SUBJECT: Chapter 4.44 Regulation of Smoking
INTRODUCTION
On August 2, 1994, the City council directed the city
Attorney to prepare an amendment to our smoking ordinance to
~nclude all indoor workplaces in Santa Monica and requested City
staff to contact those affected regarding these changes.
BACKGROUND
The primary purpose of the amendments to this ordinance is to
provide greater protection to workers and the public from the
hazards of second-hand smoke. This will be accomplished by
narrowing the exemptions, creating a stronger local ordinance to
reach our goals in the event that the state law does not withstand
a legal challenge and regulating harmful effects of smoking until
the state law goes into effect. Additionally, these changes will
make the language of our ordinance more consistent with section
6404.5 of the Labor Code relating to occupational Safety which
goes into effect on January 1, 1995.

To the extent that the state law does not supersede all local
and government and workplace restr~ctions, it is the intent of the
leg1slature that any area that is not defined as "place of
employmenttl pursuant to subsection (d) of 6404.5 or 1n Wh1Ch the
smok1ng of tobacco products is not regulated pursuant to
subsect10n 6404.5(e) shall be subject to local regulation of
smoking of tobacco products. A copy of the complete text of AB 13
1S attached to this report.
There are fourteen (14) 1tems that are not included in the
def1nit1on of a "place of employment" according to Section
6404.5(d) of the Labor code. In the event section 6404.5 1S
repealed or modified by subsequent legislative or Judicial act10ns
so that the 100% smoklng prohiblt1on is no longer appllcable to
all enclosed places of employment ln California, local government
shall have the full right and author1ty to enforce prevlously
enacted, and to enact and enforce new restrictions on the smoking
of tobacco products 1n enclosed places of employment within thelr
jurisdlctions includlng a complete prohibition of smoklng.
Seven of the fourteen areas that the state excluded from the
deflnition of a "place of employment" lnvolve subject matter that
would not be very relevant to the goals of the City. The councll
has voiced concerns in the areas of restaurants, bars and places

of public accommodations as well as indoor work areas In general.
Accordingly, we have not incorporated the followlng state excluded
subjects ln our extension of smoking prohibltions:
(1) Sixty-five percent of the guest room accommodatlons in a
hotel, motel or similar transient lodging establlshment.
(2) Retail or wholesale tobacco shops and private smokers'
lounges.
(3) Cabs of motortrucks, as defined in Sectlon 410 of the
Vehlcle Code or truck tractors, as defined in section 655 of the
Vehlcle Code, if no nonsmoklng employees are present.
(4) Theatrlcal production sites, if smoking lS an integral
part of the story 1n the theatr1cal product1on.
(5) Medical research or treatment sltes, if smoking is
integral to the research and treatment belng conducted.
(6) Private residences, except for private residences
llcensed as fam1ly day care homes, during the hours of operat1on
as family day care homes and 1n those areas where children are
present.
(7) Patient smoking areas ln long-term health care
facilities, as defined in section 1418 of the Health and Safety
Code.
The above areas will be governed exclusively by the state
law.
Santa Monica Munic1pal Code section 4.44.030, regarding
"General Prohibitions" 1S amended to include seven areas that the
state has excluded from the deflnlt10n of places of employment.

The seven areas that are lncluded in our amendments are:
(1) Lobby areas in hotels, motels or other similar transient
lodglng establishments.
(2) Meetlng and banquet rooms ln a hotel, motel or other
transient lodging establlshments slmllar to a hotel or
motel, restaurant, or publlC conventlon center.
(3) Warehouse facillties
(4) Gamlng clubs
(5) Bars and taverns
(6) Employee breakrooms
(14) Employers wlth flve or fewer employees.
A more extensive description of these fourteen areas excluded
by the state can be found in the attached copy of AB13. Language
that was lnconsistent with the state law In thlS area has been
stricken from sectlons 4.44.10, 4.46.10, 4.44.40, 4.44.50 and
4.44.60.
RECOMMENDATION
It is respectfully recommended that the ordlnance amending
Section 4.44.010, 4.44.020, 4.44.030, 4.44.040 and 4.44.060
regarding regulation of smoking in the city of Santa Monica be
lntroduced for first reading at the October 25, 1994 meetlng of
the Clty Council.

SECTION 1. Santa Monica Munlclpal Code section 4.44.010 is
amended to read as follows:
4.44.010 Declaration of purpose.
The city Council of the City of Santa Monica finds and
declares:
(a) Smok~ng ~s a positive danger to health and a cause of
material annoyance, inconvenience, discomfort and a health
hazard to those who are present in conflned places.
(b) The public health, safety, and general welfare of the
residents of, persons employed in, and persons who frequent
the City of Santa Monica would be furthered by the prohibition
and regulation of smoking in publlC places, workplaces, and
restaurants.
(c) ThlS Chapter regulates smoking ln public places,
selected workplaces, restaurants and bars to the extent that
t.hey are not covered by Labor Code suction 6404.5.

Santa Monica Municipal Code section 4.44.020 is amended to
read as follows:
4.44.020 Definitions.
The following words and phrases, as used in thls Chapter,
shall have the following meanings:
(a) Bar. An area where alcoholic beverages are served for
consumption on the premises and in which the serving of food,
if any, is only incidental to the consumption of such
beverages. Although a restaurant may contain a bar, the term
"bar" shall not include the restaurant dining area.
(b) Employee. Any person who is employed by any employer
ln consideration for monetary compensation or profit,
including an independent contractor regularly performing
services at the place of employment of the other contracting
party.
(c) Any person, partnership, corporation, including a
public entity, who employs the serVlces of more than five (5)
employees.
(d) Place of Employment. Any enclosed area under the
control of a public or private employer which employees
normally frequent during the course of employment, including,
but not limited to, work areas, employee lounges, conference
rooms, and employee cafeterlas. A private residence is not a
place of employment.
(e) Restaurant.
Any
public
or
private
eating

establishment of any kind whatsoever which gives or offers
food for sale to the public, guests, patrons, members, or
employees including, but not limited to, any coffee shop,
cafeteria, luncheonette, soda fountain, shopping center or
mall, private school cafeteria or eating establishment,
organization, club, including veterans' club, except that the
term IIrestaurant" shall not include a "bar" as defined above.
Restaurant shall include any common dining or seating area
whether shared or under the exclusive control of one or more
businesses.
(f) Smoke or Smoking. The carrying or holding of a
lighted pipe, cigar, or cigarette of any kind, or any other
lighted smoking product or equipment used to burn any tobacco
products, weed, plant, or any other combustible substance.
Smoking includes the emitting or exhaling the fumes of any
pipe, cigar, or cigarette of any kind, or any other lighted
smoking equipment used burning any tobacco product, weed,
plant, or any other combustible substance.
SECTION 3.
Santa Monica Municipal Code section 4.44.030 is
amended to read as follows:
4.44.030 General prohibitions.
It shall be unlawful to smoke in the following places:
(a) Those portions of any building, structure, or other
enclosed facility open to the general public for the primary
purpose of holding meetings or exhiblting any motion picture,

stage production, musical recital, or similar performance.
(b) Those portions of any bUllding, structure, or other
enclosed facility open to the general public for the primary
purpose of a museum, library, or gallery.
(c) Any elevator.
(d) On any bus used in the business of transporting
passengers for hire in the City, excepting for charter
operations.
(e) Any restroom open to the general public or provided
for use to customers or patrons.

access to minor9 under 18 years of age.
(n) Oars and taverns.

sect10n 1n a manner consistent with all applicable state or
federal statutes, rules or regulations on employer-employee
relations.

SECTION 5. Santa Monica Municipal Code section 4.44.050
1S amended to read as follows:
4.44.050 Posting of Signs.
(a) The person having the authority to manage and control
any area designated as an nonsmoking area pursuant to section
4.44.030 or 4.44.040, shall post or cause to be posted and
prominently displayed, and shall maintain "No Smoking" signs
in conspicuous locations within said area. All such s1gns
shall clearly and conspicuously recite the phrase "NO SMOKING"
and/or use the international no-smoking symbol.
(b) In all places regulated by Section 4.44.030 or
Section 4.44.040 other than restaurants, signs shall be posted
not less than five (5) feet nor more than eight (8) feet above
floor level and shall be of sufficient number and location to
cause the message of at least one of the signs to be clearly
visible, legible, and readable by all patrons.
(c) In connection with restaurants and bars, one of the
following shall be required in order to comply with this
Section:
(1) Free-standing signs or permanent wall signs of
sufficient number and location to cause the message of at
least one of the signs to be clearly visible, legible, and
readable by all patrons.
(2) Placement of washable placards or other signs on all
non omoking tables.
(d) Violation of, or failure to comply with, this Section

is a misdemeanor.

4.44.070 Penaltles.
(a) No person shall wilfully mutilate or destroy any
sign required by this Chapter.
(b) No person shall smoke in any area posted as a
nonsmoking area.
(c)
No
employer
shall
discharge
or
in
any
manner
dlscriminate against any employee who exercises his or her

rights under this Chapter if the dominant intent of the
employer is retaliation against the employee for exercising
those rights. Violation of this provision shall be a
misdemeanor.
(d) Except as otherwise provided for in this Chapter,
violation of any provision or failure to comply with any
requirement of this Chapter is an infraction punishable by a
fine of not more than one hundred dollars ($100.00).
4.44.080 Enforcement.
(a) civil Action. Any aggrieved person may enforce the
provisions of this Chapter by means of a civil actlon.
(b) Injunction. Any person who commits, or proposes to
commit, an act in violation of this Chapter may be enjoined
therefrom by any court of competent jurisdiction. An action
for injunction under this subdivision may be brought by any
aggrieved person, by the city, Attorney, or by any person or
entity which will fairly and adequately represent the
lnterests of the protected class.
(c) Attorneys' Fees. In any action under this section by
an employee alleging retaliation or discrimination by an
employer for exercising rights under this Chapter, the
prevailing party shall be awarded costs and reasonable
attorneys' fees.
(d) Duty to Inform. Owners, operators, managers, or
employees of any place subj ect to thls Chapter shall be

required to orally inform persons violating this Chapter of
the provisions hereof. The duty to inform such violator shall
arise when such owner, operator, manager, or employee of same
becomes aware of such violatlon.
4.44.090 Sale of tobacco by vending or other mechanical device or
out of package.
(a) Purpose. The city council finds cigarette smoklng
and other tobacco use by minors to be a continuing problem
with grave public health consequences. Studies show that the
vast majority of adult smokers began as teenagers, and that
teenagers who begin using tobacco before the age of 15
eventually have much higher cancer rates than non-tobacco
using teenagers. In recognition of the surgeon General' 5
conclusion that nicotine is as addictive as cocaine or heroin,
action is needed to curtail the easy access of minors to
cigarettes and other tobacco products. Furthermore, by
adoption of Santa Monica Municipal Code Sections 4.44.010
through 4.44.080, the city has already prohibited smoking ln
public places, workplaces, and restaurants. The sale of
tobacco by vending machine encourages violations of these
Sections of the Municipal Code since minors have access to
most of these types of premises. The purpose of this Chapter
is to implement a strict and enforceable system to prevent the
illegal sale of cigarettes and other tobacco products to
minors.

(b) Vending Machines. On or after May 1, 1991, no person
shall sellar dispense cigarettes or other tobacco products by
vending machine or any other device that automatically sells
or dispenses tobacco products.
(c) Out of Package Sales Prohibited. It is unlawful to
sell cigarettes out of the manufacturer's package with
required health warnings.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES ORDAIN AS FOLLOWS:
SECTION 7.
The Mayor shall sign and the City Clerk shall
attest to the passage of this Ordinance. The City Clerk shall cause
the same to be published once in the official newspaper within 15
days after its adopt lon.
This Ordinance shall become effective
after 30 days from its adoption.
