J GS:CP:PAM:swset189\WP51 council Meeting: December 14, 1993 Santa Monica, California TO: Mayor and city council FROM: City staff SUBJECT: A Resolution Setting a Public Hearing for January 25, 1994, on the Confirmation of Assessment of Costs to Repair Damaged Sidewalks, Driveways, Curbs, and the Removal of Damaged Pavement in Parkway Areas on various City Streets (SR-94-189) Introduction This report recommends that the city council set a public hearing for January 25, 1994, to hear protests regarding the completed work and confirm the assessment of costs to repair damaged sidewalks, driveways, curbs, and the removal of damaged pavement in parkway areas on various City streets. Backqround On October 9, 1979, city Council approved a sidewalk repair program which provided for property owner participation in the cost of repairing damaged sidewalks. Residential property owner participation is 50% of the cost of the repairs if the damage is related to tree roots with the city paying the remaining 50% of the repair costs. Property owners are assessed 100% of the cost if the damage is not related to tree roots and commercial property owners are assessed 100% of the cost regardless of the cause of the damage. - 1 - L~~L. ~ ~ 1;j:;S (P-b ~ , , A public hearing to confirm the assessment of costs must be held pursuant to the provisions of Chapter 22, sections 5600 to 5630, of the streets and Highways Code of the state of California. A Resolution setting the public hearing for 6:30 p.m. on January 25, 1994, is attached. All affected property owners will be notified of the public hearing date and the assessment amount fifteen days prior to the public hearing. A list of property owners and assessment amounts will be available to Council at the time of the public hearing. BudQet/Financia1 Imoact The financial analysis, which will indicate total revenues to be derived from this assessment district over the next two years, will be presented to City council at the time of public hearing. Recommendation It is recommended the city Council adopt the attached Resolution setting a public hearing on January 25, 1994 to confirm the assessment of costs of the repair of damaged sidewalks, driveways, curbs, and the removal of damaged pavement in the parkway areas for the above-cited properties. " RESOLUTION NUMBER 8694 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING A PUBLIC HEARING DATE ON JANUARY 25, 1994, FOR ANY PROTESTS OR OBJECTIONS TO THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING REPAIR OF SIDEWALKS, DRIVEWAYS, CURBS AND THE REMOVAL OF DAMAGED PAVEMENT IN PARKWAY AREA (SR-94-189) THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The Superintendent of streets will file a report of repair pursuant to Section 5617 of the streets and Highways Code of the state of California, relating to the construction of certain improvements to sidewalks and driveways at 464 16th Street, 628 18th street, 451 19th Street, 475 22nd street, 318 23rd Street, 350 25th street, 722 25th street, 858 25th Street, 2637 32nd street, 1430 California Avenue, 1935 Cloverfield Boulevard, 2401 Cloverfield Boulevard, 2628 Fifth street, 708 Grant street, 1211 Grant street, 1344 Hill street, 1502 Hill street, 1311 Montana Avenue, 2121 Navy street, 2025 Ocean Park Boulevard, 838 Pacific street, 1020 Pier Avenue, 823 Seventh street, 827 Seventh street, 1058 Seventh street, 2629 sixth street, 2526 Washington Avenue, 233 Wilshire Boulevard, 315 Wilshire Boulevard, 1145 Yale street, all within the City of Santa Monica. SECTION 2. Pursuant to Section 5600 et seq. of said code, the City Council does hereby order and declare that on the 25th day of January 1994, at 6:30 p.m. I in the City council Chambers of city Hall, it will hear and pass upon the report by - 4 - . . . . the Superintendent of streets of the cost of repairs, together with objections or protests, if any, which may be raised by any property owner liable to be assessed for the cost of such repairs and any other interested persons. SECTION 3. All protests or objections must be in writing and filed with the City Clerk on or before the time set for the hearing of the protests and objections. SECTION 4. The superintendent of streets is hereby directed to mail notices, in the manner and form prescribed by law, of the costs of repair and of the adoption of this Resolution to all persons owning real property affected by the sidewalk assessment repair program, whose names and addresses appear on the last equalized assessment roll for the City taxes or as known to the City Clerk. SECTION 5. The city Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
