SUBJECT: Recommendation to Authorize the City Manager to
Negotiate and Execute the National Pollutant Discharge
Elimination System (NPDES) Municipal Stormwater Permit
Implementation Agreement
Introduction
This report requests that the City Council authorize the City
Manager to negotiate and execute a Letter of Intent with the County
of Los Angeles for the Nat ional Pollutant Discharge Elimination
System (NPDES) Municipal Stormwater Permit.
Backqround
In 1987, amendments to the United States Clean Water Act called for
metropolitan areas to apply for municipal stormwater permits from
the u.s. Environmental Protection Agency under the National
Pollutant 'Discharge EIJ.mination System (NPDES) program The
objective of the program is to reduce surface water pollution
(oceans, lakes, rivers) which is caused by water runoff from
streets, landscaped areas and parking lots.
In 1989, the City of Santa Monica joined eighteen (18) other citJ.es
as co-permittees with the County of Los Angeles and received an
early NPDES permit. This permit expires on June 18, 1995. At
least 180 days prior to the expiration of the permit, the co-

permittees are requlred to submit a progress report (Report of Work
Discharge) and a Letter of Intent to join together as co-permittees
for a new permlt application.
Discussion
Currently, the City undertakes several practlces which asslst in
the prevention of stormwater pollutlon and are specified ln the
Permlt. These pract~ces include catch basin cleaning, street
sweeplng, recycling, hazardous waste dlsposal, landscape
malntenance, sidewalk cleaning and control of urban runoff due to
the implementation of the City's Urban Runoff Pollutlon Control
Ordinance. In addition, the Clty of Santa Monica is continuing to
pursue and develop various other stormwater pollution control
measures/programs which wlll be implemented during the next one to
three years. The Los Angeles Regional Water Quality Control Board
(LARWQCB) lS currently revlewing the City's current best management
practlces and wlll determlne If, ln their opinlon, additional
measures are required. Agencles that do not particlpate in the
Implementation Agreement could be liable for legal actions and
fines levled by the LARWQCB.
Budget/Fiscal Impact
Although the Clty of Santa Monica has committed, and will continue
to commit, significant financial resources to stormwater
management/pollutlon control programs, this requested Councll
action has no direct flscal/budget impact. As speciflc stormwater

programs and measures associated with the NPDES permit are
formulated and recommended for Council approval in the future, each
of the ind1vidual budget 1mpacts will be discussed.
Recommendation
It is recommended that the Clty Council authorize the City Manager
to negotiate and execute a Letter of Intent with the County of Los
Angeles to particlpate In a new National Pollutant Discharge
Eliminat10n System (NPDES) Municipal Stormwater Permlt
