BACKGROUND On June 21, 1994, the city Council adopted an emergency ordinance relating to the repair and retrofitting of potentially hazardous structures, lncluding soft-story structures. The ordinance requires that within 120 days of the effective date of the ordinance, or by October 21, 1994, owners of soft-story buildings damaged by the earthquake submit an engineering report demonstrating whether the building complies with the Earthquake Design Standards contained in the Uniform Building Code. OCT 1 1 199't 1 8A It I' . ~ Due to the fact that it has taken longer than anticipated to identify the soft-story buildings damaged by the January 17 Northridge Earthquake and prepare the notice, staff is recommending that the deadline be changed to February 1, 1995. This extension will give property owners a reasonable time period in which to obtain the required engineering report. ~UDGET/FINANCIAL IMPACT This recommendation will have no budgetary or financial impacts. RECOMMENDATION It is recommended that the city council adopt an amendment to Section 4 of Ordinance #1748 as reflected in Attachment "A" to extend the deadline for the submission of engineering reports on damaged soft-story structures. Attachment "A": Amended ordinance #1748 Prepared by: Suzanne Frick, peD Director Paul Casey, Acting Senior Planner Tad Read, Assoc~ate Planner 2 CA:f:\atty\muni\laws\mhs\vbld3 City Council Meeting 10-11-94 Santa Monica, Californla ORDINANCE NUMBER 1771 (CCS) (City Councll Serles) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AMENDING SANTA MONICA MUNICIPAL CODE SECTION 8.04.172 REGARDING REPAIR OF POTENTIALLY HAZARDOUS STRUCTURES AND DECLARING THE PRESENCE OF AN EMERGENCY WHEREAS, numerous bUlldlngs and other structures ln the Cl ty of Santa Monica experlenced substantl.al damage due to the January 17, 1994 Northrldge earthquake and its aftershocks; and WHEREAS, an evaluat~on of the damage reveals that because of constructlon methods certaln structures are especlally susceptlble to damage ln the event of major earthquakes and pose a substantial risk to publlC health, safety, and welfare; and WHEREAS, for the reasons set forth above, and for the protection of the public health, safety and welfare, on June 21, 1994, the City Counc1.l adopted an Ordloance regarding repair, reconstructlon and relnforcement of potentlally hazardous structures; 1 WHEREAS, that Ordinance requlred, among other things, that the owner of any soft story structure damaged by the January 17, 1994 Northrldge Earthquake or lts aftershocks submit an engineering report to the Building and Safety Divlslon within 120 days of the effective date of the Ordlnance; and WHEREAS, lt took more time than anticipated to identify and notify owners of thelr obllgation to submlt an engineering report pursuant to the Ordinance due to the exceSSlve number of such soft story structures damaged by the earthquake; and WHEREAS, it is consequently necessary to allow addltional time for owners to prepare and submlt such englneering reports; and WHEREAS, absent this amendment, owners would be required to submit englneering reports by October 21, 1994 which is insufficient time for compliance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES ORDAIN AS FOLLOWS: SECTION 1. Santa Monica Municipal Code Sectlon 8.04.172 is amended to read as follows: 2 8.04.172 UAC section 206(h) added- Repair, Reconstruction, and Reinforcement of Potentially Hazardous structures. Section 206(h) of the Uniform Administrative Code, 1991 Edition, relating to Repair, Reconstruction, and Reinforcement of Potentlally Hazardous Buildings, lS added to read as follo1ilS: Division 1.00 Definitions. As used ln this Section, the followlng terms shall be defined as follows: (a) Non Ductlle Precast Concrete Buildlng. Any structure designed and constructed Wl th concrete elements that are cast in other than their final position. (b) Non Ductile Reinforced Concrete Building. Any structure deslgned and constructed \-lith poured ln place relnforced concrete. (c) Soft Story Building. Any structure or portion of a structure classified as soft story in the UniforM Building Code as adopted by the Clty of Santa Monica. (d) Steel Frame Buildlng. Any structure designed or constructed wlth steel frame 3 elements of load bearing and lateral load resistance systems. Divlsion 2.00 Determination of occupant Load and Building Type. For purposes of this Section, the occupant load of each structure shall be determ~ned by the Building Offic~al in accordance wlth the Unlform Buildlng Code as adopted by the c~ty of Santa Honica and shall be appllcable to both vacant and occupled structures. For purposes of this Section, the structure type shall be as deflned in the Earthquake Deslgn Sectlon of the uniform BUlldlng Code as adopted by the City of Santa Monlca. Division 3.00 scope. The owner of any structure identified in this Section shall, within the time limits set forth in this Sectlon, cause the structure to be evaluated, repalred or retrofltted to conform to the cr1ter1a specifled in this Sect1on. Division 4.00 soft story Construction. (a) Wlthin 120 days of the date of notlce to the owner by the City, but no later than March 31, 1995, the owner of any soft story structure damaged by the January 17, 1994 Earthquake or its aftershocks, where the cost 4 of repair is less than 50% of the replacement value of the structure, shall submit an eng~neering report prepared by a llcensed engineer (lIenglneering reportll) to the Buildlng and Safety Div~slon, except that any owner who did not receive notice shall be granted at least an additional th~rty (30) day extension by City staff from the date the owner lS notlf~ed of non-compliance. The report shall be based on a non-rotational lateral analysis and shall denonstrate whether the building complies with the Earthquake Design Standards contained ln the Uniform Building Code ~n effect at the tlme the structural eng~neerlng report is submitted to the c~ty. If the report concludes the structure does not comply with the standards, the structure shall be strengthened with~n the timelines of Divislon 7.00 of this section and according to the follow~ng standards: (1) Calculated story drift shall not exceed 0.04 jRw or 0.005 times the story height for structures hav~ng a fundamental period of less than 0.7 seconds. For structures having a fundamental period of 0.7 second or greater, the calculated story drift 5 shall not exceed 0.03jRw or 0.004 times the story height. (2) Use K=2.1, the buckling factor for a cantilever column, for the design of the steel colur.ms. (3) Do not allow the principle of diaphragm rotatlon in wood frame bUlldings to distribute the design lateral force(s). (b) W1.thin 120 days of notice to the owner by the City, the owner of any soft story structure not damaged by the January 17, 1994 Northrldge earthquake or its aftershocks, shall submit an englneerlng report to the Buildlng and Safety Oivlsion. The report shall be based on a non-diaphragm rotatlonal lateral analysls and shall demonstrate whether the structure conforms to the Earthquake Design Standards contained in the Uniform BU1.1ding Code as adopted by the C1.ty of Santa Monica. If the report concludes the structure does not comply wlth the standards, the structure shall be strengthened wlthin the tirnelines of Division 7.00 of this Section and according to the standards listed in subsection (a) above. 6 Divislon 5.00 Tilt-up Buildings Constructed to Pre-1976 Building Code. Within 275 days of the date of notice to the owner by the City, the owner of any Tilt-up bUllding constructed to pre-1976 Building Code standards shall submit an engineering report to the BUllding and Safety Divlslon. The report shall demonstrate whether the structure conforms to the Earthquake Design Standards contained ln the Uniform Building Code in effect at the tlIDe the report is subrnltted to the Clty. If the report concludes the structure does not comply with the standards, the structure shall be strengthened to comply with the standards T.vithin the timelines of Division 7.00 of this Section. Divlsion 6.00 Non Ductile Reinforced Concrete and Non Ductile Pre-Cast Concrete structures. within 275 days of the date of notice to the owner by the City, the owner of any non ductile relnforced concrete or non ductile pre-cast concrete structure shall submlt an engineerlng report to the Building and Safety Division. For structures over three stories in helght, the report shall be based upon a dynamlc lateral-force analysls 7 and for structures three storles or less, the report shall be based upon a stralght lateral load analysls. The report shall demonstrate whether the structure conforms to the Earthquake Design Standards contalned in the Uniform Building Code in effect at the time the report is submitted to the city. If the report concludes that the structure does not comply wlth the standards, the structure shall be strengthened to comply with the standards wlthln the tl~ellnes of D1V1Slon 7.00 of this Section. 8 Division 7.00 Timetable for Compliance. For purposes of thls Sectlon, "date of englneering report submlttalll shall be either that date upon which the report was due to be submltted to the Clty, or the date of actual submlttal to the City, whlchever is earlier. Divislon 8.00 Historical Buildings. Buildings deslgnated as historically or architecturally slgnificant landmarks on national, state or local historlcal reglsters shall comply with this Section. At the Building official's discretion, modiflcations to the standards set forth In thlS Section may be made on a case by case basls, so long as such modif~cations are conslstent with the provislons of the State Historlcal BUlldlng Code. 10 SECTION 2. Any provislon of the Santa Monica Municipal Code or appendices thereto, lnconsistent wlth the provisions of thlS Ordinance, to the extent of such inconsistencles and no further, are hereby repealed or modified to that extent necessary to effect the provlslons of thls Ord1nance. SECTION 3. This Ordinance is declared to be an urgency measure adopted pursuant to the provisions of Section 615 of the Santa Monica city Charter. It is necessary for preserving the public health, safety, or welfare as set forth in the Findlngs and Purpose section of thls Ordlnance. SECTION 4. If any section, subsectlon, sentence, clause, or phrase of this Ordlnance 1S for any reason held to be invalid or unconsti tutlonal by a decision of any court of any competent jurisdiction, such decision shall not affect the validity of all remaining portions of this Ordlnance. The City Council hereby declares that it would not have passed thlS Ordinance lf any portion, section, subsectlon, sentence, clause, or phrase would subsequently be declared 1nvalid or unconstitutional. 11 SECTION 5. The Mayor shall slgn and the c~ty Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once In the off lClal newspaper within 15 days after its adoptlon. ThIS Ordinance shall be effective upon its adoption.
