Necessity for Closed Session on November 2, 1993
FROM:
The Brown Act was recently amended to provide more specific
standards for holding closed sessions for pending litigation.
The new changes are contained in Government Code section 54956.9.
Under Government Code Section 54956.9, the City Council,
based upon the advice of its legal counsel, may hold a closed
session to confer with, or receive advice from, its legal counsel
regarding pending litigation when discussion in open session
concerning those matters would prejudice the position of the city
in litigation. The Section requires that the legal counsel
submit to the legislative body a memorandum stating the specific
reason and legal authority for the closed session. The
memorandum, if feasible, should be submitted to the legislative
body prior to the closed session, but in no event later than one
week after the closed session.
In connection with the closed session on November 2, 1993,
the following specific cases will be considered in closed
session:
~. City of Santa Monica v. City of Los Angeles, threatened
litigation concerning proposed Playa Vista Development.
2. People v. Regina Barrett, Los Angeles Municipal Court
Case No. 93M00496.
The legal authority for holding a closed session on the
litigation cases outlined above is contained in Government Code
Section 54956.9(a). It is the opinion of the city Attorney that
discussion of this case in open session would prejudice the
position of the City in litigation, since the discussion of each
case will involve the legal strategy or legal course of action
that the city intends to take in the case.
The legal authority for holding a closed session on the
threatened litigation outlined above is contained in Government
Code section 54956.9(b) (1). Based upon existing facts and
circumstances, it is our opinion that there is a significant
exposure to litigation against the city.

SUBJECT: Ordinance Amending section 4.44.030 of the Santa Monica
Municipal Code to Prohibit All Smoking in Indoor
Restaurants, Amending section 4.44.040 of the santa
Monica Municipal Code to Prohibit All Smoking in
Cafeterias in Places of Employment and Lounge Areas in
Buildings Open to the General Public and Amending section
4.44.060 to Prohibit Smoking in Bars which are contiguous
with Restaurant Dining Areas When Meals Are Being Served
On June 29, 1993, the City Council directed the City
Attorney to amend the city's smoking regulation ordinance to have
it conform to recent changes made by the city of Los Angeles to its
ordinance.
The changes reflected in the attached draft Santa Monica
Municipal Code Smoking Ordinance will bring the Santa Monica
Ordinance up to the level of restrictions in the newly amended Los
Angeles city Smok.ing Ordinance. Specifically, the proposed changes
will prohibit smoking in indoor restaurants, cafeterias in places
of employment and lounge areas in buildings open to the general
public.
The first changes appear in Sections 4.44.030(a) and (b).
The Section (a) and (b) changes were made because as we examined
the Los Angeles Ordinance it did not have any exemptions for
separate balcony areas and lounge areas in public facilities.

The next changes are in Section 4.44.03(h) which
regulates smoking in restaurants. Because of the growing trend
towards non-smoking restaurants and the public's interest in
pursuing a policy of non-smoking restaurants, the draft ordinance
reflects these interests. Currently, the Santa Monica Municipal
Code allows up to 40% of the total seating capacity of a restaurant
to be a smoking area. The new changes would prohibit all smoking
in indoor restaurants including bars that are adjacent to enclosed
restaurant dining areas when meals are being served. To further
this measure, Section 4.44.060, the "exemptions" section had to be
modified to specify the conditions under which smoking in bars
would be allowed.
Modifications were also made in section 4.40.040
involving places of employment. Section 4.40.040(a) is deleted
because the change is very minor and all places of employment
should already have a smoking policy in place. In Section
4.40.040(a) (1) we added the prohibition of smoking in cafeterias to
Section (1) and deleted it from Section (2). Therefore, smoking
will be totally prohibited in cafeterias located in places of
employment. We also deleted section (h) (i.e., the statement that
an employer does not include the City of Santa Monica) because we
have a separate municipal code section which addresses smoking
policies in the city of Santa Monica.
The major impact of these changes will be upon
restaurants. The prohibi tions that we have made in Sections
4.44.030 and 4.44.040 do not apply to private enclosed offices

occupied exclusively by smokers even though such an office may be
visited by non-smokers; separate banquet rooms within restaurants
and hotel banquet rooms when in use for private parties or
functions and cocktail lounges and nightclubs as defined in the
Zoning Ordinance.
Smoking will be allowed in bars in which the
serving of food is only incidental to the consumption of alcohol
and where the bar is not contiguous with a restaurant dining area
when meals are being served. All outdoor seats in uncovered areas
of restaurants can still allow smoking. Therefore, the areas in
the Third street Promenade with outdoor dining will in no way be
affected by the changes.
RECOMMENDATION
It is respectfully recommended that the accompanying
ordinance amending Sections 4.44.030, 4.44.040 and 4.44.060
regarding regulation of smOking in the City of Santa Monica be
introduced for first reading at the September 28, 1993 meeting of
the city Council.

written smoking policy which shall contain the
following minimum provisions:
(1) The prohibition of smoking in
cafeterias, restrooms, elevators and nurses
aid stations or similar facilities for
treatment of employees.
(2) The provision and maintenance
of a contiguous nonsmoking area of not less
than two-thirds of the seating capacity and
floor
space
in

(3) A statement providing that in
any dispute arising between smokers and
nonsmokers, efforts shall be made by the
employer to accommodate the desires of both
smokers and nonsmokers.

(4) A smoke-free work area for non-
smokers to the maximum extent possible.
Employers are not required to incur any
expense to make structural or other physical
modifications in providing these areas. An
employer who in good fai th makes reasonable
efforts to develop and promulgate a policy
regarding smoking and nonsmoking in the work
place shall be deemed to be in compliance with
this SUbdivision, provided that a policy which
designates an entire work place as a smoking
area shall not be deemed in compliance with
this paragraph.
(b) An employer shall post "No Smoking"
signs in any area designated as a nonsmoking
area.
(c) The smoking policy shall be
communicated in writing to all current
employees within three (3) weeks of the date
of adoption, and to all future employees at
the time of their entry into employment.
(d) Notwithstanding the above, every
employer shall have the authority to designate
any work area or the entire premises
controlled by the employer as a nonsmoking
area.

(e) An employer who fails to adopt a
smoking policy, or who fails to post signs in
any area designated as a nonsmoking area as
required by Subdivision (1) of this section
shall be in violation of said Subdivision.

misdemeanor.
(f) Those places in which smoking is
prohibited under section 4.44.030 shall not be
considered places of employment under this
section.
(g) Employers

implement
the
provisions of this section in a manner
consistent with all applicable state or
federal statutes, rules or regulations on
employer-employee relations.

SECTION 4. Any provision of the Santa Monica Municipal Code
or appendices thereto inconsistent with the provisions of this
ordinance, to the extent of such inconsistencies and no further,
are hereby repealed or modified to that extent necessary to affect
the provisions of this ordinance.
SECTION 5. If any section, subsection, sentence, clause, or
phrase of this ordinance is for any reason held to be invalid or
unconstitutional by a decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of the ordinance.
The City Council hereby

declares that it would have passed this ordinance and each and
every section, subsection, clause or phrase not declared invalid or
unconsti tutional wi thout regard to whether any portion of the
ordinance
would
be
subsequently
declared
invalid
or
unconstitutional.
SECTION 6.
The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance.
The City Clerk shall
cause the same to be published once in the official newspaper
within fifteen (15) days after its adoption. This ordinance shall
be effective thirty (30) days from its adoption.
