Account
Introduction
This report recommends that the C1ty Council award a contract for
the FY 1994-95 street improvement program and m1scellaneous paving
work to Damon Construction Company, the lowest responsible bidder,
in the amount of $2,471,791.60 and to appropriate $200,000 to the
Carlyle Intersection Improvements elP account.
Background
Each fiscal year, the city Council authorizes the implementation of
street improvements slated by the Department of Environmental and
Public Works Management for the year including street resurfacingi
slurry sealingi and curb, gutter, curb ramp, bus pad, and sidewalk
repairs. The priority projects for the year are determined through
an evaluation and inspection of streets that ranked high in the
hierarchy of warranted street repairs outlined in the "Pavement
Management System" Report. This report has been required since
1989 to qua11fy for Federal funding and is updated annually. It
ranks the condition of all streets, sidewalks, curbs, and gutters
in the city.

Discussion
During the on-site inspection of these priority locations,
evaluation further qualifies streets for type and schedule of
repair by age, surface and subsurface conditions, complaints
received, type of use (Le. , commercial, industrial or
residential) , current traffic volume, and projected change of use
or volume.
Financial considerations are also factored into the scheduling of
the street resurfacing projects. More comprehensive projects
requiring appurtenant work on gutters and sidewalks are more
costly, limiting the number of locations that can be addressed in
one year. Every effort is made to repair and recycle existing
pavement rather than unnecessarily incur the expense of total
pavement replacement. Badly damaged streets are resurfaced by
heating and scarifying the top I", adding oil to rejuvenate the
pavement and then adding I" of new rUbber-asphalt. For streets
with more limited traffic and/or where the pavement is not as badly
damaged, an asphalt slurry coating of approximately 1/811 thickness
is applied over the old pavement. This seals the cracks and
prevents stormwater intrusion, and smooths surface irregularities.
Sidewalks, curb ramps, bus pads, curbs, gutters, driveways and
parkway pavements in need of repair are also replaced at the time
of resurfacing or slurry sealing.

In addition to the street resurfacing work, this contract includes
seven related Capital Improvement Projects. These projects are the
drywall improvement at Ninth Court; the construction of ADA curb
ramps at various locations; earthquake street repairs; the
construction of bus pads on transit routes; City Hall parking lot
resurfacing; several bridge repairs and improvements on Carlyle
Avenue to include the removal of dips at several intersections:
16th street, 21st Street, 21st Place, 22nd street, and 23rd street.
By combining all of these proposed activities into a single
contract, bid proposals totaled less than if the projects were bid
separately.

street Resurfacing Assessments
In accordance with city policy on assessments for public
improvements, an assessment district has been formed to assess
commercial and industrial property owners for the actual costs of
street resurfacing, gutter construction, sidewalk, parkway
pavement, driveway and curb repairs. Residential property owners
will only be assessed for sidewalk, parkway pavement, driveway and
curb repairs. Revenues will be deposited in FY 1995-1996. Unpaid
assessments will appear on the delinquent property owners' FY 1996-
97 property tax bill.
Bid Package
The Notice Invitlng Bids was published in The Outlook on October 5
and 6, 1994. Plans and speciflcations were also submitted to four
construction journals, and were sent to six women/minority business
enterprise (WMBE) associations. Bidding packages were requested by
18 contractors. The city Clerk's Office received six sealed bids,
which were publicly opened and read aloud on October 30, 1994, by
the Deputy City Clerk.
The base bid results were as follows:

Sully Miller Contracting Co. has requested to withdraw their bid
due to an error in their calculation. Their estimate is 20% lower
than the second bidder and some of their unit prices are 50% less
than the market value which indicates that an error was made.
Therefore, Sully Miller's bid is deemed nonresponsive. The city
Attorney concurs that withdrawal of the Sully Miller bid is in the
best interest of the City.
The second low bidder, Damon Construction Company, has done work
for the city and staff has been satisfied with their performance.
The Damon Construction Company1s license "A" was verified to be in
good standing by the California state Contractors License Board.
BUdget/Financial Analysis
Assessments are expected to generate approximately $250,000 in
revenue in FY 1995-96 which will be deposited in Revenue Account
Numbers: "street Resurfacing Assessmentl1 01-500-402-00000-0124-
10000 in the amount of $190,000 and "sidewalk Repair" 01-500-421-
00000-0179-10000 in the amount of $60,000.
It is requested that the city Council appropriate funds in the
amount of $200,000 to Account Number 20-770-402-20095-8905-99615,
"Carlyle Intersection Improvements", to cover the costs of removing
dips at various intersections on Carlyle Avenue. The City will be
reimbursed 100% by Propositlon C funds.

Recommendation
It is recommended that the City council:
1. Award a contract to perform the annual street improvement
program and miscellaneous paving work to Damon Construction
Company, the lowest responsible bidder, in the amount of
$2,471,791.60.
2. Approve new capital Improvements Program appropriations in the
CIP Account Number 20-770-402-20095-8905-99615 in the amount
of $200,000.
3. Authorize the City Engineer to Issue any necessary change
orders to complete additional work in conformance with the
AdministratIve Instruction on change orders.
