 1
minute and 35 seconds of total impact during any 30 minute period Although the
relatively short d~ration of excessive noise le~els from the roller coaster does not
violate the City's Noise OrdEnance, i# w~ll impact neighboring residents during #he quieter
late night and early morning hours requested by the applicant Since noise from the
5ea Dragon ride is significant, particulariy during the quieter week nights, the applicant
proposed closing the Sea Dragan r~de at midn~ght to mitigate noise impacts on the
neighbaring residents A copy of the applican#'s proposal is contained in Attachment C
Planninq Commission Action
As previously stated, the Planning Commission determined that the applicant's request
was reasonable and would be compatible with nearby res-dential land uses and, an a 4-

- Increased evenir~g and early marning hours to allow the Park to close at 1 a m on
Friday, and Saturday, midnight on Sur~day and Thursday, and 11 p m Monday
thraugh Wednesday during the Memorial Day ta Labor Day peak season

Dur~ng the Off-Peak season, the Park wauld close at midnight on Friday and
Saturday, 11 p m on Sunday, and 1 ~ p m Monday through Thursday
- Increased the number of holidays from 8 to 11, and permit the Park to stay open
unfil 1 00 a m on the 11 specified Holidays, and
- Appro~ed a 1 00 a m closing time, any day of the week, for up tfl 24 private
events annually held m the off-peak season
The Planning Commission also imposed conditions to mitigate impacts on the
ne~ghborhood, ~neludmg
- No Sea Dragon r~de after 11 00 p m during the peak season, 11 specified
holidays, Easter and Christmas ~acations and dur~ng the 24 off-peak season
pri~a#e party nights, when the Park can otherwise aperate until 1 00 a m,
- No Sea Dragon ride after 10 00 p m Friday tt~rough Sunday, and 9 00 p m
weekdays, during the off-peak season, ir~-I~eu of mEdnight as requested,
- Ticket sales would stop thirty minutes prior to closing time,
- Additional secur~ty ~n ad~acent parking areas would be required after midnigh#,
- Amphfied musiclPA ~olume wauld be restric#ed, and
- A Traffic Management Plan, directing ~rafffc onto Pacific Coast Highway or Ocean
Avenue, would be developed and implemented ta minim~ze the number of ~ehicles
exiting the Pier parking lats through tFte ad~acent residential neighborhood

Appeal 98-008
On July 15, 1998, the appeflants filed an appeal The basis for the appeal is the

appellants' belief that the late night and early morning operating hours will adversely
impact the South Beach ne~ghborhood These impacts, according to the appellants,
r~late to the increased haurs of no~se fram the amusement park and assoc~ated traffic,
mcreased hours of traffic cangestion tF~rough the neighborhood, increased hours of
park~ng problems and the potential for ~ncreasing crime The appeal statement is
conta~ned m Attachment B The appellant's request that the City Council reverse the
Plann~ng Comm~ssion action and appro~e only the limited increases recommended in
the July 1, '{ 998 StafF Report, providing 1) Pacific Park retrofits the Sea Dragon ~o
el~mmate passenger norse (encbsrng the passer~ger gondola, ete ), 2) afl amplrf~ed
music be prohibited, and 3} adoption of the Traffic M~tigatian Plan, as detailed in the
Planning Commission's appr~val. The Appeal Statement is conta~ned in Attachment B
and is summarized in the staff recammendation portion of Attachment A
Noise I mpacts
As discussed in Addendum 2 ta the FEIR, the proposed pro~ect wilk not create any new
naise sources, or increase naiss 1er~els above those be~ng generated by the current
operation Howe~e~, the propasal w~ll result in amusement ride related noise extending
into late e~ening and early mornir~g hours Durmg these time per~ods, the ambient, or
Community No~se Equivalent Level (CNE~), ~s cam~arati~ely low As a result, the same
noise impacts from Pacific Park would become more not~ceable to neighbormg
residents as the CNEL drops
There is a significant number of resider~tial dwelling unjts in the beach area ad~acent to
the Pisr The Pacific Park operatian do~s not violate the C~ty No~se Ordinance, or
~
exceed noise ievels antic~pated in the EIR dunng the current operating hours
Nevertheless, residents who lea~e t~eir windows open, on summer nights in particular,
have experienced noise ~rom Pacific Park The noise is more noticeable as the ambien~
no~se from wind, surf, traffic and people subsides in the late e~ening hours, and when
residents #end ta be the mast sensi#ive to noise
Only three of the amusemen# attractions generate noise that is discernable in the
resident~al neighborhood a public address system used by #he "barker" at the hammer
booth, the Sea DragaR, and the Ra(~er Coaster rrde Ali three of t~e attracttons are
iocat~d on the Pier's open deck Reducing the le~el of noise from the barker's public
address system can be accompl~shed by reducing the volume at night andlor
redesigning the system with more speakers at lawer valum~ to co~er the same area
and locating the speakers so that sound ~s directed away from beach dwellmgs
Currently, there are no feasible methods to reduce no~se from the Sea Dragon and
Ro~ler Coaster, short of restrict~ng the hours that they can be operated The applicar~t
recently advised staff that they believe the passenger gondola of #he Sea Dragon can
be enclosed to mitigate passenger noise However, the applicant has not pravided any
specific details ar noise analysis far this new praposal and st~ff was unable E~aluate its
~easibility Accordingly, fhe Mitigat~on Measures ir~ the EIR addendum require redes~gn
of the barker's public address system and restricting operating hours for the Sea
Dragon and Roller Coaster The Planning Commission conditions of appra~al
addressed the Sea Dragon hours of operat~on, but bid not specifically require redesign
of the "barker" sound system and Roller Coaster hours of aperation

Excep~ for the Roller Caaster, the appficant's Noise Study recommends the same
mi#igation measures as Addendum 2 Although the Roller Coaster may not ~iolate the
City Noise Ordinance, staff belie~es ~t will unreasonably impact neighbors after 10 DO

Paiice Department Comments
The Poltce Department has expressed concerns about the requested modif~cat~ons in
Pacific Park's hours While they recognize that t~e Park's own security force maintams
overal! satety a~d secur~ty w~thm the co~fnes of Pac~f+c Park, they are concerned about
the effect that additional Park hours could have on security issues outside tF~e confines
of the Park The Palice Department supported the staff recommendation, providing
Pacific Park cons~dered augmenting off-site security on the Pier and the 1550 Beach
Parking Lat
in response to Police Department concerns, the Plann~ng Cornm~ssion imposed
Condit~on 11 e, requiring Pacific Park to provide a pri~ate security presence in parking
areas ad~acent to the Pier, from ~4 00 p rn ta 2~00 a m, on any of the 139 autharized
nights fhe applicant efected ta remain apen after Midnight The private security is nat
required if the Park closes by midnight Condition 11 e requires Pacific Park to fund the

could be interpreted as requiring the security presence if the Park is open after 10 00
p m If the City Council appro~es operating hours after midnight, the condition should
be modrfred to clarify that t~e security presence is requ~red any trme the Park is open
after Midnight
Pier Restarafion Corporation Recammendatian
The Pier Restoration CorporatEOn (PRC} Board of Directors support Pacifc Park's
request for expanded aperating hours In its letter dated fi117198, the PRC states that
Pacific Park is a key element m the new success of the Santa Monica Pier Extending

the aperat~ng hours wauld allow v~sitors to en~oy the Park during times that are more
closely aligned with the hours of other entertainment on the Pier The PRC
recommer~dation is contained in Attachment G
Amusement Park Hours in Surroundinq Areas
Pacific Park's current e~ening operating hours exceed the hours of other Southern
California amusement parks, most of which do not have Pacific Park's compatibility and
scale canstraints Staff has surveyed the operating hours af other area amusement
parks to determ~r~e ~f Pac~fc Park's ex~stmg hours are Qverly restr~ct~~e Belmont Park,
located in the Mission Bay area of San Diego, is the most s~milar attraction to Pacific
Park, given its beach location, proximity to residential ~ses and de~elopment scale
Belrnont Park also operates on a pay-as-you ride format, like Pacific Park Belmont
Park is open from 11 a m to 10 p m Sunday through Thursday, and 19 a m to 11 p m
Friday and Saturday G~ven the site context and development h~story, staff believes the
applicant's request to operate amusement rides and attractions on the Pier's open deck
until 1 a m on weekends, midnight on Sunday and Thursday, and 11 p rn on
weekdays is excessi~e
Operating hours ~or Belmont Park, Disneyland, Knott's Berry Farm, Universal Studios
and Magic Mountain are pro~ided in AttacF~ment K ft shoufd be nofed that the
published operatmg hours for all of these amusement parks is lim~ted to only midn~ght,
except for Disneyland and Knott's Berry Fa~m BotF~ of these parks are apen until 1 00
a m on Saturday nights during the peak summer season Most parks also use p~ak
season hours durEng the Sprmg and New Yea~'s schoal breaks, and Saturday operating

Based upan this survey of ather parks in Southern California, and the location of Pac~fic
Park in proximity to residential uses, staff belie~es that the current park hours are
appropr~ate There are, howe~er, some ~nstances where add~tional hours are warranted
as further analyzed below
Pri~ate Parties
Pac~fic Park is requesting 24 pri~ate parties per y~~r dur~ng fhe off-peak season with a
1 00 a m closing, any day of the week Pn~ate funct~ons are currently allowed any day
of the week if conducted during normal operating hours. For example, a private party
must clvse at 9 p m an a week night during the off-peak season
Staff recommends
- Allowing up to ~ 2 pri~ate partEes a year during the off-peak season using peak
season hours for the particular day of the week the private party is held,
- Restr~c~ing the hign no~se generat~ng r~des af#er 9 p m on week n~ghts
This provides Pacific Park with a means of expanding its patron base while respecting
neighbarhood neec~s The Planning Comm~ssion ~p~ro~ed 24 nights with a 1 QO a m
clasing time and no Sea Dragon after 11 00 ~ m
Holidays
Paafic Park has requested that the Park be able to operate unt~l 1 DO a m on 1'i
holidays, wEth the optton for the Park to select either the holiday or the hol~day eve for
the extend~d operating hours, as outlined in Attachment A Staff recommends that, on

~ 1 f~olidays a year, the Park sf~ould be permitted to operafe untif midnight. Sfaff
believes that tf~ese holidays, or e~e of the haliday, are days that typically function
similar to a Fr~day or Saturday evening Therefore, usmg the weekend hours for
holidays is reasonably consistent with current operatians S~nce New Year's Eve is
different from vther holidays, as the focus of the holiday is midn~ght, staff belie~es that
allowing #he Park to operate until 12 30 a m o~ t~is holiday is ~us#ified The Planning
Commiss~on approved the requested 1 QO a m clos~ng t~me, with the Sea Dragon
elosing at 11 00 p m The recomrnended holidays are also identifi~d ~n Attachment A
Additionally, the applicant ~as requested that the ~eak season hours be extended far
four weeks during spring break and three weeks during ChristmaslN~w Year's school
breaks Staff recognizes the Park's des~re ta accommodate fam~l~es on ~acatian and
students who are not in schoof dunng these periods However, staff belie~es a more
reasonable approach that would co~ncide with these holiday periods and be compatible
with neighborhood cancerns would be to allow peak season hours dur~ng the two
weeks surraunding Easter Sunday (Sunday before to Sunday after Easter) and the
week between Christmas and New Year's (December 26 - Jan~aary 2} The Planning
Commission approved the raques#ed four weeks during spr~ng break and three weeks
durir~g ChristmaslNew Year's school breaks, per the local schoal calendar
TwEliqht Dance Series
Pac~f~c Park is requesting a midnight clos~ng on summer Thursdays to capture a larger
share of the Twilight Dance Series pa#rons that are aiready on the Pier The Twilight
Dance programs conclude at 9 00 p m A later c~osing time is ~~stified for the Twilight

Dance nights if the park's high noise generating ~ides (the Sea Dragon, and Roller
Coaster) are prohibited from operating after 10 00 p m How~ver, staff belie~es that an
11 00 p m closing is more appropriate for the TwElight Dance nigh~s given the praximity
to resiclential uses Th~s additional hour is not expected to draw new customers to the
Park, but merely to provide an additional attraction to Pier ~isitors during the popular
summer P~er e~ent The Planning Commission approved t~e Midnight closmg time,
with the Sea Dragon clasmg at 11:00 p m
MUNlCIPAl. CaDE ANQ GENERA~ P~AN CONFORMANCE
The amusement park use is consistent with the Municipal Code and in conformi~y with
the General Plan
CEQA STATUS
A Final Env~ronmental Impaet Report {FEIR) was prepared and cert~fied for the Pier
Pro~ect on April 2$, 1992 The FEIR analyzed impacts associated with the amusement
park developme~t and ongoing operation (The amusement park is referred to as the
Fun Zone in the FEIR). The FEIR identified potential impacts and mitigatian measures
to address arnusement park impacts Specifically, Addendum 2 to the pro~ect EIR was
prepared pursuant to t~e reqwrernents of Sections 15300 2~c) and 15164 of the CEQA
Guidelines to pro~ide suffic~ent analysis to insure compliance with CEQA The
addendum analysis includes information from a noise stucfy that was recently
conducted by the app[icar~t's consu[tant Addendum 2 is prov~ded in Attachment H
The en~~ronmental analysis identified three potential en~ironmental issues (1) potential
Noise irnpacts, ~2) patential TransportationlCirculation rmpacts, and (3) potential Public

Ser~ice Empacts These impacts, however, are mit~gable to a level of ~nsignificance A
copy of the FEIR ancE Addendum 1 are prov~ded in Attac~ment L
PUBLIC NOTIFICATION
Pursuant to Mur~icipal Code Sect~on 9~4,20 20 080, with~n 3Q days after the sub~ect
applicat~on was deemed complete, the applica~t posted a sign on the ~roperty stating
the following information pro~ect case number, brief pro~ecf descript~on, narne and
telephone number of applicant, site address, date, time and location of public hearing,
and the City Planr~mg Qi~~sion phone number
In addition, pursuant to Municipal Code Sections 9 04 20 22 050 and 9 20 14 01 p,
not~ce of th~ public hearing was mailed to all owne~-s and residential and commercial
tenants af property [ocated w~thin a 500 faot radius of the pra~ect and published in the
Argonaut newspaper at least ten cansecutive calendar days pr~or to the hearing A
copy of the notice is contained in Attachment A The Applicant also indica#es that they
attended meetings of the South Beach Ne~gh~orhood Watch group and met with the
Pier Restoration Corporation and the Santa Monica Pier Lessee's Ass~ciation ta
discuss the proposed pro~ect
BU~GETfFINANCfAL IMPACT
The recommendation presented in this report does not have a s~gnificant budget or
f~sca! Empact However, the Po~ice Departmer~t nas determmed that the ap~~~car~t's
request, as approved by the Planning Cornmission, would have a significant impact on
Police resources

Conclusion
The amusement Park's current operating hours were adopted to pro~ide the maximum
use of the P~er resource without unreasonably impactir~g neighboring land uses Pacific
Park's current evening operating ho~rs exceed the hours of mast other Southern
California amusement parks Unlike other amusement parKs which ha~e access from
freeways or commercial carr~dors, mast of Pacific Park's Wisitors dri~e through the
residential neighborhood to access and depart the amusement park The appellants
believes the applicant's request to operate amusement rides and at#ractions on the
P~er's operr deck untrl 4 a m on weeker~ds, halydays and during 24 Spec~a~ Pr~~ate
Parties, midnight on Sunday and Thursday, and 11 p m on weekdays goes beyond the
intent of the pro~ect and are not warranted The Planning Commiss~on determined the
requ~st was reasonable and would not unreasonably ~mpact neighboring res~dential
uses The Pier Restoration Corporation also recommends approval of the applicant's
request Ne~ertheless, the apphcant's re~ues# represents a 69% increase in the
number of days peak season operat~ng hours would be allowed Additionally, the
proposed off-peak season hours would exceed current peak season operating hours
Staff and the appellants beEie~e the applicant's request is incompatible with the
surroundmg residential land uses and would unreasonably impact these beachfront
neighborhoods during the late evening and early morning hours
RECOMMENDATION
It ~s recammended that the C~ty Council adopt Addendum 2 to the Final Environmental
Impact Repart, amending Mitigation Measures, and adopt the following findings and

Miscellaneous Condition 11 of DR 91-406 are amended as follows

31 a The operation shall at all tim~s be conducted in a manner not detrimental to
surroundmg properties or residents by reason of laghts, noise, acti~ities, parking
or other actions Pacific Park's amplified sound systems shal! be
redesigned so that the maximum measurable exterior noise le~el after 9:40
p.m. shall not exceed 45 dBA for mare than 15 minutes within any 30
minute period and 65 dBA at any time. Mechanical Noise shall not exceed
50 dBA {Lmax) after 10:00 p.m.
11 b The hours of operation for the Fun ZonelPacific Park Amus~ment area shall
be:
~1) Peak Season operating hours are from 10:D4 a.m. to 1U:a0 p.m.
Sunday through Thursday, and from ~Q:QO a.m. to Midnight Friday
and Saturday. The Peak Season includes the period from the
Friday before Memorial Day through Tuesday morning following
Labor Day. Qn Twilight Dance Series nights only, the operating
hours are from 'f0:00 a.m, to 'I1:00 p.m., providing the Sea Dragon
and Roller Coaster are not operated after 10:00 p.m.
(2) Off-Peak Season operating hours are from 10:00 a.m. to 9:00 p.m.
Sunday through Thursday, and 10:OU a.m. to Midnight on Friday
and Saturday. The Non-Peak Season begins the day after Labor
Day and continues to the Friday before IVlemorial Day. Peak
Season hours, as specified in 11b{1) above, are allowed from the
Sunday preceding Easter Sunday to the Saturday following Easter
Sunday ~Spring break}, and from Decemb~r 26t" to January 2nd
(Chris#maslNew Year's break), providing the Sea Dragon and Roller
Coaster are not operated after 9:00 p.m. Sunday through Thursday.
(3) The Park may operate from 10:00 a.m. to 12:30 a.m. on New Year's
Eve, and from 10:0~ a.m. to Midnight on fhe following holidays:

permitted during the Off-Peak Season only. Operating hours shatl
be from 10:00 a.m. to 1U:00 p.m. Sunday through Thursday, and
from 10:U0 a.m. to Midnight Friday and Saturday, pro~iding the Sea
Dragon and Rollsr Coaster are not operated after 9:00 p.m. Sunday
through Thursday, and the follawing conditions are met:
(a} Any amplified musiclsound systems shall be designed to
direct sound to the west. The Operator shall provide an on-site
audio technician for the cfuration of any special private party that
in~olves amplified musiclsaund systems. The tech~ician shall
monitor Pacific Park's amplified sound systems to insure that the
maximum measurable exterior noise le~els after 9:00 p.m. shall not
exceed 4~ dBA for more than 15 minutes within any 30 minute
period and 65 dBA {Lmax) at any #ime. Mechanical Noise shall not
exceed 5D d8A {Lmax~ after ~t0:00 p.m.
(b~ The operator shall prepare and distribute a flyer notifying
residential and commercial neighbors, west of Qcean A~enue,
south of Santa Monica Boule~ard and north of Pico Boule~ard, at
least fi~e ~a) days prior to a special private party. The notice shall
also be delrvered to the City Planning Division, Pier Restoration
Corporation and the Santa Monica Police Department's Operation
OfFice Commander {at Police Department Headquarters}. The
neighborhood notification shall incl~de a brief description of the
event, event times, and the on-site location, telephone number and
name of ti~e contact person(sj that is directly r~sponsibie for the
e~ent and will be a~ailab[e during the e~ent.
~c) A sign pro~iding noti#ication that the amusement park will be
closed to the general public shall be prominently posted on the pier
two weeks prior to a special pri~ate party.
~d) Pacific Park shall he directly responsible for all pri~ate party
acti~ities. No outside promoters are permitted.
Subsectian 11 b(6} does not apply to pri~ate functions which are
conduc#ed pursuant to other pro~isions of this permit durmg r~vrmaf
operat~ng hours
(5) Ride ticket sales shall cease thirty (34) minutes prior to the closing
time.
The following condition should be adapted if the City Councii approves aperating hours
after midn~ght
(91 ej The amusement park's securify plan shafl be amended to provide,

af the expense of the operator of Pacific Park, an overtime Police
pafrol in the pier area and pier parking lofs along Appian Way from
90:00 p.m. to 2:00 a.m. on nighfs the park wil! operate after
Midnight. Such security patro! is intended to prov~de a uniformed
securify presence during fhe haurs Park vis~tors are Ieaving fhe
area. The mode of operafion and deployment shall be consistent
with the Police Departmen# approved security plan. The patrol unit
shall be a two (7} person car, or other conf~guration specifically
approved by the Police department
CONDITIONS ~F APPR~VAL PER THE EIR MITIGATION MEASURES
(11 b) The Roller Coaster ride shall be designed to require and use plasfic
wheels on metaf rails Subject to appropriate safety codes, buffers
that reduce noise from the Rofler Coaster's safety ratchets shall be
maintained andlar upgraded with newer designs or materials as
they become available to minimize noise.
Except as modified by this approval, a~l pre~ious conditEOns relatmg to DR 91-006,
RPP91-008, and EIA 90-007 shall rema~n in full force and effect

the~ing. Hawever, these effarts can only continue if ways are
~ound to generate substan~ially greater revenue.
To address this situ~tion, Paciflc Park has form~.:lated an
averall plan which includ2s both operational and bus~ness
reorganization. Pacific Park has solic~ted the City's input
and coope~ration zn this plan by undertaking discusslons kT1t}]
~he City Manager, the City P~anning De~artment, the Pier
Restoration Corporation, and the Police Department.
A fundamental cornponent of Pacific Park's strategy ~s the
goal of ~ncreasing revenu~s by capturing "lost business."
This is business from patronage wr;ich curren4ly exists, but
which Pac~f~c Park is for~ed to turn away by v~rtue of ~he
orzginal operatir.q res~ric~icns established in Development
Review Permit 97-006_ These restrictions were established in
the abstrac~ befare the Park was opened, and indeed, before an
apera~or had be~n selected. Accordir~g~y, cansumer demand and
act~al a~tendance pa~terns were only estzmated --- nat
properly underst~od. Based on its operat~ng experience,
?acific Park now requests the fcllowing amendments:
A. Qperatxng Hour Arnendments
Pac.~~zc Park is r~q~esting that its authorized hours of
operation be extended for one additional hour on mast days
;twc addivional hours are requested for Sundays and for "Peak"
season Thursdays). Na changp in rours is r~quested for "Non-
Peak" seasons Fridays or Saturdays. Existing and proposed
operating hours are shown in detail cn Exhib3t 1.
This modest request would erable Pacific Park to capture
a significant amaunt of "lost business" which Manag~rnent rias
learned is already present at the P~er, but which is currently
be~ng tur~eci away by virtue of t~ne City's ex~sting operatzng
rest~ictions, which agair~, were establ~shed before the Park
was opened and before consumer demand and actual a~tendar_ce
patterns were properly understood. Importantly, because these

Expanded operating hours, par~icularly in the summer, are
necessary ta properly serve Pacific Park's guests, and capture
~n-Park spe~ding to i~s falles~ potential. The Fark's short
"Peak" season ~s comprzsea of only 4 months betiaeen Meinoria'
~ay and Labor Day. During ~hese warmer months family mer:~ber~
visit the Pier in the evering to "~ake the air~" and visits
are at si~n~ficantly lnigher levels than the rest of the year.
During ~his time, ~he Park must make up for the operating
losses w'^_ich are outside ~ne Park's control, and which occur
du~ing Nor.-Peak ~r~onths and for particularly poor operat~ng
r~sul~s azising frcm exr~acrdinary weather events such as this
season's El Nino. As ~r?dicated by the attached letter of
s~apport irom the Pier ~estora~ion Corpcration, the requested
hours extens~on wo~ld be cons~sten~ w~th the operating hours
of other Pier and Prornenade businesses {for example, ~he Boat
House, Mirasol's, Rusty's and Playiand Arcade are all open
until 2 a.m. on weekends as customers neEds dictate).
The Park's Non-Peak season extends through 8 months of
t'r_e year. Dur~ng this lengthy pEriod, low attendance is
experienced as Pacific Park's operations and attendance are
ir~~eded by schoo~. scnedules and regu~ar shutdowns are caused
by aaverse weather conditior.s. To reduce the inevitable
operating losses which result during these montr~s, it is
essent~a~ that eJery v~ab~e operat~ng hour be captured. To
th~s end, ~t is proposed that six addit~onal hours be added
each week. Still, on weekdays, the Park would be closed by
10 p.r.z., on Fr~days and Saturdays by midnight and by 11 p.m.
on Sundays.
The amended Y:ours requested b~ Pacific Park are alsa
supparted by current ~ndusLry standards. Unlike typica~ theme
parks wn~ch capture up-f~ont revenue by charging a signif3can~
fee for admission to the~r facilities, admission to Pacific
~ark's premises is "free" to the public. Consistent with the
C~ty's ob~ective of serving famiiiesf customers pay only a
modest charge for the particular attract~ons they choose to
experience. By being forced to close its attractior~s when it
is substantially full of guests, as is currently the case,
Pacif~c Park is Ios~.ng signif?cant revenue that is negatively
~mpact~ng its viab~lity.
Pacific Park's request ~s also c~nsis~ent with the
practices of other area therne parks. For example, Knott's
Berry Farm 1998 operating calendar indicates a 1:00 a.m. close
on Friday ar.d Saturday during the summer. See Exhibit 2.

they must continue seeking new revenue saurces to fund the
increasing high cost of rew rides, attractians and overaZZ
operations, all rna~or the~ne park operations have made
significant entries in~o the event market. These high revenue
f~snctions include film premieres, chari~y events and carparate
fur.ctions; and have the potential to bring some of the nations
tap corporations ta the Pier and Santa Man3ca, ~nclud3ng
Nabisco, Sony Carpozat~on, Walt ~isney, Buena V~sta Pic~ures,
Nations Bank and Merv Griffin Productions. Events are
typ~cally coordinated througn prc~fess~.onal meetina plar.ners

Howevey, du~ ta Faczfic Pa~k's inabiZxty to accammadate their

C. Environmental Issues
The ~ity Planning Div~.sion has prepared an ~ddendum ta
the Park's original Env~ronmentai Impact Repart in cannectio~
with the current applica~ion to am~end Development Review
Permit 91-006. 'Ihe analysis of tne Addendum indicates tha~
tne Park ~s complying with the requ~rements of DRP 91-00&,
municipal xeguZatians, and tna~ the modest hau~s extension
requestEd would r_ot result in any new significan~ adverse
effects. Just as important, Pacific Park is committed to
being a respons~ble cit~zen and good neighbor.
1. Security
The safety and security of our guests ~s always o~r
number one prioriry, and to that end Pacific Park has worked
c~asely w~th the Santa Monica Pa?ice Departrnent in connection
with its existing operations anc.'' its request to amend present
aperating hours. The Park has a proven track record with
respect to security iss~;es, and it is acknowledged that the
Park's presence, includir_g its 24-haur private security force,

wholesome environment found at the Pier.
The Park ma~n~ains a year xound full ~~me team of
securzty professionals, led by Tom DoLy, a forme~ Redondo
Beach Lieutenant. Mr. Dc~y brings to the Park ove~r 14 year's
experiencE with the Redondo Pi~r and Harbor Patrol, as well as
servzng as the Critical Incic~ents Manager for the PoZice
Department. He ~eads his team throug~ rigorous annual
tra~ning in rnany areas ir~cluding but no~ lirnited to; defense
~actics, gang traininq, laws of civilian arrest, fire
fighting, first aid tecnniques and CPR cer~ification. There
is a cantinua3 reir.vestment ~~ trainzng thraughout the year
ranging from even~ management, report writing, search and
seizure, crowd control and loss preven~ion techniques.
Additionally, a park-wide video surveillance system is
monitored twenty-four hours a day.
In connectio~ with its o~2rating hours request, Pac~fic
Parl~ will expand the operations cf its security force to cover
new operat~.n~ hours. In additlon, Pacific Park ~s commi}ted
to working cooperatively with zhe Pol~ce Department, other
busznesses an the Pz.er, and the Pier Restoration Corporation
to 3ointly address existing and future security needs at thE
P~er. Park management recognizes the responsibility
associated with running a family at~ractian in a diverse
er_vYronm~nt.
2. Noise Concerns
The Park and the area wh~.ch surrounds i~s has
his~orically been horne tc residential, commercial, and
entertainment uses, and wni~e not everyane can be satisfied,
~ne Park has dane its best ~o respond to legitimate noise
concerns raised by members of tne Seaside re~~hborhood.
Specifically, Paci~~c Park has:
• Attended ne~ghborhood association meetings regularly
to address concerns and obtain information regarding
locatlons of noise irnp~ct;
• Developed a noise-monitoring pragram with Management
staff;
• Provided ~eiqhbors w~th a"hot line" number to ca~l so
tha~ complaints can be promptly addressed;
• LowEred "~~igh Str~ker", "Roci~-n-P,ol1" & Coaster public
address systems;

has agreed that the Sea Dragon, wr~~ch ras been t~e sub~ect of
most noise complaints, will not be operatied past midnight. In
addit~on, Facif~c Park has retained t~-ie services of Santa
Monica acoustic consultdnts, N:artin Newson & Assoc~ates to
review Park operations and make speci~~c recomiciendations.
Thelr study, attach~d as Exh~bit 4, inaicates that the Park ~s
ir_ full compliance with a'1 cizy r~oise ordinances.
Impartantly, the analysis conducted b;~ Newson &
Associates confirms that zhe requested hours extenszon will
r~ot create szgnificant noise ~mpacts. Fox exarrtple, when the
Pa~-k is experiencing peak demand, a single roller coaster
cycl~ occurs every 4.5 minutes. During a s~ngle cycle cnly 14
secends of no~se was detected as aud~bZe at the nearest
neighborhood rnonitoring lccation. However, most of this noise
c~uld not be measured wi~n precision because it did not exceed
existing background 1evels. Audible screams and mechanical
noise above background ncise levels were limited to a t~tal
c~uration of 4 seconds per cycle, ~ut even so, we~'e measured as
quieter than the sound c~eated by pedestrians walk~ng past and
aircraft £ly~ng over. As discussed earlier, on mast days only
.~ s~ngle r,our would be aQded to Pacific Park's operat~or~s (or
approximately 10-13 Coaster cycles).
3. Traffzc and Parkinq
Because they are related to non-peak periods, and will
primaxily accommodate customexs who are already at the P~e?"~
extended hours and special events will not materially impact
ex~stin~ traff~c and park~~a conci~t~ons. HaweTer, Pacif~c
Pa~k re*_r.az:~s a ccncerne~ part~cipan~ in all tra~f~c p~annin~
meet~ngs and is prepared to offer suggesLions and ~esaurces to

2.1 Typical Background Noise Levels
Pac~fic Park, the Santa Momca Pier and the ad~acent res~dential areas are shown on the
attached Figure 1 The closest residential propert~es to the Pac~fic Park are located to the
sauth of the p~er entrance roadway and to the west of 4cean Avenue Th~s neighborhood
~s generall~~ zoned RVC It is noted that Ocean Avenue is busy~ with traffic even at rught-
time and so potential for noise impact from Pacific Park is greatest at properties that are
located away from Ocean Avenue For tlvs reason the potential for no~se impact from the
park ~s considered to be greatest for properties located on the Promenade and on Appian
Waj-
I`o~se surve_ys have been canducted m the resident~al area closest to the p~er The noise
sun~eys measured the noise parameters of Leq and Lma~ Leg ~s the "equivalent continuous
~-~veighted sound pressure level' and is the average noise level over time Lma~, is the
maximum A-weighted sound pressure level, which ;s the ma~mum instantaneous noise
level within a pa.rticular noise measurement per~od

most critical noise zone The Santa Monica Crtv Noise Ordmance sets "allowable e~rtenor
no~se equivalent level'' of 60 dBA before 10 p m and 50 dBA after 10 p m It is unlawful

only sources of noise located wrtlun Pacific Park that were audrble outside the resident~al
properties In considerat~on of their nei~hbors, Pacific Park do not propose to operate the
Sea Draaon ride dunng the proposed extended hours of park operation This means that
the Sea Dragon R~de ~~rould never be operated after rmdmght It is therefore considered
that the only potential noise fmpact duruig the proposed e~tended hours of park operation
is from the rolter coaster
The Santa Moruca City ?`TO~se Ordinance sets quannfied allowable extenar noise levels as
reproduced zn Table 3 above Quieter noise luruts apply after 10 p m at m~ht than in the
da~~time The followmg analysis has therefore used the rvght-time no~se lim~ts as this
represents the most str~n~ent requirement
The roller coaster ~enerates sygruficant noise far substantially less than 15 irunutes ~n an~
30 minute per~od Considenng the roller coaster contmuously operating at ~ts muwnum
Izkely c~~cle t~me (4 rrunutes and 24 seconds); the e~~e~Its that are identlfied as bemg audrble
at the nearest neighbor~ng residentlal builc~m~ in Table 2 above ~~ould have a cumulatrve

Thus notse erruss~ons from the roller coaster (and customers} needs to be compared «~th

respect to prediction of roller coaster nosse since ti~znd condrtlons and hi~h roller coaster
occupancy at the tlrne of our no~se survey ~-ould have resulted m comparat~vely high noise
le~els durui~ this survey period compared to typical roller coaster operatmg cond~t~ons It
is however noted that the predicted overall low le~el of noise transfer from the park to the
ne~~hbonng resident~al area assumes that Pacific Park cantmue to be responsrble «~ith
respect to management of noise errussions Martin Newsan and Assocrates ha~-e conducted
an audit of the varxous potet~tial noise sources located w~thin the park The results of this
aud~t are included m Appendix A It is recommended that ui order to m~ivm~ze patential
naise d~sturbanee from the park to neighbo~ng res1dent~al bu~ldmgs the nosse mstt~atyon
measures recommended ~n Append~ A should be follo~~ed at all tinies
6.0 CONCLUSION
Based upon the acoustical analysis conducted, ~t is predicted that the proposed extension
of the hours of operat~on af Pacif~c Park would not lead to sign2ficant no~se ~m~act upon
resident~al properties ne~ghbonng the Santa Mon~ca Pier
It is recommendetl that m order to tnimm~ze potemlal no~se disturbance from the park to
neighboring residential buildmgs the no~se m2t~gation measures recommended in Appendzx

times and tv~~o (2) hours prior to the Friday and Saturc~ay closing time. The
Peak Season includes the period from Nlemorial Day through Labor Day.
(Z) Off-Pea1~ Season operating hours are from ~0:00 a.m. to 10:00 p.m.lVlanda~
through Thursday, 10:0U a,m, to 11:00 p.m. Snnda`~, and 10:OD a.m. to
Midnight an Friday and Saturdas, providing the Sea Dragan rede staps
operating one (1) hour prior to the Sunda3~ through Thursda~ closing times
and two {2} hours prior to the Fridai and Saturday closing time. Non-Peak
Season begins the day after La6or Day and continues through the day before
l~7ernorial Day. Peak Season hours, as specified i~ l lb(1) above, are allowed

the ~vest. The Operator shall provide an on-site audio technician for fhe
duration of any Special Private Party that in~~obes amplified music/sound
systems. The technician shall monitor Pacific Park's ampIified sound systems
to insure that the maa~imum noise le~el generated after 9:00 p.m. shall not
exceed 65 dBA {ar is not a~dible above the actual CNEL, which ever is lowcr)
as measured aIong The Promenade ~Valk Street.
(c) A sign providing notificAtion that the Amusement park will be clased to
the general public shalI be prominentl` posted on the pier two v~~eeks prior to
a Special Pri~ate Part~~.
(d) Pacific Park shall be directly responsible for all private part~ activities.
~To outside promotcrs are permitted.
{e} Pacific Park shall prepare and implemer~t a Traf~ic Management Plan, at
the expense of the Pacific Park operator, to direct vehicles leaving the 144D
and 1554 parking Iots, after 10:00 p.rn., to the Pacific Coast HighFVa~ exit.
The plan shauld minimize or eliminate departing traftic from using Appian
~VaS south of the Pier, and shall be approved bv the Planning and Communitv
Developmen~ Director and Beach l1~Tanager.
Subsection llb {4} does not apply to pri~atc functions which are conducted
pursuant to other provisions of this permit during normal operating hours.
(5) Ride ticket sales shall cease thirty (30} minutes prior to the closing time.
11 c The Fun Zone shall consist of no more than 70,040 square feet of Pier deck area and shall
provide a maximum of tu~elve rides in addit~on to a maximum of 21 ~ame booths and a
