BACKGROUND
The C1ty Plannlng Commission approved the Tentat1ve Map and the Ten-
ant-Partlclpating Conversion for the above proJect on September 16,
1992, after a public hear~ng and a careful review of the record and
staff recommendations. The action of the Planning Comm1SS1on was
based on the Comm1ss1on's findings that the proposed Tenant-
Partlclpating Conversion meets the requirements of Article XX of the
City Charter and that the proposed subdlvlsion lS cons1stent w1th
applicable general and speclflc plans as adopted by the Clty of Santa
Monlca along w1th all mandatory requirements of the Subd1 vision Map
Act of the State of Callfornia.

The owners have submitted to the C1.ty a Wr1.tten Consent Agreement
b1.nd1.ng the owners and any successors in interest to each condition
1.mposed 1.n connect1.on W1.th approval of th1.s Tenant-Partlcipating Con-
version. This Written Consent has been approved by the City Attorney
and the City Manager. Each part1.C1.patlng tenant has been informed 1.n
wr1.t1.ng of h1.s or her rights under Article XX of the City Charter.
The License Division reports that proper arrangements have been made
to ensure payment of the Tenant-Part1.Clpating Converslon Tax.
The Final Map conforms to the Tentat1.ve Map. The Final Map has been
cert1.f1.ed by the City Engineer for conformance w1.th the Tentat1.ve Map
and conditions thereon, the Subd1.v1.s1on Map Act and local ordinances.
The City Attorney's office has approved a Declaration of Covenants,
Cond1.tions, and Restr1.ctions, or equivalent document, for this proj-
ect as complYlng wlth the conditions of the Tentat1.ve Map and the
Tenant-Participat1.ng Conversion.
Counc1.l approval of a final map for a Tenant-Part1.c1.pat1.ng Conversion
represents one of the last steps necessary 1.n the conversion process
Following City Counc1.l actlon and approval by the California Depart-
ment of Real Estate the applicants may begln sell1.ng thelr un1.ts to
the tenants. As each un1.t lS sold a conversion tax per Sectlon 2008
of Article XX lS due l.n an amount equal to twelve tlmes the monthly
maximum allowable rent for that unit. These taxes wlII be used to
assist low and moderate income households to purchase or improve
thelr unlts subject to affordable repayment per Section 2009 of Arti-
cle xx

BUDGET/FISCAL IMPACT
The recommendatlon presented In thls report does not have an lmmedi-
ate budget or fiscal impact If and as unlts In the project are sold
in the future, Tenant-Particlpatlng Converslon Taxes will be col-
lected pursuant to the provlsions of Article XX of the Clty Charter
and some increased property tax revenues may be generated.
RECOMMENDATION
It lS respectfully recommended that the Flnal Map for thlS Tenant-
Participating Conversion be approved by adoption of the accompanying
resolutlon.

A FINAL SUBDIVISION MAP FOR TRACT NO. 51205
AT 2325-2329 KANSAS AVENUE
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. That the Final Map for Tract No. 51205 in the City
of Santa Monica hereby ~s accepted and approved.
SECTION 2. That the City Clerk hereby is authorized and direct-
ed to endorse upon the face of said Map this order authent~cated by
the Seal of the City of Santa Monica.
SECTION 3. That the City Clerk shall certify to the adopt~on of
th~s Resolution, and thenceforth and thereafter the same shall be in
full force and effect.
