INTRODIICTION With this report, sta~f is recommending tha Couneil take the Following actians with respect to a S~nset Park Traffic Plan: 1) Canduct a public hearing; 2y adopt a resalution ta certify the Final EnvirQnrr~enta~ Impact Repo~-t ~EIR); 3) conceptually appxove a Plan and mit~gatian measures; 4) direct staff to prepare a Statement of Overriding Cansiderations with recvmmendation for findings and benefits of the Project; and 5) adopt a resolution of intention to direct the Planning Commission to amer~d the Land Use and Czrc~latZOn Element of the GeneraZ Plan if necessary. Because implemantation of soma of the Sunset Park Traffic Plans would require an amEndment to the General Plan if they include a barrier or diverter, the pracess for implementing a Plan may require subsequen~ Cauncil and Planning Cammiss~on actions. The 1 SEP27~ first step for implementing a Plan ~s far the Council to certify the EIR and give direction to staff on which Plan and mitigation measures to implement. Staff wou~d return at a subsequent meeting with the statement of o~erriding considerations on the significant impacts for the recommended plan, an implementation schedule, and a request for budget authorizat~on. In the event the recommended plan requires a Gsneral Plan amendment, staff would return to the Council after the Planninq Commission acts on the General Plan amendment. This report provides background on the Sunset Park Traffic Plan, discusses the significant impacts identified and mitigation measures proposed for various alternatives in the EIR, discusses the public pracess for development of the Plan, outlines the cost of the plans and mitigation measures, and provides a recommendation for Council approval of a Traffic Plan. A range of options are available ta the C~uncil in selecting a traffic plan. One of ~he three plans (Enciave, Paral2el, and Staff), the staff rec~mmended Hybrid Plan, or one of the alternatives identified in the EIR, may be chosen. Elements of the plans may also be combined to create a modified traffic plan. As ~ong as el~ments were analy~ed ~n the EIR, or the~ are modified in a less restrictive manner, they can be used by Council in selecting a Plan. Staff i.s recommending a Hybra.d Plan consisting of cammon elements within each Plan pius individual measures from one of the 2 three plans where there was not agreement. This recommendad plan is described in more detail later in the staff r2port. New traffic control measures not sp~cifically analyzed in the EIR that would likely create a significant impact can not be used unless further environmental review is done. The identification of new measures may create new significant impacts and therefore will reqvire re-circulation of the EIR. BACKGROUND For several years, City staff has been working with groups of neighbors in Sunset Park to develop and implement neighborhood traffic plans within the area boundad by Pico Boulevard on the north, the south city limit, Lincoln Bou~evard on the west and Centinela Avenue on the east. A neighborhoad traffic plan is the comprehensive and coordinated implementation of traffic controZ measures to address neighborhood traffic concerns. The Sunset Park Traffic Plans were developed by the City with the assistance of interested residents in the neighborhoad starting in the Spring of 1990. The two Sunset Park neighborhaod organizations, Friends af Sunset Park and Sunset Park Associatian of Neighbors, created separate plans for the neighborhood, known as the Enclave and Parallel plans, respectively. 3 The primary objectave of these plans is to mitigat~ the volume of "through" traffic which is traveling or "cutting" through residential areas. The goal of mo~ing "through" traffic out of residential areas is be~ng addressed by installing traffic contral measures on the residential streets to discpurage or divert traffic out of the neighbarhoads and improving tha adjacent arterial highway system to facilitate traffic flow thereby reducing the need to divert through a residential area. Traffic control measures are being proposed in various degrees ir- the p~ans to me~t this goal, including the use of typical types of cantrol such as stop signs, parking restrictions, speed humps, signal improvements, modified roadway striping and turn restrict~ons. The plans include co~nmon elements such as traffic circles and one traffic diverter, while the Enclave plan proposes the use af numerous barriers and divert~rs or street closur~s that are not included in the Paral~el or Staff Plans. DESCRIPTION OF PLAIdS Enclave Plan The foZlowing is a brief discussion ~nodified by the Friends of Sunset Park. from the Enclave Plan ana~yzed in restrictive ~nanner. Partial road closures on 23rd Street and Cloverfield north of ~cean Park. o Partial cul-de-sacs east of Lincoln on Wilson Place, Ashland Avenue, and Hill Street. o Peak Periad Parking restrictions on both sides of Lincoln Boulevard from Pica to the south City 3imits. o A forced right turn di~erter for northbound traffic at 23rd Street and Ocean Park Baulevard, and pylons in the median an Ocean Park Boulevard at Cloverfield restricting turn movements. o Pedestrian signals on 23rd Street at Hill and Pier, as well as an 15th Street between John Adams School and Will Rogers school. o Traffic circles, speed humps, stop signs, and re--timed traffic signals throughout the project area. The differences between the Enclave Plan summarized above and the one analyzed in the Draft EIR are outlined in detail in Attachment A. The most recent modifa.cations eliminated ten full barriers by rep~acing them with p~ak hour turn restrictions, reduced two full barriers to partial barriers, and left four full bazriers in the Enclave Plan. Some o~ the measures added to the Enclave Plan were already included in the Parallel Plan, while other changes are less restrictive than the original Enclave P~an studied in the EiR. One propos~d modification not analyz~d in the Draft EiR is a partial barrier or- Pier Avenue just east of Lincaln. Since this 5 measure was no~ analyzed in th~ Draft EIR and may have a significant impact, further enviranmental analysis and a recirculatian of the EIR would be required if Gouncil chaoses to impl~ment the measure. The remainder of the changes outlined abave may be implementad withaut further environmental review. Parallei Plan The following is a brief description of the Parallel Plan. The EIR provides additional details about the Plan: o Conversion of 23rd Street and Clo~erfield Baule~ard ta a one-way couple~, with 23rd Strest nbrthbound and Cloverfield Boulevard southbound from Pico to Ocean Park Boulevards with only ane trave~ lan~ on each. a Peak Haur turn restrictions at the intersections of 23rd Street with Pier Avenue, Ashland Avenue, Hil~ Street, and Oak Street. Median an 23rd Stree~ from Dewey Str~et to Pier Avenue. Peak hour turn restrictions also on Pearl Street at 20th and Centinela, at th~ intersectians af Lincoln Boule~ard with O~one Avenue, Marine Street, Pier Avenue, Ashland Avenue, and Hill Street, and on Pico and Ocean Park Boulevards at 21st and 22nd Streets. o Planted median on 23rd Street between Pier Avenue and the sauth City limits. o Pedestr~an signal on 23rd Street at Ashland. o Peak period parking restrictions on l~oth sides of Lincoln Boulevard from Pico to th~ so~th City limits, and on Pico Baulevard from Lincaln to Centinela. Partial parking removal on Ocean Park Boulevard bEtween 16th Street and 25th Street. o Stap signs at Airport Avenue and Walgrove Avenue, along with rep].acement of stop signs on Airport Avenue wi~h pedestrian activated signal.s. o Traffa.c circles, speed humps, stop siqns, and re-timed traffic eircles throughout the project area. 6 Staff Plan As part af the preparation of the EIR, staff develflped a third prQposal (the "Staff" Plan) to be included in the analysis to provide Cauncil with a wide range of options for implementing transportation control measur~s. The Staff Plan was developed by comparing the daily traffic volumes with the capacities identified in the Land Use and Circulation Element (LUCE) of the Ger~eral Plan for all streets in the study area and noting those corridors that exceeded the volumes suggested in the LUCE. The Pian addresses those rautes by installing measures to reduce the speed and valume of traffic on thase streets without major diversion of traffic to ather streets. The Staff Plan is not as restrictive as the other two plans, but still addresses the key corridors. The key elements nf the Staff Plan include the following: o Peak Period parking restrictions on both sides af Lincoln Boulevard between Pico Bou~evard and the south City limit. o Pedestrian signal at 23rd Street and Ashland o Speed humps at various Iocations in the project area, including 23rd Street, Cloverfield, 28th Street and 34th Street between Pica and ~cean Park Boulevards. a Stap signs throughout the project area, including on 23rd Street at Hill Street, Pier Straet, Dewey Street and Airport Avenue. Copies of the three plans, alang with a wxitten summary, are provided in the F'inal EIR beginning on Page 3-10. As outlined, the 7 Enclave Plan has been modified from the descriptian included in the Final EIR. Recommended Hybrid Plan Staff is recommending ado~tion of a hybrid plan including elements frorn all three plans. This includes adoption of common elements ta all three plans, plus the recomm~nded elements as outlined below in this section. A detailed summary of the Hybrid Plan is included as Attach~nent B. Staff recommends this hybrid plan for the following reasons: o Minimize impacts to the City of Los Angeles. o Eliminate th~ need for amending th~ General Plan for incorporation of adopted elements by removing barri~rs and diverters from th~ proposed plan. o Provide a plan that is mare consistent with the legal apinian presented by the City Attorney's office with regards to what elements the City is able to implement. Staff analyxed the three pians s~udied in the EIR, along with the recommended changes to the Enclave Plan, and identified the cammon areas of traffic control measures. Thes~ elements include peak period turn restric~ians, stop signs, speed hu~nps, signxl synchronization, traffic circles, and most importantly, peak period parking restrictions on Lincaln Boulevard. These primary common elements include stop signs on 23rd Stre~t south of ~eean Park Boule~ard at Ashland, Dewey and Airport, peak hour turning restriction along 23rd Street sauth of Ocean Park Boule~ard, peak hour parking restrietions on Lincaln Boulevard, speed humps on 23rd 8 Street and Clo~erfield between Pica and Ocean Park Baulevards. For a complete list a~ measures see Attachment B. Staff feels that this is a reasonable plan which addresses the key corridors without imposing major changes to the circulation system both inside and outside the neighborhood. It also will not require an amendment to the Land Use and Circulation Element of the General P].an and will. allow implementation ta proceed in a more timely manner. In brief, a summary of the hybrid plan includes the adaption af the following: o Common elements of a11 traffic plans, including stop signs on 23rd Street south of Ocean Park, peak hour turn restrictions an 23rd Street south af Ocean Park, and additional stop signs, speed humps and traffic circles throughout the project area. a Speed humps on 23rd Street and Cloverfield Boulevard between Pico and Ocean Park Boulevard. a No change to existing condit~ons at Pear~ Street and 20th Street. o Left turn packets on Ocean Park Boulevard at 17th, 20th, 21st, 23rd and Cloverfield, while minimizing the amount of green time for signals at minor cross streets af Ocean Park. o Chang~s to the signal timing at PearZ and Centinela, pl~zs addition of stop signs an Pearl Street at 31st and 34th Streets. o Addition af stap signs at Airport Avenue and Walgrove Avenue, but no further changes on Airport at th~s time. o Peak hour parking restrictions on Lincoln Boulevard. 9 REY DEGISION AREAS The follawing is a discussion of areas where each plan proposed a different approach to a similar issue beyond those common elements, along with recornmendations far the Hybrid P1an: Cloverfield/23rd Street Corridox The three plans provide for different m~asures to address the volume and speed of traffic on this corridor between Pico and Ocean Park Boulevard. The measures include the following: Enc~ave Plan: o A diverter at Ocean Park Boulevard for traffic travell~ng north on 23rd Street requiring a right turn onta Ocean Park and no left turn onto Cloverfield thraugh use of pylons in th~ median of Ocean Park. o Partial barri~rs to traffic travelling sauthbound on 23rd Street and Cloverfield Boulevard at Ocean Park preventing the use af those streets o Full barriers just narth of Ocean Park Boulevard at 21st, 22nd and 25th Street. o No left turn in the peak hours from sauthbound 20th Street to Eastbaund Ocean Park Baulevard. ParaZ~el PZan: o Convert 23rd street to one-lane and one-way northbound, and convert Cloverfield Boulevard to one-lane and one-way southb~und. a Speed h~mps added to both Claverfi~ld and 23rd Street from Pico to Ocean Park to slow traffic. o Peak period turn restrictions from Ocean Park and Pico Baulevards an to 21st and 22nd Streets, and no right turn from southbound Cloverfield to westbaund Pearl Street. 10 Staff Plan: a Speed humps on 23rd 5treet and Cloverfield Boulevard. Hvbrid Recommendation: Staff recommends incorporation af spaed humps on 23rd Street and Cloverfield Boulevard between Pico and Ocean Park Baulevards. The stop signs an 23rd Street south of ocean Park Boulevard at Ashland, Dew~y and Airport, along with improvements to the arterials including peak hour parking restriction on Lincoln, will divert some traffic from the 23rd Street/Cloverfield corridor. The speed humps will address speeding issues on the segments of the streets between Pico and Ocean Park Boulevard where the EIR s~.ates that existing valumes 13,840 on 23rd Street and 14,Q00 on Clo~erfield. These valumes of traffic are less than the ].5,000 average daily trips limit called for in the Circulation Element. xOth Street~PearZ Street/Ca~leqe Traffic Both the Enclave and Parallel Plans propose traffic cantx~ol measures to address traffic issues east af Santa Monica College. These measures include: Enclave Plan: o Partial barrier at 20th Street and Pearl Street, allowing westbound Pearl traffic to turn north or south on 20th Street only. Parallel Plan: I1 o Peak hour turn restrictions including no right turn from sauthbound Cloverfield ta westbound Pearl, no left or right-hand turns from Pico Boulevard to southbound 21st and 22nd Streets, and na right or left turns from 2oth Street to eastbound Pearl Street, 5taff Plan: o No measures in this area. Hybrid Recommendation: Far vehicles travelling ta the College, Dath of the propased measures listed abave will divert traffic to 20th and 16th Streets, a~ong with adding additianal traffic to Pico Boul~vard. These streets already have high vQ~umes of average daiZy traffic on them and are r~sidentially zoned streets. While the volume of traffic on Pearl Street west of 20th is 9~380 which ~xceeds the 7,~00 volume limit ealled for a collector street in the Circulation Element, staff recommends maintaining all exist~ng access aptions ta the Col~ege and therefore no change ta this area. Ocean Park Bou~evard Similar to the 23rd Street/Cloverfield Baulevard corridor, the Enclave and Parallel P~ans recommend different traffic control measures on Ocean Park Bo~xievard fram 15th street to 25th Street. ThESe include the following: Enclave Plan: o Barriers just north of Ocean Park BouZevard on 21st, 22nd and 25th Streets. o No left turn in the peak hours from southbound 20th Street to eastbound Ocean Park Boulevard. 12 These measures are recommended by the Enclave Plan to prevent diversion of traffic from the 23rd Street/Cloverfield Boulevard measures to these parallel streets. Parallel Plan: o Left turn pock~ts are recommended at every intersection fram 16th Stre~t ~0 25th Street. This would require the removal of parking spaces at these intersectians as outlined in the EIR and the response to camments. Staff Plan: o Signal timing, which is a common element to all three Plans. Hybrid Recommendation: Staff recommends l~ft-turn pockets at the fallowing signalized intersections on QcEan Park Boulevard: 17th Street, 20th Street, 2Zst Street, 23rd Street and Cloverfield Boulevard. This will improve the flow of traffic on ~cean Park Baulevard by removing turning vehicles aut of the flow of tra£fic. Improving the arterials is one af the stated goals of all the traffic plans. Staff also recommends that signal timing be changed to minimiz~ the gre~n time for minor cross-streets of Ocean Park Boulevard. CentineZa Avenue/Pear~ Street Both the Enc~ave and Parallel Plans recommend measures for the Pearl Str~et/Centinela Avenue intersection. These include: Enclave Plan: o Partia~ barrier at Pearl and Centinela to allow eastbound Pearl traffic to turn narth or south on Centine~a only. 13 Parallel Plan: o Peak hour turn restrictiohs are used. In both peak hours, left and right turns are prevented from Centinela to westbound Pearl Street, while in the PM peak hour anly, ~eft turns are prevented from eastbound Pear1 Street to northbound Centinela. Staff Plan: o Does nat propase any traffic control measures at this interseetion, except to modify the signal timing to maximize tha green time far north/south traffic on Centinela. Hybrid Recommendation: Staff proposes no changes at this intersection, except for the signal timing modification af the Staff Plan. The staff recammendatian already includes the addition of two additional stop signs on Pearl Street in this area as part of the cammon elements, at 31st and 34th Streets, and feels this is adequate ta discourage cut-through traffic withaut incanvenienc~ng the local residents. Also, the street currently carries 5,71Q vehicles per day which is less than the ~imit of 7, 500 veh~cles per day as stated in the ~irculatio~ Element. Airport Avenue Improvements to Airport Avenue are recommended in the Paralle~ Plan, but only stop signs on Walgro~e are included in the Staff Plan, and no recommendations ar~ included in the Enclave Plan. A range of impravements are detailed in the EIR, including the follawing: 14 o Replace stop signs on Airport Avenue with pedestrian ar traffic signals. o Add a stop sign at Airport and Wa~grave Avenue (23rd Street). o Ymplement and enforce a speed limit as approved by the Parking and Traffic Engineer. If implemented, the Airport Avenue improvements will pzovide an additianal option to motarists in the Walgrove/23rd Street corridar. The cost of these measure is appr~ximately $360,000. The left-turn prahibition wili remain at Walgrove for westbound airport traffic, but may be changed at a later date after further analysis of eff~ctiveness of th~ propased traffic control measures. Hybrid Recommendation: The sta~f recommendation already includes stop signs at Airport Avenue and Walgrove. Staff feels that the traffic increases an Airpart Avenue are modest ~rom the proposed plans, and do not warrant the installation of expensive pedestrian ar traffic signals on Airport Avenue. Also, removal of the left- turn restriction is not proposed as part of this Plan~ k~ut the appropriateness of removing it af~er initiation o~ the Plan will be evaluated at that time. Lincoln Boulevard All three Plan~ recommend the peak hour parking restrictions on Lincoln Baulevard between the freeway and the southern City limits. This m~asure wou~d add capacity to Lincoln Boulevard and thereby handle more traffic and reduce vehicles on residential streets. 15 As mentioned b~fore, there is a tradeoff between peak hour parking restrictions, and the effectiveness o~ the Plans in reducing traffic on residential streets. ~ybrid Recommendation: Staff recommends that Council adopt peak hour parking restrictions on Lincoln Boul~vard as r~cammended in all three analyzed plans. EIR PROCESS On May 12, 1992 the City Council directed staff to move forward with an EIR on these two plans. The Enclave Plan was to be considered the project, while the Parall.el Plan was the main alternative. However, bath plans would be studied with the same levei of detail. Other minor alternatives were a~so recommended to be analyzed in the EIR. A Public Scoping Meeting was heZd on June ~8, 7.992 as part of this pracess to se~ if other alternatives should be added or what ~dditianal items shauld be addressed in the EIR. One alternative, cansisting of the addition of two barriers ta the Enclave PZan was added to the EIR based upan the pub].ic scoping meeting. On Sep~ember 29, 1992, the City Council awarded the EIR contract to The Keith Companies, along with Kaku Associates. Traffic counts on residential streets occurred in Dec~mber, 1992, with the develapment of the traffic model taking place from December, 1992 16 thrauqh June, 1993. In June, 1993 a series of public wvrkshaps were held at Jahn Adams Middle School to provide an opportunity for residents to comment an the proposed plans. Notices were sent to all residents in Sunset Park announcing the workshops. In December, 1993, the City Council directed staff to meet with the two neighborhood organizations before completion of the EIR in an effort to develop a compromise plan that could be analyzed in the EIR. In addition to staff, Councilmembers Ken Genser, Paul Rosenstein and Tony Vazquez attended the meetings. Three meetings were held in the following manths, however no consensus could be reached on any one plan. There were numerous measures in a11 threa plans that bath organizations agreed upan, but a full campromise cauld not be reached. The significant difference of apinion centered on the treatment proposed for the 23rd Street/CZoverfi~].d corridor. AZthough significant discussion occurred on this issue, the neighborhaad organizations were unable to reach a cansensus. Based upan the inabil~ty to reach a consensus on ane plan, staff completed the EIR which studied the Enclave, Parallel, and Staff Plans plus other minor alternatives. In May, 1994 the Draft EIR was released for a 45 day public r~view period. 17 Notices were sent to over 240 interested people announcing the availability of the Draft EIR, along with pub~ished notices in bath The Outlook and Los Anqeles Times. Notices for this public hearing were sent to those who were noticed about the Draft EIR, in addition to all people who commented on the Draft ETR. A notice was also published in The Outlook, and a flyer announcing the public heari~ng was sent to every business and resident in Sunset Park. EIR FINDINGS The EIR cancludes that there are significant impacts in the existing and future conditiar-s as a result of any of the Sunset Park Traffic Plans before mitigation. The EIR sets forth mitigation measures to offset these adverse impacts, which eliminate many of the signi.ficant impacts. However, for each plan, several significant traffic impacts r~main aven after mitigation measures are implemented. A sum~ary of the t~affic analysis shows that, in general, the three plans perform in a similar fashion. They increase eapacity, thereby encauraging more traffic and creat~ng more impacts, on the main arterial streets (Lincaln Boulevard, Pico Boulevard, Ocean Park Boulevard, and Centinela Avenue/Bundy DrzvE~. Capacity on the main arterials is increased through improvements to the arterials like peak period parking restrictions on Lincoln 18 Boulevard and traffic signal synchronization throughaut the project area. Also, in varying degrees, through the use nf peak hour and full time parking removal on Pica and ocean Park Bou~evards are proposed. The plans, as expected, reduce traffic on most residentiaZ streets, however, removal of on-street parking on Lincoln Baulevard impacts loca~ businesses since many af the businesses do not have o~f- street parking. A tradeoff occurs between the removal of peak parking an Lincoln Boulevard and a reduction of traffic on residentia~ streets. A total of 48 signalized intersectians throughout ~.he study area were analyzed in the EIR, and e~en with mitigation, all three plans would have significant adverse ~mpacts with respect to traffic. However, using the City's definition of significance in the reverse, with the increased capacif.y or signal improvements on the arterials, the plans wflu~d hav~ beneficial impacts at some signalized intersectians. The beneficial impacts occur from directing traffic away from some intersections or providing for eapacity ar signal improvements a~. intersections. Beneficial impacts are not a required component of the Califarnia Environmental Quality Act. How~ver, tYllS infarmation is provided as a way of determining the positi~e and negative impacts these plans would ha~e on the circu~ation system. 19 Traffic Impacts with Enclave Plan The Enclave Plan would have significant adverse impacts in the future at 10 signalized intersections in the AM and 17 intersectians in the PM peak hours, but would have beneficial impacts at 17 intersectians in the AM and 20 intersections in the PM peak periads. The EYR analyzed ~he Plans with and without peak hour parking restric~ians, and the Enclave Plan wauld impact 1~ resident~al street segments with peak period parking res~rictions, while ~9 segments will be impacted withaut the restrictions. In order to mitigate the identified significant impacts, the ETR proposes numerous mitigation measures for the Enclave Pian, including the following: 0 11th Street/Pico B~vd: Re-stripe the westbound approach to provide an exclusive right turn lane. 0 21st Street/Ocean Park Blvd: Re-s~ripe Ocean Park Blvd. ta provide an exclusive left-turn lane in both the eastbound and westbound directions. This would require the removal of about nine parking spaces on the eastbound approach and 14 spaces on the eastbound departure. 0 33rd 5treet/Pico Blvd.: Re-stripe Pica Blvd. ta provide an exclusive left-turn lane an the westbound approach. This would require the removal of about six parking spaces on the westbound approach. o Bund~ Drive~pearl Street: Re-stripe Pearl ta provide an exclusive l~ft-turn lane on the eastbound and westbaund approaches. This wauld require the remo~al of about five parking spaces on the eastbound approach and two on the eastbound departure. Traffic Impacts with Hybrid Plan The EIR did not analyze the impacts af the Hybrid Plan since it is a combination of elements from aIl three plans that were put tagether af~~r the ~IR analysis was conducted. The impacts associated with the Hybrid Plan are most closely compared with the analysis af the Parallel Plan in the EIR, although it is expected there would be fewer impacts to the City of Los Angeles since there is Iess diversion of traffic. Therefore, the mitigation measures outlined above with the Paral~el Plan will be applicable to the Hybrid Plan if adopted. Alley Imnac~s The EIR a~so discusses the impacts on alleys near proposed barriers. In almost every insta~ce in the Enclave Plan, a barrier is proposed on a street to block off automobile traffic where there is an al~ey parallel to the street. It is likely that motarists wiii use the alleys as a way to bypass the barriers, even though alleys have Iimited capacity, narrow widths, poor raadway geometry and poor sight distances. Therefare, the Enclave Plan could decrease traffic on the residential streets, but inerease traftic in the a~leys. 28 Lincoln Boulevard Peak Haur Parkinq Restrictian It should be noted that a~l three pxoposed plans call for peak hour parking removal on both sides of LincaZn Boulevard €rom Pica Boulevard to th~ sauth City limit during the AM and PM peak periods (generally 7:Oa to 9:00 AM and 4:0o to &:00 PM). This is an important capacity impronement which would add a third travel lane in each direction and aliow more traffic to use ~incoln Boulevard as opposed to the r~s~dential streets. There are simi2ar differences for beneficial impacts to residential streets in all three plans, with the peak haur parking restriction having more beneficial impacts on residential streets than the analysis without peak haur parking restrict~ans. In all three Plans, there is a tradeoff between peak hour parking restrictions, and the effectiveness of the Plar~s in reducing traffic on residential streets. Addendum to EIR One mitigation measur~ was inapprapriately identified in the EIR for the Enclave and Staff Plans. The measure was restriping at Cloverfield and the I-10 eastbound on-ramp to remove a significant impact at that intersection. This m~asure is already included in the Cloverfield Boulevard w2dening praject and therefore can not be identified as a mitigatian measure. The staff report correctly lists the intersection as significan~ after mitigation, and AttachYnent D provides the Council with an addendum to the EIR which 29 reflects this issue, and should be included when the EIR as certified. EIR PDBLIC COMMENTS Upon campletion of the public comment period on the Draft EIR, forty-eight comment letters were recei~ed, incZuding 42 from residents on Rose Avenue in the City of Los Angeles east of Walgrove Avenue. Resid~nts on Rose Avenue were concerned abaut increased diverted traffic onto their street. The response to comments state that traffic decreases east of Walgrave Avenue on Rose Avenue under all thr~e Plans ta varying degrees, from a rninor reduction under the Staff Plan to a reduction of elase t~ a00 vehicles per hour under the Enclave and Parallel Plans. On the ather hand, traffic increases on Rose Avenue west of Wa~grove Avenue under the Enclave and Paralle~ Plan, especially in the PM peak hours, by 42a vehicles per haur and 135 vehicle per hour respectively. The Staff Plan reduces traffic by 90 vehicle per hour in the PM peak hours on Rose Avanue west of Walgrove Avanue. In additian to the comments ~ro~ the Rase Avenue n~ighbars, Los Ange~es Councilwoman Ruth Galanter and Haripal Vir from the City af Las Angeles Department of mransportatian submitted separate comment letters stating that the plans will have negative impacts on City of Los Angeles streets that ar~ unacceptable. 3a Comment letters were also recei~ed from Friends af Sunset Park and Sunset Park Associated Neighbors representatives providing detailed comments on numerous issues in the Draft ~IR. These letters and responses are included in the Final EIR. LEGAL ~PINION The Council has previously received an information item containing a 1993 by the City Attorney's office discussing the City~s authority to make the ~ariaus road and traffic impravements to i~p~ement specific traffic contral measures, including physieal diversions and barriers. This opinion primarily impacts implementation o~ the Enclave pian with respect to the use of barriers on 23rd Street and passibly Cloverfield Boulevard. The opinion by the City Attorney~s office states that the City~s authority to make road improveme~ts depends upon the purpose of the improvements and the ~orm of the improvements. The City does have authority under the City's constructian and maintenance power to impl~ment speed bumps, traffic circles, and islands, as long as ~hey are not designed mereZy as barricades to prevent through traffic onto a stre~t. The City may also r~gulat~ traffic by means af stop signs, traffic signs prohibiting turns, and restripings. However, the City's authority to prevent entry to or exit from a street through th~ placement of barriers and diverters is very limited. The City may do this only ~f the street is not regionally 31 significant, and the closure ar diversinn is authorized by a g~neral plan amendment and an ordinance or resolution implementing the modified general plan. As noted ~n the opinion by the City Attorney's office, no definitive criteria have been established regarding what canstitu~es a"regionally significant roadway". However, in a previous court decisian, a road in 5an Diega which carried over 5,000 vehicles per day and continued into another City was determined to be regionally significant and continued into another City. In Sunset Park, 23rd Street carries between 1~,800 and 21,400 vehicles per day from Pico to the southern City limit. It is the dpinion of the City Attorney's office that a court may find 23rd Street to be regianal].y significant, precluding the City from closing it at the Los Angeles border as originally proposed. Additional, although less certain, the City may a~so be precluded from implementing some of the proposals included in the "Enclave" plan which use barriers and div~rters. Cloverfie~d Baulevard does not continue into the City of Los Angeles, but it connects with the I-10 freeway on- and off-ramps and serves the same travel corridar as 23rd Street. Due to this, Claverfield Boulevard may be considered regionally signi~icant by a Court which cauld also preclude the City from impiementing barriers or diverters. 3'? It is staff's opinion that the diverter on Pearl Street in the Enclave Plan could be implemented since Pearl Street carries ~ess traffic than 23rd and Claverfield. While Pearl Street does continue into the City of Los Angles, Pico and Ocean Park Boulevards are immediately adjacent to, and ar~ much more regionally significant, than Pearl Street. The ather streets recommended for barriers in the "Enclave" p~an do not appear to be regionally significant, sa barriers could be implemented if the Circulation Element of the General Plan is amended. Staff did provide both neighborhoad organizations an opportunity to modify their plans based upan the opinian of the Ci.ty Attorney~s office. In order to reduce the risk af the Plan being overturnEd by a Court consisten~ with th~ opinion af the City Attorney~s office, the Enclave Plan wou~d have ~o remove approximately four of the forty to fifty measures in the Plan. However, the four measures are a crucial. element of the Enclave Plan since they address the traffic issue on the 23rd Street/Cloverfield Boulevard carridor by directing traffic heading for the Santa Monica Freeway to use Ocean Park BouZevard and Cent~nela Avenue thrQUgh the use of barriers and pylons. Removal of these measures from the Plan would essential~y eliminate efforts of the Plan to address traffic issues in the 23rd Street/Cloverfield Bouleuard corridor. Representatives af Sunset Park Associated Neighbors (SPAN) modified the Parallel Plan to remove the praposed full and partial barriers 33 on Pearl Street at 20th Street and Centinela Avenue respectively that were originally praposed before completion of th~ EIR. In place of the barriers, the Parallel Plan now uses turn restrictions. These modifications of the Parallel Plan were analyzed in the EIR. GENERAL PLAN CONSISTENCY Currently the adopted Circulation Element identifies neighborhoods and priorities for implementing neighborhaod pratection plans and identifies street classifications and acceptable traffic volumes. Sunset Park is nat identified as one of the neighborhoods targeted for a pratection plan, however, that would not preciude the implementatian of a protection plan for the area. In addition, the Circulatian Elemen~ cantains the following two policies: o "Upgrade the capacity of 23rd Street south of Ocean Park Boulevard within the existing street width to facilitate north-south access ta the City." (Page ~19) o "The C~t~ shall investigate the feasibility of upgrading the capacity by improvements to 23rd Street south of Ocean Park Boul~vard w~thin the existing street width." (Page 136) Figur~ 22, on Page 118 of the LUCE alsa identifies 23rd Street south of Ocean Park Boulevard as a roadway in need of improvements ta facilitate access. The State Vehicle Code autlines specific procedures a City must go through to implement barriers and diverters. On streets that are 34 not regionally significant, a local jurisdictian may implement a barrier ar div~rter pravided it is identified in the Circulation Element of the G~neral Plan. Therefo~e, the Land Use and Circulation Element (LUCE) must be modified before such traffic control measures may be implemented. Should ~he Council approve a plan with a barrier or diverter, or measures which limit access to 23rd Street south of Ocean Park Boulevard, the follawinq changes must occur to the LUCE: o Amend Figure 22 (Page 118} of the LUCE relating to ~ajor circulation proposals and neighborhood traffic plans. This will require the deletian 23rd Street as an identified street ~o "Improve to Facilitate Access". o Amend the first bullet of Major Proposal discussion of Loca~ Streets (Page 119) to read as follows: "~mplement neighborhood traffic control plans to discourage traffic in residential neighborhoods in the Mid--City, Pico and Sunset Park areas as shawn in Figure 2 2 . ,~ o Amend Policy 4.2.2 of the LUCE (Page 134) ta incorparate the adoption of a Suns~t Park Traffic Plan. ASHLAND PROJECT MITIGATIQN MEASURES The prapased seniar housing project at the corner of Lincoln and Ashland is in the pracess af being built. The project includes mitigation measures, most of which have been implemented. Two measures include half barriers on Hill and Ashland just east of Lincoln Boulevard. While these m~asure ha~~ been incorporated into the Ene~ave Plan, they wi~l be implemented when the housing project is campleted whether or nat any ~f the traffic plans are adopted by the Council. These measure will be included in any Land Use and Circulation Element revision that occurs as part of this process. BIIDGET/FINANCIAL IMPACT The EIR identifies cost estimates far the neighborhood traffic plans, mitigation measures, and alternatives in Volume II, Appendix G. This section summarizes the costs of implementing the neighborhoad traffic plans and the costs associated with implementation of the mitigatian measures identified in the EIR. As indicated in the ETR, the C05t ~D imp~~ment th~ Enclave Plan is approximately $3,259,792 of which $2,73~,040 is far signal zmprovements. Hawever, the City and Caltrans are already updating the signal systems along Lincoln, Pica and Ocean Park Bou~evards. 36 Therefore, the major signal improvement measures included in the Enclave Plan (and the ather two Plans} are already in place and will not require the full funding as identified in the EIR. Therefore, the cost to implement the Enclave Plan aft~r accounting for thase costs is $529,792. Implementation of the mitigation measures associated with the Enclave Plan wil~ cost approximately $378,647, of which $360,576 are for Airport Avenue Mitigatians identified by the EIR. The total remaining costs associated with implementation and mitigation are $908,439. The cost to implement the Parallel Plan is approximately $3,901,830, of which $2,730,000 is for signaZ impravements. The cost to i~plement th~ Parallel Plan after accounting for thase measures already funded as mentioned above is $1,171,621. The cost of the mitxgation measures for the Parallel Plan are $5,259. (all Airport measures except for speed limit enforcement are already included in the Parallel Plan). The total remaining costs associated with implementation and mitigation are $1,176,880. The cost to impZement the Staff PZan is approximate2y $3,~55,19i, af which $2,73D,000 is for signal improvements. The cost to implement the Staff P1an after accounting far those measures alread~ funded as mentzoned abflve is $425,191. The cost of the mitigation measures for the Staff Plan ar~ $73,341 {there are no mitigation measures required for Aixport Avenue in the EIR}. The total remaining costs assoeiated with implementation and mitigation 37 are ~498,~32. The approximat~ cost for the Hybrid Plan is $3,fl80,00D, of which $2,730,000 is far signal improvements. Since it is most similar to the Parallel Plan, the Para~lel Plan mitigation measures would be adoptEd, which cost $5,259. The tota~ remaining costs associated with implementation and mitigation of the Hybrid Plan, after accounting for those measures already funded, are appraximately $355,259. The recommendations in this report da not require budget action at this time. ~nce the Council has identified the plan or measures ta be implemented, staff will return with a finaneing strategy. Such strategy may consider advancing general fund dollars in anticipatian of the Playa Vista mitigation funds. The Playa Vista Phase I development agreement between the City and Maguire Thamas Partners provides for $1,500,000 to mitigate potential traf~ic impacts on Santa Monica generated by the first phase of the deveZapmer~t. One--half of that sum will be paid ta the Ci~y at the time of recordation of a constructian loan for any second subphase of the First Phase development. The balance will be paid to the City at the recordation of a construction l.oan for any fifth subphase of the First Phase development. 38 Representatives with Maguire Thomas Partners state that recordatian of a constructian loan for a second subphase will not occur until early 1997 at best. RECOMMENDATION It is recommended that the C~ty Council: 1} hold a public hearing; 2) adopt a resolution to certify the Final Environmental impact Report (EiR) for the Plan (See Attachment F); 3) conceptually apprave a traffic plan and mitigation measures; 4) direct staff to prepare a Statement of Overriding Cansiderations with recommendations ~or find~ngs and benefits of the project; and 5) adopt a resolution of intention to direct the Planning Cammission ta amend the Land Use and Circulation Element of the General Plan if necessary (See At~.achment E}. The measure was restriping at Cloverfield and the I-10 eastbaund on-ramp to remove a significant impact at that intersection. Th~s measure is already included in the Cloverfield Boulevard widening pro~ect and therefore can not be identified as a mit~gat~an measure. The attached pages remove that mit~gation measure and state that no feasible mit~gataons measures are ident~fied. The ~n~ersection is there€ore listed as an una~~oidable sigmficant ~mpact. The staff report correctly lists t~e intersect~on as remain~ng sigmficant after mitigation. The City Council f~nds that the Final Environmenta~ Impact Report adequately discusses all signifieant environmental ~ssues and c~rtifies that the final EIR was prepared in compliance with CEQA~ the State EIR Guide~ines and the City of Santa Monica CEQA Guidelines, and that the Ci~y Council has reviewed and considered the contents o~ the Final EIR in its decision-making process. SECTION 2. The City Council finds that the Final Environmental Impact Report does not requixe recirculatian sinc~ the additional infarmation added in response to comments on the Draft Environmental Tmpact Report clarifies or amplifies i~formation provided in the Draft Environmental Impact Report. The additiona~ infarmation or eiarification provided does not identify new substantial environmental effects, new mitigation measures which the City decl~nes to adapt, or concern a substantial increase in the severity of a previously identified enyironmenta~ effect. SECTION 3. The City Clerk shall certify to the adoption of this Resoiution, and thenceforth and thereafter the same sha11 be in full force and effect.
